सा.का.नि. 16(अ).औषधि और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23 ) ( जिसे इसके पश्चात् उक्त अधिनियम के रूप में उल्लिखित ) का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप , जिसे केन्द्रीय सरकार , उक्त अधिनियम की धारा 33ण द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , औषधि तकनीकी सलाहकार बोर्ड के परामर्श से करने का प्रस्ताव करती है, को एतद्वारा उससे प्रभावित होने वाले सभी व्यक्तियों के सूचनार्थ उक्त अधिनियम की उक्त धारा केअपेक्षानुसार प्रकाशित किया जाता है और एतद्वारा यह सूचित किया जाता है कि सरकारी राजपत्र में इस अधिसूचना की सार्वजनिक की गई प्रतियों के प्रकाशन की तिथि से तीन माह की अवधि समाप्त होने के पश्चात् उक्त प्रारूप नियमों पर विचार किया जाएगा ।
2. ऐसे आक्षेप या सुझाव पर, जो उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से, इस प्रकार विनिर्दिष्ट अवधि अथवा अवधि की समाप्ति के पूर्व प्राप्त होंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
प्रारूप संशोधन
औषधि और प्रसाधन सामग्री अधिनियम , 1940 (1940 का 23 ) की अनुसूची Ⅰ .में - (क) " आयुर्वेद " उप- शीर्षक के अंतर्गत , क्रम संख्यांक 21 के पश्चात्, निम्नलिखित जोड़ा जाएगा: -
"21 (क) रसतंत्र सार व सिद्ध प्रयोग संग्रह , भाग- II ( संस्करण 2006 ) "
(ख) " आयुर्वेद " उप - शीर्षक के अंतर्गत , 54 क की तदनुरूप प्रविष्टियों " भारतीय आयुर्वेदिक फॉर्मूलरी [xxx ] " , को " भारतीय आयुर्वेदिक फॉर्मूलरी और इसके भाग " संबंधी प्रविष्टियों के साथ प्रतिस्थापित किया जाएगा ।
(ग) क्रम संख्यांक 54 ग और इससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित क्रम संख्यांक और प्रविष्टियां अंतःस्थापित की जाएंगी , अर्थात्:--
" 54घ भारतीय आयुर्वेदिक भेषजसंहिता एवं इसके भाग "।
( घ) " सिद्ध " उप- शीर्षक के अंतर्गत , क्रम संख्यांक 84 और इससे संबंधित प्रविष्टियों के पश्चात्, निम्नलिखित क्रम संख्यांक और प्रविष्टियांअंतःस्थापित की जाएंगी , अर्थात्:-
" 85 भारतीय सिद्ध भेषजसंहिता एवं इसके भाग " ।

NOTIFICATION
New Delhi , the 7th January, 2010
G.S.R. 16(E).-- The following draft amendment further to amend the Drugs and Cosmetics Act, 1940 (23 of 1940) (hereinafter referred to as ' the said Act' ), which the Central Government proposes to make , after consultation with the Drugs Technical Advisory Board, in exercise of the powers conferred by Section 33 -O of the said Act, is published as required by the said section of the said Act for information of all persons likely to be affected thereby, and notice is hereby giventhat the said draft amendment will be taken into consideration after the expired of 3 months from the date on which the copies of the Official Gazette in which this notification is published are made available to the public .
2. Any objection or suggestion which may be received from the person with respect to the said draft on or before the expiry of the period so specified shall be considered by the Central Government.
DRAFT AMENDMENT
In the Schedule I to the Drugs and Cosmetics Act, 1940 (23 of 1940),—
(a) under sub -heading " AYURVEDA " , in the entries after serial number 21, the following shall be added:-
"21 ( a ) Rastantra Sar Va Siddha Prayog Samgraha Part II (Edition 2006). "
(b) under sub-heading " AYURVEDA ", the entries corresponding to 54A " Ayurvedic Formulary of India [ xxx] " , shall be substituted with the entries " Ayurvedic Formulary of India and its Parts " .
(c) inserted, namely:--- after serial number 54C and the entries relating thereto , the following serial number and entries shall be
"54 D. Ayurvedic Pharmacopoeia of India and its Parts . "
(d) number and entries shall be inserted, namely:-- under sub-heading " SIDDHA", after serial number 84 and the entries relating thereto , the following serial
"85. Siddha Pharmacopoeia of India and its Parts. "
