का.आ. 292(अ) .- भारत सरकार ने पेट्रोलियम और खनिज पाइपलाइन ( भूमि में उपयोग के अधिकारका अर्जन) अधिनियम, 1962 (1962 का 50) ( जिसे इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 की उपधारा (1 ) के अधीन जारी की गई भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना संख्या का. आ. 3144 (अ) तारीख 4 दिसम्बर, 2009 व्दारा मैसर्स रिलायंन्स इंडस्ट्रीज लिमिटेड व्दारा महाराष्ट्र राज्य के तहसील रोहा जिला रायगड में स्थित नागोथाने मैन्यूफैक्चरिंग विभाग तक प्राकृतिक गैस के परिवहन के लिए शिवाजी नगर और दिघाटी वाल्व स्टेशनों के बीच पाइपलाईन बिछाने के प्रयोजन के लिए उक्त अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में उपयोग के अधिकार का अर्जन करने के लिए अपने आशय की घोषणा की थी ;
और, उक्त राजपत्र अधिसूचना की प्रतियां जनता को तारीख 05 जनवरी, 2010 को अथवा उससे पूर्व उपलब्ध करा दी गई थीं ;
और,पाइपलाइन बिछाने के सबंध में जनता की ओर से प्राप्त आक्षेपों पर सक्षम प्राधिकारी व्दारा विचार कर लिया गया है और अननुज्ञ्जत कर दिया गया:
और, सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 6 की उपधारा ( 1 ) के अधीन भारत सरकार को अपनी रिपोर्ट दे दी है;
और , भारत सरकार ने, उक्त रिपोर्ट पर विचार करने के पश्चात् और यह समाधान हो जाने पर कि उक्त भूमि पाइपलाइन बिछाने के लिए अपेक्षित है, उसमें उपयोग के अधिकार का अर्जन करने का विनिश्चय किया है ; अतः, अब भारत सरकार उक्त अधिनियम की धारा 6 की उपधारा (1 ) व्दारा प्रदत्त शक्तियों का प्रयोग करते हुए यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में पाइपलाइन बिछाने के लिए उपयोग के अधिकार का अर्जन किया जाता है ;

और भारत सरकार उक्त अधिनियम की धारा 6 की उपधारा (4) व्दारा प्रदत्त शक्तियों का प्रयोग करते हुए यह निर्देश देती है कि उक्त में उपयोग का अधिकार इस घोषणा के प्रकाशन की तारीख से भारत सरकार में निहित होने के बजाए सभी विल्लंगंमों से मुक्त मैसर्स रिलायंन्स इंडस्ट्रिज लिमिटेड, नागोथाने मैन्यूफैक्चरिंग विभाग में निहित होगा ।

NOTIFICATION
New Delhi , the 8th February , 2010
S.O. 292 (E). Whereas by notification of Government of India in the Ministry of Petroleum & Natural Gas number S.O.3144 ( E) dated 04th December , 2009 , issued under sub - section ( 1 ) of Section 3 of the Petroleum & Minerals Pipelines ( Acquisition of Rights of Users in Land) Act , 1962 ( 50 of 1962) ( hereinafter referred to as the said Act ) , Government of India declared its intention to acquire the Right of User in the land , specified in the Schedule appended to that notification , for the purpose of laying pipeline between Shivaji Nagar and Dighati Valve Station for the transportation of natural gas from Mahul , Mumbai to Nagothane Manufacturing Division , Nagothane in Tehsil Roha , District- Raigad in Maharashtra State by M / s Reliance Industries Limited;
And , whereas copies of the said Gazette notification were , made available to the public on or before 05th January, 2010;

And whereas , the objections received from the public to the laying of the pipeline have been considered and disallowed by the Competent Authority;
And whereas the Competent Authority has , under sub - section ( 1 ) of Section 6 of the said Act, submitted report to the Government of India;
And whereas , Government of India , after considering the said report and on being satisfied that the said land is required for laying the pipeline , has decided to acquire the Right of User therein;
Government of Now, therefore , in exercise of the powers conferred by sub- section ( 1 ) of the Section 6 of the said Act , India hereby declares that the Right of User in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline ;
And , further , in exercise of the powers conferred by sub section ( 4) of Section 6 of the said Act , Government of India hereby directs that the Right of User in the said land for laying the pipeline shall , instead of vesting in Government of India , vest , on the date of publication of the declaration , in M/ s Reliance Industries Limited , Nagothane Manufacturing Division , free from all encumbrances .
