सा.का.नि. 60 (अ) . केन्द्रीय सरकार, उपभोक्ता मामले, खाद्य और सार्वजनिक वितरण मंत्रालय ने आवश्यक वस्तु अधिनियम , 1955 की धारा 3 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए अधिसूचना संख्या सा.का.नि. 597 ( अ ) , तारीख 22 अगस्त, 2009 ( इसमें इसके पश्चात् इसे मूल अधिसूचना कहा जाएगा ) जारी की थी जो उसके प्रकाशन से 21 दिन के पश्चात् प्रवृत्त हुई थी , जैसाकि उसके पैरा 2 में निर्दिष्ट है;
और अतः , भारत सरकार , उपभोक्ता मामले , खाद्य और सार्वजनिक वितरण मंत्रालय की अधिसूचना संख्या सा.का.नि. 640 (अ ) , तारीख 7 सितम्बर, 2009 द्वारा केन्द्रीय सरकार ने मूल अधिसूचना के पैराग्राफ 2 में इस आशय का संशोधन किया था कि मूल अधिसूचना 19 सितम्बर, 2009 से 28 दिन के पश्चात् प्रवृत्त होगी;
और अतः , केन्द्रीय सरकार द्वारा यह आवश्यक और समीचीन हो गया है कि चीनी का स्टाक रखने की अवधि पंद्रह दिनों से घटाकर दस दिन कर दी जाए और मूल अधिसूचना के प्रचालन की अवधि 20 फरवरी , 2010 से छः मास के लिए बढ़ा दी जाए ;
अतः अब केन्द्रीय सरकार आवश्यक वस्तु अधिनियम , 1955 की धारा 3 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , मूल अधिसूचना में और निम्नलिखित संशोधन करती है, अर्थात्:-
मूल अधिसूचना में,
(क) प्रथम पैराग्राफ में शब्द " पंद्रह दिन " के स्थान पर " दस दिन " शब्द रखे जाएंगे ;
(ख) पैराग्राफ 2 के स्थान पर निम्नलिखित पैराग्राफ रखा जाएगा , अर्थात्:--
" 2. यह आदेश 20 फरवरी , 2010 को प्रवृत्त होगा और एक सौ अस्सी दिनों की अवधि के लिए प्रवृत्त रहेगा । " ।

NOTIFICATION
New Delhi , the 5th February, 2010
G.S.R. 60 (E) . Whereas the Central Government in the Ministry of Consumer Affairs , Food and Public Distribution , in exercise of the powers conferred by sub - section ( 1 ) of Section 3 of the Essential Commodities Act , 1955 , had issued notification number G.S.R. 597 (E ) , dated 22nd August, 2009 (hereinafter referred to as the principal notification ) which came into effect after twenty - one days of its publication as specified in paragraph 2 thereof;
Andwhereas , vide notification number G.S.R. 640 ( E) , dated 7th September , 2009 of the Government of India in the Ministry ofConsumer Affairs , Food and Public Distribution , the Central Government amended paragraph 2 of the principal notification to the effect that the principal notification would come into effect after twenty- eight days from the 19th day of September , 2009;
And whereas , it is considered necessary and expedient by the Central Government to reduce the period of stocking of sugar from fifteen days to ten days and to extend the period of operation of the principal notification for a period ofsix months with effect from 20th February , 2010 ;
Now, therefore, in exercise of the powers conferred by sub - section ( 1 ) of Section 3 of the Essential Commodities Act, 1955, the Central Government hereby makes the following further amendments in the principal notification , namely:-
In the principal notification ,-
(a) in the first paragraph , for the words " fifteen days " , the words " ten days " , shall be substituted;
(b) for paragraph 2 , the following paragraph shall be substituted , namely:--
"2. This order shall come into force on the 20th day of February , 2010 and shall remain in force for a period of one hundred and eighty days . " .
