आ.अ. 1(अ).-यतः गुजरात राज्य की विधान सभा के निर्वाचित सदस्यों द्वारा निर्वाचित श्री सूर्यकान्तभाई आचार्य का स्थान , उनकी पदावधि जो 18 अगस्त, 2011 को सम्मिलित करते हुए , उस तारीख तक थी , के समाप्त होने से पूर्व उनकी मृत्यु के कारण 21 दिसम्बर , 2009 को रिक्त हो गया है; और
यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप - निर्वाचन कराना है;
अतः , अब , लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 147 , धारा 39 की उप- धारा ( 1 ) और धारा 56 के अनुसरण में, भारत निर्वाचन आयोग एतद्वारा :-
(अ ) गुजरात राज्य की विधान सभा के निर्वाचित सदस्यों से यह अपेक्षा करता है कि वे 1 मार्च , 2010 ( सोमवार ) से पूर्व तथा उक्त अधिनियम और तद्दीन बनाए गए नियमों और किए गए आदेशों के उपबन्धों के अनुसार राज्य सभा में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित कर दें;
(आ) उक्त निर्वाचन के संबंध में :-
(क) नाम- निर्देशन करने की अंतिम तारीख
-15 फरवरी , 2010 ( सोमवार) (ख) नाम- निर्देशन की संवीक्षा की तारीख
-16 फरवरी , 2010 ( मंगलवार) (ग) अभ्यर्थिताएं वापस लेने की अन्तिम तारीख
-18 फरवरी , 2010 ( बृहस्पतिवार)
-25 फरवरी , 2010 ( बृहस्पतिवार) (घ) वह तारीख , जिसको यदि आवश्यक हुआ तो मतदान होगा; और
(ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न कर लिया जाएगा
-1 मार्च , 2010 ( सोमवार )
नियत करता है; और
( इ) 9.00 बजे पूर्वाह्न से 4.00 बजे अपराह्न तक का समय , ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ है तो , निर्वाचन के लिए उपर्युक्त विनिर्दिष्ट तारीख को , मतदान होगा ।

NOTIFICATION
New Delhi , the 8th February, 2010
O.N. 1 (E) . Whereas , the seat of Shri Suryakantbhai Acharya in the Council of States , elected by the elected members of the Legislative Assembly of the State of Gujarat, has become vacant on 21st December, 2009 by the reason of his death, before the expiration of his term of office which was up to and including the 18th August, 2011 ; and Whereas , a bye - election is to be held for the purpose of filling the vacancy so caused;
Now, therefore , in pursuance of Section 147 , sub- section ( 1 ) of Section 39 and Section 56 of the Representation ofthe People Act , 1951 (43 of 1951 ) , the Election Commission of India hereby..
(A) calls upon the elected members of the Legislative Assembly of the State of Gujarat to Elect, before 1st March , 2010 (Monday) , and in accordance with the provisions of the said Act and of the rules and orders inade thereunder, a person for the purpose of filling the said vacancy in the Council of States;
(B) appoints , with respect to the said election :---
(a) the 15th February, 2010 (Monday) , as the last date for making nominations ;
(b) the 16th February , 2010 (Tuesday ) , as the date for the scrutiny of the nominations ;
(c) the 18th February, 2010 (Thursday ) , as the last date for the withdrawal of candidatures;
(d) the 25th February, 2010 (Thursday) , as the date on which a poll shall , if necessary, be taken ; and (e) the 1st March, 2010 (Monday) , as the date before which the election shall be completed ; and (C) Fixes the hours from 9.00 A.M. to 4.00 P.M. , as the hours during which the poll shall , if necessary be taken on the date specified above for the election .

आ.अ. 2(अ).-लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 21 के अनुसरण में और धारा 22 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निर्वाचन आयोग , गुजरात राज्य सरकार के परामर्श से एतद्वारा तारीख 8 फरवरी , 2010 को भारत के राजपत्र में प्रकाशित आयोग की अधिसूचना के अनुसरण में इस राज्य में राज्य सभा के लिए उप- निर्वाचन के संबंध में :-
(i ) नीचे की सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट अधिकारी को रिटर्निंग आफिसर के रूप में पदाभिहित करता है; और (ii) उक्त सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट अधिकारी को , रिटर्निंग आफिसर की उसके कृत्यों के पालन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है ।

NOTIFICATION
New Delhi , the 8th February , 2010
O.N. 2(E) . In pursuance of Section 21 , and in exercise of the powers conferred by sub - section ( 1 ) of Section 22, ofthe Representation of the People Act, 1951 (43 of 1951 ) , the Election Commission of India, in consultation with the Government ofthe State of Gujarat , hereby :----
(i) designates the officer , specified in column ( 1) of the Table below, to be the Returning Officer ; and (ii) appoints the officer, specified in column (2) of the said Table , to be the Assistant Returning Officer to assist the Returning Officer in the performance of his functions;
in respect of the bye - election to the Council of States , to be held in that State in pursuance of the Commission's Notification , published in the Gazette of India on 8th February, 2010.
