का.आ. 2792(अ) . केन्द्रीय सरकार की राय है कि मेघालय की हन्नीवट्रेप नेशनल लिब्रेशन काउंसिल ( जिसे इसमें इसके बाद एच एन एल सी कहा गया है ) मेघालय राज्य को भारत संघ से अलग करने के अपने उद्देश्य की खुलेआम घोषणा करती रही है ;
और यतः , केन्द्रीय सरकार की पुनः राय है कि एच एन एल सी ,--
( क) ने मेघालय राज्य को भारत संघ से अलग करने के अपने उद्देश्य की खुलेआम घोषणा कर दी है ;
( ख ) अपने इस उद्देश्य को प्राप्त करने हेतु वह अपने को शस्त्र एवं हथियारों से लैस करती रही है ; और
(ग) अपने संगठन के लिए निधियां एकत्रित करने के उद्देश्य से जबरन धन वसूली की कार्रवाइयों में लिप्त रही है;
और यतः केन्द्रीय सरकार का यह भी मत है कि एच एन एल सी ,-
( क) जबरन धन वसूली तथा डराने - धमकाने की कार्रवाइयों को अंजाम देने के लिए पूर्वोत्तर क्षेत्र के अन्य विद्रोही गुटों के साथ संपर्क बनाए हुए है; और
( ख ) शरण स्थल अथवा प्रशिक्षण के लिए कुछ पड़ोसी देशों में शिविर स्थापित किए हुए हैं ।
संगम हैं; और यतः कि केन्द्रीय सरकार का यह भी मत है कि उक्त कारणों से एच एन एल सी तथा इसके द्वारा स्थापित अन्य निकाय विधिविरुद्ध
और यतः केन्द्रीय सरकार का यह भी मत है कि एच एन एल सी की उपर्युक्त गतिविधियां भारत की प्रभुसत्ता और अखंडता के लिए हानिकारक हैं और यदि इन पर तत्काल नियंत्रण न किया गया तो उक्त एच एन एल सी पुनर्संगठित होगा , पुनः शस्त्रों से लैस होगा , अपने कार्यकर्ताओं की संख्या बढ़ाएगा , अत्याधुनिक हथियार प्राप्त करेगा , नागरिकों और सुरक्षा बलों की हत्या करेगा और राष्ट्र विरोधी गतिविधियों को तेज करेगा;
अतः , अब , विधिविरुद्ध क्रियाकलाप ( निवारण ) अधिनियम , 1967 ( 1967 का 37 ) की धारा 3 की उप - धारा ( 1 ) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार , एतद्वारा हन्नीवट्रेप नेशनल लिब्रेशन काउंसिल ( एच एन एल सी ) को इसके सभी गुटों , विंगों और मुख्य संगठनों सहित विधिविरुद्ध संगम घोषित करती है ;

केन्द्रीय सरकार का यह मत है कि एच एन एल सी को इसके सभी गुटों, विंगों और मुख्य संगठनों सहित तत्काल प्रभाव से विधिविरुद्ध संगम घोषित करना आवश्यक है , और तदनुसार विधिविरुद्ध क्रियाकलाप ( निवारण ) अधिनियम , 1967 ( 1967 का 37 ) की धारा 3 की उप - धारा ( 3 ) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार, एतद्वारा निदेश देती है कि यह अधिसूचना उक्त अधिनियम की धारा 4 के अधीन किए जा सकने वाले किसी आदेश के अध्यधीन सरकारी राजपत्र में इसके प्रकाशित होने की तारीख से प्रभावी होगी ।

NOTIFICATION
New Delhi , the 16th Noventber , 2010
S.O. 2792 ( E ) Whereas the Central Government is of the opinion that the Hynniewtrep National Liberation Council (hereinafter referred to as the HNLC ) of Meghalaya has been openly declaring as its objective the secession of the State of Meghalaya from the Indian Union ;
And whereas , the Central Government is further of the opinion that the HNLC , ---
(a) has openly declared as their objective the secession of the State of Meghalaya from the Indian Union ;
(b) has been employing and engaging in armed means to achieve their objective; and
(c) has been indulging in acts of intimidation and extortion for collection of funds for their organisation ;
Andwhereas the Central Government is also of the opinion that HNLC has been ,-
(a) maintaining links with other insurgent groups of the North Eastern Region for carrying out extortion , and intimidation; and
(b) maintaining camps in some neighbouring countries for the purpose of sanctuary or training .
And whereas , the Central Government is also of the opinion that for the reasons aforesaid , the HNLC and other bodies set up by it, is unlawful association;
And whereas , the Central Government is also of the opinion that the aforesaid activities of the HNLC is detrimental to the sovereignty and integrity of India, and if these are not immediately curbed and controlled , the said HNLC would regroup and rearm it selves , expand its cadres , procure sophisticated weapons , cause heavy loss of lives of civilians and Security Forces , and accelerate its anti - national activities ;
Now , therefore , in exercise of the powers conferred by sub - section ( 1 ) of section 3 of the Unlawful Activities (Prevention) Act , 1967 ( 37 of 1967 ) , the Central Government hereby declares the Hynniewtrep National Liberation Council (HNLC) alongwith all its factions , wings and front organisations as unlawful association ;
The Central Government is of further opinion that it is necessary to declare the HNLC alongwith all its factions , wings and front organisations as unlawful associations with immediate effect and accordingly , in exercise of the powers conferred by the proviso to sub- section ( 3 ) of section 3 of the Unlawful Activities ( Prevention ) Act , 1967 ( 37 of 1967 ) the Central Government hereby directs that this notification shall , subject to any order that may be made under section 4 of the said Act, have effect from the date of its publication in the Official Gazette .
