का.आ. 2823(अ). जबकि राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) (जिसे इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 क की उप - धारा ( 1 ) के तहत जारी और भारत के राजपत्र , असाधारण भाग II , खंड 3 , उप - खंड ( ii ) में प्रकाशित भारत सरकार , सड़क परिवहन और राजमार्ग मंत्रालय , ( सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना संख्या का.आ. 724 (अ ) दिनांक 31 मार्च, 2010 द्वारा केन्द्र सरकार ने महाराष्ट्र राज्य के नासिक जिले में राष्ट्रीय राजमार्ग संख्या 50 के कि.मी. 177/000 से कि.मी. 185/550 तक ( सिनार बाइपास खंड ) ( 4/6 लेन बनाया जाना , आदि ) के निर्माण , अनुरक्षण, प्रबंधन और प्रचालन के लिए उक्त अधिसूचना के साथ संलग्न अनुसूची में विनिर्दिष्ट भूमि के अधिग्रहण के अपने आशय की घोषणा की थी;
और जबकि उक्त अधिसूचना का सारांश उक्त अधिनियम की धारा 3 क की उप- धारा ( 3 ) के तहत 9 अगस्त, 2010 के " दैनिक भ्रमर " ( मराठी) , में प्रकाशित किया गया है;
और जबकि आक्षेप प्राप्त हुए हैं और सक्षम प्राधिकारी द्वारा इन पर विचार किया गया तथा इन्हें अस्वीकृत कर दिया गया ;
कर दी है; और जबकि उक्त अधिनियम की धारा उघ की उप - धारा ( i ) के अनुसरण में सक्षम प्राधिकारी ने अपनी रिपोर्ट केन्द्र सरकार को प्रस्तुत
इसलिए अब , सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त होने और उक्त अधिनियम की धारा उघ की उप- धारा ( i ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा यह घोषणा करती है कि संलग्न अनुसूची में विनिर्दिष्ट भूमि का उपर्युक्त प्रयोजन के लिए अधिग्रहण किया जाएगा;
और यह भी कि उक्त अधिनियम की धारा उघ की उप- धारा ( 2 ) के अनुसरण में केन्द्र सरकार एतद्वारा यह घोषणा करती है कि इस अधिसूचना के सरकारी राजपत्र में प्रकाशन के बाद उक्त अनुसूची में विनिर्दिष्ट सभी विल्लंगमों से मुक्त भूमि पूर्णतः केन्द्र सरकार की संपत्ति होगी ।

S.O. 2823 (E ) . Whereas by the notification of the Government of India in the Ministry of Road Transport and Highways (Department of Road Transport and Highways ) , number S.O. 724 ( E ) , dated 31st March 2010 , published in the (1) 2
THE GAZETTE OF INDIA : EXTRAORDINARY
[PART II - SEC . 3 ( ii) ]
Gazette of India , Extraordinary, Part II , Section 3, Sub - section ( ii) , and issued under Sub - section ( i ) of Section 3A of the National Highways Act, 1956, (48 of 1956) ( hereinafter referred to as the said Act) , the Central Government declared its intention to acquire the land specified in the schedule annexed to the said notification for building, maintenance , management and operation of National Highway No. 50 (widening four/six laning etc. ) on the stretch of land from km. 177/000 to 185/550 ( Sinnar bypass section ) in Nashik District in the State of Maharashtra;
And whereas , the substance of the said notification has been published in " Dainik Bhramar " ( Marathi ) , dated 9th August , 2010 under Sub- section (3) of Section 3A of the said Act;
Andwhereas , objections have been received and the same have been considered and disallowed by the competent authority;
And whereas , in pursuance of Sub- section ( i) of Section 3D of the said Act , the competent authority has submitted its report to the Central Government ;
Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by the sub - section ( i) of Section 3D of the said Act , the Central Government hereby declares that , the land specified in the said schedule should be acquired for the aforesaid purpose ;
And further , in pursuance of Sub- section (2) of Section 3D of the said Act , the Central Government hereby declares that, on publications of this notification in the official Gazette , the land specified in the said schedule shall vest absolutely in the Central Government , free from all encumbrances .
