सं. जेईआरसी-07/2009. विद्युत अधिनियम, 2003 ( 2003 का 36 ) की धारा 87 के साथ पठित धारा 181 तथा इस निमित्त सामर्थ्यकारी सभी अन्य शक्तियों का प्रयोग करते हुए, गोवा राज्य तथा संघ राज्यक्षेत्रों के लिए संयुक्त विद्युत विनियामक आयोग , निम्नलिखित विनियम बनाता है :
1. संक्षिप्त नाम , प्रारंभ तथा निर्वचन
(1 ) इन विनियमों का संक्षिप्त नाम संयुक्त विद्युत विनियामक आयोग ( राज्य सलाहकार समिति ) विनियम , 2009 है ।
(2 ) ये विनियम राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
(3 ) ये विनियम संपूर्ण गोवा राज्य या अंदमान , निकोबार द्वीपसमूह , चंडीगढ़, दादरा तथा नागर हवेली , दमन तथा दीव , लक्षद्वीप तथा पुड्डुचेरी संघ राज्यक्षेत्रों को लागू होंगे ।
2. परिभाषाएं
( 1 ) इन विनियमों में, जब तक कि संदर्भ से, अन्यथा अपेक्षित न हो,
(क) " अधिनियम " से विद्युत अधिनियम, 2003 (2003 का 36 ) अभिप्रेत है;
(ख) " आयोग " से गोवा राज्य तथा संघ राज्यक्षेत्रों के लिए संयुक्त विद्युत विनियामक आयोग अभिप्रेत है;
(ग ) " समिति" से अधिनियम की धारा 87 के उपबंधों के अनुसार गठित राज्य सलाहकार समिति अभिप्रेत है ।
2. उन शब्दों तथा पदों का, जो इसमें प्रयुक्त हैं और किन्तु परिभाषित नहीं हैं, वहीं अर्थ होगा जो अधिनियम में है ।
3. समिति के सदस्यों की पदावधि समिति का प्रत्येक सदस्य, अध्यक्ष के सिवाय , तथा आयोग के सदस्य जब तक कि अन्यथा उनकी नियुक्ति इन विनियमों में विहित रीति से समाप्त नहीं कर दी जाती, दो वर्ष की अवधि तक पद धारण करेंगे । किसी सदस्य की पदावधि की समाप्ति पर आयोग अपने विवेकानुसार ऐसी सदस्य की पुनः नियुक्तिकर सकेगा ।
4. राज्य सलाहकार समिति के उद्देश्य : राज्य सलाहकार समिति का उद्देश्य आयोग को निम्नलिखित पर सलाह देना होगा:-
( i ) नीति संबंधी प्रमुख प्रश्न;
(ii ) अनुज्ञप्तिधारियों द्वारा प्रदान की गई सेवा की क्वालिटी , निरंतरता तथा सेवा विस्तार से संबंधित मामले;
(iii ) अनुज्ञप्तिधारियों द्वारा अपनी अनुज्ञप्ति की शर्तों तथा अपेक्षाओं का अनुपालन;
(iv) उपभोक्ता हित का संरक्षण; तथा
(v ) विद्युत प्रदाय तथा उपयोगिताओं द्वारा निष्पादन के समग्र मानदंड ।

5. समिति का सचिव आयोग का सचिव समिति का सचिव होगा । वह इस अतिरिक्त कार्य के लिए किसी अतिरिक्त पारिश्रमिक के लिए हकदार नहीं होगा ।
6. बैठक की सूचना : ( 1 ) समिति की बैठक कम से कम
तीस मिनट के भीतर कोरम पूरा नहीं होता है तो बैठक नहीं बुलाई जाएगी तथा बैठक का अध्यक्ष अगली तारीख , जैसा उसके द्वारा निदेश दिया, तक के लिए बैठक को स्थगित करेगा । इस प्रकार स्थगित किए जाने की कोई पृथक् सूचना नहीं दी जाएगी ।
(2) यदि बैठक के दौरान किसी भी समय कोरम में कमी हो जाती है तो कोरम के अभाव में बैठक की अवहेलना की जाएगी तथा समिति अपने कारबार के संव्यवहार को जारी रखेगी ।
तीन मास में एक बार सचिव द्वारा अध्यक्ष के निदेशाधीन बुलाई जाएगी । सचिव आयोग के सदस्यों को बैठक की तारीख , समय तथा स्थान के बारे में कम से कम 10 दिन पूर्व लिखित में सूचना देगा । सामान्यतः बैठक के कम से कम सात दिन पूर्व , सचिव बैठक की कार्यवृत्त की प्रतियां ऐसे सदस्यों को भेजेगा ।
(2 ) पदेन सदस्य से भिन्न सदस्य जो समिति की तीन लगातार बैठकों में उपस्थित नहीं होता है उसे तत्काल समिति की सदस्यता से हटा दिया जाएगा ।
(3) उप -विनियम ( 1 ) के अधीन स्थगित बैठक में ऐसे किसी मामले पर विचार नहीं किया जाएगा जो स्थगित समिति की बैठक में रखे गए विषय से अलग हो परन्तु यह कि बैठक का अध्यक्ष ऐसे किसी विषय को लाने या उसकी अनुज्ञा या निदेश दे सकेगा जो उसकी राय में सूचना सहित या उसके बिना स्थगित बैठक के समक्ष लाया जाना आवश्यक हो ।
7. बैठक का अध्यक्ष आयोग का अध्यक्ष, अध्यक्ष के रूप में समिति की बैठक की अध्यक्षता करेगा :

प्रश्न का विनिश्चय बैठक की अध्यक्षता करने वाले अध्यक्ष द्वारा किया जाएगा तथा उस पर उसका विनिश्चय अंतिम होगा ।
12. सदस्यों का त्यागपत्र समिति के सदस्य पदेन सचिव से यदि अध्यक्ष को समिति की बैठक में भाग लेने से निवारित किया गया है तथा जिसकी सूचना उसे दे दी गई हो , तो उपस्थित समिति का सदस्य, बैठक के अध्यक्ष के रूप में उस बैठक की अध्यक्षता करेगा ।
भिन्न , आयोग के सचिव को लिखित सूचना देकर अपने पद से त्यागपत्र दे सकेगा तथा यह उस दिन से प्रभावी होगा जिस दिन से उसे समिति का अध्यक्ष स्वीकार करता है ।
8. समिति के सदस्यों के लिए ठहरने तथा यात्रा की व्यवस्था : ( 1 ) समिति की बैठक में भाग लेने वाले समिति के सदस्यों के ठहरने तथा यात्रा की व्यवस्था आयोग द्वारा की जाएगी ।
13. सदस्य का हटाया जाना ( 1 ) आयोग , पदेन सदस्य से भिन्न किसी भी सदस्य को पद से हटा सकेगा , यदि वह,
(क) दिवालिया न्यायनिर्णीत किया गया है; या (2) सरकारी सेवक से भिन्न समिति के सदस्य को उस दर पर मानदेय दिया जाएगा , जैसा आयोग द्वारा समय समय पर विनिश्चय किया जाए ।
(ख) वह किसी ऐसे अपराध के लिए सिद्धदोष ठहराया गया हो जिसमें नैतिक अधमता अंतर्वलित हो; या
(ग ) सदस्य के रूप में कार्य करने में शारीरिक या मानसिक रूप से असमर्थ हो गया है;
(3 ) समिति का ऐसा सदस्य , जो सरकारी सेवक है, उस सरकार , जहां वह नियोजित है, के यात्रा भत्ता नियमों के अधीन अनुज्ञेय मापमान पर यात्रा भत्ता , जिसमें दैनिक भत्ता भी है, प्राप्त करने का हकदार होगा ।
9. कार्यवाहियां : ( 1 ) समिति की प्रत्येक बैठक की कार्यवाहियां उसके सचिव द्वारा तैयार की जाएंगी तथा बैठक के अध्यक्ष द्वारा उसे अनुमोदित किया जाएगा ।
(घ ) उसने अपनी स्थिति का स्वयं ऐसी रीति से दुरूपयोग किया है जिससे उसके पद पर रहने से लोकहित या अधिनियम के उद्देश्य तथा प्रयोजन पर प्रतिकूल प्रभाव पड़ेगा ।
(2) समिति की बैठकों का कार्यवृत्त व्यापक रूप से उन विषयों के अनुसार होगा , जिन पर समिति अधिनियम के अधीन परामर्श किए जाने के लिए अपेक्षित है ।
(2) उस सदस्य, जिसे उप - विनियम ( 1 ) के अधीन हटाए जाने का प्रस्ताव किया गया है , को समिति के अध्यक्ष के सम्मुख अपनी स्थिति रखने का उचित अवसर दिया जाएगा ।
14. कार्यवाहियों की विधिमान्यता के बारे में व्यावृत्ति:
(3) समिति की बैठक में ऐसे किसी विषय पर विचार- विमर्श या चर्चा नहीं की जाएगी जो कार्यवृत्त में सम्मिलित नहीं है । उस विषय पर विचार- विमर्श या चर्चा के लिए समिति के अध्यक्ष की विशेष अनुज्ञा ली जाएगी ।
समिति की कोई कार्यवाही समिति में विद्यमान रिक्ति या रिक्तियों या कार्यवृत्त की सूचना या प्रति न मिलने के कारण भले ही यह सम्यक् रूप से जारी की गई हो , या बैठक के कारबार के संचालन में किसी अनियमितता के कारण अविधिमान्य नहीं होगी ।
( 4) राज्य सलाहकार समिति की बैठकों में परोक्षी उपस्थिति अनुज्ञात नहीं की जाएगी ।
10. बैठक के लिए कोरम तथा स्थगन ( 1 ) समिति की बैठक के लिए कोरम सलाहकार समिति के कम से कम सात सदस्यों का होगा. जिसमें पदेन सदस्य भी है । यदि बैठक के नियत समय के
