का.आ. 26(अ).-यतः मै. मायर इन्फ्रास्ट्रक्चर डेवलपर्स प्राइवेट लिमिटेड ने हरियाणा राज्य के राखा और निमोथ गाँव, तहसील - सोहना , जिला गुड़गाँव में जैव प्रौद्योगिकी के लिए एक क्षेत्र विशिष्ट विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28 ) ( जिसे एतपश्चात् अधिनियम कहा गया है ) , की धारा 3 के अंतर्गत प्रस्ताव किया है;
और यतः केन्द्र सरकार ने विशेष आर्थिक जोन नियम, 2006 के नियम 8 के साथ. पठित के अधिनियम की धारा 4 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए वाणिज्य एवं उद्योग मंत्रालय की दिनांक 9 सितम्बर , 2008 की अधिसूचना सं. का.आ. 2174(अ) में हरियाणा राज्य के राखा और निमोथ गाँव , तहसील- सोहना , जिला गुड़गाँव में जैव प्रौद्योगिकी के लिए एक क्षेत्र विशिष्ट विशेष आर्थिक जोन के रूप में 12.4928 हेक्टेयर का कुल क्षेत्र अधिसूचित किया है ;
और यतः मै. मायर इन्फ्रास्ट्रक्चर डेवलपर्स प्राइवेट लिमिटेड ने हरियाणा राज्य के राखा और निमोथ गाँव , तहसील- सोहना , जिला गुड़गाँव में 2.59 हेक्टेयर के अतिरिक्त क्षेत्र को उस विशेष आर्थिक जोन के एक हिस्से के रूप में शामिल करने का प्रस्ताव है;
यतः , केन्द्र सरकार , इस बात से संतुष्ट है कि अधिनियम की धारा 3 की उप - धारा ( 8 ) के अंतर्गत अपेक्षाओं तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसके उक्त राखा और निमोथ गाँव , तहसील- सोहना , जिला गुड़गाँव में जैव प्रौद्योगिकी के

लिए एक क्षेत्र विशिष्ट विशेष आर्थिक जोन के विकास , एवं प्रचालन हेतु उक्त अधिनियम की धारा 3 की उप- धारा ( 10 ) के अंतर्गत दिनांक 13 नवम्बर , 2009 को अनुमोदन प्रदान कर दिया है;
अतः , अब , विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28 ) की धारा 4 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विशेष आर्थिक जोन नियमावली , 2006 के नियम 8 के अनुसरण में केन्द्र सरकार एतद्वारा हरियाणा राज्य के राखा और निमोथ गाँव , तहसील- सोहना, जिला गुड़गाँव में 2.59 हेक्टेयर्स के अतिरिक्त क्षेत्र को उस विशेष आर्थिक जोन के एक हिस्से के रूप में अधिसूचित करती है एवं उपरोक्त अधिनियम में ऐसे अधिक्रमण से पूर्व किए गए कार्यों या किए जाने के लिए विलोपित कार्यों को छोड़कर निम्नानुसार संशोधन करती है, अर्थात्:-

S.O. 26( E ) . Whereas M/ s . Mayar Infrastructure Development Private Limited, has proposed under Section 3 of the Special Economic Zones Act , 2005 ( 28 of 2005 ) , (hereinafter referred to as the Act) to set up a Sector Specific Special Economic Zone for Biotechnology Sector at Rakha andNimoth Villages , Tehsil - Sohna , District -Gurgaon in the State of Haryana;
Andwhereas the Central Government, in exercise of the powers conferred by sub - section ( 1) of Section 4 of the Act read with Rule 8 of the Special Economic Zones Rules 2006 , has notified a total area of 12.4928 hectares at Rakha and Nimoth Villages , Tehsil Sohna , District- Gurgaon in the State of Haryana as Special Economic Zone inthe Ministry of Commerce and Industry Notification No. S.O. 2174 ( E) , dated 9th September , 2008;
And whereas M/ s . Mayar Infrastructure Develop- ment Private Limited has proposed to include additional area of 2.59 hectares at Gurgaon , Haryana as a part of that Special Economic Zone ;
And whereas the Central Government is satisfied that the requirements under sub - section (8) of Section 3 of the Act and other related requirements are fulfilled and it has granted letter of approval under sub - section ( 10) of [ भाग II- खण्ड 3 ( ii ) ]
