सा.का.नि. 2 (अ) .-केन्द्रीय सरकार , निःशक्त व्यक्ति ( समान अवसर , अधिकार संरक्षण और पूर्ण भागीदारी ) अधिनियम , 1995 ( 1996 का 1 ) की धारा 73 की उप - धारा ( 1 ) और ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निःशक्त व्यक्ति ( समान अवसर , अधिकार संरक्षण और पूर्ण भागीदारी ) नियम , 1996 का संशोधन के लिए निम्नलिखित नियम बनाती है , अर्थात् :-
1. ( 1 ) इन नियमों का संक्षिप्त नाम निःशक्त व्यक्ति ( समान अवसर , अधिकार संरक्षण और पूर्ण भागीदारी ) संशोधन नियम , 2009 है ।
(2 ) ये राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. निःशक्त व्यक्ति ( समान अवसर , अधिकार संरक्षण और पूर्ण भागीदारी ) नियम , 1996 में (i ) नियम 2 के स्थान पर निम्नलिखित नियम रखे जाएंगे अर्थात्: -
" 2. परिभाषाएं -
( 1 ) इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो ,-
(क) " अधिनियम " से निःशक्त व्यक्ति ( समान अवसर , अधिकार संरक्षण और पूर्ण भागीदारी ) अधिनियम , 1995 ( 1996 का 1 ) अभिप्रेत है ;
(ख ) " प्रमाणपत्र " या " निःशक्तता प्रमाणपत्र " से अधिनियम की धारा 2 के खण्ड ( न ) के अनुसरण में जारी प्रमाणपत्र अभिप्रेत है ;
(ग ) " बहुनिःशक्तता " से अधिनियम की धारा 2 के खण्ड ( i ) में परिभाषित दो या दो से अधिक निःशक्तताओं का संयोजन अभिप्रेत है;
(घ) " प्ररूप " से इन नियमों के परिशिष्ट में दिए गए प्ररूप अभिप्रेत हैं ।

(2) परिभाषित नहीं है, का क्रमशः वही अर्थ होगा जो उनके अधिनियम में है । " ऐसे शब्दों और पदों, जो अधिनियम में परिभाषित है किंतु इन नियमों में
( ii ) अध्याय 2 के स्थान पर निम्नलिखित अध्याय रखा जाएगाः-
"अध्याय 2
निःशक्तता प्रमाणपत्र
3 . निःशक्तता प्रमाणपत्र जारी करने के लिए आवेदन--
(1 ) अपने पक्ष में प्रमाणपत्र प्राप्त करने के इच्छुक निःशक्त व्यक्ति को प्ररूप 1 में अपना आवेदन प्रस्तुत करना होगा और इस आवेदन के साथ निम्नलिखित संलग्न करने होंगे: -
(क) निवास - स्थान का प्रमाण , और
(ख ) पासपोर्ट आकार के हाल में खींचे गए दो फोटो,
(2) आवेदन निम्नलिखित के समक्ष प्रस्तुत किया जाएगा
(i ) आवेदक ने अपने आवेदन के साथ जिस निवास स्थान का प्रमाण संलग्न किया है, उस जिले का चिकित्सा प्राधिकारी जो ऐसे प्रमाणपत्र जारी करने में सक्षम हो ।
(ii ) सरकारी अस्पताल का संबंधित चिकित्सा प्राधिकारी जहां आवेदक अपनी निःशक्तता के संबंध में उपचार करा रहा हो अथवा कराया हो :
परंतु यह कि जहां कोई निःशक्त व्यक्ति अवयस्क हो या मानसिक मंदता से पीड़ित हो अथवा ऐसी किसी निःशक्तता से ग्रस्त हो जिसके कारण वह स्वयं ऐसा आवेदन देने में अनुपयुक्त अथवा असमर्थ हो तो उसके विधिक संरक्षक द्वारा उसकी ओर से आवेदन प्रस्तुत किया जा सकता है ।
4. निःशक्तता प्रमाणपत्र को जारी किया जाना
(1 ) नियम 3 के अधीन आवेदन प्राप्त होने पर, चिकित्सा प्राधिकारी , स्वयं को संतुष्ट करने के पश्चात् कि आवेदक अधिनियम की धारा 2 के उपखण्ड (न) में दी गई परिभाषा के अनुसार निःशक्त व्यक्ति है, तो वह प्ररूप 2 , भारत का राजपत्र : असाधारण

प्ररूप 3 या प्ररूप 4 , जो भी लागू हो, में निःशक्त व्यक्ति के पक्ष में निःशक्तता प्रमाणपत्र जारी कर सकता है ।
(2) चिकित्सा प्राधिकारी द्वारा आवेदन प्राप्त होने की तारीख से यथासंभव एक सप्ताह के भीतर प्रमाणपत्र जारी कर दिया जाएगा किंतु किसी भी मामले में , प्रमाणपत्र जारी करने में आवेदन प्राप्ति की तारीख से एक मास से अधिक का विलंब नहीं होगा ।
सम्यक् जांच के पश्चात् चिकित्सा प्राधिकारी
(3 )
(i ) ऐसे मामले में स्थायी निःशक्तता प्रमाणपत्र देगा जिनमें निःशक्तता की डिग्री में, समय के गुजरने के साथ , किसी प्रकार के परिवर्तन की संभावना नहीं हो , और
(ii ) उन मामलों में जहां निःशक्तता की डिग्री में समय के गुजरने के साथ किसी प्रकार के परिवर्तन की संभावना हो, प्रमाणपत्र में विधिमान्यता की अवधि उपदर्शित करेगा ।
(4) यदि आवेदक निःशक्तता प्रमाणपत्र जारी किए जाने के लिए अपात्र पाया जाता है तो चिकित्सा प्राधिकारी उसका आवेदन निरस्त करने के कारणों को स्पष्ट करेगा और आवेदक को प्ररूप 5 में लिखित में उन कारणों की सूचना भी देगा ।
(5) मुख्य चिकित्सा अधिकारी को छोड़कर किसी अन्य चिकित्सा प्राधिकारी द्वारा इन नियमों के अधीन जारी प्रत्येक निःशक्तता प्रमाणपत्र की प्रति ऐसे चिकित्सा प्राधिकारी द्वारा जिले के मुख्य चिकित्सा अधिकारी को भी साथ - साथ भेजी जाएगी ।
निःशक्तता प्रमाणपत्र जारी करने या इंकार करने के निर्णय की समीक्षा
(1 ) निःशक्तता प्रमाणपत्र के लिए कोई आवेदक जो यथास्थिति, उसको जारी किए गए प्रमाणपत्र के स्वरूप या उसके पक्ष में ऐसा प्रमाणपत्र जारी करने से इंकार करने से व्यथित है , समुचित सरकार द्वारा इस प्रयोजन THE GAZETTE OF INDIA : EXTRAORDINARY

के लिए यथाविर्निदिष्ट चिकित्सा प्राधिकारी के ऐसे विनिश्चय के विरूद्ध अभ्यावेदन कर सकेगा ।
परंतु यह कि जहाँ कोई निःशक्त व्यक्ति अवयस्क हो या मानसिक मंदता से पीड़ित हो अथवा ऐसी किसी निःशक्तता से ग्रस्त हो जिसके कारण वह ऐसा आवेदन देने में अनुपयुक्त अथवा असमर्थ हो तो उसकी ओर से आवेदन उसके विधिक संरक्षक द्वारा प्रस्तुत किया जा सकता है ।
(2) समीक्षा के आवेदन के साथ प्रमाणपत्र की प्रति या उसके विरूद्ध नामंजूर किए गए पत्र की प्रति संलग्न करना आवश्यक होगा ।
(3 ) समीक्षा के लिए आवेदन प्राप्त होने पर चिकित्सा प्राधिकारी अपीलकर्ता को सुनवाई का अवसर दिए जाने के पश्चात् ऐसे आदेश पारित कर सकता है जैसे वह उचित समझता हो ।
(4) जहां तक संभव हो , समीक्षा के लिए आवेदन का आवेदन प्राप्ति की तारीख से एक पखवाड़े के भीतर निपटान कर दिया जाएगा किंतु किसी भी स्थिति में , आवेदन प्राप्ति की तारीख से एक मास से अधिक का विलंब नहीं होगा ।
6. नियम 4 के अधीन जारी प्रमाणपत्र को सभी प्रयोजनों के लिए साधारणतः विधिमान्य बनाया जाना
नियम 4 के अधीन जारी प्रमाणपत्र, यथास्थिति , ऐसी शर्तों के अधीन रहते हुए जो सुसंगत स्कीमों या सरकार के अनुदेशों , आदि में विर्निदिष्ट किया जाए , सरकार और सरकार द्वारा वित्तपोषित गैर सरकारी संगठनों की स्कीमों के अधीन ग्राह्य सुविधाओं , रियायतों और फायदों के लिए आवेदन करने का पात्र बनाएगा । " ;

( iii) नियम 43 के स्थान पर निम्नलिखित नियम रखे जाएंगे , अर्थात् : -
43. मुख्य आयुक्त की नियुक्ति के लिए अर्हता -
मुख्य आयुक्त के रूप में नियुक्ति के लिए पात्र होने के उद्देश्य से किसी व्यक्ति द्वारा निम्नलिखित शर्तों को पूरा करना आवश्यक है, अर्थात् : -
(i) उसके पास निःशक्तता व्यक्तियों के पुनर्वास से संबंधित मामलों के संबंध में विशेष ज्ञान अथवा व्यावहारिक अनुभव हो;
( ii ) उसकी उस वर्ष , जिसमें नियम 43 क के उपनियम ( 1 ) के अधीन जारी विज्ञापन में यथाविनिर्दिष्ट आवेदनों की प्राप्ति की अंतिम तारीख हो , की 1 जनवरी को, 60 वर्ष की आयु पूरी न की हो;
( iii ) यदि वह केन्द्रीय सरकार अथवा किसी राज्य सरकार के अधीन सेवारत है, तो उसे इस पद पर नियुक्ति से पूर्व उस सेवा से सेवानिवृत्ति लेनी आवश्यक है; और
( iv ) उसके पास निम्नलिखित शैक्षिक अर्हता और अनुभव हो , अर्थात् : -
(क) शैक्षिक अर्हताः-
(i ) आवश्यकः किसी मान्यताप्राप्त विश्वविद्यालय से स्नातक ।
( ii ) वांछनीयः सामाजिक कार्य/ विधि/प्रबंधन / मानव अधिकार/ पुनर्वास/निःशक्तता व्यक्ति शिक्षा में मान्यताप्राप्त डिग्री / डिप्लोमा ।
(ख) अनुभवः
निम्नलिखित प्रकार के एक या अधिक संगठनों में निर्धारित स्तरों पर कम से कम 25 वर्ष का अनुभव: -
(क) केन्द्रीय / राज्य सरकार/ पब्लिक सेक्टर उपक्रम/ निःशक्तता से संबंधित मामलों के अर्द्ध सरकारी या स्वायत्त निकाय और/ अथवा सामाजिक क्षेत्र ( स्वास्थ्य/ शिक्षा/ गरीबी उन्मूलन/ महिला एवं बाल विकास ) में किसी समूह " क " स्तर के पद, अथवा (ख ) निःशक्तता/ सामाजिक विकास के क्षेत्र में कार्यरत किसी रजिस्ट्रीकृत राष्ट्रीय या अन्तरर्राष्ट्रीय स्तर के स्वयंसेवी संगठन में एक ज्येष्ठ स्तर के कृत्यकारी , या ( ग) सामाजिक कार्य में लगे हुए और संगठन के सामाजिक विकास कार्यकलापों को संचालित करने के प्रभारी किसी प्रमुख प्राइवेट सेक्टर संगठन में तैनात ज्येष्ठ कार्यकारीः
परन्तु यह कि ऊपर वर्णित कुल पच्चीस वर्षों के अनुभवों में से , निःशक्त व्यक्तियों के सशक्तिकरण के क्षेत्र में हाल ही में कम से कम तीन वर्षों का अनुभव होना आवश्यक है ।

43क. मुख्य आयुक्त की नियुक्ति की पद्धतिः-
(1 ) मुख्य आयुक्त के पद के रिक्त होने के कारण , लगभग छह मास पूर्व नियम 43 में वर्णित मानदंडों को पूरा करने वाले पात्र अभ्यर्थियों से इस पद के लिए आवेदन आमंत्रित करने के लिए कम से कम दो राष्ट्रीय स्तर के दैनिकों में अंग्रेजी तथा हिन्दी में एक विज्ञापन प्रकाशित किया जाएगा ।
(2) मुख्य आयुक्त के पद के लिए तीन उपयुक्त अभ्यर्थियों का एक पैनल अनुशंसित करने के लिए एक जांच -सह- चयन समिति गठित की जाएगी ।
(3 ) समिति का गठन कार्मिक और प्रशिक्षण विभाग द्वारा समय - समय पर जारी सुसंगत अनुदेशों द्वारा प्रशासित होगा ।
(4) समिति द्वारा अनुशंसित पैनल उन व्यक्तियों में से होगा जिन्होंने उक्त उपनियम (1 ) में प्रकाशित विज्ञापन की अनुक्रिया में आवेदन किया हो अन्य पात्र व्यक्ति विचार करने के लिए जिन्हें समिति उपयुक्त समझे ।
(5) केन्द्रीय सरकार जांच-सह- चयन समिति द्वारा अनुशंसित अभ्यर्थियों में से एक को मुख्य आयुक्त के पद पर नियुक्त करेगी ।
43ख. मुख्य आयुक्त का कार्यकाल
(1) मुख्य आयुक्त उस तारीख को जिसको वह पदधारण किया हुआ था से तीन वर्ष की अवधि के लिए पूर्णकालिक आधार पर नियुक्त किया गया हो या पैंसठ वर्ष की आयु पूरा करने तक , जो भी पूर्वतर हो ।
(2) कोई व्यक्ति पैंसठ वर्ष की उपरी आयु सीमा के अधीन रहते हुए अधिकतम दो बार के लिए मुख्य आयुक्त के रूप में सेवा कर सकेगा ।
43ग. मुख्य आयुक्त का वेतन और भत्ते -
(1) मुख्य आयुक्त का वेतन और भत्ते सचिव, भारत सरकार को अनुज्ञेय वेतन और भत्ते के समान होगा ।
(2) जहां सेवानिवृत्त सरकारी कर्मचारी या सरकार द्वारा वित्तपोषित किसी संस्था या स्वायत्त निकाय के सेवानिवृत्त कर्मचारी रहते हुए मुख्य आयुक्त ऐसी पूर्व सेवा की बाबत पेंशन प्राप्त करता है वहां वह इन नियमों के अधीन उसको अनुज्ञेय वेतन में से पेंशन की रकम और यदि उसने पेंशन के भाग के बदले उसका संराशित मूल्य प्राप्त किया था तो पेंशन की ऐसी संराशित भाग की रकम घटा दी जाएगी ।

43घ. मुख्य आयुक्त की सेवा की अन्य शर्तें और निबंधन --
छुटटी-
(1)
मुख्य आयुक्त ऐसी छुटटी के लिए पात्र होगा जो केन्द्रीय सिविल सेवा ( छुटटी) नियम , 1972 के अधीन सरकारी सेवकों के लिए अनुज्ञेय है ।
छुटटी यात्रा रियायत -
(2)
मुख्य आयुक्त ऐसी छुटटी यात्रा रियायत का हकदार होगा जो केन्द्रीय सिविल सेवा (एलटीसी) नियम , 1988 के अधीन समूह "क अधिकारियों के लिए अनुज्ञेय है ।
चिकित्सा लाभ -

मुख्य आयुक्त ऐसे चिकित्सा लाभ प्राप्त करने का हकदार होगा जो केन्द्रीय सरकार स्वास्थ्य स्कीम ( सीजीएचएस) के अधीन समूह " कै अधिकारियों के लिए अनुज्ञेय है ।
43ड. त्यागपत्र और हटाना --
(1) मुख्य आयुक्त अपने पद से केन्द्रीय सरकार को संबोधित अपने हाथ से लिखित सूचना द्वारा त्यागपत्र दे सकता है ।
(2) केन्द्रीय सरकार मुख्य आयुक्त के पद से किसी व्यक्ति को तब हटा सकती है, जब वह -
अनुन्मोचिन दिवालिया हो गया हो;
(क)
(ख) अपने कार्यकाल के दौरान किसी आर्थिक लाभ वाले रोजगार अथवा अपने कार्यालय के बाहर के कार्यकलापों का निष्पादन करता है ;
(ग ) ऐसे अपराध जिसमें केन्द्रीय सरकार की राय में नैतिक अधमता में अंतर्वलित हो , के लिए दोषसिद्धि और दंडादेश का कारावास पाया हो;
( घ ) केन्द्रीय सरकार की राय में मन या शरीर के अंग- शैथिल्य अथवा अधिनियम में यथा वर्णित उसके कार्य संपादन के कारण से कार्यालय में निरंतर अनुपयुक्त रहा हो;
(ड. ) केन्द्र सरकार से छुटटी की अनुमति लिए बिना , 15 दिन अथवा इससे अधिक की एक क्रमिक अवधि के दौरान कार्य से अनुपस्थित रहा हो ; अथवा
( च ) केन्द्रीय सरकार की राय में मुख्य आयुक्त के पद का ऐसा दुरूपयोग हो जिससे निःशक्त व्यक्तियों के हित के लिए पद पर बने रहना हानिकारक होता हो :
परन्तु किसी व्यक्ति को केन्द्रीय सरकार के समूह " क " कर्मचारी को हटाने के लिए विहित प्रक्रिया के सिवाय इस नियम के अधीन नहीं हटाया जाएगा ।
( 3 ) केन्द्रीय सरकार ऐसे मुख्य आयुक्त को , जिसके संबंध में उप - नियम ( 2 ) के अनुसार हटाने के लिए कार्यवाहियां की गई है, इस प्रकार की कार्यवाहियों के लंबित रहने के दौरान निलम्बित कर सकती है ।
43च. अपशिष्ट उपबंध -
ऐसे मुख्य आयुक्त की सेवा शर्तें जिनके संबंध में इन नियमों में कोई स्पष्ट उपबंध नहीं किया गया है, भारत सरकार के सचिव को तत्समय लागू नियमों और आदेशों द्वारा अवधारित की जाएगी । "

NOTIFICATION
New Delhi , the 30th December , 2009
G.S.R. 2 ( E) .-In exercise of the powers conferred by sub - sections ( 1 ) and (2 ) of Section 73 of the Persons with Disabilities ( Equal Opportunities , Protection of Rights and Full Participation ) Act , 1995 ( 1 of 1996 ) , the Central Government hereby makes the following rules to amend the Persons with Disabilities ( Equal Opportunities , Protection of Rights and Full Participation ) Rules , 1996, namely :-
1.. (1) These rules may be called the Persons with Disabilities (Equal Opportunities , Protection of Rights and Full Participation ) Amendment Rules, 2009.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. In the Persons with Disabilities ( Equal Opportunities , Protection of Rights and Full Participation ) Rules , 1996 , -
(i) for rule 2 , the following rule shall be substituted, namely: -
" 2. Definitions.-
(1) In these rules unless the context otherwise requires ,-
(a ) "Act " means the Persons with Disabilities ( Equal Opportunities , Protection of Rights and Full Participation ) Act , 1995 ( 1 of 1996 ) ;

(b ) " certificate " or " disability certificate " means a certificate issued in pursuance of clause (t ) of section 2 of the Act ;
(c ) " multiple disabilities " means a combination of two or more disabilities as defined in clause ( i ) of section 2 of the Act ;
(d) " Form " means a form appended to these rules .
(2) Words and expressions defined in the Act but not defined in these rules , shall have the meanings respectively assigned to them in the Act . " ;
(ii) for CHAPTER II , the following Chapter shall be substituted , namely : -
" CHAPTER II
DISABILITY CERTIFICATE
3. Application for issue of disability certificate
(1) A person with disability desirous of getting a certificate in his favour shall submit an application in Form I , and the application shall be accompanied by -
(a) proof of residence , and
(b) two recent passport size photographs .
(2) The application shall be submitted to
(i ) a medical authority competent to issue such a certificate in the district of the applicant's residence as mentioned in the proof of residence submitted by him with the application , or
(ii ) the concerned medical authority in a government hospital where he may be undergoing or may have undergone treatment in connection with his disability :

Provided that where a person with disability is a minor or suffering from mental retardation or any other disability which renders him unfit or unable to make such an application himself , the application on his behalf may be made by his legal guardian .
4. Issue of disability certificate
(1) On receipt of an application under rule 3 , the medical authority shall , after satisfying himself that the applicant is a person with disability as defined in sub - clause ( t) of section 2 of the Act , issue a disability certificate in his favour in Form II , Form III or Form IV as applicable .
(2) The certificate shall be issued as far as possible , within a week from the date of receipt of the application by the medical authority , but in any case , not later than one month from such date.
(3) The medical authority shall , after due examination , -
( i ) give a permanent disability certificate in cases where there are no chances of variation , over time , in the degree of disability , and (ii ) shall indicate the period of validity in the certificate , in cases where there is any chance of variation , over time , in the degree of disability.
(4) If an applicant is found ineligible for issue of disability certificate , the medical authority shall explain to him the reasons for rejection of his application , and shall also convey the reasons to him in writing .
( 5) A copy of every disability certificate issued under these rules by a medical authority other than the Chief Medical Officer shall be simultaneously sent by such medical authority to the Chief Medical Officer of the District .

5. Review of a decision regarding issue of, or refusal to issue , a disability certificate -
(1) Any applicant for a disability certificate , who is aggrieved by the nature of a certificate issued to him , or by refusal to issue such a certificate in his favour , as the case may be , may represent against such a decision to the medical authority as specified for the purpose by the appropriate Government :
Provided that where a person with disability is a minor or suffering from mental retardation or any other disability which renders him unfit or unable to make such an application himself, the application on his behalf may be made by his legal guardian .
(2) The application for review shall be accompanied by a copy of the certificate or letter of rejection being appealed against .
( 3) On receipt of an application for review , the medical authority shall , after giving the appellant an opportunity of being heard , pass such orders on it as it may deem appropriate .
(4) An application for review shall , as far as possible , be disposed of within a fortnight from the date of its receipt , but in any case , not later than one month from such date .
6. Certificate issued under rule 4 to be generally valid for all purposes.- A certificate issued under rule 4 shall render a person eligible to apply for facilities , concessions and benefits admissible under schemes of the Government and of Non - Governmental Organizations funded by the Government , subject to such conditions as may be specified in relevant schemes or instructions of Government , etc. , as the casemay be. " ;

(iii ) for rule 43 , the following rules shall be substituted , namely: -
" 43. Qualification for appointment of Chief Commissioner -
In order to be eligible for the appointment as Chief Commissioner , a person must satisfy the following conditions, namely : -
(i ) he should have special knowledge or practical experience in respect of matters relating to rehabilitation of persons with disabilities ;
( ii ) he should not have attained the age of sixty years on the 1st January of the year in which the last date for receipt of applications , as specified in the advertisement issued under sub - rule ( 1 ) of rule 43 A, falls ;
(iii ) if he is in service under the Central Government or a State Government , he shall seek retirement from such service before his appointment to the post ; and (iv) he must possess the following educational qualification and experience , namely (A) Educational qualifications.-
(i) Essential : Graduate from a recognised university.
( ii ) Desirable : Recognised degree/ diploma in Social Work/ Law/ Management / Human Rights/ Rehabilitation/ Education of Disabled Persons.
(B) Experience.-
Should have at least twenty- five years experience in one or more of the following types of organizations at specified levels : -
(a) In a Group ' A ' level post in Central /State Government / Public Sector Undertaking / Semi Government or Autonomous Bodies dealing with disability related matters and / or social sector ( health / education /poverty alleviation / women and child development) ; or
( b) A senior level functionary in a registered national or international level voluntary organisation working in the field of disability/ social development ; or 22

1 (c) Senior Executive position in a leading private sector organisation , involved in social work and in charge of handling social development activities of the organization :
Provided that out of the total twenty - five years experience mentioned above , at least three years of experience in the recent past should have been in the field of empowerment of persons with disabilities .
43A . Mode of appointment of the Chief Commissioner -
(1) About six months before the post of Chief Commissioner is due to fall vacant , an advertisement shall be published in at least two national level dailies each in English and Hindi inviting applications for the post from eligible candidates fulfilling the criteria mentioned in rule 43 .
(2) A Search- cum- Selection Committee shall be constituted to recommend a panel of three suitable candidates for the post of the Chief Commissioner .
(3) Composition of the Committee will be governed by relevant instructions issued by the Department of Personnel and Training from time to time .
(4) The panel recommended by the Committee may consist of persons from amongst those who have applied in response to the advertisement mentioned in sub - rule ( 1 ) above , as well as other eligible persons whom the Committee may consider suitable .
(5) The Central Government shall appoint one of the candidates recommended by the Search - cum - Selection Committee as the Chief Commissioner .
43B . Term of the Chief Commissioner -
(1) The Chief Commissioner shall be appointed on full - time basis for a period of three years from the date on which he assumes office , or till he attains the age of sixty- five years , whichever is earlier .

(2) A person may serve as Chief Commissioner for a maximum of two terms , subject to the upper age limit of sixty - five years .
43C. Salary and allowances of the Chief Commissioner -
(
1) The salary and allowances of the Chief Commissioner shall be the salary and allowances as admissible to a Secretary to the Government of India .
(2) Where a Chief Commissioner , being a retired Government Servant or a retired employee of any institution or autonomous body funded by the Government , is in receipt of pension in respect of such previous service , the salary admissible to him under these rules shall be reduced by the amount of the pension , and if he had received in lieu of a portion of the pension , the commuted value thereof, by the amount of such commuted portion of the pension .
43D . Other terms and conditions of service of the Chief Commissioner Leave-
(1)
The Chief Commissioner shall be entitled to such leave as is admissible to Government servants under the Central Civil Service ( Leave ) Rules , 1972 .
Leave Travel Concession -
(2)
The Chief Commissioner shall be entitled to such Leave Travel Concession as is admissible to Group ' A' officers under Central Civil Service ( LTC) Rules, 1988 .
Medical Benefits -
(3)
The Chief Commissioner shall be entitled to such medical benefits as is admissible to Group 'A' officers under the Central Government Health Scheme( CGHS ) .

43E . Resignation and removal
(1) The Chief Commissioner may , by notice in writing , under his hand , addressed to the Central Government , resign his post .
(2) The Central Government shall remove a person from the office of the Chief Commissioner , if he -
(a) becomes an undischarged insolvent;
(b) engages during his term of office in any paid employment or activity outside the duties of his office;
(c) gets convicted and sentenced to imprisonment for an offence which in the opinion of the Central Government involves moral turpitude ;
(d) is in the opinion of the Central Government , unfit to continue in office by reason of infirmity of mind or body or serious default in the performance of his functions as laid down in the Act ;
(e) without obtaining leave of absence from the Central Government , remains absent from duty for a consecutive period of 15 days or more ; or (f) has , in the opinion of the Central Government , so abused the position of the Chief Commissioner as to render his continuance in office detrimental to the interest of persons with disability :
Provided that no person shall be removed under this rule except after following the procedure , mutatis mutandis , prescribed for removal of a Group ' A' employee of the Central Government.
(3) The Central Government may suspend a Chief Commissioner , in respect of whom proceedings for removal have been commenced in accordance with sub- rule ( 2 ) , pending conclusion of such proceedings .
43F . Residuary provision -
Conditions of service of a Chief Commissioner in respect of which no express provision has been made in these rules shall be determined by the rules and orders for the time being applicable to a Secretary to the Government of India . " ;
