संशोधन अधिसूचना

सं. डीई - 147-2010.- दंतचिकित्सक अधिनियम 1948 (1948 का 16 ) की धारा 10 (4) अथवा 10 (5 ) के साथ पठित धारा 20 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय दंत्य परिषद, केन्द्र सरकार के पूर्व-अनुमोदन से, भारत के राजपत्र भाग- III खंड (4) में 13 अगस्त, 2009 को प्रकाशित प्रधान " भारतीय दंत्य परिषद जांच परीक्षा विनियम , 2009 " में और संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाती है , अर्थातः
1. लघु शीर्षक तथा प्रवर्तन
(i) इन विनियमों को "जांच परीक्षा (पहला संशोधन) विनियम, 2010 कहा जाएगा ।
(ii) ये सरकारी राजपत्र में अपने प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. प्रधान भारतीय दंत्य परिषद जांच परीक्षा विनियम , 2009 के विनियम 2 में शीर्षक 'परिभाषा' के अंतर्गत उप- विनियम (2) के पश्चात निम्नलिखित नए उप - विनियम (3 ) को जोड़ा गया है अर्थातः-
" (3) शब्द ' भारत का विदेशी नागरिक' (ओसीआई) तथा 'भारतीय मूल का व्यक्ति' (पीआईओ) का अर्थ क्रमशः वही होगा जोकि उन्हें नागरिकता अधिनियम, 1955 की धारा 7 ए और गृह मंत्रालय द्वारा समय - समय पर यथासंशोधित दिनांक 19.8.2002 की इसकी अधिसूचना संख्या 26011 / 4 / 98- एफ.1 के माध्यम से अधिसूचित ' भारतीय मूल के व्यक्तियों का कार्ड जारी करने संबंधी स्कीम 2002 ' नामक स्कीम में निर्धारित किया गया है । "
3. ( i) विनियम 4 में शीर्षक 'उपयुक्तता' के अंतर्गत पहली लाइन में शब्द " भारतीय नागरिक " के पश्चात निम्नलिखित शब्दों को जोड़ा जाएगाः-
"अथवा भारतीय मूल का व्यक्ति (पीआईओ) अथवा भारत का विदेशी नागरिक (ओसीआई)"
( ii) विनियम 4 के पहले, दूसरे और तीसरे परंतुक में पहली लाइन में शब्द " भारतीय विद्यार्थी" के पश्चात निम्नलिखित शब्द जोड़े जाएंगे:-

"अथवा भारतीय मूल का व्यक्ति (पीआईओ) अथवा भारत का विदेशी नागरिक (ओसीआई)"
(iii ) भारत के राजपत्र , असाधारण , भाग III , खंड 4 में 13.8.2009 को अधिसूचित एवं प्रकाशित प्रधान भारतीय दंत्य परिषद जांच परीक्षा विनियम, 2009 की क्रम संख्या 144 पर दिए गए विनियम संख्या 4 के परंतुक 3 को एतद्वारा हटाया जाता है ।
4. प्रधान भारतीय दंत्य परिषद जांच परीक्षा विनियम, 2009 के विनियम संख्या 5 खंड (क) की समाप्ति पर एतद्वारा निम्नलिखित प्रावधानों को जोड़ा जाता है: - "और इस प्रकार की संस्था को या तो विश्व स्वास्थ्य संगठन (डब्ल्यूएचओ ) अथवा जनरल डेंटल काउंसिल , लंदन की डायरेक्टरी में सूचीबद्ध होना चाहिए । "
5. विनियम 5 (क) में पहली लाइन में शब्द " भारत के नागरिक " के पश्चात निम्नलिखित शब्दों को जोड़ा जाएगाः- "अथवा भारतीय मूल का व्यक्ति (पीआईओ ) अथवा भारत का विदेशी नागरिक (ओसीआई)"
6. प्रधान भारतीय दंत्य परिषद जांच परीक्षा विनियम, 2009 के विनियम 8 में शीर्षक " शुल्क संरचना" के अंतर्गत खंड (घ) के पश्चात निम्नलिखित नए खंड (ड.) को जोड़ा जाएगा अर्थातः-
"(ङ) आवेदक द्वारा एक बार भारतीय दंत्य परिषद को दे दिया गया " शुल्क" केवल उन्हीं आवेदकों को वापस किया जाएगा जोकि इन विनियमों में निर्धारित किए गए अनुसार विहित प्राधिकारी द्वारा आयोजित किए जाने वाली जांच परीक्षा में बैठने संबंधी पात्रता मानदंडों को पूरा नहीं करते हैं अथवा जिनका आवेदन संबंधित प्राधिकारियों द्वारा समय- समय पर बनाए गए विनियमों और स्कीम के अनुसार अपूर्ण हो। "
7.
विनियम 15 में प्रथम लाइन में शब्द " भारत का नागरिक " के पश्चात निम्नलिखित शब्दों को जोड़ा जाएगाः-
"अथवा भारतीय मूल का व्यक्ति (पीआईओ) अथवा भारत का विदेशी नागरिक (ओसीआई)"

AMENDMENT NOTIFICATION
New Delhi , the 7th December , 2010
No. DE- 147-2010 .- In exercise of the powers conferred by section 20 read with Section 10(4) or 10 (5) of the Dentists Act, 1948 ( 16 of 1948 ), the Dental Council of India , with the previous approval of the Central Government , hereby makes the following Regulations to further amend the Principal " Dental Council of India Screening Test Regulations , 2009 " , published on 13th August, 2009 in Part - III , Section (4) of the Gazette of India , namely: -
1. Shorttitle and commencement :
(i)
2010 . These regulations may be called the " Screening Test ( 1st Amendments ) Regulations ,
(ii) They shall come into force from the date of their publication in the Official Gazette .
2. In Regulation 2 under the heading " Definition " of the Principal Dental Council of India Screening Test Regulations, 2009 , after sub- regulation (2) , the following new sub- regulation (3) shall be inserted namely:-

"(3 ) The meaning of the words " Overseas Citizen of India " (OCI ) and " Person of Indian Origin " ( PIO) shall have the same meaning respectively as assigned to them under section 7A of the Citizenship Act, 1955 and the Scheme called " Scheme for issuance of Person of Indian Origin Card ( PIO) Scheme 2002 " notified by the Ministry of Home Affairs vide its notification No.26011 /4/98- F.I dated 19.08.2002 , as amended from time to time. "
3. (i) . InRegulation 4 under the heading "Applicability " , after the word " Indian citizen" in the first line, the following words shall be inserted: - "orPerson of Indian Origin ( PIO) or Overseas Citizen of India ( OCI ) "
(ii). In first , second and third proviso to Regulation 4, after the word " Indian students " in the first line, the following words shall be inserted:- "orPerson of Indian Origin ( PIO ) or Overseas Citizen of India ( OCI ) "
(iii) The proviso 3 to Regulations No. 4 of the Principal DCI Screening Test Regulations , 2009, notified and published in the Gazette of India , Extraordinary , Part-III , Section 4 atSl . No. 144 dated 13.8.2009 is hereby deleted.
4. The following provisions are hereby inserted at the end of clause ( a) of the Regulation No. 5 ofthe Principal Dental Council of India Screening Test Regulations , 2009:- " and such institution must be listed either in the directory of World Health Organization (WHO ) or General Dental Council , London . "
5 . In Regulation 5(a) , after the word " citizen of India" in the first line , the following words shall be inserted:- "or Person of Indian Origin (PIO ) or Overseas Citizen of India ( OCI ) "
6. In Regulation 8 under the heading " Fee Structure " of the Principal Dental Council of India Screening Test Regulations , 2009, after clause (d) , the following new clause (e) shall be inserted namely:-
"e) The " Fee" once remitted to the Dental Council of India by the applicant shall be refunded to those applicant who does not fulfil the eligibility criteria to appear in the Screening Test to be conducted by the prescribed authority as laid down in these Regulations or the application thereof is incomplete in terms of Regulations and scheme made thereunder by the concerned authorities from time to time . "
7. In Regulation 15 , after the word " citizen of India " in the first line , the following words shall be inserted:-
"or Person of Indian Origin ( PIO) or Overseas Citizen of India ( OCI ) "
