का.आ. 2826(अ).-यतः नेशनल डेमोक्रेटिक फ्रंट ऑफ बोडोलैंड ( जिसे इसमें इसके पश्चात् एन.डी.एफ.बी. कहा गया है ) का घोषित उद्देश्य पूर्वोत्तर क्षेत्र के अन्य सशस्त्र पृथकतावादी संगठनों से मिलकर बोडोलैण्ड जिसमें अधिकतर असम के वे क्षेत्र सम्मिलित हैं जहां बोडो निवास करते हैं, को " मुक्त कराना " और उक्त क्षेत्र को भारत से पृथक करना है ;
और यतः , केन्द्रीय सरकार की यह राय हे कि एन.डी.एफ.बी.
लगातार :-
(i ) पृथक बोडोलैण्ड स्थापित करने के अपने उद्देश्य को पूरा करने के लिए , भारत की संप्रभुता और क्षेत्रीय अखंडता को विच्छिन्न करने वाले या विच्छिन्न करने का आशय रखने वाले अवैध और हिंसात्मक क्रियाकलापों में लिप्त रहा है ;
( ii ) पृथक बोडोलैण्ड के सृजन के अपने उद्देश्य को पूरा करने के लिए पूर्वोत्तर क्षेत्र के अन्य भूमिगत संगठनों के साथ सम्बद्ध रहा है;
( iii ) विधिविरुद्ध और हिंसक क्रियाकलापों में लगा हुआ है , इस प्रकार उसने भारत सरकार तथा असम सरकार के प्राधिकार को कम किया है और जनता में आतंक और संत्रास फैलाया है;
(iv) अपनी योजनाओं और गतिविधियों के वित्त पोषण और निष्पादन की दृष्टि से समाज के विभिन्न वर्गों से जबरन धन वसूली में संलिप्त रहा है;

(v) अपने आतंकवादी और विद्रोही क्रियाकलापों को जारी रखने के उद्देश्य हेतु नए कॉडरों की भर्ती के लिए व्यवस्थित अभियान चला रहा है ;
( vi ) गैर- बोडो लोगों में डर और असुरक्षा फैलाने के उद्देश्य से हत्याकाण्ड और नृजातीय हिंसा फैला रहा है जिसके परिणामस्वरूप असम के बोडो प्रभुत्व वाले क्षेत्रों में रह रहे गैर - बोडो लोगों की हत्या करना , उनकी सम्पत्ति को नष्ट करना आदि जैसी गतिविधियों में शामिल रहा है ;
(vii) अपने पृथकतावादी क्रियाकलापों को चलाने के लिए देश की सीमा से पार कैंपों और छिपने के ठिकानों की स्थापना कर रहा है;
और यतः केन्द्रीय सरकार की यह भी राय है कि हिंसक गतिविधियों में शामिल है :-
(i) 2008 में हिंसा की 168 घटनाएं हुईं जिनमें 63 आम नागरिक तथा 3 सुरक्षा बल कार्मिक मारे गए; तथा
(ii) 2010 (30 जून तक) में हिंसा की 74 घटनाएं हुईं जिनमें 13 आम नागरिक मारे गए ।
और यतः केन्द्रीय सरकार की यह भी राय है कि पूर्वोक्त कारणों से, एन.डी.एफ.बी. के क्रियाकलाप भारत की प्रभुता और अखण्डता के लिए हानिकर हैं और यह एक विधिविरुद्ध संगम है;
और यतः केन्द्रीय सरकार की यह भी राय है कि यदि एन.डी.एफ.बी. के विधिविरुद्ध क्रियाकलापों पर नियंत्रण नहीं लगाया जाता है तो संगठन पुनः नई भर्तियां कर सकता है , हिंसा , आतंकवादी और अलगाववादी क्रियाकलापों में लग सकता है, निधि आदि का संचय कर सकता है और निर्दोष नागरिकों तथा सुरक्षा बलों के कार्मिकों के जीवन के लिए खतरा पैदा कर सकता है; और इसलिए ऐसी परिस्थितियां विद्यमान हैं जिनसे एन.डी.एफ.बी. को तत्काल प्रभाव से, विधिविरुद्ध संगम घोषित किया जाना आवश्यक हो जाता है;

and executing its plans and activities ;
(v) embarking on a systematic drive for recruitment of fresh cadres with a viewto continuing its terrorist and insurgency activities ;
अतः , अब , केन्द्रीय सरकार, विधिविरुद्ध क्रियाकलाप ( निवारण) अधिनियम, 1967 ( 1967 का 37 ) की धारा 3 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , एतद्द्वारा नेशनल डेमाक्रेटिक फ्रंट ऑफ बोडोलैण्ड (एन. डी. एफ. बी. ) को विधिविरुद्ध संगम घोषित करती है ;
(vi) creating carnage and ethnic violence resulting in killings , destruction of property ofnon -Bodos inhabiting in Bodo dominated areas in Assam with a view to spreading panic and insecurity among non -Bodos ;
(vii) establish camps and hideouts across the Country'sborder to carry out its secessionist activities;
केन्द्रीय सरकार की यह भी राय है कि एन.डी.एफ.बी. को तत्काल प्रभाव से विधिविरुद्ध संगम घोषित किया जाना आवश्यक है और तदनुसार, केन्द्रीय सरकार , उक्त अधिनियम की धारा 3 की उप- धारा ( 3 ) के परंतुक द्वारा प्रदत्त शक्तियों का उपयोग करते हुए , यह निदेश देती है कि यह अधिसूचना किसी ऐसे आदेश के अधीन रहते हुए , जो उक्त अधिनियम की धारा 4 के अधीन किया जा सकेगा, सरकारी राजपत्र में इसके प्रकाशन की तारीख से प्रभावी होगी
And whereas the Central Government is further of the opinion that the violent activities of the NDFB include-

(i) killing of63 persons including 3 Security Force personnel in 168 incidents of violence in 2008 ; and

(ii) killing of 13 civilians in 74 incidents of violence in2010 (up to 30th June) .

And whereas the Central Government is also of the opinion that for the reasons aforesaid , the activities of the NDFB are detrimental to the sovereignty and integrity of India and that it is an unlawful association ;
S.O. 2826 (E) . Whereas the National Democratic Frontof Boroland (hereinafter referred to as NDFB ) has its professed aim , the " Liberation " of Boroland consisting largely ofBodo inhabited areas of Assam and to bring the secession of the said areas from India , in alliance with other armed secessionist organizations ofthe North East Region;
And whereas , the Central Government is of the opinion that the NDFB , has been :-
And whereas the Central Government is also of the opinion that unless the unlawful activities of the NDFB are kept under control , the organization may make fresh recruitments , indulge in violent , terrorist and secessionist activities, collect funds and endanger the lives of innocent citizens and security forces personnel ; and therefore , circumstances do exist which render it necessary to declare the NDFB as an unlawful association with immediate effect;
(i) indulging in illegal and violent activities intended to disrupt , or which disrupt , the sovereignty and territorial integrity of India in furtherance of its objective of achieving a separate Boroland;
Now, therefore, in exercise of the powers conferred by sub - section ( 1 ) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) , the Central Government hereby declares the National Democratic Front ofBoroland (NDFB) as an unlawful association;
(ii) aligning itself with other underground outfits of the North Eastern Region in furtherance of its objectives to create a separate Boroland ;
(iii) engaging in unlawful and violent activities thereby undermining the authority of the Government of India and the Government of Assam and spreading terror and panic among the people;
(iv) indulging in extortion of money from various sections of the society with a view to financing
The Central Government , is of further opinion that it is necessary to declare the NDFB to be an unlawful association with immediate effect and accordingly, in exercise ofpowers conferred by the proviso to sub - section (3) of section 3 of the said Act, the Central Government hereby directs that this notification shall , subject to any order that may be made under section 4 of the said Act, have effect from the date of its publication in the Official Gazette.
