सं. एल-1 /( 5 )/2009-केविविआ. केन्द्रीय विद्युत विनियामक आयोग , विद्युत अधिनियम , 2003 की धारा 178 के अधीन प्रदत्त शक्तियों तथा इस निमित्त सामर्थ्यकारी सभी अन्य शक्तियों का प्रयोग करते हुए तथा पूर्व प्रकाशन के पश्चात्, केन्द्रीय विद्युत विनियामक आयोग ( कारबार संचालन) विनियम, 1999. ( जिसे इसमें इसके पश्चात्" मूल विनियम " कहा गया है ) का संशोधन करने के लिए निम्नलिखित विनियम बनाता है , अर्थात्:-
1. संक्षिप्त नाम तथा प्रारंभ (1 ) इन विनियमों का संक्षिप्त नाम केन्द्रीय विद्युत विनियामक आयोग (कारबार संचालन) ( संशोधन) विनियम , 2009 है ।
(2) ये विनियम राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. विनियम 87 का संशोधन मूल दिनियम के विनियम 87 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्:-
"87. (1 ) उत्पादन तथा पारेषण टैरिफ के अनुमोदन के लिए या टैरिफ के पुनरीक्षण के लिए सभी याचिकाएं आयोग द्वारा विनिर्दिष्ट विनियमों के अनुसार ही फाइल की जाएगी तथा इन विनियमों के अध्याय II में विनिर्दिष्ट याचिकाओं को फाइल करने से संबंधित अपेक्षाओं के अनुरूप भी होंगी ।

(2) याचिका के प्राप्त होने पर, आयोग का सचिवालय याचिकाओं की प्रारंभिक संवीक्षा करेगा तथा याचिका की प्राप्ति के 15 दिन के भीतर यथासंभव शीघ्र त्रुटियों , यदि कोई हों, को सुधारने के संबंध में सूचित करेगा तथा टैरिफ के अवधारण के लिए कोई अतिरिक्त जानकारी, यदि अपेक्षित हो, मांगेगा ।
. (3) याचिकाकर्ता, सचिवालय द्वारा संसूचना की तारीख से 20 दिन के भीतर इन विनियमों में विनिर्दिष्ट प्रक्रिया के अनुसार त्रुटियों को दूर करेगा तथा मांगी गई अतिरिक्त जानकारी देगा ।
(4) यदि याचिकाकर्ता उपरोक्त विनिर्दिष्ट समय के भीतर त्रुटियों को दूर करने तथा अतिरिक्त जानकारी देने में असफल रहता है तो आयोग अपने विवेकानुसार याचिकाकर्ता को कोई और सूचना बिना याचिका को रद्द कर सकेगा या/ और याचिकाकर्ता द्वारा किए गए आवेदन पर उसका यदि यह समाधान हो जाने पर कि याचिकाकर्ता ने पर्याप्त कारणों से त्रुटियों को दूर करने से तथा अतिरिक्त जानकारी देने से निवारित किया गया था तो यथास्थिति, त्रुटियों को दूर करने या अतिरिक्त जानकारी देने के लिए समय दे सकेगा :
परंतु यह कि इस खंड के अधीन याचिका को खारिज किए जाने से याचिकाकर्ता को टैरिफ के अवधारण के लिए नया आवेदन करने से प्रवारित नहीं करेगी :
परंतु यह और कि फाइल करने की फीस के प्रयोजन के लिए, इस खंड के अधीन खारिज याचिका पर अंर्तवर्ती आवेदन के रूप में विचार किया जाएगा तथा फीस तद्नुसार संदेय होगी ।
(5) याचिकाकर्ता द्वारा त्रुटियों को सुधारने या अतिरिक्त जानकारी देने पर उसके 10 दिन के भीतर सचिवालय द्वारा यथासंभव शीघ्र याचिका पर आयोग की सुनवाई के लिए कार्यवाही की जाएगी ।"।
3. विनियम 103 का संशोधन मूल विनियम के विनियम 103 के खंड (1 ) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -
" 103. (1 ) आयोग ऐसे विनिश्चय, निदेश या ओदश करने के 45 दिन के भीतर किसी भी समय स्वप्रेरणा से या संबंधित व्यक्ति या पक्षकारों के किसी आवेगन पर ऐसे विनिश्चय, निदेश या आदेश का पुनर्विलोकन कर सकेगा तथा ऐसे समुचित आदेश पारित कर सकेगा जो आयोग ठीक समझे :
परंतु यह कि इस खंड के अधीन स्वप्रेरणा पर आयोग द्वारा पुनर्विलोकन करने की शक्तिका प्रयोग किसी आनुषंगिक भूल या लोप से उद्भूत लेखन या गणितीय भूल के लिए किया जा सकेगा ।" ।

' टिप्पण : मूल विनियम भारत के राजपत्र ( असाधारण ) , भाग III , खंड 4 में तारीख 26 अप्रैल , 1999 को अधिसूचित किए गए थे तथा निम्नानुसार उनमें समय- समय पर , संशोधन किया था :
इन विनियमों के शुद्धिपत्र को भारत के राजपत्र (असाधारण) , भाग 3 , खंड 4 में तारीख 31. 5.1999 को प्रकाशित किया गया था । (i)
(ii) केंद्रीय विद्युत विनियामक आयोग (कारबार संचालन) (पहला संशोधन) विनियम, 2000 भारत के राजपत्र (असाधारण) , भाग 3 , खंड 4 में तारीख 10.5.2000 को प्रकाशित किए गए थे ।
(iii) केंद्रीय विद्युत विनियामक आयोग (कारबार संचालन) (पहला संशोधन) विनियम, 2002 भारत के राजपत्र ( असाधारण ) , भाग 3, खंड 4 में तारीख 9.12.2002 को प्रकाशित किए गए थे ।
CENTRAL ELECTRICITY REGULATORY COMMISSION
NOTIFICATION
New Delhi , the 28th May , 2009
No. L-1 /(5)/2009-CERC.-In exercise of the powers conferred under Section 178 of the Electricity Act, 2003 (36 of 2003 ) , and all other powers enabling it in this behalf , and after previous publication , the Central Electricity Regulatory Commission hereby makes the following Regulations,to further amend the Central Electricity Regulatory Commission (Conduct of Business ) Regulations , 1999 , hereinafter referred to as "the principal regulations " , namely:-
1. Short title and commencement. ( 1 ) These regulations may be called the Central Electricity Regulatory Commission (Conduct of Business ) (Amendment) Regulations , 2009 .
(2) These regulations shall come into force with effect from the date of their publication in the Official Gazette.
2. Amendment of Regulations 87: Regulation 87 of the principal regulations shall be substituted as under, namely:
"87. (1 ) All petitions for approval of generating or transmission tariff or for revision of tariff shall be made strictly in accordance with the regulations specified by the Commission and shall also be in conformity with the requirements relating to filing of petitions specified in Chapter Ii of these Regulations.
(2) TheSecretariat of the Commission shall , on receipt of the petition , carry out preliminary scrutiny of the petitions and convey the defects , if any, for rectification and call for additional information , if any required for determination of tariff, as far as possible, within 15 days of receipt of the petition.
(3) The petitioner shall rectify the defects and submit the additional information called for , in accordance with the procedure specified in these regulations within 20 days from the date of communicationby the Secretariat.

(4) If the petitioner fails to rectify the defects or submit the additional information within the time specified above, the Commission may, at it discretion , dismiss the petition without any further notice to the petitioner or /and on an application made by the petitioner, on being satisfied that the petitioner was prevented from rectifying the defects or providing additional information for sufficient reason , extend time for rectification of defects or for providing additional information , as the casemaybe:
Provided that the dismissal of the petition under this clause shall not preclude the petitioner from making a fresh petition for determination of tariff:
Provided further that for the purpose of filing fee , the petition dismissed under this clause shall be considered as an interlocutory application , and fee shall be payable accordingly.
(5) Onrectification of the defects or providing additional information by the petitioner, the petition shall be processed by the Secretariat for hearing by the Commission , as far as possible, within 10 days thereof. "
3. Amendment of Regulations 103: Clause (1 ) of Regulation 103 of principal regulations shall be substituted as under :
" 103. ( 1 ) The Commission may at any time , on its own motion , or on an application of any of the persons or parties concerned , within 45 days of making such decision , directions or order , review such decision , directions or orders and pass such appropriate orders as the Commission deems fit:
Provided that power of review by the Commission on its own motion under this clause may be exercised only for correction of clerical or arithmetical mistakes arising from any accidental slip or omission . "

Note : The principal Regulations were notified in the Gazette of India ( Extraordinary) PartIII , Section 4 on 26th April , 1999 and were amended from time to time as under:-
(i) The corrigendum to these regulations was published in Part III , Section 4 of Gazette of India ( Extraordinary ) dated 31.5.1999.
(ii) Central Electricity Regulatory Commission ( Conduct of Business ) ( First Amendment) Regulations ,2000 was published in Gazette of India (Extraordinary) Part III , Section 4 on 10.5.2000 .
(iii) Central Electricity Regulatory Commission (Conduct of Business) ( FirstAmendment) Regulations ,2002 was published in Gazette of India(Extraordinary ) Part III , Section 4 on 9.12.2002.
