जाँच समाप्ति संबंधी अधिसूचना

विषय : चीन जनवादी गणराज्य के मूल के अथवा वहां से निर्यातित " सोडिसम नाईट्राइट " के आयातों से संबंधित प्रतिसंतुलनकारी शुल्क जाँच की समाप्ति ।
सं. 17/1 /2008-डीजीएडी समय- समय पर यथा संशोधित सीमा शुल्क टैरिफ अधिनियम , 1975 ( जिसे एतपश्चात् अधिनियम कहा गया है ) और उसके अन्तर्गत निर्मित , समय - समय पर यथा संशोधित सीमा शुल्क टैरिफ ( सब्सिडी प्राप्त वस्तुओं की पहचान , उन पर प्रतिसंतुलनकारी शुल्क का आकलन , संग्रहण एवं क्षति निर्धारण ) नियमावली , 1995 ( जिसे एतद्दश्चात् सीवीडी नियमावली कहा गया है ) को ध्यान में रखते हुए।
2. यतः मैसर्स दीपक नाईट्राइट लिमिटेड ( जिन्हें एतद्दश्चात् घरेलू उद्योग कहा गया है ) ने उक्त अधिनियम तथा सीवीडी नियमावली के अनुसरण में चीन जन.गण. ( जिसे एतपश्चात् संबंद्ध देश कहा गया है ) के मूल के अथवा वहां से निर्यातित सोडियम नाईट्राइट ( जिसे एतपश्चात् सम्बद्ध वस्तु कहा गया है ) के आयातों के संबंध में प्रतिसंतुलनकारी जांच की शुरुआत हेतु निर्दिष्ट प्राधिकारी ( जिन्हें एतपश्चात् प्राधिकारी कहा गया है ) के समक्ष एक लिखित आवेदन प्रस्तुत किया है ।
3. और यतः प्राधिकारी ने डब्ल्यूटीओ के सब्सिडी एवं प्रतिसंतुलनकारी उपाय करार के अनुच्छेद 13.1 के अनुसार जाँच शुरुआत - पूर्व विचार -विमर्श के आयोजन के उपरांत सम्बद्ध देश के मूल की अथवा वहां से निर्यातित सम्बद्ध वस्तु के संबंध में दिनांक 14 जनवरी , 2009 की अधिसूचना सं. 17/1/2008 - डीजीएडी द्वारा सीवीडी नियमावली के अनुसार जाँच की शुरुआत की थी ।
4. यतः घरेलू उद्योग ने सीवीडी नियमावली के नियम 16 के अनुसार दिनांक 3 जनवरी , 2010 के पत्र द्वारा अपना आवेदन अब वापस ले लिया है और जाँच को समाप्त करने का अनुरोध किया है ।
5. प्राधिकारी घरेलू उद्योग के अनुरोध को ध्यान में रखते हुए सीवीडी नियमावली के नियम 16 के अनुसरण में सम्बद्ध देश के मूल के अथवा वहां से निर्यातित संबंद्ध वस्तु से संबंधित जाँच को एतद्वारा समाप्त करते हैं ।

TERMINATION NOTIFICATION
New Delhi , the 12th January, 2010
Subject : Termination of Countervailing Duty investigation concerning imports of ' Sodium Nitrite' originating in or exported from People's Republic of China.
No. 17/1 /2008 - DGAD. Having regard to the Customs Tariff Act , 1975 as amended from time to time (hereinafter referred to as the Act) and the Customs Tariff (Identification , Assessment and Collection of Countervailing Duty on Subsidized Articles and for Determination of Injury ) Rules , 1995 as amended from time to time (hereinafter referred to as CVD Rules), thereof.
2. Whereas M/ s . Deepak Nitrite Limited (hereinafter referred to as the domestic industry ), had filed a written application before the Designated Authority (hereinafter referred to as the Authority ) in accordance with the Act and the CVD Rules for initiation of a Countervailing Duty investigation concerning imports of " Sodium Nitrite " ( hereinafter referred to as the subject goods ) originating in or exported from China PR (hereinafter referred to as the subject country) .
3.And whereas , the Authority after holding pre - initiation consultations in accordance with Article 13.1 of the WTO'sAgreement on Subsidies and Countervailing Measures , initiated the investigation as per CVD Rules concerning the subject goods originating in or exported from the subject country vide Notification No. 17/ 1 /2008 - DGAD, dated 14th January , 2009.
4.Whereas the Domestic Industry vide their letter dated 3rd January , 2010 has now withdrawn their application and requested for termination of the investigation as per Rule 16 of the CVD Rules .
5. The Authority, in view of the request of the domestic industry, hereby terminates the investigation concerning the subject goods originating in or exported from the subject country in accordance with Rule 16 of the CVD Rules .
