NOTIFICATION

New Delhi, the 29th January, 2010

S.O. 212(E).—Whereas, the Krishna Water Disputes Tribunal (hereinafter called the said Tribunal) was constituted on 2nd April, 2004 vide notification number S.O. 451(E) under Section 4 of the Inter-State River Water Disputes Act, 1956 (33 of 1956) for the adjudication of the water disputes regarding Inter-State River Krishna, and river valley thereof;

And whereas, the said Tribunal was required to submit its report and decision under Sub-section (2) of Section 5 of the said Act on or before the 1st day of April, 2007;

And whereas, the said Tribunal had requested to extend the period of submission of report and decision for further periods from time to time;

And whereas, the Central Government vide notifications number S.O. 400(E), dated the 20th March, 2007, S.O 414(E), dated 3rd March, 2008, S.O. 2116(E), dated 27th August, 2008 had extended the period of submission of report and decision upto 1st April, 2009;

And whereas, the Government of Karnataka approached Hon'ble Supreme Court vide Writ Petition 408/2008 to direct the Central Government to reckon the date of constitution of the Tribunal as February or March, 2006;

Whereas the Hon'ble Supreme Court heard the matter on 17-12-2008 and directed that effective date of the constitution of the Krishna Water Disputes Tribunal under Section 3 of the Inter-State River Water Disputes Act, 1956, would be 1st February, 2006;

And whereas, the said Tribunal again had requested to extend period of submission of its report and decision for a further period of one year with effect from 1st February, 2009;

And whereas, after taking into consideration the Court order, the notification number 21 I 6(E), dated the 27th August, 2008 and the proviso to Sub-section (2) of Section 5 of the said Act, the Central Government vide Notification No. S.O. 543(E) dated 25th February, 2009 extended the period of submission of report and decision for a further period of one year with effect from 1st February, 2009 upto 31st January, 2010.

And whereas, the said Tribunal has again requested to extend the period of submission of report and decision for a further period of eight months with effect from 1st February, 2010.

Now, therefore, in exercise of the powers conferred by the proviso to Sub-section (2) of Section 5 of the said Act, the Central Government hereby extends the period of submission of report and decision by Krishna Water Disputes Tribunal upto 30th September, 2010.
