का.आ. 42(अ).-केन्द्रीय सरकार संतुष्ट हो , जाने पर कि लोकहित में ऐसा करना अपेक्षित था, औद्योगिक विवाद अधिनियम, 1947 ( 1947 का 14 ) की धारा 2 के खण्ड ( ढ) के उप- खण्ड ( vi ) के उपबंधों के अनुसरण में भारत सरकार के श्रम और रोजगार मंत्रालय की अधिसूचना दिनांक 2 जुलाई, 2009 द्वारा खनिज तेल ( कच्चा तेल ) मोटर और विमानन स्पिरिट , डीजल तेल , मिट्टी का तेल , ईंधन तेल , विविधा हाइड्रोकार्बन तेल और उनके मिश्रण जिनमें सिंथेटिक तेल , ल्यूब्रिकेटिंग तेल और इसी प्रकार का तेल शामिल है के निर्माण या उत्पादन में लगे उद्योग में सेवाओं में है , जोकि औद्योगिक विवाद अधिनियम, 1947 ( 1947 का 14 ) की प्रथम अनुसूची की प्रविष्टि 26 में शामिल है , को उक्त अधिनियम के प्रयोजनों, के लिए दिनांक 16 जुलाई , 2009 से छः मास की कालावधि के लिए लोक उपयोगी सेवा घोषित किया था;
और केन्द्रीय सरकार की राय है कि लोकहित में उक्त कालावधि को छः मास की और कालावधि के लिए बढ़ाया जाना अपेक्षित है;
अतः , अब , औद्योगिक विवाद अधिनियम , 1947 (1947 का 14) की धारा 2 के खण्ड (ढ ) के उप-खण्ड ( vi ) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार उक्त उद्योग को उक्तअधिनियम के प्रयोजनों के लिए दिनांक 16 जनवरी , 2010 से छः मास की कालावधि के लिए लोक उपयोगी सेवा घोषित करती है ।

NOTIFICATION
New Delhi , the 8th January , 2010
S.O. 42 ( E ) .- Whereas the Central Government having been satisfied that the public interest so requires that in pursuance of the provisions of sub - clause (vi ) of the clause (n) of Section 2 of the Industrial Disputes Act , 1947 ( 14 of 1947) , declared by the Notification of the Government of India in the Ministry of Labour and Employment,dated 2nd July , 2009 the services in Industry engaged in manufacture or production of mineral oil (crude oil) motor and aviation spirit , diesel oil , kerosene oil , fuel oil , diverse hydrocarbon oils and their blends including synthetic fuels , Lubricating oils and the like which is covered by item 26 of the First Schedule to the Industrial Disputes Act, 1947 ( 14 of 1947) to be a Public Utility Service for the purpose of the said Act , for a period of six months from the 16th July, 2009;
Andwhereas , the Central Government is of opinion thatpublic interest requires the extension of the said period by a further period of six months ;
Now, therefore , in exercise of the powers conferred by the proviso to sub - clause ( vi ) of clause (n) of Section 2 of the Industrial Disputes Act , 1947 , the Central Government hereby declares the said industry to be a Public Utility Service for the purposes ofthe said Act, for a period ofsix months from the 16th January , 2010 .
