का.आ. 2719(अ).-जबकि, फाइल सं. 673/21/ 2010- कस्टम- VIII , दिनांक 20-9-2010 को जारी विदेशी मुद्रा संरक्षण और तस्करी निवारण अधिनियम, 1974 ( 1974 का 52 ) की धारा 3 की उप- धारा ( 1 ) के तहत विशेष रूप से अधिकार प्राप्त संयुक्त सचिव, भारत सरकार द्वारा कथित उप- धारा के तहत निदेश दिया गया था कि श्री गिआन चन्द @ गियान चंद अग्रवाल @ ज्ञान चंद @ गिआन चंद दास सिंघल , सुपुत्र श्री राम किशन दास @ राम किशन , निवासी 25/75 , शक्ति नगर , कमला नगर के पास, दिल्ली-110007 को भविष्य में माल की तस्करी करने से रोकने की दृष्टि से निरुद्ध किया जाए तथा केन्द्रीय तिहाड़ जेल , नई दिल्ली में अभिरक्षा में रखा जाए ।
2. जबकि केन्द्र सरकार के पास यह विश्वास करने के कारण हैं कि पूर्वोक्त व्यक्ति भगोड़ा है या अपने को छिपाये हुए है ताकि आदेश तामील न किया जा सके ।
3. अतः , अब , कथित अधिनियम की धारा 7 की उप- धारा ( 1 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा पूर्वोक्त व्यक्ति को निदेश देती है कि सरकारी राजपत्र में इस आदेश के प्रकाशन की तिथि से सात दिन के अंदर वह पुलिस आयुक्त, दिल्ली के सामने उपस्थित हो ।

ORDER
New Delhi , the 2nd November , 2010
S.O. 2719 (E ) .-Whereas the Joint Secretary to the Government of India, specially empowered under sub- section ( 1 ) of Section 3 of the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act , 1974 (52 of1974) issued order.F. No. 673/21/2010-Cus . VIII , dated 20-9-2010 under the said sub - section directing that Shri Gian Chand @ Giyan Chand Aggarwal @ Gyan Chand @Gian Chand Dass Singhal , S /o Shri Ram Kishan Dass @Ram Kishan, R/ o 25/75 , Shakti Nagar , Near Kamla Nagar, Delhi- 110007 , be detained and kept in custody in the Central Tihar Jail , Delhi with a view to preventing him from smuggling goods in future .
2. Whereas the Central Government has reasons to believe that the aforesaid person has absconded or has been concealing himself so that the order cannot be executed .
3.Now, therefore , in exercise of the powers conferred by Clause (b ) of sub- section ( 1 ) of Section 7 of the said Act, the Central Government hereby directs the aforesaid person to appear before the Commissioner of Police, Delhi within 7 days of the publication of this order in the Official Gazette.
