सा.का.नि. 950(अ).- केन्द्रीय सरकार, राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 9 द्वारा प्रदत्त शक्तियों का उपयोग करते हुए , राष्ट्रीय राजमार्ग फीस ( दर का निर्धारण एवं संग्रहण ) नियम, 2008 में संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है, अर्थात्ः-
1. (1) इन नियमों को राष्ट्रीय राजमार्ग फीस (दर का निर्धारण एवं संग्रहण ) संशोधन नियम 2010 कहा जाएगा ।
(2) ये सरकारी राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. राष्ट्रीय राजमार्ग फीस ( दर का निर्धारण एवं संग्रहण ) नियम 2008 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के, नियम 4 में, -
(क) उप-नियम (3) में, "एक करोड़ रुपए प्रति किलोमीटर " को " 01 अप्रैल , 2008 के मूल्योंपर 22 करोड़ रुपए प्रति किलोमीटर" से प्रतिस्थापित किया जाएगा;
(ख) उप-नियम (4) में , " बाइपास" शब्द जहां- कहीं पर आए , को विलोपित किया जाएगा;
(ग) उप-नियम (4 ) के पश्चात्, निम्नलिखित उप- नियम अंतर्निहित किया जाएगा, अर्थात्ः- "(5) आधार वर्ष 2007-08 के लिए ऐसे बाइपास के प्रयोग के लिए जो दस करोड़ रुपए अथवा अधिक की लागत से निर्मित और राष्ट्रीय राजमार्ग खंड का भाग हो, फीस की दर, उप- नियम (2 ) में विनिर्दिष्ट फीस की दर का 1½ गुना होगीः
परंतु यह कि उस राष्ट्रीय राजमार्ग के सेक्शन जिसका हिस्सा वह बाइपास हो , के लिए फीस की संगणना करते समय ऐसे बाइपास की लंबाई को राष्ट्रीय राजमार्ग के ऐसे सेक्शन की लंबाई में से निकाल दिया जाएगा:

परंतु यह भी कि जहां ऐसे बाइपास की लागत दस करोड़ रुपए से कम है , वहां उक्त बाइपास के प्रयोग के लिए फीस की दर वही होगी जो उस राष्ट्रीय राजमार्ग के खंड के लिए है जिसका वह हिस्सा है । "
3. उक्त नियमों में , नियम 5 में
(क) उप-नियम (2) में , "वर्ष के 01 जनवरी को अथवा उसके तुरंत पश्चात् सप्ताहंत पर" शब्दों और अंकों को " वर्ष के दिसंबर माह के लिए थोक मूल्य सूचकांक" से प्रतिस्थापित किया जाएगा;
उप-नियम (3 ) में, -
(ख)
(i) स्पष्टीकरण में , खंड ( ग) में, " 01 जनवरी को अथवा उसके पश्चात् समाप्त होने वाले सप्ताह का थोक मूल्य सूचकांक" शब्दों और अंकों को "तुरंत पहले के वर्ष के दिसंबर माह के लिए थोक मूल्य सूचकांक" से प्रतिस्थापित किया जाएगा;
(ii) उदाहरण के लिए , निम्नलिखित उदाहरण प्रतिस्थापित किया जाएगा, अर्थात्ः- "उदाहरणः
यदि वर्ष के दिसंबर , 2007 माह के लिए थोक मूल्य सूचकांक (अर्थात् 216.4 ) को लागू करके वर्ष 2008-09 के लिए संशोधन किया जाना है, तो कार , जीप अथवा वैन के लिए दर 0.6794 होगी जिसका आकलन निम्न प्रकार किया जाएगा:-
फीस की लागू दर : 0.6695 +0.6695 X ( 216.4 - 208.7 } X 0.4 = 0.6794 " 208.7
(4) अर्थात्ः- उक्त नियमों में , नियम 11 के लिए , निम्नलिखित नियम प्रतिस्थापित किया जाएगा,
" 11. फीस के संदाय से छूट ( 1 ) ऐसे यांत्रिक यान से फीस उद्ग्रहीत और संग्रहीत नहीं की जाएगी-
(क) जो निम्नलिखित को ले जा रहे हैं और उनके साथ चल रहे हैं : -
i) भारत के राष्ट्रपति;
ii) भारत के उपराष्ट्रपति;
भारत के प्रधान मंत्री ;
iv) राज्य के राज्यपाल;
v) भारत के मुख्य न्यायमूर्ति ;
vi) लोक सभा के अध्यक्ष;
vii) संधीय मंत्रिमंडल के मंत्री;
viii) किसी राज्य के मुख्य मंत्री;
ix) उच्चतम न्यायालय के न्यायमूर्ति;
x) संघ के राज्य मंत्री;

xi) संघ राज्य क्षेत्र के उप राज्यपाल;
xii ) सेनाध्यक्ष जो पूर्ण जनरल अथवा समकक्ष रैंक पर हो;
xiii ) राज्य विधान परिषद के सभापति;
xiv) राज्य विधान सभा के अध्यक्ष;
xv) उच्च न्यायालय के मुख्य न्यायाधीश ;
xvi) उच्च न्यायालय के न्यायाधीश;
xvii ) संसद सदस्य;
xviii ) आर्मी कमांडर अथवा उप- सेनाध्यक्ष तथा अन्य सेनाओं में समकक्ष रैंकधारी;
xix) राज्य में संबंधित राज्य सरकार के मुख्य सचिव;
xx) सचिव, भारत सरकार;
xxi ) सचिव , राज्य सभा;
xxii ) सचिव , लोक सभा;
xxiii ) सरकारी दौरे पर उच्च पदस्थ विदेशी अधिकारी;
xxiv) अपने संबंधित राज्य में किसी राज्य की विधान सभा अथवा विधान परिषद के सदस्य, यदि वह राज्य के संबंधित विधानमंडल द्वारा जारी अपना पहचान पत्र प्रदर्शित करते हैं;
xxv) परमवीर चक्र, अशोक चक्र, महावीर चक्र , कीर्ति चक्र, वीर चक्र और शौर्य चक्र के पुरस्कार -प्राप्तकर्ता व्यक्ति, यदि ऐसे प्राप्तकर्ता व्यक्ति ऐसे पुरस्कार के लिए उपयुक्त अथवा सक्षम प्राधिकारी द्वारा विधिवत् प्रमाणित अपना फोटो- युक्त पहचान पत्र प्रदर्शित करते हैं;
जो निम्नलिखित द्वारा शासकीय प्रयोजनों के लिए प्रयुक्त किया जा रहा है - (ख)
i) रक्षा मंत्रालय जिनमें वे भी हैं जो भारतीय पथकर (सेना और वायु सेना) अधिनियम, 1901 के उपबंधों और उसके अधीन बनाए गए नियमों, जो नौ सेना पर भी लागू हैं, के अनुसार छूट के लिए पात्र हैं;
ii) अर्द्ध सैनिक बलों और पुलिस सहित वर्दीधारी केन्द्रीय और राज्य सशस्त्र बल;
कार्यपालक मजिस्ट्रेट;
iv) अग्निशमन विभाग या संगठन;
v) भारतीय राष्ट्रीय राजमार्ग प्राधिकरण या कोई अन्य संगठन जो ऐसे यान का प्रयोग राष्ट्रीय राजमार्ग के निरीक्षण, सर्वेक्षण , निर्माण या प्रचालन और तत्संबंधी रखरखाव के लिए कर रहा है ।
(ग) एंबुलेंस के रूप में प्रयुक्त यान; और
(घ) शव वाहन के रूप में प्रयुक्त यान । "

NOTIFICATION
New Delhi , the 3rd December , 2010
G.S.R. 950(E) . In exercise of the powers conferred by the section 9 of the National Highways Act , 1956 (48 of 1956) , the Central Government hereby makes the following rules to amend the National Highways Fee (Determination of Rates and Collection) Rules, 2008 , namely: -
1. ( 1) These rules may be called the National Highways Fee ( Determination of Rates and Collection) Amendment Rules , 2010 .

2. In the National Highways Fee ( Determination of Rates and Collection) Rules , 2008 ( hereinafter referred to as the said rules) , in rule 4, -
(a) in sub - rule (3 ) , for the words "Rupees one crore per kilometer " , the words , figures and letters " rupees two and a half crore per kilometer at the 1st April , 2008 prices " shall be substituted;
(b) in sub - rule (4) , the word " bypass" wherever it occurs , shall be omitted ;
(c) after sub - rule (4) , the following sub - rule shall be inserted , namely : -
" (5 ) The rate of fee for use of bypass forming part of a section of a national highway constructed with the cost of rupees ten crore or more , for the base year 2007-08 , shall be one and a half times the rate of fee specified in sub - rule (2) :
Provided that while computing the fee for a section of a national highway of which such bypass forms a part , the length of such bypass shall be excluded from the length of such section of national highway:

Provided further that where the cost of such bypass is less than rupees ten crore , then the rate of fee for the use said bypass shall be the same as that of the section of the national highway of which it forms a part ." .
3. In the said rules , in rule 5 (a) in sub - rule (2), for the words and figure "the week ending on or immediately after January 1 of the year " , the words " the wholesale price index for the month of December of the year " shall be substituted;
(b) in sub - rule (3 ) , -
(i) in Explanation, in clause (c) , for the words , figures and letters "the wholesale price index of the week ending on or subsequent to 1st January ", the words "the wholesale price index for the month of December of the immediately preceding year " shall be substituted;
(ii) for Illustration, the following Illustration shall be substituted , namely: - "Illustration:
If the revision is to be made for the year 2008-09 by applying the wholesale price index for the month of December , 2007 ( i.e. 216.4) , then the rate for car, jeep or van will be 0.6794 as computer bel
Applicable rate of fee: 0.6695 +0.6695 X (216.4 208.7 ) Χ 0 . 0.6794".

4. In the said rules , for rule 11 , the following rule shall be substituted, namely: -
"11. Exemption from payment of fee . ( 1 ) No fee shall be levied and collected from a mechanical vehicle , -
(a) transporting and accompanying-
(i) the President of India;
(ii) the Vice-President of India ;
( iii) the Prime- Minister of India;
(iv) the Governor of a State;
(v) the Chief Justice of India ;

(vi) the Speaker of the House of People ;
(vii) the Cabinet Minister of the Union
(viii ) the Chief Minister of a State;
(ix) the Judge of the Supreme Court ;
(x) the Minister of State of the Union ;
(xi) the Lieutenant Governor of a Union territory;
(xii) the Chief of Staff holding the rank of full General or equivalent rank ;
(xiii) the Chairman of the Legislative Council of a State;
(xiv) the Speaker of the Legislative Assembly of a State;
(xv) the Chief Justice of a High Court ;
(xvi ) the Judge of a High Court ;
(xvii) the Member of Parliament ;
(xviii) the Army Commander or Vice-Chief of Army Staff and equivalent in other services;
(xix) the Chief Secretary to a State Government within concerned State;
(xx) the Secretary to the Government of India ;
(xxi) the Secretary , Council of States;
(xxii) the Secretary, House of People;
(xxiii) the Foreign dignitary on State visit ;
(xxiv) The Member of Legislative Assembly of a State and the Member of Legislative Council of a State within their respective State , if he or she produces his or her identity card issued by the concerned Legislature of the State;
(xxv) the awardee of Param Vir Chakra, Ashok Chakra, Maha Vir Chakra , Kirti Chakra , Vir Chakra and Shaurya Chakra , if such awardee produces his or her photo identity card duly authenticated by the appropriate or competent authority for such award;
(b) used for official purposes by -
(i) the Ministry of Defence including those which are eligible for exemption in accordance with the provisions of the Indian Toll (Army and Air Force) Act, 1901 and rules made thereunder , as extended to Navy also;

(ii) the Central and State armed forces in uniform including para military forces and police ;
(iii) an executive Magistrate ;
( iv) the fire- fighting Department or organisation;
(v) the National Highways Authority of India or any other Government organisation using such vehicle for inspection, survey, construction or operation of national highways and maintenance thereof;
(c) used as ambulance ; and
used as funeral van ." .
