भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( भर्ती , वरिष्ठता और प्रोन्नति ) संशोधन विनियम , 2010
सं. भाराराप्रा/11011/09/2009- एच.आर. 1.- भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 ( 1988 का 68 ) की धारा 9 के साथ पठित धारा 35 द्वारा प्रदत्त शक्तियों को प्रयोग करते हुए भारतीय राष्ट्रीय राजमार्ग प्राधिकरण , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( भर्ती, वरिष्ठता और प्रोन्नति ) विनियमावली , 1996 में और संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाता है , अर्थात्:-
1. ( 1 ) ये विनियम भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( भर्ती, वरिष्ठता और प्रोन्नति ) संशोधन विनियम, 2010 कहलाए जाएंगे । (2) ये सरकारी राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( भर्ती, वरिष्ठता और प्रोन्नति ) विनियमावली, 1996 ( जिसे इसमें इसके पश्चात् मूल विनियम संदर्भित किया गया है ) की अनुसूची में निम्नलिखित पदों के लिए पात्रता मानदण्ड और योग्यताएं निर्धारित करते हुए अनुसूचियां अंतःस्थापित की जाएंगी , अर्थात्:-
" उप महाप्रबंधक (विधिक)
प्रबंधक ( विधिक) "
3. मूल विनियम की अनुसूची में कॉलम 1 में , महाप्रबंधक ( विधि) के पद के सामने, प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टि प्रतिस्थापित की जाएगी , अर्थात्:--

[विज्ञापन 111/4/122/09-असा. ] का कोई प्रभाव नहीं पड़ेगा । स्पष्टीकरण ज्ञापन : इस संशोधन की अधिसूचना से पहले , कर ली गई अथवा करने से लोप हो गई किसी बात पर इस संशोधन के प्रख्यापन पाद टिप्पणी : मूल विनियमावली , अधिसूचना संख्या एनएचएआई-12011/ 1/95 - प्रशा. तारीख 11 मार्च , 1996 द्वारा भारत के राजपत्र , असाधारण , भाग III , खण्ड 4, तारीख 11 मार्च , 1996 में प्रकाशित की गई थी और इसमें गत संशोधन अधिसूचना संख्या भाराराप्रा/ 11012/ 147/2009- एचआर. 1 तारीख 23 नवम्बर, 2009 द्वारा भारत के राजपत्र , असाधारण , भाग III , खण्ड 4 तारीख 25 नवम्बर , 2009 में किया गया था ।

भारतीय राष्ट्रीय राजमार्ग प्राधिकरण में कम से कम 3 वर्ष कीअवधि तक नियमित आधार पर प्रबंधक (विधिक) का पद धारण करने वाले तथा कॉलम 7 में निर्दिष्ट शैक्षिक योग्यता और अनुभव वाले उम्मीदवारों में से पदोन्नति के द्वारा ।
किसी मान्यता प्राप्त विश्वविद्यालय से विधि में डिग्री ।
वांछनीय
अथवा
केन्द्रीय सरकार अथवा राज्य सरकारों अथवा संघ शासित क्षेत्रों अथवा विश्वविद्यालयों अथवा मान्यता प्राप्त अनुसंधान संस्थानों अथवा सरकारी उद्यमों अथवा अर्धसरकारी अथवा सांविधिक अथवा स्वायत्तशासी संगठनों और अन्य सरकारी निकायों के अधीन कार्यरत अधिकारियों में से प्रतिनियुक्ति/ सीधी भर्ती द्वाराः-
किसी मान्यता प्राप्त विश्वविद्यालय से विधि में स्नातकोत्तर की डिग्री।
(i) वेतनमान पीबी-3 (15600-39100/-रुपये) और श्रेणी वेतन 7600/-रुपये (केन्द्रीय महंगाई भत्ता पद्धति) में सदृश पद पर नियमित आधार पर कार्यरत अधिकारी; अथवा
अनुभव
(ii) वेतनमान पीबी-3 ( 15600-39100 रुपये ) और श्रेणी वेतन 6600/- रुपये ( केन्द्रीय महंगाई भत्ता पद्धति) के वेतनमान वाले पद पर तीन वर्ष की नियमित सेवा वाले। अधिकारी; और
जिनके पास कॉलम 7 में निर्दिष्ट शैक्षिक योग्यता और अनुभव हो ।
विधिक/विधायी के क्षेत्र में कम से कम नौ वर्षों का अनुभव तथा ठेका और माध्यस्थम/दावों संबंधी विधिक दायित्वों के संबंध में पूर्णतः दक्ष।
प्रतिनियुक्ति की अवधि
सामान्यतः 4 वर्ष किंतु इसे सक्षम प्राधिकारी के अनुमोदन से बढ़ाया/ घटाया जा सकेगा ।

वांछनीय
(i ) वेतनमान पीबी -3 (15600-39100/-रुपये) और श्रेणी वेतन 6600/-रुपये (केन्द्रीय महंगाई भत्ता पद्धति) में सदृश पद पर नियमित आधार पर कार्यरत अधिकारी ; अथवा
किसी मान्यता प्राप्त विश्वविद्यालय से विधि में स्नातकोत्तर की डिग्री ।
(ii) वेतनमान पीबी-3 (15600-39100 रुपये) और श्रेणी वेतन 5400/- रुपये (केन्द्रीय महंगाई भत्ता पद्धति) के वेतनमान वाले पद पर तीन वर्ष की नियमित सेवा वाले अधिकारी; अथवा
अनुभव
(iii) वेतनमान पीबी-2 (9300-34800 रुपये) और श्रेणी वेतन 4800/- रुपये (केन्द्रीय महंगाई भत्ता पद्धति) के वेतनमान वाले पद पर छह वर्ष की नियमित सेवा वाले अधिकारी; और
जिनके पास कॉलम 7 में निर्दिष्ट शैक्षिक योग्यता और अनुभव हो ।
प्रतिनियुक्ति की अवधि
के विधिक/विधायी क्षेत्र में कम से कम छह वर्षों का अनुभव तथा ठेका और माध्यस्थम/दावों संबंधी विधिक दायित्वों के संबंध में पूर्णतः दक्ष।
सामान्यतः 3 वर्ष किंतु इसे सक्षम प्राधिकारी के अनुमोदन से बढ़ाया/घटाया जा सकेगा ।

The National Highways Authority of India (Recruitment, Seniority and Promotion) Amendment Regulations , 2010
No.NHAI/ 11011/09/2009-HR.I . In exercise of the powers conferredby section 35 , read with section 9, of the National Highways Authority of India Act, 1988 (68 of 1988 ) , the National Highways Authority of India hereby makes the following regulations further to amend the National Highways Authority of India (Recruitment, Seniority and Promotion ) Regulations , 1996, namely: -
1.
(1) These regulations may be called the National Highways Authority of India (Recruitment , Seniority and Promotion ) Amendment Regulations , 2010.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Schedule to the National Highways Authority of India (Recruitment, Seniority and Promotion ) Regulations , 1996 (hereinafter referred to as the principal regulations) , the Schedules prescribing the eligibility criteria and qualifications for the following posts shall be inserted ; namely: -

3. In the Schedule to the principal regulations, against the post of General Manager (Law), in column 1 , for the entry, the following entry shall be substituted, namely: -

By deputation / direct recruitment from officers under the Central Government or State Governments or Union Territories or Universities or Recognized Research Institutions or Public Sector Undertakings or Semi Government or Statutory or Autonomous Organizations and other Government Bodies:
At least nine years experience in the field of Law/Legislative matters and well versed in legal obligations relating to contractual matters and arbitrations/ claims.
