सा.का.नि. 922(अ), वायुयान नियम, 1937 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप , जो केन्द्रीय सरकार, वायुयान अधिनियम , 1934 ( 1934 का 22 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बनाने का प्रस्ताव करती है , उक्त अधिनियम की धारा 14 की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और सूचना दी जाती है कि उक्त प्रारूप पर उस तारीख से जिसको भारत के राजपत्र में प्रकाशित अधिसूचना की प्रतियां जिसमें यह अधिसूचना प्रकाशित की जाती है , जनता को उपलब्ध करा दी जाती है , तीस दिन की अवधि के पश्चात् विचार किया जाएगा;
ऐसे आक्षेप या सुझाव पर, जो उक्त प्रारूप नियमों के संबंध में किसी भी व्यक्ति से विनिर्दिष्ट अवधि के अवसान से पूर्व प्राप्त हो सकेंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा;
अपत्तियां या सुझाव , यदि कोई हों, तो महानिदेशक नागर विमानन , सफदरजंग विमानपत्तन के सामने , नई दिल्ली-110003 को भेजें जा सकेंगे ।
प्रारूप नियम
1. ( 1 ) इन नियमों का नाम वायुयान ( संशोधन ) नियम, 2010 है।
(2 ) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त
होंगे ।

2. वायुयान नियम , 1937 ( इसमें इसके बाद उक्त नियम कहा गया है ) में नियम 39 ग के स्थान पर , निम्नलिखित नियम को प्रतिस्थापित किया जाएगा , नामशः :-
"39ग, चिकित्सक दृष्टया योग्यता निर्धारण और अनुज्ञप्तियों की वैधता की अवधि ( 1 ) चिकित्सक दृष्ट्या योग्यता निर्धारण और अनुज्ञप्तियों के विभिन्न प्रवर्गों के बारे में वैद्यता की अवधिनिम्नलिखित सारणी में, यथाविनिर्दिष्ट होगी , नामशः:-
अनुज्ञप्ति का प्रवर्ग
अनुज्ञप्ति की वैधता
चिकित्सक दृष्ट्या योग्यता निर्धारण कीवैधता

दो वर्ष ( i ) विमान सेवा परिवहन
पायलट अनुज्ञप्ति
(विमान या हेलीकॉप्टर )

चौबीस मास दस वर्ष ( iv ) प्राइवेट पायलट अनुज्ञप्ति (विमान या हेलीकॉप्टर ) , पायलट अनुज्ञप्ति ( हल्के वायुयान या ग्लाइडर या बैलून) , उड़ान रेडियो , दूरभाष प्रचालक अनुज्ञप्ति निर्बन्धित और उड़ान इंजीनियर अनुज्ञप्ति
(2) प्रारंभिक चिकित्सक दृष्टया योग्यता निर्धारण की वैधता की अवधि चिकित्सीय परीक्षा की तारीख से आरंभ होगी ।
(3) नवीकरण के मामले में, चिकित्सक दृष्ट्या योग्यता निर्धारण की वैधता की अवधि, पिछले चिकित्सक दृष्टया योग्यता निर्धारण की समाप्ति की तारीख से अगली तारीख से आरंभ होगी , बशर्ते कि नवीकरण हेतु चिकित्सीय परीक्षा की पिछली वैधता की समाप्ति की तारीख से पूर्ववर्ती एक माह से अनधिक अवधि के भीतर संचालित की गई हो ।
(4) उप-नियम ( 3 ) में उल्लिखित उन अतिरिक्त मामलों में, चिकित्सक दृष्ट्या योग्यता निर्धारण के नवीकरण की वैधता चिकित्सीय परीक्षा की तारीख से आरम्भ होगी ।
(5) उप - नियम ( 1 ) के तहत सरणी की मद ( i ) और ( ii ) केसामने विनिर्दिष्ट अनुज्ञप्तियों के संबंध में चिकित्सक दृष्ट्या योग्यता निर्धारण की वैधता की अवधि, अनुज्ञप्ति धारक के चालीस वर्ष की आयु प्राप्त करने के पश्चात् कम करके आधी कर दी जाएगी ।
(6) अनुज्ञप्ति की वैधता की अवधि अनुज्ञप्ति जारी करने की तारीख से आरंभ होगी ।
(7) नवीकरण के मामले में अनुज्ञप्ति की वैधता की अवधि, पिछली अनुज्ञप्ति की समाप्ति की तारीख से अगली तारीख से आरंभ होगी , बशर्ते कि नवीकरण हेतु पिछली वैधता की समाप्ति की तारीख से पूर्ववर्ती एक मास से अन्यून अवधि के भीतर आवेदन जमा कर दिया हो ।
(8) उप- नियम ( 7 ) में उल्लिखित उन अतिरिक्त मामलों में अनुज्ञप्ति के नवीकरण की वैधता , अनुज्ञप्ति के नवीकरण की तारीख से आरंभ होगी । "
3. उक्तनियमों की अनुसूची II में,-
(i) अनुभाग , ख, ग , घ, ङ, च , छ , ज, झ , ञ, ट, ड , द, प, फ, ब , भ , म, और य में पैरा 2 के स्थान पर निम्नलिखित पैरा प्रतिस्थापित किया जाएगा, नामशः :-
" 2. वैधता- अनुज्ञप्ति नियम 39 ग में विनिर्दिष्ट अवधि हेतु वैध होगी । "

( ii) ञ तथा ड़ अनुभागों में , पैरा 6 में, दूसरे और तीसरे उपबंध के बाद , क्रमशः निम्नलिखित उपबंध अन्तःस्थापित होगा, नामशः:-
" परंतु यह और भी कि पैंसठ वर्ष की आयु प्राप्त होने पर ऐसे विशेषाधिकार निजी पायलट अनुज्ञप्ति (विमानों) तक निर्बन्धित होंगे । "
(iii ) ट और ठ अनुभागों में, पैरा 6 में, तीसरे उपबंध के बाद निम्नलिखित उपबंध अंतःस्थापित होगा नामशः :-
" परंतु यह और भी कि पैंसठ वर्ष की आयु प्राप्त होने पर, ऐसे विशेषाधिकार निजी पायलट अनुज्ञप्ति ( हेलीकाप्टर ) तक निर्बन्धित होंगे । "
( iv ) ण, त , थ और द अनुभागों में , पैरा 2 के लिए , निम्नलिखित पैरा प्रतिस्थापित होगा , नामशः:-
" 2. वैधता ( क ) रेटिंग , रेटिंग जारी होने की तिथि से बारह मास की अवधि तक के लिए वैध होगी ।
(ख) नवीकरण के मामले में , रेटिंग की वैधता की अवधि, बारह मास की अवधि होगी जो पूर्व वैधता के समाप्त होने की तारीख के बाद की तारीख से प्रारंभ होगी बशर्ते कि नवीकरण के लिए समाप्ति की तारीख के एक माह के भीतर आवेदन प्रस्तुत किया हो और आवेदन करने की तारीख को नवीकरण हेतु अन्य सभी अपेक्षाएं पूर्ण हो रही हों ।
(ग) खंड ( ख ) में उल्लेखित मामलों के अलावा अन्य में, रेटिंग के नवीकरण की वैधता , रेटिंग के नवीकरण की तारीख से प्रारंभ होगी । "

टिप्पण:-मूल नियम सरकारी राजपत्र में दिनांक 23 मार्च, 1937 की अधिसूचना सं. वी 26 के द्वारा प्रकाशित किए गए थे और अंतिम संशोधन दिनांक 17 सितम्बर , 2010 के भारत के राजपत्र के भाग II , खंड 3 , उप - खंड ( i ) में प्रकाशित दिनांक 17 सितम्बर , 2010 की अधिसूचना सं. सा.का.नि. 766 ( अ ) द्वारा किया गया ।

G.S.R. 922 (E) .-The following draft of certain rules further to amend the Aircraft Rules , 1937 , which the Central Government proposes to make in exercise of the powers conferred by Section 5 of the Aircraft Act , 1934 (22 of 1934), is hereby published as required by Section 14 of the saidAct, for information of all persons likely to be affected thereby, and notice is hereby given that the said draft will be taken into consideration after a period of thirty days from the date on which copies of the Gazette of India in 3

which this notification is published , are made available to the public;
Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry ofthe period specified above, will be considered by the Central Government;
Objections or suggestions , if any, may be addressed to the Director General of Civil Aviation , Opposite SafdarjungAirport , New Delhi - 110003 .
DRAFT RULES
1. (1) These rules may be called the Aircraft (Amendment) Rules, 2010.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Aircraft Rules , 1937 (hereinafter referred to as the said rules), for rule 39C, the following rule shall be substituted, namely :-
"39C . Period of validity of medical fitness Assessment and Licences-( 1 ) The period of validity ofmedical fitness assessment and licence in respect of various categories shall be as specified in the following Table , namely :-

(iii) Student Pilot's Licence (acroplanes or helicop- ters or microlight aircraft or gliders or balloons ) , Student Flight Navigator's Licence, Student Flight Engineer's Licence and Student Flight Engineer's Licence.

(iv) Private Pilot's Licence (aeroplanes or helicopters) Pilot'sLicence (micro- light aircraft or gliders or balloons ) , Flight Radio Telephone Operator's Licence (Restricted) and Flight Engineer's Licence.
(2) Theperiod of validity ofthe initial medical fitness assessment shall commence from the date of the medical examination .
(3) In case of renewal; the period of validity of medical fitness assessment shall commence from the date following the date of expiry of the previous medical fitness assessment, subject to the condition that the medical examination for renewal has been conducted within a period of not more than one month preceding the date of expiry of the previous validity .
(4) In cases other than those referred to in sub - rule (3), the validity of the renewal of the medical fitness assessment shall commence from the date ofthe medical examination.
(5) The period of validity of medical fitness assessment in respect of the licences specified against items ( i) and ( ii) of the Table under sub- rule ( 1 ) shall be reduced to half after the holder ofthe licence has attained the age of forty years .
(6) The period of validity of a licence shall commence from the date of issue of the licence .
(7) In case of renewal , the period of validity of the licence shall commence from the date following the date of expiry of the previous validity of the licence , subject to the condition that the application for renewal has been submitted within a period of not more than one month preceding the date of expiry of the previous validity.
(8) In cases other than those referred to in sub - rule (7) , the validity of renewal of the licence shall commence from the date of renewal of the licence."
3. In Schedule II of the said rules , -
(i) in Sections B, C, D , E, F, G, H, I, J, K, M, N, U, V, W, X, Y and Z , for paragraph 2, the following paragraph shall be substituted, namely :--
" 2. Validity. The licence shall be valid for a period as specified in rule 39C. "
(ii) in Sections J and M, in paragraph 6, after the second and third proviso , respectively, the following proviso shall be inserted , namely :--- "Provided also that on attainment of the age of sixty - five years , such privileges shall be restricted to that of Private Pilot's Licence (Aeroplanes) . "
(iii) in Sections K and N, in paragraph 6, after the third proviso , the following proviso shall be inserted, namely :-
"Provided also that on attainment of the age of sixty - five years , such privileges shall be restricted to that of Private Pilot's Licence (Helicopters) . " 4

(iv) in Sections O , P, Q and R, for paragraph 2, the following paragraph shall be substituted , namely:-
"2. Validity.-( a) The rating shall be valid for a period of twelve months from the date of issue oftherating.
(b) In the case of renewal , the period of validity of the rating shall be for a period of twelve months which shall commence from the date following the date of expiry of the previous validity subject to the condition that the application for renewal has been submitted within one month preceding the date of expiry and all other requirements for renewal are met on the date of application.

(c) In cases other than those referred to in clause (b), the validity of renewal of the rating shall commence from the date of renewal of the rating."
