सा.का.नि. 63 (अ) ,-खाद्य अपमिश्रण निवारण नियम , 1955 का और संशोधन करने के लिए , खाद्य अपमिश्रण निवारण अधिनियम , 1954 ( 1954 का 37 ) की धारा 23 की उप - धारा ( 1 ) की अपेक्षानुसार कतिपय नियमों का प्रारूप , भारत के राजपत्र , असाधारण में , भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय (स्वास्थ्य विभाग ) की अधिसूचना संख्यांक सा.का.नि. 871 ( अ ) , तारीख 23 दिसम्बर , 2008 में प्रकाशित किए गए थे , जिसमें उन सभी व्यक्तियों से , जिनके उनसे प्रभावित होने की संभावना है , उस तारीख से , जिसको उक्त अधिसूचना की भारत के राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थी , साठ दिन की समाप्ति के पूर्व आक्षेप और सुझाव मांगे गए थे;
और उक्त राजपत्र की प्रतियां जनसाधारण को 26 दिसम्बर , 2008 को उपलब्ध करा दी गईं थीं;
और उक्त प्रारूप नियमों पर विनिर्दिष्ट अवधि के भीतर जनसाधारण से प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार द्वारा विचार कर लिया गया है ;
अतः , अब , केन्द्रीय सरकार , खाद्य अपमिश्रण निवारण अधिनियम , 1954 की धारा 23 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय खाद्य मानक समिति से परामर्श करने के पश्चात् खाद्य अपमिश्रण निवारण नियम, 1955 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्
1. ( 1 ) इन नियमों का संक्षिप्त नाम खाद्य अपमिश्रण निवारण (पहला संशोधन ) नियम , 2010 है ।

(2) ये राजपत्र में अंतिम प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. खाद्य अपमिश्रण निवारण नियम , 1955 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) की परिशिष्ट ख की मद क. 16.01 , क. 16.02 , क. 16.03 , क. 16.04 , क. 16.05 , क. 16.06 , क. 16.07 , क. 16.08 , क. 16.09 , क. 16.10 , क. 16.11 , क. 16.12 , क. 16.13 , क. 16.14 , क. 16.16 , क. 16.17 , क. 16.18 , क. 16.21 , क. 16.22 , क. 16.23 , क. 16.24 , क. 16.26 , क. 16.27 , क. 16.28 , क. 16.29 , क. 16.30 , क. 16.34 , क. 16.41 , क. 20 , क. 20.01 के पैरा " आधान में उत्पाद को पूरी तरह भरा जाएगा और जब उत्पाद को अनम्य आधानों में भरा जाएगा तो उत्पाद उसके शुद्ध भार के 90 प्रतिशत से कम नहीं होगा । आधान के शुद्ध भार 20 डिग्री सेल्सियस पर आसवित जल का वह आयतन है जिसे सीलबंद आधान , जब उसे पूर्णतया भरा जाए , धारण करने में सक्षम है " में और " आधान के शुद्ध भार " शब्दों के स्थान पर दोनों स्थानों पर , " आधान की जल क्षमता " रखे जाएंगे ।
3. उक्त नियमों की परिशिष्ट ख के , तापीय रूप से प्रसंस्कृत फलों के रस से संबंधित मद 16.06 में,-
(क) " उसके एक या अधिक पौष्टिक मीठे पदार्थ मिलाए जा सकते हैं जिसकी मात्रा 50 ग्राम/किलोग्राम से अधिक नहीं होगी परन्तु अत्यधिक अम्लीय फलों में इनकी मात्रा 200 ग्नम/किलोग्राम से अधिक नहीं होगी " शब्दों और अंकों के पश्चात् निम्नलिखित शब्द अंतःस्थापित किए जाएंगे , अर्थात्:-
" सेब का रस , संतरे का रस ( सान्द्रित रस से पुनः बनाया गया ) अंगूर का रस , अनानास का रस ( सान्द्रित रस से पुनः बनाया गया ) के सिवाय " । ;

(ख) पैरा 2 में , अपेक्षाओं की सारणी में ,
( i ) " साइट्रिक अम्ल के रूप में व्यक्त अम्लता अधिकतम ( % ) " स्तंभ के नीचे , नींबू रस ( लेमन जूस ) और नींबू जूस ( लाइम जूस ) से संबंधित क्रम संख्या 4. और 5 के सामने विद्यमान प्रविष्टि के स्थान पर निम्नलिखित . प्रविष्टियां अंतस्थापित की जाएंगी , अर्थात्:
"4.0 न्यूनतम 4. नींबू रस ( लेमन जूस )
5.0न्यूनतम " 5. नींबू रस ( लाइम जूस )
( ii ) स्तंभ " मिलाए गए पौष्टिक मीठे पदार्थ अधिकतम (ग्राम/किग्रा. ) " और उससे संबंधित प्रविष्टियों का लोप किया जाएगा ।
4. उक्त नियमों में , फल और सब्जी चटनी से संबंधित मद सं. क. 16.41 में, पीएच की अपेक्षाओं के सामने " 4.6 से कम नहीं " प्रविष्टिके स्थान पर " 4.6 से अधिक नहीं " प्रविष्टि रखी जाएगी ।
5. उक्त नियमों की परिशिष्ट ग की सारणी 8 में,
(क ) क्रम सं. च.2 के पश्चात् निम्नलिखित क्रम सं. और प्रविष्टिअंतःस्थापित की जाएगी , अर्थात्:-

(ख ) इस प्रकार अंतःस्थापित सार्बिक अम्ल से संबंधित क्रम सं. च.3 में " कार्बोनेट युक्त फूट बीवरेज या फूट ड्रिंक " स्तंभ के नीचे निम्नलिखित प्रविष्टि अंतःस्थापित की जाएगी , अर्थात्:-

(ग ) पेक्टिन से संबंधित क्रम सं. छ. 3 में " कार्बनेट युक्त फ्रूट बीवरेज या फ्रूट ड्रिंक " स्तंभ के नीचे " जीएमपी " प्रविष्टिअंतःस्थापित की जाएगी ।
6.. उक्त नियमों की परिशिष्ट ग की सारणी 10 में ,
(क) ( i ) अरेबिक गम से संबंधित क्रम स्. त. 2 ( i ) में " आरटीएस फल और सब्जी पेय " स्तंभ के नीचे " जीएमपी .(केवल आरटीएस फल पेय के लिए ) " प्रविष्टि अंतःस्थापित कीजाएगी;
( ii ) पोटेशियम अल्जीनेट से संबंधित क्रम सं. त. 3 ( ii ) में

" आरटीएस फल और सब्जी पेय " स्तंभ के नीचे " जीएमपी (केवल आरटीएस फल पेय के लिए ) " प्रविष्टि अंतःस्थापित कीजाएगी;
( iii ) क्रम सं. त. 3 ( iv ) के पश्चात् निम्नलिखित क्रम सं. अंतःस्थापित किया जाएगा , अर्थात्:--

( iv ) पैक्टाइन्स से संबंधित क्रम सं. त. 4 के सामने वाली प्रविष्टि में " आरटीएस फल और सब्जी पेय " स्तंभ के नीचे "जीएमपी ( केवल आरटीएस फल पेय के लिए ) " अंतःस्थापित किया जाएगा ;
(ख) गाढ़ा करने वाले कारक से संबंधित क्रम सं. त में , " सूप चूर्ण, फल चूर्ण- मिश्रित चूर्ण " स्तंभ के नीचे " 0.5 % अधिकतम " प्रविष्टि के स्थान पर " तनुकरण के पश्चात् खपत के लिए अंतिम खाद्य का 0.5 % अधिकतम " प्रविष्टि रखी जाएगी;
(ग ) ( i ) प्राकृतिक रंगों से संबंधित क्रम सं. ङ ( क ) में " मकरन्द " स्तंभ के नीचे " 100 पीपीएम अधिकतम " प्रविष्टि अंतःस्थापित की जाएगी;
( ii ) फ्लेवर से संबंधित क्रम सं. छ. । में , " मकरन्द" स्तंभ के नीचे " जीएमपी- केवल प्राकृतिक फ्लेवरिंग और प्राकृतिक फ्लेवरिंग पदार्थ " प्रविष्टि अंतःस्थापित की जाएगी;
( iii ) परिरक्षी से संबंधित क्रम सं. झ में, --
(क) मद सं. 1 " बेंजोइक अम्ल " के सामने , " मकरन्द" स्तंभ के नीचे " 120पीपीएम अधिकतम " प्रविष्टि अंतःस्थापित की जाएगी;
(ख) मद सं. 2 " सल्फरडाई आक्साइड " के सामने , " मकरन्द " स्तंभ के नीचे " 70 पीपीएम अधिकतम " प्रविष्टि अंतःस्थापित कीजाएगी;
(ग ) मद सं. 3 " सार्बिक अम्ल " के सामने , " मकरन्द " स्तंभ के नीचे " 300पीपीएम अधिकतम " प्रविष्टि अंतःस्थापित की जाएगी;
(घ ) पेक्टाइन्स से संबंधित क्रम सं. त.4 में , " मकरन्द " स्तंभ के नीचे " जीएमपी " प्रविष्टि अंतःस्थापित की जाएगी;
(ङ) पेक्टाइन्स से संबंधित क्रम सं. त.4 में , " फल रस अर्जम विधि से पैक किए हुए " स्तंभ के नीचे " जीएमपी " प्रविष्टि अंतःस्थापित की जाएगी ।

NOTIFICATION
New Delhi , the 8th February , 2010
G.S.R. 63 (E ) .- Whereas certain draft rules further to amend the Prevention of Food Adulteration Rules , 1955 were publish , as required by sub - section ( 1 ) of Section 23 of the Prevention of Food Adulteration Act, 1954 (37 of 1954) , in the notification of the Government of India in the Ministry of Health and Family Welfare (Department of Health) , Number G. S. R. 871 (E) , dated the 23rd December , 2008 , in the Gazette of India , Extraordinary , Part II , Section 3 , Sub- section (i) , inviting objections and suggestions from all persons likely to be affected thereby , before the expiry of sixty days from the date on which copies of the Gazette of India in which the said notification was published, was made available to the public ;
And whereas , the copies of the said Gazette were made available to the public on 26th December , 2008 ;
And whereas , objections and suggestions received from the public within the specified period on the said draft rules have been considered by the Central Government ;
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of Section 23 of the Prevention of Food Adulteration of the said Act, the Central Government , after consultation with the Central Committee for Food Standards , hereby makes the following rules further to amend the Prevention of Food Adulteration Rules , 1955 , namely:-
1. ( 1 ) These rules may be called the Prevention of Food Adulteration ( 1st Amendment) Rules , 2010 .
(2) They shall come into force on the date of their final publication in the Official Gazette .
2. In the Prevention of Food Adulteration Rules , 1955 (hereinafter referred to as the said rules) , in Appendix B , in items A.16.01, A. 16.02 , A. 16.03 , A.16.04 , A. 16.05 , A.16.06 , A. 16.07 , A. 16.08 , A. 16.09 , A.16.10 , A. 16.11 , A. 16.12 , Α.16.13 , A.16.14 , A.16.16 , A.16.17 , A.16.18 , A.16.21 , A.16.22 , A.16:23 , Α . 16.24 , Α.16.26 , Α.16.27 , A.16.28 , A.16.29 , Α.16.30 , A.16.34 , Α.16.41 , A. 20 , A.20.01 , in paragraph ,- " The container shall be well filled with the product and shall occupy not less than 90.0 per cent of the net weight of the container , when packed in the rigid containers . The net weight of the container is the volume of distilled water at 20 ° C which the sealed container is capable of holding when completely filled " for the words , " the net weight of container " , occurring at both the places , the words , " the water capacity of the container " shall be substituted.
3. In the said rules , in Appendix B , in item A.16.06 relating to Thermally Processed Fruit Juices ,- .

(a) after the words and figures , namely " One or more of the nutritive sweeteners may be added in amounts not exceeding 50g/ kg but not exceeding 200g/kg in very acidic fruits " , the following words shall be inserted , namely: ---
"except in case of Apple juice , Orange juice (reconstituted from concentrate ) , Grape juice , Pineapple Juice ( reconstituted from concentrate) " . ; .
(b) in Paragraph 2 , in the Table for requirements , -
(i) against the serial numbers 4 and 5 relatingto lemon juice and lime juice under column "Acidity expressed as Citric Acid maximum (%) " for the existing entries , the following entries shall be inserted , namely :

5. Lime Juice
5.0 minimum";
(ii) the column " Added Nutritive Sweeteners Maximum ( g/kg ) " and the entries relating thereto shall be omitted .
4. Inthe said rules , in item No. A. 16.41 , relating Fruits and Vegetables Chutney , in the requirements for pH , for the entry "Not less than 4.6 " , the entry " Not more than 4.6 " shall be substituted .
5. Inthe said rules , in Appendix C , in Table 8 ,-
(a) after serial number F. 2 , the following serial number and entry shall be inserted , namely :-

6. In the said rules , in Appendix C , in Table 10 , --
(a) ( i) in serial number K. 2 ( i ) relating to Arabic Gum , under column " RTS fruits & vegetable beverages " , the entry " GMP ( for RTS fruit beverages only ) " shall be inserted;
(ii) in serial number K. 3 ( ii ) relating to Potassium alginates under column " RTS fruits & vegetables beverages " , the entry " GMP ( for RTS fruitbeverages only ) " shall be inserted;
(iii) after serial number K. 3 ( iv) , the following serial number shall be inserted , namely : -

(c)( i) in the serial number E ( a ) relating to natural colours , under the column " Nectars " , the entry "100 ppm maximum " shall be inserted;

(iv) in serial number G. 1 relating to flavours , under the column " Nectars " , the entry " Natural Flavouring and Natural Flavouring Substances only - GMP " shall be inserted ;
(v) in serial number I relating to preservatives ,
(a) against the item number 1 " Benzoic acid " , under the column " Nectars " the entry " 120 ppm maximum" shall be inserted;
(b) against the item number 2 " Sulphur Dioxide " , under the column " Nectars " , the entry " 70 ppm maximum " shall be inserted;
(c) against item number 3 " Sorbic acid " , under the column "Nectars " , the entry " 300 ppm maximum " shall be inserted;
(d) in serial number K. 4 relating to pectins , under the column "Nectars " , the entry " GMP " shall be inserted;
(e) in the serial number K. 4 relating to pectins , under the column " Fruit Juices aseptically packed " the entry " GMP " shall be inserted.
