सा.का.नि. 67(अ).केन्द्रीय मोटर यान नियम , 1989 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप जिसे केन्द्रीय सरकार , मोटर यान अधिनियम , 1988 ( 1988 का 59 ) की धारा 27 और धारा 64 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , बनाने का प्रस्ताव करती है , उक्त अधिनियम की धारा 212 की उप - धारा ( 1 ) की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है ; और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से , जिसको भारत के राजपत्र में यथा प्रकाशित इस अधि सूचना की प्रतियां जनता को उपलब्ध करा दी जाती हैं, पैंतालिस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ।
2. ऐसे आक्षेपों या सुझावों पर , जो पूर्वोक्त अवधि की समाप्ति के पूर्व उक्त प्रारूप नियमों के संबंध में किसी व्यक्ति से प्राप्त हो सकेंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ।
3. आक्षेप और सुझाव , यदि कोई हों, संयुक्त सचिव ( परिवहन ) , सड़क परिवहन और राजमार्ग विभाग , परिवहन भवन , संसद मार्ग , नई दिल्ली -110001 को भेजे जा सकेंगे ।
प्रारूप नियम
1. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मोटर यान (संशोधन ) नियम , 2010 है ।
प्रवृत्त होंगे । ( 2 ) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को 2. केन्द्रीय मोटर यान नियम , 1989 में,-
(क) नियम 2 के खंड ( ध ) के स्पष्टीकरण में, --
" 4 किलो बाइट " शब्दों और अंक के स्थान पर " 64 किलो बाइट " शब्द और अंक रखे जाएंगे ;
( ख) उपाबद्ध XI में टिप्पण के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्:
"टिप्पण : पैरा 1 में उल्लिखित स्मार्ट कार्ड की 'माइक्रोप्रोसेसर चिप स्मार्ट कार्ड पर आधारित चालन अनुज्ञप्ति और परिवहन और गैर परिवहन यानों के लिए यान रजिस्ट्रीकरण दस्तावेजों के लिए इस उपाबद्ध में दिए गए विनिर्देशों के अनुरूप होगी और उसमें इन नियमों के अधीन विनिर्दिष्ट जानकारी अंतर्विष्ट होगी । "।

टिप्पण. मूल नियम सा.का.नि. 590 ( अ ) , तारीख 2 जून , 1989 में प्रकाशित किए गए थे और सा.का.नि. 148 ( अ ) , तारीख 4 मार्च, 2009 द्वारा उनका अंतिम संशोधन किया गया था ।

NOTIFICATION
New Delhi , the 10th February, 2010
G.S.R. 67 ( E) . The following draft of certain rules further to amend the Central Motor Vehicles Rules , 1989 , which the Central Government proposes to make in

exercise of the powers conferred by Sections 27 and 64 of the Motor Vehicles Act , 1988 (59 of 1988 ) , is hereby published as required by sub - section ( 1 ) of Section 212 of the said Act for information of all persons likely to be affected thereby ; and notice is hereby given that the said draft rules will be taken into consideration after the expiry offorty five days from the date on which the copies of this notification as published in the Gazette of India , are made available to the public .
2. The objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period aforesaid shall be con- sidered by the Central Government .
3. Objections and suggestions , if any, may be sent to the Joint Secretary ( Transport) , Department of Road Transport and Highways , Transport Bhawan , Parliament Street , New Delhi - 110001 .
DRAFT RULES
1. ( 1 ) These rules may be called the Central Motor Vehicles (Amendment) Rules , 2010 .
(2) They shall come into force on the date of their

final publication in the Official Gazette .
2. In the Central Motor Vehicles Rules , 1989 ,-
(a) in the Explanation to clause ( s ) of rule 2 , for the figure and words " 4 Kilo Byte " the figure and words " 64 Kilo Byte " shall be substituted;
(b) in Annexure XI , for the Note , the following shall be substituted , namely:-
"Note : The microprocessor chip of Smart Card mentioned at Para I shall conform to the specifications given in this Annexure for Smart Card based Driving Licence and Vehicle Registration documents for transport and non- transport vehicles and shall contain the infor- mation specified under these rules . " .
