सा.का.नि. 25(अ). केन्द्रीय सरकार, चीनी ( नियंत्रण ) आदेश , 1966 के खण्ड 5 के साथ पठित आवश्यक वस्तुअधिनियम , 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह निदेश देती है कि चीनी का कोई भी मान्यताप्राप्त व्यौहारी , किसी भी समय स्टाक में निर्वात कड़ाह चीनी ( वैक्यम पैन शुगर ) या खंडसारी ( खुला कड़ाह चीनी ) का कोई स्टॉक ऐसे स्टॉक के प्राप्त करने की तारीख से तीस दिन से अधिक अवधि के लिए नहीं रखेगा और किसी भी समय स्टाक में नीचे वर्णित स्थानों में प्रत्येक के सामने उल्लिखित मात्रा से अधिक निर्वात कड़ाह चीनी या खंडसारी चीनी नहीं रखेगा ।
(1) निर्वात कड़ाह चीनी:-
(i ) कोलकाता और विस्तारित क्षेत्र में
( क) मान्यताप्राप्त व्यौहारी जो पश्चिमी बंगाल के बाहर से चीनी का आयात करते हैं 10,000
क्विटल;
( ख ) अन्य मान्यताप्राप्त व्यौहारी 2000 क्विटल;
(ii) अन्य स्थानों में 2000 क्विटल ।
(2) खंडसारी ( खुला कड़ाह चीनी ) 2000क्विटल :
परंतु इस आदेश की कोई बात , निम्नलिखित द्वारा धारण या रखे गए चीनी के स्टाक में लागू नहीं होगी -
( i ) सरकारी मद्दे स्टाक; या

( ii ) किसी राज्य सरकार द्वारा या उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा नामनिर्देशित मान्यताप्राप्त व्यौहारियों द्वारा उचित मूल्य की दुकानों के माध्यम से वितरण के लिए रखा गया स्टॉक; या
( iii) भारतीय खाद्य निगम द्वारा रखा गया स्टॉक :
परंतु यह भी कि उपर्युक्त स्टॉक रखने की सीमा या स्टॉक के व्यापारावर्त की अवधि खुली साधारण अनुज्ञप्ति के अधीन चीनी के आयातकर्ताओं पर लागू नहीं होगी :
परन्तु यह भी कि जब कोई वास्तविक उपभोक्ता या उपयोगकर्ता अपने उपभोग या अपने प्रतिष्ठान में उपयोग या विनिर्माण की प्रक्रिया के लिए खुली साधारण अनुज्ञप्ति के अधीन श्वेत या परिष्कृत चीनी का आयात करता है तो उपर्युक्त स्टाक रखने की सीमा या स्टाक के व्यापारावर्त की अवधि ऐसे उपभोक्ता या उपयोगकर्ता पर लागू नहीं होगी ।
इसके अतिरिक्त, केन्द्रीय सरकार , उक्त आदेश के खंड 15 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , राज्य सरकारों या संघ राज्य क्षेत्रों के प्रशासनों को अपने राज्यों या संघ राज्य क्षेत्रों को निम्नलिखित शर्तों के अध्यधीन स्टॉक रखने और व्यापारावर्त की सीमाएं निर्धारित करने के लिए प्राधिकृत करती है-
( i ) स्टॉक रखने की सीमा और/या व्यापारावर्त की अवधि केन्द्रीय सरकार द्वारा उपर्युक्त यथाविनिर्दिष्ट सीमा या अवधिसे कम नहीं होगी; और
( ii ) खुदरा व्यापार करने वाले मान्यताप्राप्त व्यौहारी की स्टॉक रखने की सीमा एक स्तर पर थोक विक्रेता के लिए विनिर्दिष्ट सीमा से कम होगी ।

स्पष्टीकरण: इस अधिसूचना के प्रयोजन के लिए ---
( i ) जब तक विनिर्दिष्ट रूप से उल्लेख न किया जाए , तब तक इस आदेश में प्रयुक्त ' चीनी ' शब्द में निर्वात कड़ाह चीनी और खुला कड़ाह चीनी ( खंडसारी ) , दोनों शामिल होंगे ।
(ii) ' कोलकाता और विस्तारित क्षेत्र ' से पश्चिमी बंगाल सरकार की अधिसूचना संख्या 7752/एफ.एस. /एफ. 5/14आर. 92/61 , तारीख 16 दिसम्बर, 1964 की अनुसूची में विनिर्दिष्ट क्षेत्र अभिप्रेत है; और
(iii ) स्टॉक धारण करने की अवधि की संगणना के लिए , वह तारीख जिसको मान्यताप्राप्त व्यौहारी द्वारा कोई स्टॉक प्राप्त किया जाता है , सम्मिलित की जाएगी ।
( iv) जब कोई थोक विक्रेता या कोई खुदरा विक्रेता चीनी के किसी आयातकर्ता या आयातकर्ताओं से सीधे श्वेत या परिष्कृत चीनी खरीदता या अधिप्राप्त या अधिग्रहीत करता है , तब उक्त थोक विक्रेता या खुदरा विक्रेता पर आयात की गई ऐसी चीनी के स्टॉक को रखने की सीमा लागू नहीं होगी परंतु 30 दिन के व्यापारावर्त की सीमा लागूहोगी । इसमें निहित छूट चीनी के थोक विक्रेता या खुदरा विक्रेता को चीनी के ऐसे आयात किए गए स्टॉक की दूसरी और पश्चात्वर्ती बिक्री पर नहीं मिलेगी ।
(v) शंकाओं का निवारण करने के लिए यह स्पष्ट किया जाता है कि जब कोई थोक विक्रेता या खुदरा विक्रेता आयात की गई कच्ची चीनी में से प्रसंस्कृत श्वेत या परिष्कृत चीनी खरीदता या अधिप्राप्त या अधिग्रहीत करता है तो उक्त थोक विक्रेता या खुदरा विक्रेता पर स्टॉक रखने की सीमा और व्यापारावर्त करने की सीमा लागूहोगी ।
2. यह आदेश राजपत्र में इसके प्रकाशन के तत्काल पश्चात् प्रवृत्त होगा और 30 सितम्बर , 2010 तक या अगले ओदश इनमें से जो भी पहले हो , तक प्रवृत रहेगा ।

ORDER
New Delhi , the 11th January, 2010
G.S.R. 25 (E) .-In exercise of the powers conferred by Section 3 of the Essential Commodities Act , 1955 ( 10 of 1955) , read with clause 5 of the Sugar (Control ) Order , 1966, the Central Government hereby directs that no recognized dealer of sugar shall hold any stock of vacuum pan sugar or khandsari ( open pan sugar ) for a period exceeding thirty days from the date of receipt by him of such stock and shall not keep in stock at any time vacuum pan sugar or khandsari sugar , in the places mentioned below, in excess of quantities mentioned against each
[ PART II- SEC . 3 (i) )
(1) Vacuum pan sugar: -
(i) inKolkata and extended arca
(a) recognized dealers who import sugar from outside West Bengal-10,000 quintals;
(b) other recognized dealers-2000 quintals :
(ii) in other places - 2000 quintals.
(2) Khandsari (Open pan sugar )---2000 quintals :
Providedthat nothing in this order shall apply to the holding or keeping of stock of sugar
(i) on Government account ; or
(ii) by the recognized dealers nominated by a State Government or an officer authorized by it to hold stock for distribution through fair price shops: or
( iii) by the Food Corporation of India :
Provided further that the aforesaid stockholding limit or turnover period of stocks will not apply to sugar importers under Open General License:
Provided also that when an actual consumer or user imports white sugar or refined sugar under Open General License, for own consumption or for use in its establishment or process ofmanufacture , the aforesaid stockholding limit or turnover period of stocks will not apply to such consumer or user .
Further, in exercise of powers conferred by clause 15 of the said Order , the Central Government authorize the State Governments or Union Territory Administrations to fix the stockholding and turnover limits in their respective States or Union Territories subject to the following conditions-
(i) the stockholding limit and/ or the turnover period shall not be less than the limit or period as being specified above by the Central Government; and
( ii) The stockholding limit of a recognized dealer dealing in retail trade shall be at a level less than thatspecified for a wholesaler .
Explanation : For the purpose of the Notification-
(i) Unless specifically provided, the term ' sugar ' used in this Order shall include both vacuum pan sugar and open pan sugar (Khandsari ) .
(ii) "Kolkata and extended area" means the area specified in the schedule to the notification of theGovernment of West Bengal No. 7752 /FS / F.5 / 14R. 92/61 dated the 16th December , 1964; and [ भाग II- खण्ड 3 ( i) ]

(iii) For counting the period of holding of the stock , the date on which any stock is received by the recognized dealer shall be included.
(iv) When a wholesaler or a retailer of sugar purchases or procures or acquires imported white or refined sugar directly from an importer or importers of sugar, the said wholesaler or retailer shall not be subjected to stockholding limit in respect of such imported stocks of sugar butturnover limit of 30 days shall be applicable . The exemption contained herein shall not be available to the wholesaler or retailer of sugar onsecond and subsequent sale of such imported stocks of sugar .

(v) For removal of doubt , it is clarified that when a wholesaler or retailer of sugar purchases or procures or acquires white or refined sugar processed out of imported raw sugar, the said wholesaler or retailer shall be subjected to stockholding limit and turnover limit .
2. This order shall come into force immediately on its publication in the Official Gazette and shall remain in force till the 30th September , 2010 or further orders , whichever is earlier.
