का.आ. 190(अ). केन्द्रीय सरकार ने रिट याचिका ( सिविल) सं. 1985 का 13029 में माननीय उच्चतम न्यायालय के तारीख 7 जनवरी , 1998 के आदेश के अनुपालन में, तारीख 29 जनवरी , 1998 की अधिसूचना सं. का.आ. 93 ( अ ) के अधीन पर्यावरण प्रदूषण ( निवारण और नियंत्रण ) प्राधिकरण का गठन किया गया था; और उक्त प्राधिकरण का गठन राष्ट्रीय राजधानी क्षेत्र में पर्यावरण की सुरक्षा और क्वालिटी सुधार और पर्यावरणीय प्रदूषण के निवारण और नियंत्रण के उद्देश्य से किया गया था;
और उक्त प्राधिकरण उपरोक्त निर्दिष्ट अधिसूचना के अनुसार राष्ट्रीय राजधानी क्षेत्र के पर्यावरण से संबंधित विभिन्न मामलों में माननीय उच्चतम न्यायालय की सहायता कर रहा है;
और केन्द्रीय सरकार द्वारा उक्त प्राधिकरण के कार्यकाल का समय-समय पर विस्तार किया जाता रहा है और इसे अंतिम बार 27 जुलाई, 2009 को विस्तारित किया गया था;
और केन्द्रीय सरकार , उक्त प्राधिकरण का कार्यकाल एक वर्ष की और अवधि के लिए विस्तार करना आवश्यक समझती है ताकि प्राधिकरण राष्ट्रीय राजधानी क्षेत्र में प्रदूषण से संबंधित महत्वपूर्ण मुद्दों को हल करने में सक्षम हो सके;
अतः , अब, केन्द्रीय सरकार , पर्यावरण ( संरक्षण ) अधिनियम , 1986 ( 1986 का 29 ) की धारा 3 की उप- धारा ( 1 ) और उप- धारा (3 )

द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के पर्यावरण और वन मंत्रालय के आदेश सं. का.आ. 93 ( अ ) , तारीख 29 जनवरी , 1998 में निम्नलिखित और संशोधन करती है , अर्थात्:-
उक्त आदेश के पैरा 1 में " बारह वर्ष की अवधि के लिए " शब्दोंके स्थान पर " तेरह वर्ष की अवधि के लिए " शब्द रखे जाएंगे ।

MINISTRY OF ENVIRONMENT AND FORESTS ORDER
New Delhi , the 25th January , 2010
S.O.190(E). Whereas in pursuance of the Order dated the 7th January , 1998 of the Hon'ble Supreme Court inWrit Petition (C) No. 13029 of 1985, the Central Government had constituted the Environment Pollution (Prevention and Control) Authority (EPCA) vide notification number S.O. 93 (E) , dated the 29th January , 1998;
And whereas the said Authority was constituted with the objective of protecting and improving the quality of the environment and preventing and controlling environmental pollution in the National Capital Region ;
And whereas the said Authority is assisting the Hon'ble Supreme Court in various environment related matters in the National Capital Region in terms of the above referred notification;
And whereas the tenure of the said Authority was extended from time to time by the Central Government and lastly it was extended on the 27th day of July, 2009 ;
And whereas the Central Government considers it necessary to extend the tenure of the said Authority for a further period of one year so that the Authority is able to address those important issues relating to pollution in the National Capital Region;

Now, therefore , in exercise of the powers conferred by sub - sections ( 1 ) and (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) , the Central Government hereby makes the following further amendment in the Order ofthe Government of India in the Ministry of Environment and Forests , number S.O. 93 (E) , dated the 29th January , 1998 , namely:
Inthe said order, in paragraph J , for the words " for a period of twelve years " , the words " for a period of thirteen years" shall be substituted .
