सा.का.नि. 13(अ). केन्द्रीय सरकार , वाणिज्य पोत परिवहन अधिनियम, 1958 ( 1958 की 44) की धारा 356ग की उप- धारा ( 3 ) , धारा 356ङ , धारा 356 ण के खंड ( ङङ ) और धारा 457 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित नियम बनाती है, अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ -( 1 ) इन नियमों का संक्षिप्त नाम वाणिज्य पोत परिवहन ( पोतों से मल द्वारा प्रदूषण का निवारण ) नियम , 2010 है ।
( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं.-( 1 ) इन नियमों में जब तक संदर्भ से अन्यथा अपेक्षित न हो ,-
( क) " अधिनियम " से वाणिज्य पोत परिवहन अधिनियम , 1958 अभिप्रेत है;
(ख) " आब्दिक तारीख " से प्रत्येक वर्ष का वह दिन और मास अभिप्रेत है जो अन्तर्राष्ट्रीय मल प्रदूषण निवारण प्रमाणपत्र की पर्यवसान की तारीख के तदनुरूप हो;
( ग) " प्रमाणपत्र" से नियम 5 के अधीन जारी किए गए, यथास्थिति , अन्तर्राष्ट्रीय मल प्रदूषण निवारण प्रमाणपत्र या भारतीय मल प्रदूषण निवारण प्रमाणपत्र अभिप्रेत है;
(घ) " प्रमाणन प्राधिकारी " से केन्द्रीय सरकार अभिप्रेत है;
(ङ) " विद्यमान पोत " से ऐसा पोत अभिप्रेत है जो एक नया पोत नहीं है;
( च) " सरकारी पोत " से केन्द्रीय सरकार या राज्य सरकार के स्वामित्वाधीन पोत अभिप्रेत है;

(1) ( छ) " धारक टैंक " से मल के संग्रहण और भंडारण के लिए उपयोग किया गया है टैंक अभिप्रेत है;
(ज) " अन्तर्राष्ट्रीय समुद्री यात्रा " किसी ऐसे देश से समुद्री यात्रा अभिप्रेत है जिसको ऐसे देश के बाहर पत्तन को अभिसमय लागू होता है या इसके विपरीत;
(झ ) " नए पोत " से ऐसा पोत अभिप्रेत है-
(क) जिसके लिए निर्माण संविदा की जाती है या निर्माण संविदा के अभाव में, जिसकी कील बिछाई जाती है या जो 27 सितम्बर , 2003 को या उसके पश्चात् संनिर्माण के वैसे ही प्रक्रम पर है; या
(ख) 27 सितम्बर, 2003 के पश्चात् जिसका परिदान तीन वर्ष या उससे अधिक है;
(ञ) " निकटतम भूमि" , इसके सभी व्याकरणिक रूप भेदों सहित, से ऐसी आधार रेखा अभिप्रेत है जिससे प्रश्नगत राज्य क्षेत्र का राज्यक्षेत्रीय सागर अभिसमय के प्रयोजनों के सिवाय अन्तर्राष्ट्रीय विधि के अनुसार स्थापित किया जाता है , आस्ट्रेलिया के पूर्वोत्तर तट की विपरीत निकटतम भूमि से अक्षांश 11 °00 दक्षिण देशांतर 142 ° 08 उत्तर में आस्ट्रेलिया के तट पर किसी बिन्दु से खींची गई आधार रेखा अभिप्रेत होगी :
वहां से अक्षांश 10 °35 दक्षिण में बिंदु तक देशांतर 141 ° 55 पूर्व
वहां से अक्षांश 10 ° 00 दक्षिण में बिंदु देशांतर 142 °00 पूर्व वहां से अक्षांश 09 ° 10 दक्षिण में बिंदु देशांतर 143 ° 52 पूर्व वहां से अक्षांश 09 ° 00 दक्षिण में बिंदु देशांतर 144 °30 पूर्व वहां से अक्षांश 10 ° 41 दक्षिण में बिंदु देशांतर 145 ° 00 पूर्व वहां से अक्षांश 13 ° 00 दक्षिण में बिंदु देशांतर 145 ° 00 पूर्व वहां से अक्षांश 17 ° 30 दक्षिण में बिंदु देशांतर 147 °00 पूर्व

परन्तु यह कि जहां ऐसी सुधारात्मक कार्रवाई नहीं की गई है, अधीन पत्तन या तट टर्मिनलों की समुद्री यात्राओं में लगा हुआ है और में इसकी संरचना, उपस्कर, प्रणालियों, फिटिंगों व्यवस्थाओं
वहां प्रमाणपत्र वापस ले लिया जाएगा और केन्द्रीय सरकार को इसकी वहां से अक्षांश 21 ° 00 दक्षिण में बिंदु देशांतर 152 °55 पूर्व विद्यमान पोतों की दशा में, ऐसी अपेक्षा 27 सितम्बर, 2003 की और सामग्री का एक सम्पूर्ण सर्वेक्षण सम्मिलित होगा
रिपोर्ट तुरन्त की जाएगी .: वहां से अक्षांश 24 ° 30 दक्षिण में बिंदु देशांतर 154 °00 पूर्व
तारीख के पश्चात् पांच वर्ष तक लागू रहेगी । जिससे यह सुनिश्चित किया जा सके कि वे इन नियमों की
परन्तु यह और कि यदि पोत किसी अन्य राज्य पक्षकार के वहां से अक्षांश 24 ° 42 दक्षिण में आस्ट्रेलिया के तट पर बिंदु अपेक्षाओं का पूर्ण रूप से अनुपालन करते हैं ।

तुरन्त रिपोर्ट की जाएगी : द्वारा जारी किया जाएगा या पृष्ठांकित किया जाएगा और प्रत्येक
(2) " व्यक्ति " में कर्मीदल का सदस्य और यात्री भी सम्मिलित मामलों में , ऐसे प्रमाण- पत्र के लिए केन्द्रीय सरकार पूरी जिम्मेदारी वहां के सिवाय संचालित किया जाएगा जहां नियम 8 के
परन्तु यह भी कि जहां सर्वेक्षक या प्राधिकृत व्यक्ति वे पत्तन हैं; लेगी । उपनियम ( 2 ) , ( 5 ) , ( 6 ) और ( 7 ) के उपबंध लागू होते
राज्य के समुचित प्राधिकारियों को रिपोर्ट की है तो उस पत्तन राज्य की (ठ) " धारा " से अधिनियम की धारा अभिप्रेत है; हैंऔर नवीकरण सर्वेक्षण ऐसा होगा जिससे यह सुनिश्चित
सरकार इन नियमों के अधीन अपनी बाध्यताओं का पालन करने के (3 ) केन्द्रीय सरकार , अभिसमय के राज्य पक्षकार की सरकार होसके कि संरचना, उपस्कर, प्रणालियां, फिटिंग , व्यवस्थाओं
लिए ऐसे सर्वेक्षक या प्राधिकृत व्यक्ति को आवश्यक सहायता देगी (ड) " मल" के वही अर्थ होंगे जो उसके धारा 356 को के अनुरोध पर उस राज्य में रजिस्ट्रीकृत पोत का सर्वेक्षण कराएगी
उप- धारा ( 3 ) के स्पष्टीकरण में हैं । और सामग्रियां इन नियमों की अपेक्षाओं का पूर्णतया
और यह सुनिश्चित करेगी ऐसा पोत तब तक समुद्र में नहीं चलेगा और यदि समाधान हो जाता है कि अभिसमय के उपंबंधों का अनुपालन अनुपालन करते हैं ।
जब तक यह समुद्री पर्यावरण को हानि पहुंचाने की किसी अयुक्तियुक्त 3. मल द्वारा समुद्र के प्रदूषण को रोकने की बाध्यता- किया गया है , तो उस पोत को अन्तर्राष्ट्रीय मल प्रदूषण निवारण
आशंका को प्रदर्शित किए बिना उपलब्ध निकटतम समुचित मरम्मत ( 1 ) समुद्रीय यात्रा में चलने वाले निम्नलिखित पोत , पोतों के मल प्रमाण- पत्र जारी करेगी और प्रमाण- पत्र की एक प्रति और सर्वेक्षण (ग) परिस्थितियों के अनुसार एक अतिरिक्त सर्वेक्षण या तो वह
यार्ड की ओर अग्रसर होने के प्रयोजन के लिए समुद्र की ओर अग्रसर द्वारा समुद्र के प्रदूषण को रोकने की बाध्यता के अधीन होंगे और इन रिपोर्ट की एक प्रति सर्वेक्षण कराने का अनुरोध करने वाली सरकार साधारण या आंशिक होगा , उप- नियम (4 ) की अपेक्षानुसार
नहीं हो सकता है या पत्तन को नहीं छोड़ सकता है । नियमों के उपबंधों का अनुपालन करेंगे , अर्थात्:- को यथासंभव शीघ्र संप्रेषित करेगा । मरम्मत के पश्चात् संचालित किया जाएगा या जब कभी
(6 ) केन्द्रीय सरकार प्रत्येक मानकों में ऐसे सर्वेक्षण की (क) चार सौ सकल टन भार और उससे अधिक के नए पोत; महत्वपूर्ण मरम्मतें या नवीकरण किए जाते हैं और ऐसा
(4) उप- नियम ( 3 ) क्के अधीन जारी प्रमाण- पत्र में एक सर्वेक्षण यह सुनिश्चित करता है कि आवश्यक मरम्मत या
संपूर्णता तथा दक्षता को पूर्णतया प्रत्याभूत करेगी और ऐसो बाध्यता (ख) चार सौ सकल टन भार से कम के ऐसे नए पोत जो विवरण अन्तर्विष्ट होगा कि इसे राज्य पक्षकार की सरकार के अनुरोध नवीकरण प्रभावपूर्ण रूप से किए गए है और ऐसी मरम्मतों
को पूरी करने के लिए आवश्यक व्यवस्थाओं को सुनिश्चित करने का पन्द्रह से अधिक व्यक्तियों को वहन करने के लिए पर जारी किया गया है और ऐसे प्रमाण- पत्र का वही प्रभाव होगा मानो
वचनबंध करेगी । या नवीकरण की सामग्री तथा कौशल सभी बाबत समाधानप्रद
प्रमाणित किए गए हैं; इसे उस सरकार द्वारा जारी किया गया हो ।

( 7) पोत तथा इसकी सज्जा की दशा को ऐसी रीति में बनाए (ग) चार सौ सकल टन भार और उससे अधिक के विद्यमान ( 5 ) ऐसे पोत को कोई अन्तर्राष्ट्रीय मल प्रदूषण निवारण अनुपालन करता है ।
रखा जाएगा जो अभिसमय के उपबंधों के अनुरूप हो ताकि पोत , पोत , 27 सितम्बर , 2003 की तारीख के पश्चात् पांच प्रमाण-पत्र जारी नहीं किया जाएगा जो किसी राज्य की, जो पक्षकार
सभी बाबत, समुद्री पर्यावरण को हानि पहुंचाने की किसी अयुक्तियुक्त वर्ष तक; नहीं है, पताका फहराने के लिए हकदार नहीं है । (2 ) केन्द्रीय सरकार , ऐसे पोतों के लिए समुचित उपाय
संभावना को प्रदर्शित किए बिना समुद्री की ओर अग्रसर होने के लिए विनिर्दिष्ट करेगी जो ऐसी रीति में उप- नियम ( 1 ) के उपबंधों के
उपयुक्त हो । (घ) चार सौ सकल टन भार से कम के विद्यमान पोत जिन्हें अध्यधीन नहीं है और इन नियमों के उपबंधों का अनुपालन किया
पन्द्रह से अधिक व्यक्तियों को वहन करने के लिए ( 6 ) केन्द्रीय सरकार , किसी ऐसे पोत को भारतीय मल प्रदूषण
निवारण प्रमाण- पत्र जारी करेगी जो भारतीय समुद्र में पत्तन या तट जाता है ।
(8) उप- नियम ( 1 ) के अधीन , पोत के किसी सर्वेक्षण को प्रमाणित किया गया है, 27 सितम्बर , 2003 की तारीख
पूरा हो जाने के पश्चात् केन्द्रीय सरकार की मंजूरी के बिना , ऐसे के पश्चात् पांच वर्ष तक । टर्मिनलों की समुद्री यात्रा में लगे हुए हैं और विद्यमान पोतों की दशा (3) इन नियमों के उपबंधों के प्रवर्तन के प्रयोजनों के लिए
उपस्कर और फिटिंगों के किसी सीधे प्रतिस्थापन के सिवाय ऐसे में, ऐसी अपेक्षा 27 सितम्बर , 2003 की तारीख के पश्चात् पांच वर्ष पोतों का सर्वेक्षण धारा 9 के अधीन नियुक्त सर्वेक्षण द्वारा या केन्द्रीय
(2) केन्द्रीय सरकार यह सुनिश्चित करेगी कि उप- नियम ( 1 ) तक लागू होगी ।
सर्वेक्षण के अन्तर्गत आने वाली सरंचनाओं , उपस्करों, प्रणालियों, के खंड ( ग ) और ( घ ) के अधीन विनिर्दिष्ट विद्यमान पोत , जिनकी सरकार द्वारा धारा 356छ की उप - धारा ( 1 ) के अधीन प्राधिकृत
फिटिंगों , व्यवस्थाओं या सामग्रियों में कोई परिवर्तन नहीं किया कीलें बिछा दी गई हैं या जो 2 अक्तूबर , 1983 से पूर्व संनिर्माण के 6. किसी अन्य सरकार द्वारा प्रमाण- पत्र जारी किया किसी व्यक्ति द्वारा किया जाएगा ।

(9 ) जब कभी किसी पोत में कोई दुघर्टना हो जाती है या कोई कीअपेक्षाओं के अनुसार मल को निस्सारित किया जा सके : सरकार, केन्द्रीय सरकार के अनुरोध पर, पोत का सर्वेक्षण कराएगी (क) ऐसी शर्तों के अधीन रहते हुए जैसी वह ठीक समझे , पोत
ऐसी त्रुटि पाई जाती है जो इन नियमों की अपेक्षानुसार सारवान् रूप से और यदि समाधान हो जाता है कि अभिसमय के उपबंधों का पालन की मरम्मत कराने की और राज्य पक्षकार के समुचित

पोत की संपूर्णता या इसकी सज्जा की दक्षता या संपूर्णता को प्रभावित होंगे : प्राधिकारियों के अनुरोध पर सर्वेक्षण कराने की अपेक्षा
करती है तो मास्टर या पोत का स्वामी केन्द्रीय सरकार को शीघ्रतम प्रमाण- पत्र जारी करेगी या जारी करने के लिए प्राधिकृत करेगी और करने के लिए , यथास्थिति उप- नियम ( 3 ) में निर्दिष्ट
(क) पोत स मल को निस्सारित करना, पोत की और फलक जहां समुचित हो , वहां इन नियमों के अनुसार उस पोत पर उस
अवसर पर इसकी रिपोर्ट करेगा , जो यह अवधारण करने के लिए कि सर्वेक्षक या प्राधिकृत व्यक्ति को सशक्त करेगी ।
पर व्यक्तियों की सुरक्षा सुनिश्चित करने के प्रयोजन के प्रमाण- पत्र को पृष्ठांकित करेगी या पृष्ठांकन को प्राधिकृत करेगी ।
उप- नियम ( 1 ) की अपेक्षानुसार सर्वेक्षण आवश्यक है या नहीं, लिए या समुद्र में जीवन रक्षा के लिए आवश्यक है; (ख) सर्वेक्षक या प्राधिकृत व्यक्ति को , उनके अधिकारियों की
सर्वेक्षक या प्राधिकृत व्यक्ति द्वारा आरंभ किए जाने वाले अन्वेषण (2) प्रमाण- पत्र की एक प्रति और सर्वेक्षण रिपोर्ट की एक जानकारी के लिए राज्य पक्षकारों को परिचालन के लिए,
कराएगी : (ख) पोत या इसके उपस्कर के नुकसान से उत्पन्न हुए मल
प्रतिसर्वेक्षण का अनुरोध करने वाली केन्द्रीय सरकार को संप्रेषित की इस प्रकार दिए गए विनिर्दिष्ट उत्तरदायित्वों और शर्तों के
को निस्सारित करने परन्तु निस्सारण को रोकने या उसे जाएगी ।
परन्तु यह कि यदि पोत किसी अन्य राज्य पक्षकार के पत्तन में अन्तर्राष्ट्रीय समुद्री संगठन को अधिसूचित करेगी

8. प्रमाण-पत्र की अवधि और विधिमान्यता. ( 1 ) जारी हकदार होगा और नवीकरण सर्वेक्षण पूरा हो जाने के पश्चात् जारी
किया गया यथास्थिति , अन्तर्राष्ट्रीय मल प्रदूषण निवारण प्रमाण- पत्र किया गया ऐसा नया प्रमाण- पत्र विस्तार मंजूर किए जाने से पूर्व
विद्यमान प्रमाण-पत्र की समाप्ति की तारीख से पांच वर्ष की अवधि
या भारतीय मल प्रदूषण निवारण प्रमाण-पत्र अधिकतम पांच वर्ष की
अवधिके लिए विधिमान्य होगा । के लिए वैध होगा ।
(2) उप- नियम ( 1 ) में अन्तर्विष्ट किसी बात के होते हुए, (6) जहां लघुतर समुद्री यात्राओं पर चलने वाले पोत को जारी
जब नजीकरण सर्वेक्षण पूरा कर लिया जाता है, तब- किया गया प्रमाण- पत्र उप- नियम ( 5 ) के उपबंधों के अधीन विस्तारित
नहीं किया गया है , वहां केन्द्रीय सरकार इसकी समाप्ति की तारीख से
(क) विद्यमान प्रमाण- पत्र की समाप्ति की तारीख से पूर्व तीन एक मास तक माफी की अवधि बढ़ा सकेगी और नवीकरण सर्वेक्षण
मास के भीतर जारी किया गया नया प्रमाण-पत्र विद्यमान
प्रमाण-पत्र की समाप्ति की तारीख से पांच वर्ष की अवधि पूरा हो जाने के पश्चात् जारी किया गया नया प्रभाण - पत्र विद्यमान
प्रमाण-पत्र की, इसके विस्तार की मंजूरी किए जाने से पूर्व, समाप्ति
के लिए ऐसे नवीकरण सर्वेक्षण के पूरा होने की तारीख से कीतारीख से पांच वर्ष की अवधि के लिए विधिमान्य होगा ।
विधिमान्य होगा;
(7) ऐसी विशेष परिस्थितियों में , जिनका अवधारण केन्द्रीय
(ख) विद्यमान प्रमाण- पत्र की समाप्ति की तारीख के पश्चात्, सरकार द्वारा किया जाए , नया प्रमाण- पत्र नवीकरण सर्वे को पूरा हो
जारी किया गया नया प्रमाण- पत्र विद्यमान प्रमाण-पत्र की
जाने की तारीख से पांच वर्ष की अवधि के लिए जारी किया जाएगा न
समाप्ति की तारीख से पांच वर्ष की अवधि के लिए ऐसे किउप-नियम (2 ) के खण्ड ( ख ) उप- नियम ( 5 ) और उप- नियम
नवीकरण सर्वेक्षण के पूरा होने की तारीख से विधिमान्य (6) में यथा उपबंधित विद्यमान प्रमाण-पत्र की तारीख से ।
होगा;
(8) नियम 5 या नियम 6 के अधीन जारी किया गया प्रमाण-पत्र
(ग) विद्यमान प्रमाण- पत्र की समाप्ति की तारीख से तीन मास निम्नलिखित मामली में विधिमान्य नहीं रह जाएगा , अर्थात्:-
से अधिक की अवधि से पूर्व जारी किया गया नया प्रमाण-पत्र
ऐसे नवीकरण सर्वेक्षण के पूरा होने की तारीख से पांच वर्ष (क) जहां नियम 4 के उप- नियम ( 1 ) के अधीन विनिर्दिष्ट
की अवधि के लिए नवीकरण सर्वेक्षण के पूरा होने की सर्वेक्षण तद्धीन विनिर्दिष्ट अवधि के भीतर पूरा नहीं किया
तारीख से विधिमान्य होगा । जाता है; या
(3) यदि पांच वर्ष से कम अवधि के लिए प्रमाण- पत्र जारी (ख) पोत को किसी अन्य राज्य पक्षकार की पताका को अन्तरण
किया जाता है तो केन्द्रीय सरकार उप- नियम ( 1 ) में विनिर्दिष्ट किए जाने पर :
अधिकतम अवधि तक समाप्ति की तारीख से आगे प्रमाण- पत्र की परन्तु ऐसा करने की अपेक्षा करने वाली किसी सरकार द्वारा
विधिमान्यता को विस्तारित कर सकेगी । ऐसा नया प्रमाण- पत्र तब तक जारी नहीं किया जाएगा जब तक
(4) यदि नवीकरण सर्वेक्षण पूरा कर लिया गया है और सरकार का पूर्णतया यह समाधान नहीं हो जाता है कि पोत नियम 4
विद्यमान प्रमाण- पत्र की समाप्ति से पूर्व एक नया प्रमाण- पत्र जारी के उप- नियम ( 7 ) और ( 8 ) की अपेक्षाओं का पूर्णतया अनुपालन
नहीं किया जा सकता या पोत के फलक पर नहीं लगाया जा सकता करता है :
है, तो केन्द्रीय सरकार विद्यमान प्रमाण- पत्र को पृष्ठांकित कर सकेगी परन्तु यह और कि राज्य पक्षकारों के बीच अन्तरण की दशा
और ऐसा प्रमाण-पत्र समाप्ति की तारीख से पांच मास की अतिरिक्त में, यदि ऐसे अन्तरण के हो जाने के पश्चात् तीन मास के भीतर कोई
अवधि के लिए विधिमान्य रूप में स्वीकार किया जाएगा । अनुरोध नहीं किया जाता है तो ऐसे राज्य पक्षकार की सरकार ,
( 5 ) यदि किसी समय जब प्रमाण - पत्र समाप्त हो जाता है तो जिसकी पताका को पोत पहले फहराने का हकदार था , यथासंभव
पोत उस पतन में नहीं है जिसमें इसका सर्वेक्षण किया जाना है , या शीघ्र, ऐसे अन्तरण से पूर्व पोत द्वारा वहन की गई प्रमाण- पत्र की
ऐसे अन्य मामलों में जिन्हें वह ऐसा करने के लिए उचित तथा प्रतियां और सर्वेक्षण रिपोर्ट की प्रतियां, यदि उपलब्ध हों, केन्द्रीय
युक्तियुक्त समझे केन्द्रीय सरकार प्रमाण- पत्र की विधिमान्यता की सरकार को संप्रेषित करेगी ।
अवधि को विस्तारित कर सकेगी : 9. मल प्रणालियां. नियम 3 में विनिर्दिष्ट पोत जो इन
परन्तु यह कि ऐसा विस्तार उस पत्तन के जिसमें इसका नियमों के उपबंधों का अनुपालन करने की बाध्यता के अधीन है ,
निम्नलिखित मल प्रणालियों में से किसी एक प्रणाली से सज्जित
सर्वेक्षण किया जाना है , उसकी समुद्री यात्रा को पूरा करने की पोत को
अनुज्ञा देने के प्रयोजन के लिए ही अनुदत्त किया जाएगा : होगा, अर्थात्:-
परन्तु यह और भी कि ऐसा विस्तार तीन मास से अनधिक की (क) उस प्रकार का मल उपचार संयंत्र , जिसे केन्द्रीय सरकार
अवधि के लिए मंजूर नहीं किया जाएगा : अन्तर्राष्ट्रीय समुद्री संगठन द्वारा विकसित मानकों तथा परीक्षण
पद्धतियों पर विचार करने के पश्चात् अनुमोदित करे; या
परन्तु यह और भी कि ऐसा पोत जिसका विस्तार मंजूर किया
जाता है, इस पत्तन में उसके पहुंचने पर , जिसमें इसका सर्वेक्षण किया (ख) मल विखण्डन तथा विसंक्रमणकारी प्रणाली , जिसे केन्द्रीय
जाता है , एक नया प्रमाण- पत्र लिए बिना उस पत्तन को छोड़ने का सरकार अनुमोदित करे :

परन्तु यह कि जब पोत निकटतम भूमि से तीन नौ मील से कम की दूरी पर हो तो ऐसी प्रणाली मल के अस्थायी भंडारण के लिए ऐसी प्रसुविधाओं से सज्जित होगी ।
उपयोग करके विखंडित और विसंक्रमित मल का या ऐसे मल का परित्याग कर रहा हो जो निकटतम भूमि से बारह नौ मील से अधिक की दूरी पर विखण्डित या विसंक्रमित नहीं किया गया है:
( ग) पोत के प्रचालन , फलक पर व्यक्तियों की संख्या तथा अन्य सुसंगत कारकों को ध्यान में रखते हुए ऐसी क्षमता का धारक टैंक जिसे केन्द्रीय सरकार संपूर्ण मल के प्रतिधारण के लिए विनिर्दिष्ट करे :
परन्तु ऐसा मल , जिसे धारक टैंक में भंडारित किया गया है तत्काल निस्सारित नहीं किया जाएगा परन्तु एक संतुलित दर पर तब किया जाएगा जब पोत मार्गस्थ हो और कम से कम चार समुद्री मील की दूरी पर चल रहा हो :
परन्तु यह और कि निस्सारण की दर केन्द्रीय सरकार द्वारा अन्तर्राष्ट्रीय समुद्री संगठन द्वारा विकसित मानकों के आधार पर अनुमोदित की जाएगी; या
परन्तु ऐसा धारक टैंक ऐसी रीति में संनिर्मित किया जाएगा जैसी केन्द्रीय सरकार द्वारा विनिर्दिष्ट की जाए और इसकी अन्तर्वस्तुओं की रकम को दृश्यमान रूप से उपदर्शित करने के साधन होंगे ।
10. मानक निस्सारण कनेक्शन ( 1 ) पोत की निस्सारण
(ख) चलत पोत में नियम 9 के खंड ( क ) के अधीन यथा विनिर्दिष्ट संक्रियात्मक अपेक्षाओं को पूरा करने के लिए मल उपचार संयंत्र है; और-
पाइपलाइन के साथ जोड़ी जाने वाली ग्रहण सुविधाओं के पाइपों को समर्थ बनाने के लिए , दोनों लाइनें निम्नलिखित सारणी के अनुसार मानक निस्सारण कनेक्शन के साथ फिट की जाएंगी , अर्थात्:-

निस्सारण कनेक्शनों के लिए फ्लेंजों के मानक परिमाप
(ii) निस्सारी दृश्यमान प्लवमान ठोस पदार्थ उत्पन्न नहीं करेगा न ही आस- पास के जल रंग को फीका करेगा ।

18 मि.मी. व्यास वाले 4 छिद्र जो ऊपर व्यास बोल्ट सर्किल पर बराबर की दूरी पर लगे हों , 18 मि.मी. की चौड़ाई वाली फ्लेंज परिधि पर खांचा बनाया गया हो ।
12. ग्रहण प्रसुविधाएं-केन्द्रीय सरकार धारा 356 झ के उपबंधों के अनुसार पोतों के लिए अनुचित विलंब किए बिना मल को ग्रहण करने के लिए पत्तनों और टर्मिनलों पर सुविधाओं की व्यवस्था सुनिश्चित करेगी ।
फ्लेंज की मोटाई 16मि.मी.
बोल्टों और नटों की 4, प्रत्येक 16 मि.मी. के व्यास में और
मात्रा तथा व्यास
उपयुक्त लम्बाई की ।
फ्लेंज को 100 मि.मी. के अधिकतम आंतरिक व्यास तक पाइपों को स्वीकार करने के लिए परिकल्पित किया गया है और जो इस्पात या अन्य समतुल्य सामग्री का होगा जिसका अग्रभाग समतल होगा और यह फ्लेंज, जिसमें उपयुक्त गैसकेट लगा है, 600 केपीए की सर्विस दबाव के लिए उपयुक्त होगा :
13. कार्य संचालन अपेक्षाओं पर नियंत्रण : ( 1 ) धारा 356छ के अधीन भारतीय पत्तन में किसी विदेशी पोत के निरीक्षण के दौरान , यथास्थिति , सर्वेक्षक या तद्धीन प्राधिकृत कोई अन्य व्यक्ति, जिसके पास यह विश्वास करने के स्पष्ट आधार हैं कि उस पोत का मास्टर या कर्मीदल मल द्वारा प्रदूषण के निवारण संबंधी कार्य संचालन अपेक्षाओं और प्रक्रियाओं से अभिज्ञ नहीं है तो महानिदेशक या उसके द्वारा प्राधिकृत कोई अधिकारी , सर्वेक्षक या प्राधिकृत व्यक्ति की सिफारिश पर ऐसे उपाय करेगा जो धारा 356 ज में दिए गए हैं ।
परन्तु 5 मी. और उससे कम की गढी हुई गहराई वाले पोतों के लिए निस्सारण कनेक्शन का भीतरी व्यास 38 मि.मी. हो सकेगा ।
(2) इस नियम की किसी बात का यह अर्थ नहीं लगाया जाएगा कि वह अभिसमय में विनिर्दिष्ट रूप से उपबंधित कार्य संचालन अपेक्षाओं पर नियंत्रण करने वाली केन्द्रीय सरकार के अधिकारों और बाध्यताओं को परिसीमित करती है ।
(2) अनिवार्य व्यापारों में पोतों के लिए अर्थात् यात्री नौकाएं इसकी निस्सारण पाइप लाइन अनुकल्पतः केन्द्रीय सरकार के अनुमोदन से शीघ्र कनेक्शन कपलिगों जैसे निस्सारण कनेक्शन के साथ फिट की जा सकेगी ।
11. मल का निस्सारण ( 1 ) नियम 3 के उपबंधों के
14.फीस: अनुसूची में यथा विनिर्दिष्ट फीस इन नियमों के अधीन सर्वेक्षण संचालित करने के प्रयोजनों के लिए उद्गृहीत की जाएगी ।
अधीन रहते हुए, समुद्र में मल का निस्सारण निम्नलिखित परिस्थितियों में प्रतिषिद्ध है , अन्यथा नहीं , अर्थात्:-
(क ) पोत निकटतम भूमि से तीन नौ मील से अधिक की दूरी पर नियम 9 के खंड ( ख ) के अधीन यथा विनिर्दिष्ट ऐसी प्रणाली का
15. शास्ति: जो कोई इन नियमों के उपबंधों में से किसी उपबंध का अतिलंघन करता है वह धारा 458 की उप - धारा ( 2 ) के खंड ( ख ) के उपबंधों के अनुसार जुर्माने से दंडित किया जाएगा ।

G.S.R. 13 ( E) . In exercise of the powers conferred by sub - section (3 ) of Section 356C , Section 356 E , clause (ce) of Section 356-0 and Section 457 of the Merchant Shipping Act , 1958 (44 of 1958) , the Central Government hereby makes the following rules , namely :---
1. Short title and commencement. ( 1 ) These rules may be called the Merchant Shipping (Prevention of Pollutionby Sewage from Ships) Rules, 2010 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions. ( 1 ) In these rules , unless the context otherwise requires ,-
(a) "Act" means the Merchant Shipping Act , 1958;
(b) " anniversary date " means the day and the month of each year which corresponds to the date of expiry of the International Sewage Pollution Prevention Certificate;
(c) " Certificate " means and International Sewage Pollution Prevention Certificate or , as the case may be , an Indian Sewage Pollution Prevention Certificate, issued under rule 5 ;
(d) " Certifying authority " means the Central Government;
(e) " existing ship " means a ship which is not a new ship;
(f) "Government ship " means the ship owned by the Central Government or the State Government;

(g) "holding tank " means a tank used for the collection and storage of sewage;
(h) " international voyage" means a voyage from a country to which the Convention applies to a port outside such country , or conversely;
(i) " new ship " means a ship-
(A) for which the building contract is placed, or in the absence of a building contract, the keel ofwhich is laid, or which is at a similar stage of construction, on or after the 27th day of September , 2003; or
(B) the delivery of which is three years or more after the 27th day of September , 2003 ;

and such initial survey shall include a complete survey of its structure , equipment , systems . fittings , arrangements and material so as to ensure that they fully comply with the requirements of these rules .

(k) "person" includes the member of the crew and the passenger;
(1 ) " section" means section of the Act;
(b) a renewal survey shall be conducted at an interval not exceeding five years except where the provisions of sub - rules (2) , (5 ) , (6 ) and (7) of Rule 8 are applicable and the renewal survey shall be such as to ensure that the structure, equipment, systems , fittings, arrangements and materials fully comply with the requirements of these rules .
(m) " sewage" shall have the same meaning as assigned to it in the explanation to sub- section ( 3 ) of Section 356C;
3. Obligation to prevent pollution of sea by sewage. ( 1 ) The following ships engaged in voyages shall be under obligation to prevent pollution of sea by sewage from ships and shall comply with the provisions of these rules, namely:
(a) new ships of four hundred gross tonnage and above;
(c) an additional survey , either general or partial , according to the circumstances , shall be conducted after a repair is required under sub- rule (4) , or whenever important repairs or renewals are made and such survey shall ensure that necessary repairs or renewals have been effectively made and that the material and workmanship of such repairs or renewals are in all respect satisfactory and the ship complies with the requirements of these rules in all respect .
(b) new ships of less than four hundred gross tonnage which are certified to carry more than fifteen persons;
(2)The Central Government shall specify appropriate measures for ships which are not subject to the provisions of sub -rule ( 1 ) in such manner that the provisions of these rules are complied with .
(c) existing ships of four hundred gross tonnage and above , five years after the date of 27th day of Septemebr , 2003 ;
(d) existing ships of less than four hundred gross tonnage which are certified to carry more than fifteen persons , five years after the date of 27th day of September, 2003.
(3) The surveys of ships for the purposes of enforcement ofthe provisions of these rules shall be carried out by a surveyor appointed under section 9 , or a person authorised under sub - section ( 1 ) of Section 356G , by the Central Government .

(a) the discharge of sewage from a ship is necessary for the purpose of securing the safety of the ship and those on board, or for saving life at sea; or
(b) notify the International Maritime Organisation ofthe specific responsibilities and conditions of authority so given to the surveyor or the authorised person, for circulation to the State Parties , for the information of their officers .

4. Surveys. ( 1 ) Every ship specified under sub -rule (1) of rule 3 shall be subject to the following surveys , namely:

12. Reception facilities . The Central Government shall ensure the provision of facilities at the ports and terminals for the reception of sewage without causing undue delay to ships , in accordance with the provisions of section 356-1 .
(2) For ships in dedicated trades, i.e. , passenger ferries , its discharge pipeline may , alternatively , be fitted with a discharge connection such as quick connection couplings, with the approval of the Central Government .
11. Discharge of sewage .-( 1 ) Subject to the provisions of rule 3, the discharge of sewage into the sea is prohibited , except under the following circumstances , namely :-

Control on operational requirements.- (1)During inspection of a foreign ship in Indian port under section 356G , the surveyor , or as the case may be , any other person authorised thereunder , has clear grounds to believe that the master or crew of that ship are not familiar with operational requirements and procedures relating to the prevention of pollution by sewage , the Director- General or any officer authorised by him , shall , on the recommendation of the surveyor or the authorised person, take such steps as provided in section 356H.
(a) the ship is discharging comminuted and disinfected sewage using such system as specified under clause ( b) of rule 9 at a distance of more than three nautical miles from the nearest land , or sewage which is not comminuted or disinfected at a distance of more than twelve nautical miles from the nearest land :
(2)Nothing in this rule shall be construed to limit the rights and obligations of the Central Government carrying out control over operational requirements specifically provided for in the Convention .
14. Fees . The fee as specified in the Schedule shall be levied for the purposes of conducting surveys under these rules.
Provided that the sewage that has been stored in holding tanks shall not be discharged instantaneously but at a moderate rate when the ship is en route and proceeding at not less than four knots :
Provided further that the rate of discharge shall be approved by the Central Government , on the basis of standards developed by the International Maritime Organisation; or
15. Penalty. Whoever contravenes any of the provisions of these rules shall be punished with fine in accordance with the provisions of clause (b) of sub- section (2) of section 458 .
