सा.का. नि. 936(अ).-राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय सचिवालय आशुलिपिक सेवा नियम , 2010 के नियम 9 के अनुसरण में निम्नलिखित विनियम बनाती हैं , अर्थात् :-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन विनियमों का संक्षिप्त नाम केन्द्रीय सचिवालय आशुलिपिक सेवा ( प्रधान कर्मचारिवृंद अधिकारी) विनियम, 2010 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पात्रता की शर्तें: - प्रधान कर्मचारिवृंद अधिकारी के पद पर प्रोन्नति के लिए पात्रता शर्त, चयन सूची वर्ष की 1 जुलाई को केन्द्रीय सचिवालय आशुलिपिक सेवा के ज्येष्ठ प्रधान निजी सचिव की श्रेणी में कम से कम पांच वर्ष की अनुमोदित सेवा होगी ।

परंतु यदि किसी चयन सूची वर्ष में रिक्तियों के विरुद्ध पर्याप्त अधिकारी उपलब्ध नहीं होते हैं तो ज्येष्ठ प्रधान निजी सचिव और प्रधान निजी सचिव की श्रेणी में दस वर्ष की सम्मिलित नियमित सेवा वाले ज्येष्ठ प्रधान निजी सचिव जिन्होंने कम से कम तीन वर्ष की सेवा ज्येष्ठ प्रधान निजी सचिव की श्रेणी में की हो , पात्र होंगे ।

3. रिक्तियों का अवधारण- चयन सूची वर्ष की नियमित रिक्तियां , नियमों के अनुसार कार्मिक और प्रशिक्षण विभाग द्वारा अवधारित की जाएंगी और यदि चयन एक से अधिक चयन सूची

वर्ष के लिए किया जाना है तो तद्‌नुसार रिक्तियां प्रत्येक चयन सूची वर्ष के लिए अवधारित की जाएंगी ।

4. चयन समिति का गठन ( 1) प्रधान कर्मचारिवृंद अधिकारी के पद पर नियुक्ति के लिए पात्र अधिकारियों के मामलों पर विचार करने के लिए और उपयुक्त सिफारिशें करने के लिए चयन समिति की संरचना निम्मानुसार होगी : -

-अध्यक्ष सचिव (कार्मिक)

(i)

-सदस्य स्थापन अधिकारी और अपर सचिव

(ii)

सदस्य (iii) केन्द्रीय सचिवालय आशुलिपिक सेवा का भारसाधक अपर सचिव/संयुक्त सचिव

-सदस्य (iv) संयुक्त सचिव

(2) चयन समिति, समय समय पर यथा संशोधित समूह ' क' केन्द्रीय सेवा के अकृत्यिक चयन श्रेणी से संबंधित विभागीय प्रोन्नति समिति के मार्गदर्शक सिद्धांतों को अंगीकृत करेगी ।

5. पैनलों को तैयार करना ( 1 ) चयन समिति, विनियम 3 में यथा अवधारित रिक्तियों पर चयन के लिए सामान्यतया प्रत्येक वर्ष बैठक करेगी ।

(2) चयन समिति, निम्नतर श्रेणी में चयनित अधिकारियों की ज्येष्ठता में क्रमांकित उनके नामों के पैनल की सिफारिश कर सकेगी ।

परंतु भिन्न भिन्न चयन सूची वर्ष की रिक्तियों के लिए पृथक पैनल तैयार किए जा सकेंगे और यदि किसी चयन सूची वर्ष की रिक्तियों के लिए चयन एक से अधिक अवसर पर किया जाता है तो ऐसे प्रत्येक अवसर पर एक पैनल (भाग) तैयार किया जाएगा ।

(3) किसी चयन सूची वर्ष की ऐसी रिक्तियां जो उपयुक्त/ पात्र अधिकारियों की अनुपलब्धता के कारण भरी नहीं जा सकी हैं अगले चयन सूची वर्ष के लिए अग्रनीत कर दी जाएंगी और प्रथम चयन सूची वर्ष के लिए चयन प्रक्रिया को पूर्ण हुआ समझा जाएगा ।

6. प्रधान कर्मचारिवृंद अधिकारी श्रेणी में नियुक्तियां (1 ) प्रधान कर्मचारिवृंद अधिकारी की श्रेणी में नियुक्तियां, नियुक्ति प्राधिकारी द्वारा ऐसे क्रम में की जाएंगी जिसमें चयन समिति द्वारा तैयार किए गए पैनल या पैनलों (भाग ) में अधिकारियों के नाम दर्शाए गए हैं ।

(2) पैनल या पैनलों (भाग) में सम्मिलित किया जाना, उस ग्रेड में नियुक्ति का कोई अधिकार प्रदत्त नहीं करेगा जो केवल नियमित रिक्ति की उपलब्धता के आधार पर किया जाएगा ।

7. पैनल से नाम का हटाया जाना निम्नलिखित प्रवर्गों के व्यक्तियों के नाम कार्मिक और प्रशिक्षण विभाग द्वारा चयन सूची से हटा दिए जाएंगे: -

(क) किसी अन्य सेवा या पदों पर अंतरित अधिकारी ।

(ख) ऐसे अधिकारी जिनकी मृत्यु हो गई है, सेवा से सेवानिवृत्त हो गए हैं या अन्यथा जिनकी सेवाएं समाप्त कर दी गई हैं ।

G.S.R. 936( E).-In exercise of the powers conferred by the proviso to article 309of the constitution and in pursuance of rule 9 of the Central Secretariat Stenographers ' Service Rules, 2010 , the President hereby makes the following regulations , namely:-

Short title and commencement.- ( 1)

1. These regulations may be called the Central Secretariat Stenographers ' Service Principal Staff Officer Regulations , 2010.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Conditions of eligibility.- Eligibility condition for promotion to the post of Principal Staff Officer shall be at least five years approved service in the grade of Senior Principal Private Secretary of Central Secretariat Stenographers' Service on the 1st July of the select list year :

Provided that , if sufficient officers are not available against the vacancies against a select list year , Senior Principal Private Secretary with 10 years combined regular service in the grade of Senior Principal Private Secretary and Principal Private Secretary out of which minimum three years shall be in the grade of Senior Principal Private Secretary would be eligible .

3. Determination of vacancy.- Regular vacancies for a select list year shail be determinedby Department of Personnel and Training as per rules and , if selection is to be made for more than one select list year , vacancies shall accordingly be determined for each select list year .

4. Constitution of Selection Committee . ( 1 ) The composition of the

Selection Committee to consider the cases of eligible officers for appointment to the post of Principal Staff Officer and to make suitable recommendations , shall be as follows : -

(iii)

Member

Additional Secretary/ Joint Secretary in charge of Central Secretariat Stenographers ' Service

(iv) JointSecretary Member

(2) The Selection Committee shall adopt the Departmental Promotion Committee guidelines relating to Non - Functional Selection Grade of Group 'A' Central Service as amended from time to time .

5. Preparation of panels.- ( 1 ) The selection committee shall normally meet every year for selection against vacancies as determined in regulation 3 .

(2) The selection committee may recommend a panel of names of selected officers arranged in the order of their seniority in the lower grade:

Provided that separate panels may be prepared for vacancies of different select list year and if selection for vacancies of any select list year is made on more than one occasion , on every such occasion a panel (part ) will be prepared.

(3) Vacancy for a select list year which may not be filled up , due to non- availability of suitable/eligible officers would be carried forward to the next select list year and the selection process for the first select list year shall be deemed to have been completed .

6. Appointments to the Principal Staff Officer grade.- ( 1 ) Appointments

to the grade of Principal Staff Officer shall be made by the appointing authority in the order in which the names of the officers appear in the panel or panel ( part ) prepared by the Selection Committee .

(2) Inclusion in the panel or panel ( part ) shall not confer any right to appointment to the grade , which will be made only upon availability of regular vacancy .

7 . Removal of name from the panel . The names of the persons of the following categories shall be removed by the Department of Personnel and Trainingfrom the select list : -

(a) Officers transferred to any other service or posts;

(b) Officers who die , retire from service or whose services are otherwise terminated .

3. रिक्तियों का अवधारण- चयन सूची वर्ष की नियमित रिक्तियां , नियमों के अनुसार कार्मिक और प्रशिक्षण विभाग द्वारा अवधारित की जाएंगी और यदि चयन एक से अधिक चयन सूची वर्ष के लिए किया जाना है तो रिक्तियां , तदनुसार प्रत्येक चयन सूची वर्ष के लिए अवधारित की जाएंगी ।

4. विभागीय प्रोन्नति समिति का गठन ( 1 ) ज्येष्ठ प्रधान निजी सचिव के पद पर नियुक्ति के लिए पात्र अधिकारियों के मामलों पर विचार करने के लिए और उपयुक्त सिफारिशें करने के लिए विभागीय प्रोन्नति समिति की संरचना निम्नानुसार होंगी : -

अध्यक्ष (i) अध्यक्ष या सदस्य, संघ लोक सेवा आयोग

(2) पैनल या पैनलों ( भाग ) में सम्मिलित किया जाना, उस श्रेणी में नियुक्ति का कोई अधिकार प्रदत्त नहीं करेगा जो केवल नियमित रिक्ति की उपलब्धता के आधार पर किया जाएगा ।

7. चयन सूची से नाम का हटाया जाना कार्मिक और प्रशिक्षण विभाग द्वारा निम्नलिखित प्रवर्गों के व्यक्तियों के नाम चयन सूची से हटा दिए जाएंगे: -

2. Conditions of eligibility. - Any regular officer of the Central Secretariat Stenographers ' Service , who on the 1st July of the select list year has rendered not less than five years' of approved service in the grade of Principal Private Secretary , shall be eligible .

3. Determination of vacancy.- Regular vacancies for a select list year shall be determined by the Department of Personnel and Training as per rules and , if the selection is to be made for more than one select list year , vacancies shall be determined separately for each select list year .

4. Constitution of Departmental Promotion Committee. ( 1 ) The composition of the Departmental Promotion Committee to consider the cases of eligible officers for appointment to the post of Senior Principal Private Secretary and to make suitable recommendations , shall be as follows : -

4. विभागीय प्रोन्नति समिति का गठन (1 ) संघ लोक सेवा आयोग के अध्यक्ष या जहां अध्यक्ष उपस्थित होने में असमर्थ है वहां आयोग का प्रतिनित्व करने वाला कोई अन्य सदस्य और निम्नलिखित अन्य सदस्यों को मिलाकर एक विभागीय प्रोन्नति समिति का गठन किया जाएगा : -

अध्यक्ष (i) संघ लोक सेवा आयोग का अध्यक्ष या सदस्य,

4. Constitution of Departmental Promotion Committee . ( 1 ) There shall be a Departmental Promotion Committee consisting of the Chairman of the Union Public Service Commission or , where the Chairman is unable to attend, any other Member of the Commission representing it and other Members as follows : -

5. Preparation of Panels.- (1) The Departmental Promotion Committee shall normally meet every year for selection against vacancies as determined inregulation 3 above .

(2) The Departmental Promotion Committee will recommend a panel of names of selected officers assigned in the order of their seniority in the lower grade:

(3) Vacancy for a select list year which may be filled up , due to non - availability of suitable/ eligible officers shall be carried forward to the next select list year and the selection process for the first select list year shall be deemed to have been completed .

6. Appointments to the Principal Private Secretary grade.-

(1) Appointments to the Principal Private Secretary grade shall be made by the appointing authority in the order in which the names of the officers appear in the panel or panel ( part) prepared by the Departmental Promotion Committee for the time being in force .

(2) Inclusion in the panel or panel ( part) shall not confer any right to appointment to the grade , which will be made only upon availability of regular vacancy .

7. Removal of name from the select list . The names of the persons of the following categories shall be removed by the Department of Personnel and Trainingfrom the select list : -

Officers appointed as Senior Principal Private Secretary .

Officers transferred to any other service or posts .

(b )

सा.का.नि. 939(अ).-राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय सचिवालय आशुलिपिक सेवा नियम , 2010 के नियम 10 के अनुसरण में निम्नलिखित विनियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ (1 ) इन विनियमों का संक्षिप्त नाम केन्द्रीय सचिवालय आशुलिपिक सेवा, निजी सचिव श्रेणी (ज्येष्ठता कोटा) के लिए पैनल या पैनलों (भाग) की तैयारी विनियम , 2010 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पात्रता की शर्तें: - केन्द्रीय सचिवालय आशुलिपिक सेवा का कोई ऐसा नियमितं पदधारी जिसने चयन सूची वर्ष की 1 जुलाई को निजी सचिव की श्रेणी में कम से कम पांच वर्ष की अनुमोदित सेवा की है, पात्र होगा ।

3. रिक्तियों का अवधारण- चयन सूची वर्ष की नियमित रिक्तियां , नियमों के अनुसार कार्मिक और प्रशिक्षण विभाग द्वारा अवधारित की जाएंगी और यदि चयन एक से अधिक चयन सूची वर्ष के लिए किया जाना है तो रिक्तियां, तदनुसार प्रत्येक चयन सूची वर्ष के लिए अवधारित की जाएंगी ।

4. विचार क्षेत्र का निर्धारण अवधारित रिक्तियों के अनुसार पात्र पदधारियों का विचार क्षेत्र कार्मिक और प्रशिक्षण विभाग द्वारा निर्धारित किया जाएगा और काडर इकाइयों को संसूचित किया जाएगा ।

5. विभागीय प्रोन्नति समिति का गठन (1 ) निजी सचिव श्रेणी में ज्येष्ठता कोटा के अधीन प्रोन्नति के लिए पात्र पदधारियों की उपयुक्तता का निर्धारण करने के लिए विभागीय प्रोन्नति समिति का गठन प्रत्येक काडर इकाई द्वारा किया जाएगा ।

(2) निजी सचिव के पद पर नियुक्ति के लिए पात्र पदधारियों के मामलों पर विचार करने और उपयुक्त सिफारिशें करने के लिए विभागीय प्रोन्नति समिति की संरचना निम्नानुसार होगी: -

(3) विभागीय प्रोन्नति समिति , केन्द्रीय सरकार द्वारा समय समय पर यथा अधिकथित मार्गदर्शक सिद्धांतों या अनुदेशों का अनुसरण करेगी ।

6. पैनलों को तैयार करना ( 1 ) विभागीय प्रोन्नति समिति, निजी सचिव की श्रेणी में प्रोन्नति के लिए पात्र पदधारियों का विचार करने के लिए वार्षिक रूप से बैठक करेगी ।

(2) काडर यूनिटें, विभागीय प्रोन्नति समिति द्वारा योग्य पाए गए या इससे अन्यथा पदधारियों के नामों को काडर प्राधिकारी को अग्रेषित करेगी, जो काडर इकाई विभागीय प्रोन्नति समिति द्वारा चयनित पदधारियों के नामों को, निम्नतर श्रेणी में उनकी सामान्य ज्येष्ठता सूची में ज्येष्ठता के क्रम में व्यवस्थित करके योग्य पाए गए पात्र पदधारियों में से पदधारियों का पैनल या पैनल ( भाग ) तैयार करेगी, परंतु भिन्न भिन्न चयन सूची वर्ष की रिक्तियों के लिए पृथक पैनल या पैनल (भाग) तैयार किए जाएंगे ।

(3 ) किसी चयन सूची वर्ष की ऐसी रिक्तियां जो उपयुक्त/ पात्र पदधारियों की अनुपलब्धता के कारण भरी नहीं जा सकी हैं, अगले चयन सूची वर्ष के लिए अग्रनीत कर दी जाएंगी और प्रथम चयन सूची वर्ष के लिए चयन प्रक्रिया को पूर्ण हुआ समझा जाएगा ।

7. निजी सचिव श्रेणी के लिए नियुक्तियां (1 ) निजी सचिव की श्रेणी में ज्येष्ठता कोटे की रिक्तियों के लिए नियुक्ति, सक्षम प्राधिकारी द्वारा ऐसे क्रम में की जाएंगी जिसमें काडर अधिकारी द्वारा तैयार किए गए पैनल या पैनलों (भाग) में पदधारियों के नाम दर्शाए गए हैं ।

(2) पैनल या पैनलों ( भाग ) में सम्मिलित किया जाना, उस श्रेणी में नियुक्ति का कोई अधिकार प्रदत्त नहीं करेगा क्योंकि नियुक्तियां केवल नियमित रिक्तियों की उपलब्धता के आधार पर ही की जाएंगी ।

8. चयन सूची से नाम का हटाया जाना कार्मिक और प्रशिक्षण विभाग द्वारा निम्नलिखित प्रवर्गों के व्यक्तियों के नाम चयन सूची से हटा दिए जाएंगे:-

(क) प्रधान निजी सचिव के रूप में नियुक्त अधिकारी ।

(ख) किसी अन्य सेवा या पदों पर स्थानांतरित अधिकारी ।

(ग) ऐसे अधिकारी जिनकी मृत्यु हो गई है, सेवा से सेवानिवृत्त हो गए हैं या अन्यथा

जिनकी सेवाएं समाप्त कर दी गई हैं ।

G.S.R. 939(E) .---In exercise of the powers conferred by the proviso to article 309 of the constitution and in pursuance of rule 10 of the Central Secretariat Stenographers ' Service Rules, 2010, the President hereby makes the following regulations, namely :-

1. Short title and commencement.- ( 1 ) These regulations may be called the Central Secretariat Stenographers ' Service preparation of the panel or panels (part) for the Private Secretary Grade (Seniority Quota ) Regulations , 2010.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Conditions of eligibility.-

Any regular official of the Central Secretariat Stenographers ' Service , who on the 1st July of the select list year haverendered not less than five years ' of approved service in the grade of Personal Assistant , shall be eligible.

4. Fixation of zone of consideration.- In accordance with the vacancies determined, a zone of consideration of eligible officials would be fixed by the Department of Personnel and Training and communicated to the cadre units .

5. (1) Constitution of Departmental Promotion Committee.- Departmental Promotion Committee for assessing the suitability of eligible officials for promotion under seniority quota in Private Secretary grade shall be constituted by each cadre unit .

(2) Thecomposition of the Departmental Promotion Committee to consider the cases of eligible officials for appointment to the post of Private Secretary and to make suitable recommendations , shall be as follows : -

(2) The cadre units shall forward the names of the officials found fit or otherwise by the Departmental Promotion Committee to the cadre authority, who shall prepare panel or panel (part ) of officials from the eligible officials found fit by , arranging the names of officials selected by the cadre unit Departmental Promotion Committee in the order of their seniority in the lower grade, provided that separate panel or panel (part ) shall be prepared for vacancies of different select list years .

(3) Vacancy for a select list year which could not be filled up due to non- availability of suitable/ eligible officials , shall be carried forward to the next select list year and the selection process for the first select list year would be deemed to have been completed .

7 . Appointments to the Private Secretary grade.- (1) Appointment to the vacancies of seniority quota in the grade of Private Secretary shall be made by the competent authority in the order in which the names of the officials appear in the panel or panel (part ) prepared by the cadre authority.

(2) Inclusion in the panel or panel ( part ) shall not confer any right to appointment to the grade as appointments will be made only upon the availability of regular vacancies .

8. Removal of name from the select list . - The names of the persons of the following categories shall be removed by the Department of Personnel and Trainingfrom the select list.-

2. परिभाषाएं: - (1 ) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, -

(क) " आयोग" से संघ लोक सेवा आयोग अभिप्रेत है ;

(ख) " कंप्यूटर साक्षरता " से ऐसा व्यक्ति अभिप्रेत है जो सरकार द्वारा समय समय पर यथा विनिर्दिष्ट कौशल आधारित सन्नियमों सहित किसी कम्प्यूटर पर अपने आशुलिपि टिप्पणों का प्रतिलेखन करने में समर्थ है ;

(ग) "निर्णायक तारीख " से उस चयन सूची वर्ष की 1 जुलाई अभिप्रेत है जिसके लिए परीक्षा का आयोजन किया गया है ।

(घ) " परीक्षा " से निजी सचिव श्रेणी की चयन सूची में परिवर्धन करने के लिए आयोग द्वारा आयोजित सीमित विभागीय प्रतिभोगी परीक्षा अभिप्रेत है ;

(ङ) " अनुसूचित जातियों " और " अनुसूचित अनुसूचित जनजातियों " का वही अर्थ होगा जो कमशः उनका भारत के संविधान के अनुच्छेद 366 के खंड (24) और खंड (25 ) में है।

(च) " चयन" से निजी सचिव श्रेणी की चयन सूची में सम्मिलित करना अभिप्रेत है ।

(2) अन्य सभी शब्दों और पदों का जो इन विनियमों में प्रयुक्त हैं और उसमें परिभाषित नहीं हैं किंतु केन्द्रीय सचिवालय आशुलिपिक सेवा नियम, 2010 में परिभाषित हैं वही अर्थ होगा जो क्रमशः उनका उक्त नियमों में है ।

3. परीक्षा का आयोजन -(1 ) आयोग द्वारा परीक्षा ऐसी रीति में आयोजित की जाएगी जो केन्द्रीय सरकार के कार्मिक और प्रशिक्षण विभाग द्वारा अधिसूचित की जाए ।

(2) वे तारीखें , जिसको और वे स्थान, जहां परीक्षा आयोजित की जाएगी , आयोग द्वारा निश्चित किए जाएंगे ।

4. पात्रता की शर्तें- केन्द्रीय सचिवालय आशुलिपिक सेवा का कोई ऐसा नियमित वैयक्तिक सहायक, जिसने निर्णायक तारीख को किसी मान्यता प्राप्त विश्वविद्यालय से स्नातक उपाधि प्राप्त की है और निम्नलिखित शर्तों को पूरा करता है, परीक्षा में सम्मिलित होने का पात्र होगा: -

(i ) सेवा कालः उसने उस श्रेणी में कम से कम तीन वर्ष की अनुमोदित और निरंतर सेवा की हो ।

परंतु यदि उसे प्रतियोगिता परीक्षा जिसमें सीमितः विभागीय प्रतियोगिता परीक्षा भी है, के परिणामों के आधार पर केन्द्रीय सचिवालय आशुलिपिक सेवा के वैयक्तिक सहायक के लिए नियुक्त किया गया है, तो ऐसी परीक्षा निर्णायक तारीख से कम से कम तीन वर्ष पूर्व आयोजित की गई होनी चाहिए और उसने उस श्रेणी में कम से कम दो वर्ष की अनुमोदित और निरंतर सेवा की हो ।

(ii) ऐसा वैयक्तिक सहायक , जो सक्षम प्राधिकारी के अनुमोदन से प्रतिनियुक्ति पर काडर बाह्य पदों पर है, परीक्षा में सम्मिलित होने के लिए पात्र होगा, यदि वह अन्यथा पात्र है ।

परंतु ऐसा वैयक्तिक सहायक जिसमें काडर बाह्य या अंतरण पर किसी अन्य सेवा के लिए नियुक्त किया गया है और जिसका वैयक्तिक सहायक के लिए धारणाधिकार नहीं है, परीक्षा में सम्मिलित होने का पात्र नहीं होगा ।

(iii) " कंप्यूटर साक्षरता " निजी सचिव श्रेणी में प्रोन्नति के लिए सीमित विभागीय प्रतियोगिता परीक्षा में सम्मिलित होने वाले किसी वैयक्तिक सहायक से कंप्यूटर पर अपने आशुलिपि टिप्पणों के प्रतिलेखन की अपेक्षा होगी ।

5. पात्रता के बारे में विनिश्चयः परीक्षा के लिए प्रवेश हेतु किसी अभ्यर्थी की पात्रता के बारे में या उससे अन्यथा आयोग का विनिश्चय अंतिम होगा और ऐसा कोई अभ्यर्थी जिसको आयोग द्वारा प्रवेश प्रमाण पत्र जारी नहीं किया गया है, परीक्षा में सम्मिलित नहीं होगा ।

6. परिणाम (1 ) ऐसे अभ्यर्थियों के नामों को जिन्हें आयोग द्वारा, विनियमों के प्रारंभ होने के पश्चात् आयोजित किसी परीक्षा के परिणामों के आधार पर चयन के लिए उपयुक्त माना गया है, योग्यता के क्रम में और विनियम 7 के उपविनियम (2) के उपबंधों के अधीन रहते हुए व्यवस्थित किया जाएगा और अपेक्षित संख्या तक उस क्रम में चयन के लिए उनकी सिफारिश की जाएगी ।

(2) आयोग, अनुसूचित जाति और अनुसूचित जनजाति के अभ्यर्थियों की दशा में अर्हता का स्तर तब शिथिल कर सकेगा जब इस निमित्त केन्द्रीय सरकार की विद्यमान नीति के अनुसार साधारण स्तर के आधार पर अपेक्षित संख्या में इन समुदायों के अभ्यर्थी उपलब्ध नहीं होते हैं ।

(3) प्रत्येक अभ्यर्थी को परीक्षा के परिणामों की संसूचना का प्ररूप और रीति का विनिश्चय आयोग द्वारा उसके विवेकानुसार किया जाएगा और आयोग परिणामों के संबंध में अभ्यर्थियों से पृथक रुप से कोई पत्राचार नहीं करेगा ।

7. चयन और नियुक्तियां (1 ) परीक्षा में सफलता तब तक चयन का अधिकार प्रदत्त नहीं करेगी जब तक काडर अधिकारी का ऐसी जांच करने के पश्चात्, जो वह आवश्यक समझे , यह समाधान नहीं हो जाता कि अभ्यर्थी, सेवा में उसके आचरण को ध्यान में रखते हुए चयन के लिए सभी प्रकार से उपयुक्त है ।

(2) उप विनियम (1 ) के अधीन रहते हुए सीमित विभागीय प्रतियोगिता परीक्षा के माध्यम से भरी जाने वाली निजी सचिव की रिक्तियों के लिए कोई नियुक्ति सक्षम प्राधिकारी द्वारा उपविनियम (6) के अनुसार तैयार केन्द्रीय सरकार के कार्मिक, लोक शिकायत और पेंशन मंत्रालय के कार्मिक और प्रशिक्षण विभाग द्वारा समय समय पर जारी अनुसूचित जाति और अनुसूचित जनजाति के अभ्यर्थियों के लिए आरक्षण के आदेश के अनुसार योग्यता के क्रम में व्यवस्थित सफल अभ्यर्थियों के पैनल के आधार पर की जाएगी ।

(3) किसी चयन सूची वर्ष के सीमित विभागीय प्रतियोगिता परीक्षा की ऐसी रिक्तियां , जो उपयुक्त अभ्यर्थियों की अनुपलब्धता के कारण भरी नहीं गई हैं, अगले चयन सूची वर्ष के लिए अग्रणीत कर दी जाएंगी और प्रथम चयन सूची वर्ष के लिए चयन प्रक्रिया को पूर्ण हुआ समझा जाएगा ।

8. अवचार के लिए शास्ति कोई अभ्यर्थी जिसे , आयोग द्वारा निम्नलिखित का दोषी घोषित किया है या किया जाता है--

(क) किन्हीं साधनों द्वारा अपनी अभ्यर्थिता के लिए समर्थन अभिप्राप्त करना ; या

(ख) प्रतिरूपण करना ; या

(ग) किसी व्यक्ति द्वारा प्रतिरूपण उपाप्त करना ; या

(घ) गढ़ा हुआ ऐसा दस्तावेज या ऐसे दस्तावेज प्रस्तुत करना जिन्हें बिगाड़ा गया है ; या (ङ) ऐसे कथन करना जो सही नहीं हैं या मिथ्या हैं या तात्विक जानकारी को छिपाना ;

(च) परीक्षा के लिए अपनी अभ्यर्थिता के संबंध में किसी अन्य अनियमित या अनुचित साधन का आश्रय लेना ; या

(छ) परीक्षा कक्ष में अनुचित साधनों का उपयोग करना ; या

(ज) परीक्षा कक्ष में कदाचार करना ; या

(झ) पूर्वगामी खंड़ों में विनिर्दिष्ट सभी या उनमें से किन्हीं कृत्यों को करने का प्रयास करना या करने के लिए दुष्प्रेरित करना,

वह आपराधिक अभियोजन का दायी होने के अतिरिक्त-

(i ) आयोग द्वारा उस परीक्षा से निरर्हित होने का दायी होगा जिसका वह अभ्यर्थी है ; या (ii ) स्थायी रूप से या किसी विनिर्दिष्ट अवधि के लिए- [PART II-SEC . 3 ( i) ] THE GAZETTE OF INDIA : EXTRAORDINARY

(क) आयोग द्वारा , उसके द्वारा आयोजित किसी परीक्षा या चयन से वर्जित होने का दायी होगा ;

(iii) समुचित नियमों के अधीन अनुशासनात्मक कार्रवाई का दायी होगा ।

2. Definitions.- (1 ) In these regulations , unless the context otherwise requires , -

"Commission " means the Union Public Service Commission ; (a)

(b) "computer literacy " means a person who shall be able to transcribe his/ her shorthand notes on a computer with the skill based norms as specified by the Government from time to time ;

(d) "examination " means a Limited Departmental Competitive Examination held by the Commission for making additions to the select list of Private Secretary grade ;

(e) "Scheduled Castes " and " Scheduled Tribes " shall have the same meanings as are assigned to them by clauses ( 24 ) and ( 25 ) respectively of article 366 of the Constitution of India ;

(f) "selection " means inclusion in the select list of Private Secretary grade .

(2) All other words and expressions used in these regulations and not defined herein but defined in the Central Secretariat Stenographers ' Service Rules , 2010 , shall have the meanings respectively assigned to them in the said rules .

3. Holding of the examination . (1) The examination shall be conducted by the Commission in the manner notified from time to time by the Central Government in the Department of Personnel and Training .

(2) The dates on which and the places at which the examination shall be held shall be fixed by the Commission .

4. Conditions of eligibility.- Any regular Personal Assistant of the Central Secretariat Stenographers ' Service who possess a bachelors degree from a recognised University , on the crucial date and satisfies the following conditions , shall be eligible to appear at the examination : -

(i ) Length of Service : He/ She should have rendered not less than three years ' of approved and continuous service in the grade:

Provided that if he/she had been appointed to the Personal Assistant of the Central Secretariat Stenographers ' Service on the results of the competitive examination including a Limited Departmental Competitive Examination , such an examination should have been held not less than three years before the crucial date and he/she should have rendered not less than two years approved and continuous service in that grade .

(ii ) Personal Assistants who are on deputation to ex - cadre posts with the approval of the competent authority shall be eligible to be admitted to the examination , if otherwise eligible:

Provided that the Personal Assistant who has been appointed to an ex - cadre post or to another service on ' transfer ' and does not have a lien in Personal Assistant shall not be eligible to be admitted to the examination .

( iii ) Computer Literacy : Any Personal Assistant appearing in the Limited Departmental Competitive Examination for promotion to Private Secretary grade shall be required to transcribe his shorthand notes on computers .

5. Decision as to eligibility. The decision of the Commission as to the eligibility or otherwise of a candidate for admission to the examination shall bé final and no candidate to whom a certificate of admission has not been issued by the Commission shall be admitted to the examination .

6. Results.- ( 1 ) The names of the candidates who are considered by the Commission to be suitable for selection on the results of any examination held after the commencement of these regulations shall be arranged in the order of merit and subject to the provisions of sub- regulation (2 ) of regulation 7 , and they shall be recommended for selection in that order upto the required number.

(2) The Commission may relax standard of qualification in case of the candidates belonging to the Scheduled Castes and the Scheduled Tribes, in case required number of the candidates from these communities are not available on the basis of general standard as per extant policy of the Central Government in this regard .

(3) The form and manner of communication of the results of the examination to the individual candidates shall be decided by the Commission In their discretion and the Commission shall not enter into any correspondence with individual candidates regarding the results .

7. Selection and appointments . - ( 1) Success in the examination shall confer no right to selection unless the cadre authority is satisfied , after such enquiry as may be considered necessary , that the candidate , having regard to his conduct in service , is suitable in all respects for selection .

(2) Subject to sub- regulation ( 1 ) , any appointment to the vacancies of Private Secretary to be filled through Limited Departmental Competitive Examination shall be made by the competent authority on the basis of the panel of successful candidates to be prepared as per regulation ( 6) and arranged in order of merit in accordance with the order on reservations for the candidates belonging to the Scheduled Castes and the Scheduled Tribes issued by the Central Government in the Department of Personnel and Training in the Ministry of Personnel , Public Grievances and Pensions , from time to time .

(3) Limited Departmental Competitive Examination vacancies for a select list year which are not filled up due to non - availability of suitable candidates shall be carried forward to the next select list year and the selection process for the first select list year would be deemed to have been completed .

8. Penalty for misconduct . Any candidate who is or has been declared by the Commission to be guilty of,

(a) obtaining support for his candidature by any means ; or

impersonating ; or (b)

(d) submitting fabricated documents or documents which have been tampered with ; or

(e) making statements which are incorrect or false , or suppressing material information ; or

(f) resorting to any other irregular or improper means in connection with his candidature for the examination ; or

(g) using unfair means in the examination hall ; or

(h) misbehaving in the examination hall ; or

(i) attempting to commit or , as the case may be , abetting the commission of all or any of the acts specified in the foregoing clauses ,

may , in addition to rendering himself liable to criminal prosecution , be liable

(i) to be disqualified by the Commission from the examination for which he is a candidate ; or

(ii) to be debarred either permanently or for a specified period 23

सा.का.नि. 941 (अ) .-राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय सचिवालय आशुलिपिक सेवा नियम , 2010 के नियम 11 के अनुसरण में निम्नलिखित विनियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ- ( 1 ) इन विनियमों का संक्षिप्त नाम केन्द्रीय सचिवालय आशुलिपिक सेवा, वैयक्तिक सहायक श्रेणी (ज्येष्ठता कोटा) के लिए पैनल या पैनलों ( भाग) की तैयारी विनियम, 2010 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पात्रता की शर्तें: - केन्द्रीय सचिवालय आशुलिपिक सेवा का कोई ऐसा नियमित पदधारी जिसने चयन सूची वर्ष की 1 जुलाई को आशुलिपिक श्रेणी " घ" की श्रेणी में कम से कम दस वर्ष की अनुमोदित सेवा की है, पात्र होगा ।

3. रिक्तियों का अवधारण चयन सूची वर्ष की नियमित रिक्तियां, नियमों के अनुसार कार्मिक और प्रशिक्षण विभाग द्वारा अवधारित की जाएंगी और यदि चयन एक से अधिक चयन सूची वर्ष के लिए किया जाना है तो रिक्तियां, तदनुसार प्रत्येक चयन सूची वर्ष के लिए अवधारित कीजाएंगी ।

4. विचार क्षेत्र का निर्धारण अवधारित रिक्तियों के अनुसार पात्र पदधारियों का विचार क्षेत्र कार्मिक और प्रशिक्षण विभाग द्वारा निर्धारित किया जाएगा और काडर इकाईयों को संसूचित किया जाएगा ।

5. विभागीय प्रोन्नति समिति का गठन (1 ) वैयक्तिक सहायक श्रेणी में ज्येष्ठता कोटा के अधीन प्रोन्नति के लिए पात्र पदधारियों की उपयुक्तता का निर्धारण करने के लिए विभागीय प्रोन्नति समिति का गठन केन्द्रीय सचिवालय आशुलिपिक सेवा नियम , 2010 की पहली अनुसूची के स्तंभ (2 ) में यथा विनिर्दिष्ट प्रत्येक काडर इकाई द्वारा किया जाएगा ।

करने और उपयुक्त सिफारिशें करने के लिए विभागीय प्रोन्नति समिति की संरचना निम्नानुसार होगी : -

(3) विभागीय प्रोन्नति समिति, केन्द्रीय सरकार द्वारा समय समय पर यथा अधिकथित मार्गदर्शक सिद्धांतों या अनुदेशों का अनुसरण करेगी ।

6. पैनलों को तैयार करना ( 1 ) विभागीय प्रोन्नति समिति, वैयक्तिक सहायक की श्रेणी में प्रोन्नति के लिए पात्र पदधारियों का विचार करने के लिए वार्षिक रूप से बैठक करेगी ।

(2) काडर यूनिटें, विभागीय प्रोन्नति समिति द्वारा योग्य पाए गए या इससे अन्यथा पदधारियों के नामों को काडर प्राधिकारी को अग्रेषित करेगी , जो काडर इकाई विभागीय प्रोन्नति समिति द्वारा चयनित पदधारियों के नामों को, निम्नतर श्रेणी में उनकी सामान्य ज्येष्ठता सूची में ज्येष्ठता के क्रम में व्यवस्थित करके योग्य पाए गए पात्र पदधारियों में से पदधारियों का पैनल या पैनल ( भाग) तैयार करेगी , परंतु भिन्न भिन्न चयन सूची वर्ष की रिक्तियों के लिए पृथक पैनल या पैनल ( भाग ) तैयार किए जाएंगे ।

(3) किसी चयन सूची वर्ष की ऐसी रिक्तियां जो उपयुक्त/ पात्र पदधारियों की अनुपलब्धता के कारण भरी नहीं जा सकी हैं, अगले चयन सूची वर्ष के लिए अग्रेषित कर दी जाएंगी और प्रथम चयन सूची वर्ष के लिए चयन प्रक्रिया को पूर्ण हुआ समझा जाएगा ।

7. वैयक्तिक सहायक श्रेणी के लिए नियुक्तियां ( 1 ) वैयक्तिक सहायक की श्रेणी में ज्येष्ठता - कोटे की रिक्तियों के लिए नियुक्ति, सक्षम प्राधिकारी द्वारा ऐसे क्रम में की जाएंगी जिसमें काडर अधिकारी द्वारा तैयार किए गए पैनल या पैनलों (भाग ) में पदधारियों के नाम दर्शाए गए हैं ।

(क) निजी सचिव के रूप में नियुक्त पदधारी ।

(ख) किसी अन्य सेवा या पदों पर स्थानांतरित पदधारी ।

G.S.R. 941 ( E) .-In exercise of the powers conferred by the proviso to article 309 of the constitution and in pursuance of rule 11 of the Central Secretariat Stenographers ' Service Rules, 2010 , the President hereby makes the following regulations , namely :-

1. Short title and commencement.- ( 1 ) These regulations may be called the Central Secretariat Stenographers ' Service preparation of the panel or panels (part) for the Personal Assistant grade (Seniority Quota ) Regulations , 2010 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Conditions of eligibility.- Any regular official of the Central Secretariat Stenographers' Service who , on the 1st July of the select list year has rendered not less than ten years ' of approved service in the grade of Stenographer Grade ' D ' , shall be eligible .

4. Fixation of zone of consideration.- In accordance with the vacancies determined , a zone of consideration of eligible officials shall be fixed by the Department of Personnel and Training and communicated to the cadre units .

5. Constitution of Departmental Promotion Committee.-

(1) Departmental Promotion Committee , for assessing the suitability of eligible officials for promotion under seniority quota in Personal Assistant grade shall be constituted by each cadre units as specified in column ( 2) of FirstSchedule of the Central Secretariat Stenographers ' Service Rules , 2010 .

(2) The composition of the Departmental Promotion Committee to consider the cases of eligible official for appointment to the post of Personal Assistant and to make suitable recommendations , shall be as follows : -

(3) instructions as laid down by the Central Government from time to time . TheDepartmental Promotion Committee shall follow the guidelines or

6. Preparation of Panels . ( 1 ) The Departmental Promotion Committee shall normally meet on annual basis for consideration of eligible officials for promotion to the grade of Personal Assistant .

(2) The cadre units shall forward the names of the officials found fit or otherwise by the Departmental Promotion Committee to the cadre authority, who shall prepare panel or panel ( part ) of officials from the eligible officials found fit , by arranging the names of officials selected by the cadre unit Departmental Promotion Committees in the order of their seniority in the lower grade , provided that separate panel or panel ( part ) shall be prepared for vacancies of different select list years .

(3) Vacancy for a select list year which may not be filled up due to non- availability of suitable/ eligible officials , shall be carried forward to the next select list year and the selection process for the first select list year shall be deemed to have been completed .

7. Appointments to the Personal Assistant grade.- ( 1 ) Appointment to the vacancies of seniority quota in the grade of Personal Assistant shall be made by the competent authority in the order in which the names of the officials appear in the panel or panel ( part ) prepared by the cadre authority.

(2) Inclusion in the panel or panel ( part ) shall not confer any right to appointment to the grade as appointments will be made only upon the availability of regular vacancies .

8. Removal of name from the select list.- The names of the persons of the following categories shall be removed by the Department of Personnel and Trainingfrom the select list : -

(a) Officials appointed as Private Secretary .

Officials transferred to any other service or posts .

(क) "कंप्यूटर साक्षरता " से ऐसा व्यक्ति अभिप्रेत है जो सरकार द्वारा समय समय पर यथा विनिर्दिष्ट कौशल परीक्षण सन्नियमों सहित किसी कम्प्यूटर पर अपने आशुलिपि टिप्पणों का प्रतिलेखन करने में समर्थ है ;

(ख) " निर्णायक तारीख " से उस चयन सूची वर्ष की 1 जुलाई अभिप्रेत है जिसके लिए परीक्षा का आयोजन किया गया है;

(ग) " परीक्षा " से सेवा की वैयक्तिक सहायक श्रेणी के लिए चयन सूची में परिवर्धन करने के लिए कर्मचारी चयन आयोग द्वारा आयोजित सीमित विभागीय प्रतियोगिता परीक्षा अभिप्रेत है ;

(घ) "नियमित रूप से नियुक्त आशुलिपिक श्रेणी घ" से केन्द्रीय सचिवालय आशुलिपिक सेवा नियम, 2010 में उपबंधित भर्ती के ढंगों के अनुसार श्रेणी में नियुक्त हुआ व्यक्ति अभिप्रेत है ;

(ङ) " अनुसूचित जातियों " और " अनुसूचित जनजातियों" का वही अर्थ होगा जो क्रमशः उनका भारत के संविधान के अनुच्छेद 366 के खंड (24) और खंड (25) में समनुदेशित है ।

(च) " चयन " से सेवा के वैयक्तिक सहायक के लिए चयन सूची में सम्मिलित करना अभिप्रेत है ।

(2) अन्य सभी शब्दों और पदों का जो इन विनियमों में प्रयुक्त हैं और उसमें परिभाषित नहीं हैं किंतु केन्द्रीय सचिवालय आशुलिपिक सेवा नियम, 2010 में परिभाषित हैं वही अर्थ होंगे जो क्रमशः उनका उक्त नियमों में है ।

3. परीक्षा का आयोजन (1) कर्मचारी चयन आयोग द्वारा ऐसी रीति में परीक्षा आयोजित की जाएगी जो केन्द्रीय सरकार के कार्मिक और प्रशिक्षण विभाग द्वारा समय समय पर अधिसूचित की जाए ।

(2) वे तारीखें , जिसको और वे स्थान, जहां परीक्षा आयोजित की जाएगी, कर्मचारी चयन आयोग द्वारा नियत किए जाएंगे ।

4. पात्रता की शर्तें- सेवा का कोई ऐसा नियमित रूप से नियुक्त आशुलिपिक श्रेणी " घ" जो निम्नलिखित शर्तों को पूरा करता है परीक्षा में सम्मिलित होने का पात्र होगा: -

(क) सेवा कालः उसने निर्णायक तारीख को कम से कम छह वर्ष तक आशुलिपिक श्रेणी " घ" के रूप में अनुमोदित सेवा की हो ।

टिप्पणः ऐसा आशुलिपिक श्रेणी " घ " जो सक्षम प्राधिकारी के अनुमोदन से बाह्य काडर पद पर प्रतिनियुक्ति पर है और जो सेवा के आशुलिपिक श्रेणी " घ " में धारणाधिकार रखता है, यदि वह अन्यथा पात्र है परीक्षा में प्रवेश के लिए पात्र होगा ।

परंतु यदि किसी पदधारी को प्रतियोगिता परीक्षा जिसमें सीमित विभागीय प्रतियोगिता परीक्षा भी है , के परिणामों के आधार पर केन्द्रीय सचिवालय आशुलिपिक सेवा के श्रेणी " घ " के लिए नियुक्त किया गया था तो ऐसी परीक्षा के परिणाम निर्णायक तारीख से कम से कम छह वर्ष पूर्व घोषित हो गए हों और उस पदधारी की उस श्रेणी में पांच वर्ष से अन्यून अनुमोदित और निरंतर सेवा होनी चाहिए ।

(ख) कंप्यूटर साक्षरताः- वैयक्तिक सहायक में प्रोन्नति के लिए सीमित विभागीय प्रतियोगिता परीक्षा में सम्मिलित होने वाले किसी आशुलिपिक श्रेणी " घ " के लिए कंप्यूटर पर अपने आशुलिपि टिप्पणों का प्रतिलेखन करना अपेक्षित होगा ।

5. पात्रता के बारे में विनिश्चयः परीक्षा के लिए प्रवेश हेतु किसी अभ्यर्थी की पात्रता या अन्यथा के बारे में कर्मचारी चयन आयोग का विनिश्चय अंतिम होगा और ऐसा कोई अभ्यर्थी 29

जिसे कर्मचारी चयन आयोग द्वारा प्रवेश प्रमाण पत्र जारी नहीं किया गया है, परीक्षा में प्रवेश नहीं दिया जाएगा ।

6. परिणाम- ( 1 ) ऐसे अभ्यर्थियों के नामों को, जिन्हें कर्मचारी चयन आयोग द्वारा , इन विनियमों के प्रारंभ होने के पश्चात् आयोजित किसी परीक्षा के परिणामों के आधार पर चयन के लिए उपयुक्त माना गया है, योग्यता के क्रम में और विनियम 7 के उपविनियम (2) के उपबंधों के अधीन रहते हुए व्यवस्थित किया जाएगा और विनिश्चित की गई नियुक्तियों की संख्या तक उस क्रम में चयन के लिए उनकी सिफारिश की जाएगी ।

(2) कर्मचारी चयन आयोग , यदि इस विषय में केन्द्रीय सरकार की विद्यमान नीति के अनुसार साधारण स्तर के आधार पर अपेक्षित संख्या में इन समुदायों के अभ्यर्थी उपलब्ध नहीं होते हैं तो वह अनुसूचित जाति और अनुसूचित जनजाति से संबंधित अभ्यर्थियों की दशा में अर्हता के स्तर को तब शिथिल कर सकेगा ।

(3) अभ्यर्थियों को व्यक्तिगत रूप से परीक्षा के परिणामों की संसूचना का प्ररूप और रीति का विनिश्चय कर्मचारी चयन आयोग द्वारा उसके विवेकानुसार किया जाएगा और आयोग परिणामों के संबंध में अभ्यर्थियों से पृथक रुप से कोई पत्राचार नहीं करेगा ।

7. चयन और नियुक्तियां ( 1 ) परीक्षा में सफलता तब तक चयन का अधिकार प्रदत्त नहीं करेगी जब तक काडर प्राधिकारियों का, ऐसी जांच करने के पश्चात्, जो वह आवश्यक समझे , यह समाधान नहीं हो जाता है कि अभ्यर्थी, सेवा में उसके आचरण को ध्यान में रखते हुए चयन के लिए सभी प्रकार से उपयुक्त है ।

(2) उपरोक्त उप विनियम (1 ) के अधीन रहते हुए सीमित विभागीय प्रतियोगिता परीक्षा के माध्यम से भरी जाने वाली वैयक्तिक सहायक की रिक्तियों के लिए कोई नियुक्ति सक्षम प्राधिकारी द्वारा उपविनियम (6) के अनुसार तैयार की जाने वाली और केन्द्रीय सरकार द्वारा समय समय पर जारी इस निमित्त अनुसूचित जाति और अनुसूचित जनजाति के अभ्यर्थियों के लिए आरक्षण के आदेश के अनुसार योग्यता के क्रम में व्यवस्थित सफल अभ्यर्थियों के पैनल के आधार पर की जाएगी ।

(3) किसी चयन सूची वर्ष की सीमित विभागीय प्रतियोगिता परीक्षा की ऐसी रिक्तियां , जो उपयुक्त अभ्यर्थीयों की अनुपलब्धता के कारण भरी नहीं गई हैं, अगले चयन सूची वर्ष के लिए अग्रनीत कर दी जाएंगी और प्रथम चयन सूची वर्ष के लिए चयन प्रक्रिया को पूर्ण हुआ समझा जाएगा ।

8. अवचार के लिए शास्ति कोई अभ्यर्थी जिसे, कर्मचारी चयन आयोग द्वारा निम्नलिखित का दोषी घोषित किया जाता है या किया गया है-- 30

(क) किन्हीं साधनों द्वारा अपनी अभ्यर्थिता के लिए समर्थन अभिप्राप्त करना ; या

(ख) प्रतिरूपण करना ; या

(ग) किसी व्यक्ति द्वारा प्रतिरूपण उपाप्त करना ; या

(घ) गढ़ा हुआ ऐसा दस्तावेज या ऐसे दस्तावेज प्रस्तुत करना जिन्हें बिगाड़ा गया है ; या (ङ) ऐसे कथन करना जो सही नहीं हैं या मिथ्या है या तात्विक जानकारी को छिपाना ; या (च) परीक्षा के लिए अपनी अभ्यर्थिता के संबंध में किसी अन्य अनियमित या अनुचित साधन का आश्रय लेना ; या

(छ) परीक्षा कक्ष में अनुचित साधनों का उपयोग करना ; या

(ज) परीक्षा कक्ष में कदाचार करना ; या

(झ) पूर्वगामी खंड़ों में विनिर्दिष्ट सभी या उनमें से किन्हीं कृत्यों को करने का प्रयास करना या करने के लिए दुष्प्रेरित करना;

वह दांडिक अभियोजन का दांयी होने के अतिरिक्त-

(i) कर्मचारी चयन आयोग द्वारा उस परीक्षा से निरर्हित होने का दायी होगा जिसका वह अभ्यर्थी है ; या

( ii) स्थायी रूप से या किसी विनिर्दिष्ट अवधि के लिए-

(क) कर्मचारी चयन आयोग द्वारा , उसके द्वारा आयोजित किसी परीक्षा या चयन से विवर्जित होने का दायी होगा ;

(iii) समुचित नियमों के अधीन अनुशासनिक कार्रवाई का दायी होगा ।

(c) "examination " means a Limited Departmental Competitive Examination held by the Staff Selection Commission for making additions to the select list for Personal Assistant Grade of the service ;

(d) "regularly appointed Stenographer Grade D " means a appointed to the grade in accordance with the modes of the recruitment provided in the Central Secretariat Stenographers ' person Service Rules , 2010 .

(e) "Scheduled Castes" and Scheduled Tribes " shall have the meanings assigned to them in clause (24 ) and clause (25 ) respectively of article 366 of the Constitution of India ;

(f) "selection " means inclusion in the select list for the Personal Assistant of the service .

(2). All other words and expressions used in these regulations and not defined herein but defined in the Central Secretariat Stenographers ' Service Rules , 2010 , shall have the meanings respectively assigned to them in the said rules .

The examination shall 3. be Holding of the examination.- (1 ) conducted by the Staff Selection Commission in the manner notified from time to time by the Central Government in the Department of Personnel and Training.

(2) The dates on which and the places at which the examination shall be held shall be fixed by the Staff Selection Commission .

4. Conditions of eligibility.- ( 1 ) Any regularly appointed Stenographer Grade ' D ' of the Service who satisfies the following conditions shall be eligible to appear at the examination : -

(a) Length of service : He/She should have on the crucial date, rendered not less than six years ' approved service as Stenographer Grade 'D ' .

Note.- Stenographers Grade ' D ' who are on deputation to ex - cadre post with the approval of the competent authority , and those having a lien in Stenographer Grade ' D ' of the service will be eligible to be admitted to the examination , if otherwise eligible:

Provided that if the official had been appointed to Stenographer Grade ' D ' of the Central Secretariat Stenographers ' Service on the results of the Competitive Examination , including a Limited Departmental Competitive Examination , the results of such examination should have been announced not less than six years before the crucial date and the official should have rendered not less than five years ' approved and continuous service in that grade.

(b) Computer Literacy : Any Stenographer Grade ' D ' appearing in the Limited Departmental Competitive Examination for promotion to Personal Assistant shall be required to transcribe his/ her shorthand notes on computers.

5. Decision as to eligibility of a candidate.- The decision of the Staff Selection Commission as to the eligibility or otherwise of a candidate for admission to the examination shall be final and no candidate to whom a certificate of admission has not been issued by the Staff Selection Commission shall be admitted to the examination .

6. Results.- ( 1 ) the names of the candidates who are considered by the Staff Selection Commission to be suitable for selection on the results of the examination shall be arranged in the order of merit and , subject to the provisions of sub - regulation ( 2 ) of regulation 7 , and they shall be recommended for selection in that order upto the number of appointments decided to be made .

(2) The Staff Selection Commission may relax standard of qualification in case of the candidates belonging to the Scheduled Castes and the Scheduled Tribes, in case required number of the candidates from these communities are not available on the basis of general standard as per extant policy of Central Government in this regard .

(3) The form and manner of communication of the results of the examination to the individual candidates shall be decided by the Staff Selection Commission in their discretion and the said Commission shall not enter into any correspondence with individual candidates regarding the results .

7. Selection and appointments.- ( 1 ) Success in the examination shall confer no right to selection unless the cadre authorities are satisfied , after such enquiry as may be considered necessary , that the candidate, having regard to his / her conduct in service , is suitable in all respects for selection .

(2) Subject to sub - regulation ( 1 ) above , appointment to the vacancies of Personal Assistant to be filled through Limited Departmental Competitive Examination shall be made by the competent authority on the basis of the panel of successful candidates to be prepared as per regulation ( 6) and arranged in order of merit , subject to the reservations for the candidates belonging to the Scheduled Castes and the Scheduled Tribes in accordance with the orders issued by the Central Government from time to time , in this behalf.

8. Penalty for misconduct . Any candidate who is or has been declared by the Staff Selection Commission to be guilty of, -

(a) obtaining support for his candidature by any means ; or

(b) impersonating ; or

(d) submitting fabricated documents or documents which have been tampered with ; or

(e) making statements which are incorrect or false , or suppressing material information ; or

(f) resorting to any other irregular or improper means in connection with his/ her candidature for the examination ; or

using unfair means in the examination hall ; or

(g) (h) misbehaving in the examination hall ; or

(i) attempting to commit , or as the case may be , abetting the Commission of all or any of the acts specified in the foregoing clauses ;

may in addition to rendering himself liable to criminal prosecution , be liable-

(i) to be disqualified by the Staff Selection Commission from the examination for which he is a candidate ; or

(ii) to be debarred either permanently or for a specified period-

(a) by the Staff Selection Commission from any examination or selection held by them;

(b) by the Central Government from any employment under them;

(iii) to disciplinary action under the appropriate rules .

सा.का.नि. 943(अ).-राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय सचिवालय आशुलिपिक सेवा नियम, 2010 के नियम 12 के अनुसरण में निम्नलिखित विनियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ (1 ) इन विनियमों का संक्षिप्त नाम केन्द्रीय सचिवालय आशुलिपिक सेवा आशुलिपिक श्रेणी " घ " (प्रतियोगिता परीक्षा) विनियम, 2010 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएं: - ( 1 ) इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो , -

(क) " उपलब्ध रिक्तियां " से सेवा के आशुलिपक श्रेणी " घ " की रिक्तियां अभिप्रेत हैं, जिन्हें किसी परीक्षा के परिणामों पर भरा जाना विनिश्चित किया गया है ;

(ख ) " आयोग " से कर्मचारी चयन आयोग अभिप्रेत है ;

(ग) " कंप्यूटर साक्षरता " से ऐसा व्यक्ति अभिप्रेत है जो केन्द्रीय सरकार द्वारा समय समय पर यथा विनिर्दिष्ट कौशल परिक्षण सन्नियमों सहित किसी कम्प्यूटर पर अपने आशुलिपि टिप्पणों का प्रतिलेखन करने में समर्थ है ;

(घ) " परीक्षा " से इन विनियमों के अनुसार आशुलिपक श्रेणी " घ " की श्रेणी में सीधे भर्ती के लिए कर्मचारी चयन आयोग द्वारा आयोजित प्रतियोगिता परीक्षा अभिप्रेत है ;

(ङ) भूतपूर्व सैनिक से ऐसा व्यक्ति अभिप्रेत है जिसने संघ के सशस्त्र बलों में किसी रैंक पर (चाहे योधक है या नहीं) कम से कम छह मास की निरंतर अवधि तक सेवा की है और जिसे अवचार या अधमता के कारण पदच्युति या सेवोन्मुक्ति से अन्यथा निर्मुक्त किया गया है, या जिसे ऐसी नियुक्ति के लंबित रहने तक रिजर्व में स्थानांतरित कर दिया गया है, या जिसने ऐसी सेवा की अवधि को पूरा करने के लिए, जो यथापूर्वोक्त निर्मुक्ति या रिजर्व में स्थानांतरित होने का हकदार बनाने के लिए अपेक्षित है छह मास से अनधिक की सेवा की है ।

स्पष्टीकरण : इस खंड के प्रयोजन के लिए " संघ के सशस्त्र बल " से संघ की नौसेना, सेना या वायुसेना अभिप्रेत है और जिसमें भूतपूर्व भारतीय राज्यों के सशस्त्र बल सम्मिलित हैं ।

(च) "अनुसूचित जातियों " और " अनुसूचित जनजातियों" के वही अर्थ होंगे जो क्रमशः उनका भारत के संविधान के अनुच्छेद 366 के खंड (24) और खंड (25) में समनुदेशित है ।

(2) अन्य सभी शब्दों और पदों का जो इन विनियमों में प्रयुक्त हैं और उसमें परिभाषित नहीं हैं किंतु केन्द्रीय सचिवालय आशुलिपिक सेवा नियम, 2010 में परिभाषित हैं, वही अर्थ होंगे जो क्रमशः उनका उक्त नियमों में है ।

3. परीक्षाओं का आयोजन (1) केन्द्रीय सरकार के, कार्मिक, लोक शिकायत और पेंशन मंत्रालय के कार्मिक और प्रशिक्षण विभाग द्वारा समय समय पर अधिसूचित रीति में कर्मचारी चयन आयोग द्वारा परीक्षा संचालित की जाएगी ।

(2) तारीखें जिसको और वह स्थान जहां परीक्षा आयोजित की जाएगी, कर्मचारी चयन आयोग द्वारा नियत किए जाएंगे ।

4. पात्रता की शर्तें- परीक्षा में भाग लेने का पात्र होने के लिए अभ्यर्थी को निम्नलिखित शर्तों को अवश्य पूरा करना चाहिए , अर्थात् : -

(i ) राष्ट्रीयता

(क) उसे भारत का नागरिक होना चाहिए ,

या

(ख) उसे व्यक्तियों के ऐसे प्रवर्गों से संबंधित होना चाहिए जो केन्द्रीय सरकार में कार्मिक, लोक शिकायत और पेंशन मंत्रालय के कार्मिक और प्रशिक्षण विभाग द्वारा समय- समय पर इस निमित्त अधिसूचित किया जा सके ।

(ii) आयु : वह 18 वर्ष की आयु प्राप्त कर चुका हो और उस वर्ष जिसमें परीक्षा आयोजित की गई है, के 1 अगस्त को 27 वर्ष की आयु प्राप्त नहीं करनी चाहिए :

परंतु केन्द्रीय सरकार द्वारा समय- समय पर जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और व्यक्तियों के अन्य विशेष प्रवर्गों के अभ्यर्थियों की दशा में ऊपरी आयु सीमा में शिथिलता दी जा सकेगी ।

(iii) शैक्षिक अर्हताएं वह किसी केन्द्रीय अधिनियम या प्रांतीय अधिनियम या राज्य अधिनियम के द्वारा या उसके अधीन स्थापित या निगमित किसी बोर्ड या विश्वविद्यालय की 10+2 परीक्षा अवश्य उत्तीर्ण हो, या अन्यथा केन्द्रीय सरकार द्वारा इसके समतुल्य मान्यता प्राप्त कोई अन्य अर्हता रखता हो; और 36

(iv) कंप्यूटर साक्षरता आशुलिपिक श्रेणी " घ " परीक्षा में सम्मिलित अभ्यर्थियों को कंप्यूटर पर अपने आशुलिपिक- टिप्पण के प्रतिलेखन की अपेक्षा होगी ।

(v) फीस ऐसी रियायतों की छूटों के अध्यधीन जो समय समय पर भारत सरकार में कार्मिक, लोक शिकायत और पेंशन मंत्रालय के कार्मिक और प्रशिक्षण विभाग द्वारा इस निमित्त अधिसूचित की जा सकें, अभ्यर्थी कर्मचारी चयन आयोग द्वारा यथा विनिर्दिष्ट ऐसी फीस का संदाय करेगा ।

5. पात्रता के बारे में विनिश्चयः परीक्षा में प्रवेश के लिए किसी अभ्यर्थी की पात्रता या अन्यथा के बारे में कर्मचारी चयन आयोग का विनिश्चय अंतिम होगा और कोई ऐसा अभ्यर्थी जिसका प्रवेश प्रमाणपत्र कर्मचारी चयन आयोग द्वारा नहीं जारी किया गया है , परीक्षा में सम्मिलित नहीं होगा ।

6. परिणाम- (1 ) ऐसे अभ्यर्थी के नाम जिन पर कर्मचारी चयन आयोग द्वारा परीक्षा के परिणामों पर नियुक्ति के लिए उपयुक्त होने के लिए विचार किया जाता है, उन्हें योग्यता के क्रम में व्यवस्थित किया जाएगा और विनियम 7 के उपविनियम (5) के खंड ( क) और खड (ख ) के उपबंधों के अध्यधीन तथा उनकी नियुक्तियों के लिए उस क्रम में विनिश्चित की गई नियुक्तियों की संख्या तक सिफारिश की जाएगी ।

(2) व्यष्टिक अभ्यर्थियों को परीक्षा के परिणामों की संसूचना का प्ररूप और रीति को कर्मचारी चयन आयोग द्वारा उनके विवेकानुसार विनिश्चित किया जाएगा जो परिणामों के संबंध में व्यष्टिक अभ्यर्थियों से कोई पत्र व्यवहार नहीं करेगा ।

7. नियुक्तियां ( 1 ) परीक्षा में सफलता , सेवा के आशुलिपिक समूह " घ " में नियुक्ति के लिए कोई अधिकार प्रदत्त नहीं करेगी जब तक कि केन्द्रीय सरकार का ऐसी जांच के पश्चात् जिसे वह आवश्यक समझे समाधान नहीं हो जाता है कि अभ्यर्थी सेवा में अपनी नियुक्ति मे लिए अपने चरित्र और पूर्ववृत्त को ध्यान में रखते हुए सभी प्रकार से उपयुक्त हैं ।

(2) कोई अभ्यर्थी सेवा के श्रेणी " घ " में तब तक नियुक्त नहीं किया जाएगा जब तक कि वह ऐसी चिकित्सीय जांच जिसे केन्द्रीय सरकार विहित कर सके, के पश्चात् किसी मानसिक या शारीरिक त्रुटि से मुक्त पाया गया हो जिससे सेवा के कर्तव्यों के निर्वहन में व्यवधान उत्पन्न होने की संभावना हो ।

(3) वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या 37

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा परंतु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

(4) उपविनियम (5) में यथा उपबंधित के सिवाय , केन्द्रीय सरकार में कार्मिक लोक शिकायत और पेंशन मंत्रालय के कार्मिक और प्रशिक्षण विभाग द्वारा समय समय पर जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों से संबंधित अभ्यर्थियों और भूतपूर्व सैनिकों के अभ्यर्थियों के लिए आरक्षणों के अध्यधीन, नियुक्ति के लिए कर्मचारी चयन आयोग द्वारा सिफारिश किए गए अभ्यर्थियों की योग्यता के क्रम में किसी परीक्षा के परिणामों पर सेवा के श्रेणी ' घ ' पर नियुक्तियों को उपलब्ध रिक्तियों की सीमा तक किया जाएगा ।

(5 ) ( क) किसी अनुसूचित जाति, अनुसूचित जनजाति या अन्य पिछड़े वर्गों के अभ्यर्थियों के संबंध में उस सीमा तक जिस तक अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों के लिए आरक्षित रिक्तियों की संख्या को साधारण मानक के आधार पर नहीं भरा जा सकता है, परीक्षा में योग्यता के क्रम में उनके रैंकों पर ध्यान दिए बिना सेवा में चयन के लिए इन अभ्यर्थियों की उपयुक्तता के अधीन रहते हुए कर्मचारी चयन आयोग द्वारा आरक्षित कोटा में कमी को पूरा करने केलिए शिथिल किए गए मानक के आधार पर सिफारिश की जाएगी ।

( ख) भूतपूर्व सैनिक जिन पर परीक्षा के परिणामों पर नियुक्ति के लिए कर्मचारी चयन आयोग द्वारा विचार किया जाता है, परीक्षा पर योग्यता के क्रम में उनके रैंक को ध्यान दिए बिना उनके लिए आरक्षित रिक्तियों पर वे नियुक्ति के लिए पात्र होंगे :

परंतु किसी अनुसूचित जाति, अनुसूचित जनजाति या अन्य पिछड़े वर्गों के भूतपूर्व सैनिकों के संबंध में उस सीमा तक जिस तक अनुसूचित जातियों और अनुसूचित जनजातियों और अन्य पिछड़े वर्गों के लिए आरक्षित रिक्तियों को साधारण मानक के आधार पर नहीं भरा जा सकता है, परीक्षा में योग्यता के क्रम में उनके रैंकों पर ध्यान दिए बिना सेवा में चयन के लिए इन भूतपूर्व सैनिकों की उपयुक्तता के अधीन रहते हुए कर्मचारी चयन आयोग द्वारा आरक्षित कोटा में कमी को पूरा करने के लिए शिथिल किए गए मानक के आधार पर सिफारिश की जा सकेगी:

परंतु यह और कि किसी एक भर्ती वर्ष में अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों और भूतपूर्व सैनिकों के लिए एक साथ आरक्षित रिक्तियों की कुल संख्या उस वर्ष में भरी जाने वाली रिक्तियों के 50 प्रतिशत से अधिक नहीं होगी ।

[PART II-SEC . 3 (1) ] 8. अवचार के लिए शास्ति- कोई अभ्यर्थी जिसे , आयोग द्वारा निम्नलिखित का दोषी घोषित किया जाता है या किया गया है--

(क) किन्हीं साधनों द्वारा अपनी अभ्यर्थिता के लिए समर्थन अभिप्राप्त करना ; या

(ख) प्रतिरूपण करना ; या

(ग) किसी व्यक्ति द्वारा प्रतिरूपण उपाप्त करना ; या

(घ) गढ़ा हुआ ऐसा दस्तावेज या ऐसे दस्तावेज प्रस्तुत करना जिन्हें बिगाड़ा गया है ; या (ङ) ऐसे कथन करना जो सही नहीं हैं या मिथ्या हैं या तात्विक जानकारी को छिपाना ; या (च) परीक्षा के लिए अपनी अभ्यर्थिता के संबंध में किसी अन्य अनियमित या अनुचित साधन का आश्रय लेना ; या

(छ) परीक्षा भवन में अनुचित साधनों का उपयोग करना ; या

(ज) परीक्षा भवन में कदाचार करना ; या

वह आपराधिक अभियोजन का दायी होने के अतिरिक्त -

(i ) कर्मचारी चयन आयोग द्वारा उस परीक्षा से निरर्हित होने का दायी होगा जिसका वह अभ्यर्थी है ; या

( ii) स्थायी रूप से या किसी विनिर्दिष्ट अवधि के लिए-

(क) कर्मचारी चयन आयोग द्वारा , उसके द्वारा आयोजित किसी परीक्षा या चयन से वर्जित होने का दायी होगा;

( iii ) समुचित नियमों के अधीन अनुशासनात्मक कार्रवाई का दायी होगा ।

G.S.R. 943 ( E) .-In exercise of the powers conferred by the proviso to article 309 of the constitution and in pursuance of rule 12 of the Central Secretariat Stenographers ' Service Rules, 2010 , the President hereby makes the following regulations , namely :-

1. Short Title and Commencement.- ( 1 ) These regulations may be called the Central Secretariat Stenographers ' Service Examination ) Regulations , 2010 . Grade 'D' (Competitive

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Definition.- ( 1 ) In these regulations , unless the context otherwise requires , -

(a) "available vacancies " means the vacancies of Stenographer Grade ' D ' of the service which are decided to be filled on the results of an examination;

(b) "Commission " means the Staff Selection Commission ;

(c) "computer literacy " means a person shall be able to transcribe his/her shorthand notes on a computer with the skill test norms as specified by the Government from time to time ;

(d) "examination " means a competitive examination held by the Staff Selection Commission for direct recruitment to the grade of Stenographer Grade ' D ' of the service in accordance with these regulations;

(e) "ex- serviceman " means a person who has served in any rank (whether as a combatant or not ) in the Armed Forces of the Union for a continuous period of not less than six months and who has been released otherwise than by way of dismissal or discharge on account of misconduct or inefficiency , or has been transferred to the reserve pending such release , or has to serve for not more than six months for completing the period of service requisite for becoming entitled to be released or transferred to the reserve as aforesaid .

EXPLANATION . For the purpose of this clause , "Armed Forces of the Union " means the Naval , Military or Air Force of the Union and includes the Armed Forces of the former Indian States;

(f) "Scheduled Castes " and "Scheduled Tribes " shall have the meanings assigned to them by clauses ( 24 ) and ( 25 ) respectively of article 366 of the Constitution of India .

(i) Nationality :

he must be a citizen of India ;

(a)

(b) he must belong to such categories of persons as may from time to time, be notified in this behalf by the Central Government in the Department of Personnel and Training in the Ministry of Personnel , Public Grievances and Pensions ;

(ii) Age : He must have attained the age of 18 years and must not have attained the age of 27 years on the 1st day of August of the year in which the examination is held :

Provided that the upper age limit may be relaxed in the case of the candidates belonging to the Scheduled Castes , the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time ;

(iii ) Educational qualifications : He must have passed the 10+ 2 Examination of a Board or University of an established or incorporated by or under Central Act or a Provincial Act or a State Act or otherwise possess any qualification recognised by the Central Government as equivalent thereto ; and

(iv) Computer literacy : Candidates appearing in the Steno Grade 'D' Examination shall require to transcribe their shorthand notes on computers;

(v) Fees :

Subject to such exemptions of concessions or both , as may be notified in this behalf by the Government of India in the Department of Personnel and Training , Ministry of Personnel , Public Grievances and Pensions from time to time , the candidate shall pay such fees as specified by the Staff Selection Commission .

Appointments.- ( 1 ) Success at the examination shall confer no right to appointment to the Stenographers' Grade ' D ' of the service unless the Central Government is satisfied after such enquiry as may be considered necessary , that the candidate , having regard to his character and antecedents , is suitable in all respects , for appointment to the service .

(2) No candidate shall be appointed to Grade ' D' of the service unless he is , after such medical examination as the Central Government may prescribe , found to be free from any mental or physical defect which is likely to interfere with the discharge of the duties of the service .

(3) No person-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the service:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing exempt any person from the operation of these regulations .

(4) Save as provided in sub - regulation ( 5 ) , appointments to Grade ' D' of the Service on the results of any examination shall be made to the extent of the available vacancies , in the order of merit of the candidates recommended by the Staff Selection Commission for appointment , subject to the reservations for the candidates belonging to the Scheduled Castes , the Scheduled Tribes , Other Backward Classes and for the ex - Servicemen in accordance with the orders issued from time to time by the Central Government in the Department of Personnel and Training in the Ministry of Personnel , Public Grievances and Pensions in this behalf.

(5) (a) Candidates belonging to any of the Scheduled Castes, the Scheduled Tribes or the Other Backward Classes may, to the extent the number of vacancies reserved for the Scheduled Castes , the Scheduled Tribes and the Other Backward Classes cannot be filled on the basis of the general standard, be recommendedby the Staff Selection Commission by a relaxed standard to make up the deficiency in the reserved quota , subject to the fitness of these candidates for selection to the service, irrespective of their ranks in the order of merit at the examination .

(b) Ex - servicemen who are considered by the Staff Selection Commission to be suitable for appointment on the results of the examination shall be eligible to be appointed to the vacancies reserved for them irrespective of their ranks in the order of merit at the examination:

Provided that ex - servicemen belonging to any of the Scheduled Castes , the Scheduled Tribes or Other Backward Classes may , to the extent the number of vacancies reserved for the Scheduled Castes , the Scheduled Tribes or the Other Backward Classes cannot be filled on the basis of the general standard, be recommended by the Staff Selection Commission by a relaxed standard to make up the deficiency in the quota reserved for them out of the quota of vacancies reserved for ex- servicemen , subject to the fitness of these candidates for selection to the service irrespective of their ranks in the order of merit at the examination:

Provided further that in any one recruitment year , the total number of the vacancies reserved for , the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes and ex - servicemen taken together shall not exceed 50% of the vacancies to be filled in that year .

6. Penalty for misconduct. Any candidate who is or has been declared by the Staff Selection Commission to be guilty of ,

(a) obtaining support for his candidature by any person ; or

impersonating ; or (b)

submitting fabricating documents or documents which have been (d) tampered with ; or

(e) making statements which are incorrect or false , or suppressing material information ; or

(f) resarting to any other irregular or improper means in connection with hiscandidature for the examination ; or

(g) using unfair means in the examination hall ; or

(h) misbehaving in the examination hall ; or

(i) attempting to commit or , as the case may be , abetting the Commission of all or any of the acts specified in the foregoing clauses ,

may, in addition to rendering himself liable to criminal prosecution ,be liable-

(i ) to be disqualified by the Staff Selection Commission from the examination for which he is a candidate ; or

(ii) to be debarred either permanently or for a specified period-

(a) by the Staff Selection Commission from any examination for selection held by them ;

(b) by the Central Government from any employment under them; and

(iii) if he is already in service under the Central Government to disciplinary action under the appropriate rules.

सा.का.नि. 944(अ).-राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय सचिवालय आशुलिपिक सेवा नियम , 2010 के नियम 4 के अनुसरण में निम्नलिखित विनियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ (1 ) इन विनियमों का संक्षिप्त नाम केन्द्रीय सचिवालय आशुलिपिक सेवा (सामान्य ज्येष्ठता सूची तैयार करना) विनियम , 2010 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएं : - ( 1 ) इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, -

(क) " सामान्य ज्येष्ठता सूची " से किसी श्रेणी के संबंध में किसी वर्ष के 1 जुलाई को यथाविद्यमान उस श्रेणी में कार्य कर रहे अधिकारियों की ज्येष्ठता सूची अभिप्रेत है और जिसे इन विनियमों के अनुसार पुनरीक्षित किया गया है;

(ख) " प्रतियोगिता परीक्षा " सेवा के श्रेणी " घ " आशुलिपिक के संबंध में श्रेणी में सीधी भर्ती के लिए कर्मचारी चयन आयोग द्वारा आयोजित विभागीय प्रतियोगिता परीक्षा से भिन्न प्रतियोगिता परीक्षा अभिप्रेत है ;

(ग) "सरकार" से केन्द्रीय सरकार का कार्मिक और प्रशिक्षण विभाग अभिप्रेत है ;

(घ) "नियम " से केन्द्रीय सचिवालय आशुलिपिक सेवा नियम, 2010 अभिप्रेत है ।

(2) अन्य सभी शब्दों और पदों का जो इन विनियमों में प्रयुक्त हैं और उसमें परिभाषित नहीं हैं किंतु केन्द्रीय सरकार सचिवालय आशुलिपिक सेवा नियम, 2010 में परिभाषित हैं वही अर्थ होंगे जो क्रमशः उनका इन नियमों में है ।

3. सामान्य ज्येष्ठता सूची- सामान्य ज्येष्ठता सूची, विनियम 4, विनियम 5 और विनियम 6 में निनिर्दिष्ट प्रक्रिया के अनुसार उस श्रेणी में कार्य कर रहे सभी अधिकारी/ पदीय की ज्येष्ठता 44

अवधारित करने के लिए काडर नियंत्रक प्राधिकारी द्वारा सेवा की प्रत्येक श्रेणी के लिए प्रत्येक वर्ष की 1 जुलाई , को तैयार की जाएगी और उस वर्ष की 1 जुलाई की सामान्य ज्येष्ठता सूची को प्रत्येक वर्ष अद्यतन किया जा सकेगा ।

4. प्रधान कर्मचारिवृंद अधिकारी, ज्येष्ठ प्रधान निजी सचिव और प्रधान निजी सचिव श्रेणी के लिए सामान्य ज्येष्ठता सूची तैयार करना : -

(1 ) पैनल तैयार करना चयन सूची वर्ष के लिए प्रत्येक श्रेणी के लिए प्रोन्नति पैनल को चयन समिति द्वारा तैयार किया जाएगा और यदि एक भाग से अधिक पैनल चयन सूची वर्ष की चयन प्रक्रिया के पूरा होने के लिए तैयार किया जाता है, ऐसे सभी भाग पैनल को अधिकारियों के नाम उस क्रम में सम्मिलित करके जिसमें वे निम्न श्रेणी के लिए सामान्य ज्येष्ठता सूची में आते हैं, उस चयन सूची के लिए पैनल तैयार करने के लिए विलय किया जाएगा ।

(2) चयन सूची:- किसी वर्ष के लिए चयन सूची, पैनल में सम्मिलित अधिकारियों के नाम उस क्रम में सम्मिलित करके उस भर्ती वर्ष के अंत में तैयार की जाएगी जिसमें वे इस शर्त के अधीन रहते हुए उपस्थित हुए थे कि यदि पैनल में वास्तविक रिक्तियों से अधिक नामों को सम्मिलित किया जाता है तो उस वर्ष के लिए चयन सूची वास्तविक रूप से पाए गए अधिकारियों की कुल संख्या ऐसी वास्तविक रिक्तियों तक सीमित हो जाएगी और उस दशा में जिन्हें चयन सूची में सम्मिलित नहीं किया गया है , पश्चात्तवर्ती वर्षों के लिए नए सिरे से विचार किया जाएगा ।

(3) यदि चयन सूची वर्ष के लिए किसी श्रेणी हेतु केवल भाग पैनल उपलब्ध होते हैं तो अनंतिम चयन सूची को उपरोक्त उपविनियम (2 ) के अनुसार ज्येष्ठता के सिद्धांतों को अनुसरण करके उपलब्ध भाग पैनल को मिलाकर के तैयार की जाएगी ।

(4) श्रेणी के लिए सामान्य ज्येष्ठता सूची जिसे पिछले वर्ष के लिए अंतिम रूप दिया गया है उनका पुनर्विलोकन किया जाएगा और सभी अधिकारियों के नाम जो अब श्रेणी की सेवा में नहीं हैं और जिनका उस श्रेणी में किसी पद पर धारणाधिकार नहीं है, उससे हटा दिया जाएगा ।

(5) उन अधिकारियों के नाम जिन्होंने पिछले भर्ती वर्ष के दौरान नियमित आधार पर पद ग्रहण किया है, उन्हें सामान्य ज्येष्ठता सूची में क्रम में जिसमें उनका नाम उस श्रेणी के लिए चयन सूची में आता है, सामान्य ज्येष्ठता सूची में जोड़ा जाएगा परंतु किसी पूर्व वर्ष में चयन सूची में सम्मिलित किए गए अधिकारियों के नाम उन अधिकारियों से ज्येष्ठ होंगे जिनके नाम बाद के वर्ष के लिए चयन सूची में सम्मिलित हैं और यह और कि उन अधिकारियों के नाम जिनके नाम अनंतिम चयन सूची में सम्मिलित किए जाते हैं, अनंतिम आधार पर सामान्य ज्येष्ठता सूची में सम्मिलित किया जाएगा ।

(6 ) ऐसे अधिकारियों के नाम जिनके नाम अनंतिम आधार पर सामान्य ज्येष्ठता सूची में सम्मिलित किया जाता है, चयन सूची को उस वर्ष के लिए अंतिम रूप प्रदान करने के पश्चात् और ऊपर यथा वर्णित ज्येष्ठता के सिद्धांतों का अनुसरण करते हुए किया जाएगा ।

5. निजी सचिव और वैयक्तिक सहायक श्रेणियों के लिए सम्मिलित चयन सूची : -

(1 ) पैनल को तैयार करना (क) चयन सूची के लिए निजी सचिव और वैक्तिक सहायक श्रेणियों हेतु प्रोन्नति पैनल को काडर नियंत्रण प्राधिकारी द्वारा क्रमशः केन्द्रीय सचिवालय आशुलिपिक सेवा निजी सचिव श्रेणी (ज्येष्ठता कोटा) के लिए पैनल या पैनलों (भाग ) को तैयार करना विनियम , 2010 और केन्द्रीय सचिवालय आशुलिपिक सेवा वैयक्तिक सहायक श्रेणी (ज्येष्ठता कोटा) के लिए पैनल या पैनलों ( भाग) को तैयार करना विनियम, 2010 के अनुसार तैयार किए जाऐंगे और यदि एक से अधिक भाग पैनल को चयन सूची वर्ष के चयन प्रक्रिया के पूरा होने के लिए तैयार किया जाता है तो, सभी ऐसे भाग पैनलों को अधिकारियों के नाम उस क्रम में सम्मिलित करके जिसमें वे उस चयन सूची वर्ष के लिए पैनल तैयार करने में आनुक्रमिक फीडर श्रेणियों में सम्मिलित सामान्य ज्येष्ठता सूची में आते हैं, सम्मिलित करके सभी भाग पैनल का विलय किया जाएगा. ।

(ख) चयन सूची वर्ष के लिए निजी सचिव श्रेणी और वैयक्तिक सहायक श्रेणी हेतु सीमित विभागीय प्रतियोगिता परीक्षा को केन्द्रीय सचिवालय आशुलिपिक सेवा निजी सचिव श्रेणी (सीमित विभागीय प्रतियोगिता परीक्षा) विनियम, 2010 के विनियम 7 के उप विनियम (2) और केन्द्रीय सचिवालय आशुलिपिक सेवा वैयक्तिक सहायक श्रेणी (सीमित विभागीय प्रतियोगिता परीक्षा) विनियम, 2010 के विनियम 7 के उप विनियम (2) के अनुसार तैयार किया जाएगा ।

(2) चयन सूचियां निजी सचिव और वैयक्तिक सहायक श्रेणियों के लिए यथास्थिति चयन सूची या अनंतिम चयन सूची, प्रोन्नति पैनल और सीमित विभागीय परीक्षा पैनल में सम्मिलित अधिकारियों के नाम अंतर्वेशित करके भर्ती वर्ष के अंत में इस क्रम में तैयार की जाएगी जिसमें वे निजी सचिव के लिए 2: 1 और वैयक्तिक सहायक श्रेणी के लिए 1 : 1 अनुपात में उस चयन सूची वर्ष के लिए सुसंगत पैनल में आ जाएं:

परंतु प्रत्येक पैनल में से चयन सूची में सम्मिलित होने वाले अधिकारियों की संख्या को उस चयन सूची वर्ष के लिए उस भर्ती के ढंग के लिए वास्तविक रिक्तियों को निर्बंधित किया जाएगा :

परंतु यह और कि यदि चयन प्रक्रिया को प्रोन्नति और विभागीय प्रतियोगिता परीक्षा दोनों ढंगों के लिए पूरा नहीं किया गया है तो अनंतिम चयन सूची तैयार की जाएगी ।

(2) प्रारूप सामान्य ज्येष्ठता सूची के प्रकाशन के 30 दिन के भीतर प्राप्त आक्षेप को सक्षम प्राधिकारी द्वारा विनिश्वित किए जाएंगे और पुनरीक्षण, यदि कोई हों करने के पश्चात् 30 दिन के भीतर अंतिम सामान्य ज्येष्ठता सूची तैयार की जाएगी ।

(3) प्रारूप सामान्य ज्येष्ठता सूची पर अधिकारियों के आक्षेप काडर यूनिट के माध्यम से वहां भेजा जाएगा जहां अधिकारी तैनात है ।

(4) अंतिम सामान्य ज्येष्ठता सूची का उपांतरण उन मामलों के सिवाय जहां सक्षम न्यायालय या अधिकरण के किसी आदेश को क्रियान्वित करना अपेक्षित है या उस दशा में जब निजी सचिव या वैयक्तिक सहायक श्रेणियों के लिए सीमित विभागीय प्रतियोगिता परीक्षा हेतु संघ लोक सेवा आयोग या कर्मचारी चयन आयोग से अनुपूरक चयन सूची प्राप्त होती है, नहीं किया जाएगा और ऐसा उपांतरण उपरोक्त ब्यौरेबार, अंतिम सामान्य ज्येष्ठता सूची/प्रारूप को तैयार करने हेतु अधिकथित ऐसे सिद्धांतों का अनुसरण करते हुए किया जाएगा परंतु यह न्यायालय या अधिकरण के सुसंगत आदेश के विरुद्ध न हों ।

G.S.R. 944(E).-In exercise of the powers conferred by the proviso to article 309 of the constitution and in pursuance of rule 4 ofthe Central Secretariat Stenographers ' Service Rules , 2010, the President hereby makes the following regulations, namely:---

1. Short title and commencement. ( 1 ) These regulations may be called the Central Secretariat Stenographers ' Service ( Preparation of Common Seniority List ) Regulations , 2010 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Definitions.- (1) In these regulations , unless the context otherwise requires, -

(a) 'common seniority list ' in relation to any grade means the seniority list of officers working in that grade as on the 1st July of any year and revised in accordance with these regulations;

(b) 'competitive examination ' in relation to Stenographer Grade ' D ' of the service, means the competitive examination other than Departmental Competitive Examination , heldby the Staff Selection Commission for direct recruitment to the grade;

(d) ' rules ' means Central Secretariat Stenographers ' Service Rules , 2010 .

(2) Words and expressions used in these regulations and not defined but defined in the Central Secretariat Stenographer's Service Rules , 2010 shall have the meanings respectively assigned to them in the rules

3. Common seniority list . A common seniority list shall be prepared as on the 1st July every year for each grade of the service by the cadre controlling authority to determine the inter - se seniority of all officers/officials serving in that grade as per procedure specified in regulations 4, 5 and 6 and the common seniority list may be updated every year as on the 1st July of that year.

4. Preparation of common seniority list for Principal Staff Officer, Senior Principal Private Secretary and Principal Private Secretary grade.-

(1) Preparation of panel . The promotion panel for each grade for a select list year shall be as prepared by the selection committee , and if more than one part panel is prepared for completion of the selection process of a select list year , all such part panels will be merged , by including the names of officers in the order in which they appear in the common seniority list for the lower grade , to prepare the panel for that select list year .

(2) Select list.- The select list for any year will be prepared at the end of that recruitment year.by including names of officers included in the panel in the order in which they appear in the panel subject to the condition that if more names are included in the panel than the actual vacancies that actually occurred for that year the total number of officers in the select list will be limited to such actual vacancies and in that event , officers who are not included in the select list will be considered afresh for selection for subsequent years.

(3) Ifonly part panels are available for a grade , for a select list year , a provisional select list will be prepared by merging the available part panels following the principle of seniority as in sub- regulation (2) in above .

(4) The common seniority list for the grade as finalised for the previous year shall be reviewed and names of all officers who are no longer serving in the grade and who have no lien on any post in that grade will be removed .

(5) Names of the officers who have joined the grade on a regular basis during the previous recruitment year will be added to the common seniority list in the order in which their names appear in the select list for that grade , provided that the names of officers included in select list of an earlier year will be senior to the officers whose names are included in select list for a later year and further provided that names of officers whose names are included in a provisional select list will be included in the common seniority list on a provisional basis .

(6) Names of officers whose names are included in the common seniority list on a provisional basis will be included on a final basis after select list for that year is finalised and following the principle of seniority as detailed above .

5. Preparation of common seniority list for Private Secretary and Personal Assistant grades.-

(1) Preparation of panel.-

(a) The promotion panels for Private Secretary and Personal Assistant grades for a select list year shall be prepared by the cadre authority , as per Central Secretariat Stenographers ' Service Preparation of the panel or panel ( part) for the Private Secretary Grade(Seniority Quota ) Regulations , 2010 and Central Secretariat Stenographers ' Service Preparation of the panel or panel (part ) for the Personal Assistant Grade (Seniority Quota ) Regulations , 2010 respectively and if more than one part panel is prepared for completion of the selection process of a select list year , all such part panels will be merged , by including the names of officers in the order in which they appear in the common seniority list in the respective feeder grade , to prepare the panel for that select list year.

(b) The Limited Departmental Competitive Examination panel for Private Secretary grade and Personal Assistant grade for a select list year shall be prepared as per sub - regulation (2) of regulation 7 of Centrai Secretariat Stenographers ' Service Private Secretary Grade (Limited Departmental Competitive Examination) Regulations , 2010 and sub - regulation (2 ) of regulation 7 of Central Secretariat Stenographers ' Service Personal Assistant Grade (Limited Departmental Competitive Examination ) Regulations , 2010 respectively.

(2) Select lists . Select list or provisional select list , as the case may be, shall be prepared for Private Secretary and Personal Assistant grades at the end of the recruitment year by interpolating the names of officers included in the promotion panel and Limited Departmental Competitive Examination panel , in the order in which they appear in the relevant panel , for that select list year, in the ratio of 2: 1 for Private Secretary and 1 : 1 for Personal Assistant grade:

Provided that number of officers to be included in the select list from each of the panels will be restricted to the actual vacancies for that mode of recruitment for that select list year:

Provided further that if selection process has not been completed for both the promotion and Limited Departmental Competitive Examination modes a provisional select list will be prepared .

(3) The common seniority list for the grade as finalised for the previous year shall be reviewed and names of all officers who are no longer serving in the grade and who have no lien on any post in that grade will be removed.

(4) Names of officers who have joined the grade on a regular basis during the previous recruitment year will be added to the common seniority list in the order in which their names appear in the select list for that grade:

Provided that the officers included in select list of an earlier year will be senior to the officers whose names are included in select list for a later year:

Provided further that the names of the officers whose names are included in a provisional select list will be included in the common seniority list on a provisional basis .

Names of officers whose names are included in the common seniority list on a provisional basis will be included on a final basis after select list for that year is finalised and following the principle of seniority as detailed above.

6. Preparation of common seniority list for Stenographer Grade 'D'.-

(a) The common seniority list for the grade as finalised for the previous year shall be reviewed and names of all officers who are no longer serving in the grade and who have no lien on any post in that grade will be removed.

(b) Names of officers who have joined the grade on a regular basis during the previous recruitment year will be added to the common seniority list in the order in which their names appear in the selection panel as prepared under sub - regulation (2 ) of regulation 7:

Provided that the names of officers included in the selection panel for an earlier select list year will be senior to the officers whose names are included in select list for a later year .

7. Finalisation of common seniority list.-

(1) The draft common seniority list as prepared in accordance with regulations 4, 5 and 6 will be posted on the website of Department of Personnel and Training for inviting objections, if any .

(2) All objections received within 30 days of the publication of draft common seniority list will be decided by the competent authority , and the final common seniority list will be prepared after making revisions , if any , within 30 days thereafter.

(3) Objections of officers to the draft common seniority list will be sent through the cadre unit where the officer is posted .

(4) Final common seniority list shall not be modified except in case where it is required to implement an order of a competent court or a tribunal or in case when a supplementary selection list is received from the Union Public Service Commission or Staff Selection Commission for Limited Departmental Competitive Examination selection for Private Secretary or Personal Assistant grades and such modification shall be made following the general principles laid down for preparation of draft / final common seniority list as detailed above provided that it does not come in conflict with the relevant order of the court or tribunal .
