सा.का.नि. 960(अ) . केन्द्रीय सरकार, वायुयान नियम , 1937 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप , वायुयान अधिनियम , 1934 ( 1934 का 22 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करती है , उक्त अधिनियम की धारा 14 की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है , प्रकाशित किया जाता है और सूचना दी जाती है कि उक्त प्रारूप पर उस तारीख से जिसको भारत के राजपत्र में प्रकाशित अधिसूचना की प्रतियां जिसमें यह अधिसूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती है , तीस दिन की अवधि के पश्चात् विचार किया जाएगा ।

आक्षेपों या सुझावों पर , यदि कोई हों, तो महानिदेशक नागर विमानन , सफदरजंग विमानपत्तन के सामने , नई दिल्ली -110003 को भेजे जा सकेंगे ।

ऐसे आक्षेप या सुझाव पर , जो उक्त प्रारूप नियमों के संबंध में किसी भी व्यक्ति से विनिर्दिष्ट अवधि के अवसान से पूर्व प्राप्त हो सकेंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ।

प्रारूप नियम

1. संक्षिप्त नाम एवं प्रारंभ. इन नियमों का संक्षिप्त नाम वायुयान ( संशोधन ) नियम, 2010 है ।

2. नियम 3 का संशोधन वायुयान नियम , 1937 में ( इसमें इसके पश्चात् उक्त नियम कहा गया है) , नियम 3 में,-

( i ) खण्ड ( 1 ख ) के पश्चात् निम्नलिखित खण्डों को रखा जाएगा , अर्थात्:-

(1 ग ) " हवाई यातायात " से अभिप्रेत है उड़ान में सभी हवाई या विमानक्षेत्र के युक्तिचालन तैयारी क्षेत्र पर प्रचालन;

(1 घ) ' हवाई यातायात नियंत्रक " से अभिप्रेत है हवाई यातायात सेवा इकाई में ड्यूटी पर तैनात किसी व्यक्ति और जिसे विमान प्रचालनों की सुरक्षा के हित में रेडियो टेलीफोनी के माध्यम से व्वाई पर अनुदेश या सलाह देने का कार्य सौंपा गया है ;

(1 ड) ' हवाई यातायात नियंत्रक की अनुज्ञप्ति " से अभिप्रेत है हवाई यातायात नियंत्रक ड्यूटियों के निष्पादन के लिए धारक की दक्षता को प्रमाणित करने वाले इन नियमों के अधीन प्रदान की गई कोई अनुज्ञप्ति है और उसमें उसके वैयक्तिक विवरण निहित हैं जिसमें अनुज्ञप्ति की रेटिंग , पृष्ठांकन और विधिमान्यता हैं। ;

( 1 च) ' हवाई यातायात सेवा " से अभिप्रेत है वह उड़ान सूचना सेवा , सतर्क करने वाली सेवा एवं हवाई यातायात परामर्शी सेवा और हवाई यातायात नियंत्रण सेवा (क्षेत्र नियंत्रण सेवा, पहुंच नियंत्रण सेवा या विमानक्षेत्र नियंत्रण सेवा ) ;

(1 छ) ' हवाई यातायात सेवा इकाई " से अभिप्रेत हैं वह हवाई यातायात नियंत्रण इकाई , उड़ान सूचना केन्द्र या हवाई यातायात सेवा रिपोर्टिंग कार्यालय ;

(1 ज) ' अनुमोदित प्रशिक्षण " से अभिप्रेत हैं प्रशिक्षण का वह पाठ्यक्रम जो महानिदेशक द्वारा अनुमोदित हो । "

(ii ) खण्ड ( 19 ) के पश्चात , निम्नलिखित खण्ड अंतःस्थापित किया जाएगा, अर्थातः-

(19क) 'अनुज्ञप्ति संबंधी " पृष्ठांकन " से अभिप्रेत हैं उन विशेषाधिकारों को उपदर्शित करने वाली अनुज्ञप्ति में कोई प्रविष्टि अभिप्रेत है जो उनका प्रयोग करने के लिए धारक को पात्र बनाती है , जिसमें ऐसे विशेषाधिकारों के प्रयोग को प्रभावित करने वाला कोई मूल्यांकन निहित हैं ।

( iii ) खण्ड ( 12 क) के पश्चात, निम्नलिखित उपखण्डों को अंतःस्थापित किया जाएगा, अर्थातः-- 3

(21 ख) उड़ान सूचना क्षेत्र ' से अभिप्रेत हैं उन परिभाषित आयामों का आकाशी क्षेत्र जिसके भीतर उड़ान सूचना सेवा और सतर्क करने वाली सेवा प्रदान की जाती है;

(21 ग ) उड़ान सूचना सेवा ' से अभिप्रेत है उड़ानों के सुरक्षित एवं सफल संचालन के लिए उपयोगी सलाह और सूचना देने के प्रयोजनार्थ प्रदान की गई सेवा;

(iv) खण्ड ( 37) के पश्चात , निम्नलिखित खण्ड अंतःस्थापित किया जाएगा , अर्थातः-

(37क) ' कार्य पर प्रशिक्षण ' से अभिप्रेत है वह प्रशिक्षण जो उस कार्य के लिए पहले से नियोजित किसी योग्य एवं अनुभवी व्यक्ति के पर्यवेक्षणाधीन मौजूदा कार्य प्रणाली में पूर्व में अर्जित कार्य संबंधी अर्हताओं और अनुभवों के प्रयोग में समाकलन । '

3. भाग XII का अंतःस्थापना उक्त नियमों में , भाग XI के पश्चात , निम्नलिखित भाग को अंतःस्थापित किया जाएगा , अर्थातः--

भाग XII हवाई यातायात सेवाओं के कार्मिक

93. हवाई यातायात सेवाओं के कार्मिकों के लिए अनुज्ञप्ति की अपेक्षा.- (1 ) कोई व्यक्ति भारतीय आकाशी क्षेत्र या भारतीय प्रादेशिक सीमा क्षेत्र के बाहर किसी आकाशी क्षेत्र जिसके लिए भारत ने किसी अंतर्राष्ट्रीय व्यवस्था के अनुसरण में हवाई यातायात सेवाएं उपलब्ध कराने का वचन दिया है , में हवाई यातायात सेवाएं उपलब्ध कराने में स्वयं को तब तक नहीं लगाएगा जब तक कि उसके पास इन नियमों के अधीन जारी हवाई यातायात नियंत्रक की विधिमान्य अनुज्ञप्ति नहीं होगी।

(2) इस भाग उपबन्धों के अनुसरण में सैन्य उपयोग के लिए अभिहित आकाशी क्षेत्र में सिविल वायुयान के लिए हवाई यातायात सेवाएं अभिहित सैन्य प्राधिकरण द्वारा प्रदान की जाएंगी जो महानिदेशक की विनिर्दिष्ट शर्तों के अनुरूप तथा अधीन होंगी ;

परन्तु वायुयान ( संशोधन ) नियम , 2010 के प्रारंभ होने से पूर्व हवाई यातायात सेवाएं उपलब्ध कराने में पहले से लगा ऐसा कोई व्यक्ति अनुज्ञप्ति प्राप्त करने तक या केन्द्रीय सरकार द्वारा अधिसूचित की जाने वाली तारीख तक जो भी पहले हो, महानिदेशक द्वारा विनिर्दिष्ट प्रक्रिया के अनुसरण में ऐसी सेवाएं प्रदान करना जारी रख सकेगा ।

94. विमानक्षेत्र में हवाई यातायात सेवाएं उपलब्ध कराना. - महानिदेशक किसी विमानक्षेत्र प्रचालन को हवाई यातायात सेवाएं, विमानक्षेत्र उड़ान सूचना सेवा या टू- वे रेडियो संचार या अन्य कोई सेवा प्रदान करने के लिए निदेश दे सकेंगे जिन्हें वे वायुयान प्रचालन की सुरक्षा के हित में उचित समझें ।

95. अनुज्ञापन प्राधिकारी ( 1 ) केन्द्रीय सरकार, इस भाग में और अनुसूची- III में विनिर्दिष्ट अपेक्षाओं को पूरा करने के अध्यधीन निम्नलिखित अनुज्ञप्तियां या रेटिंग्स अनुदत्त या नवीकरण कर सकेगी, अर्थातः-

(क) छात्र हवाई यातायात नियंत्रक अनुज्ञप्ति

(ख) हवाई यातायात नियंत्रक अनुज्ञप्ति

(ग) हवाई क्षेत्र नियंत्रण रेटिंग

(घ) पहुंच नियंत्रण प्रक्रियात्मक रेटिंग

(ड. ) पहुंच नियंत्रण सर्विलांस रेटिंग

(च) क्षेत्र नियंत्रण प्रक्रियात्मक रेटिंग

(छ) क्षेत्र नियंत्रण सर्विलांस रेटिंग

(ज) उड़ान सूचना सेवा रेटिंग

(झ) महासागरीय नियंत्रण रेटिंग

(2) अनुज्ञप्ति या रेटिंग की मंजूरी या नवीकरण से पूर्व अनुज्ञापन प्राधिकारी स्वयं को इस बात का समाधान हो जाने पर कि आवेदक अनुसूची III में यथाविनिर्दिष्ट आयु, अर्हता , चिकित्सा मानक , ज्ञान , अनुभव , प्रशिक्षण और कौशल की अपेक्षाओं को पूरा करता है ।

है । (3) अनुज्ञप्ति विधिमान्य नहीं होगी यदि उस पर धारक का हस्ताक्षर नहीं

(4) अनुज्ञप्ति तब तक निलंबित या रद्द नहीं की जा सकेगी जब तक उसमें निर्दिष्ट अवधि जो नियम 104 में विनिर्दिष्ट अवधि से अनधिक नहीं होगी, के लिए विधिमान्य होगी ।

(5) केन्द्रीय सरकार अनुज्ञप्ति या रेटिंग की मंजूरी या नवीकरण को रोक सकती है एवं किसी भी अनुज्ञप्ति या रेटिंग को रद्द, निलंबित या परिवर्तित कर सकती है यदि उसे इस बात का समाधान हो जाता है कि ऐसा करने के लिए उसके पास युक्तियुक्त आधार हैः 5

परन्तु लिखित में हेतुक दर्शित करने के लिए सूचना दिए बिना ऐसी कोई अनुज्ञप्ति रेटिंग रद्द या निलंबित नहीं की जा सकेगी जिसमें अनुज्ञप्ति या रेटिंग धारक को यह सूचना दी गई हो कि किस आधार पर अनुज्ञप्ति या रेटिंग को निलंबित या रद्द करने का प्रस्ताव है और सूचना में यथाविनिर्दिष्ट ऐसे उचित समय के भीतर ही उसे लिखित में अभ्यावेदन देने का युक्तियुक्त अवसर दिया गया हो यदि वह व्यक्ति चाहता है कि उसे सुना जाए ।

(6) उपनियम (5) में किसी बात के होते हुए भी यदि केन्द्रीय सरकार की यह राय है कि लोक सुरक्षा के हित में ऐसा करना आवश्यक है तो वह लिखित में अभिलेख किए जाने वाले कारणों की आगे जाँच करने की दृष्टि से अनुज्ञप्ति या रेटिंग को संक्षेप में निलंबित कर सकेगी ।

96. रेडियो टेलीफोनी प्रचालक के प्रमाण पत्र हेतु अपेक्षा. छात्र हवाई यातायात नियंत्रक या हवाई यातायात नियंत्रक अनुज्ञप्ति तभी विधिमान्य होगी जब अनुज्ञप्ति धारक के पास भारतीय टेलीग्राफ अधिनियम, 1885 ( 1885 का 13 ) के उपबंधों और उसके अधीन बनाए गए नियमों के अनुसार रेडियो टेलीफोनी उपकरण प्रचालन संबंधी प्रमाण पत्र या प्राधिकार पत्र होगा ।

97. रेटिंग और इकाई पृष्ठांकन की अपेक्षा ( 1 ) कोई व्यक्ति हवाई यातायात इकाई के हवाई यातायात नियंत्रक के रूप में तब तक ड्यूटी निष्पादित नहीं करेगा , जब तक उसकी अनुज्ञप्ति में , उक्त प्रयोजन के लिए रेटिंग अन्तर्विष्ट नहीं होगी:

परन्तु कोई छात्र हवाई यातायात नियंत्रक की अनुज्ञप्ति या हवाई नियंत्रक अनुज्ञप्ति का धारक किसी विशिष्ट हवाई यातायात सेवा इकाई में संगत रेटिंग के बिना विशिष्ट हवाई यातायात सेवा इकाई के लिए रेटिंग धारण करने वाले व्यक्ति के सीधे पर्यवेक्षणाधीन उसकी अनुज्ञप्ति में ऐसी रेटिंग के पृष्ठांकन के लिए अर्हता के प्रयोजन हेतु ड्यूटी निष्पादित कर सकेगा और जिसे महानिदेशक के अनुदेशक के रूप में कार्य करने के लिए प्राधिकृत किया है ।

(2) अनुज्ञप्ति में एक या एक से अधिक हवाई यातायात सेवा इकाई की रेटिंग हो सकती है ।

(3) उप - नियम (1 ) में किसी बात के होते हुए भी महानिदेशक उसकी अनुज्ञप्ति में विमानपत्तन के पृष्ठांकन के बिना किसी विमानपत्तन पर अस्थाई रूप से हवाई यातायात नियंत्रण डयूटी निष्पादित करने के लिए विमान यातायात नियंत्रक की तैनाती को प्राधिकृत कर सकते हैं परन्तु कि उसके पास उच्चतर हवाई यातायात सघनता के साथ - साथ किसी अन्य विमानपत्तन की समान रेटिंग हों और विमानपत्तन पर अस्थायी ड्यूटी के लिए रेटिंग धारण करने वाले हवाई यातायात नियंत्रक द्वारा ऐसी ड्यूटी के लिए उसे उपयुक्त पाया गया हो ।

98. इकाई प्रशिक्षण योजना प्रत्येक हवाई यातायात सेवा इकाई एक इकाई प्रशिक्षण योजना तैयार करेगी जिसमें कार्य पर प्रशिक्षण के पाठ्यक्रम , परीक्षा और प्रक्रियाओं के ब्यौरे होंगे तो अनुसूची में यथाविनिर्दिष्ट रेटिंग तथा इसके लिए अनुज्ञापन प्राधिकारी का अनुमोदन प्राप्त करने की अपेक्षा को पूरा करेगी ।

99. फीस और अन्य प्रभार. ( 1 ) वह अभ्यर्थी जो अनुज्ञप्ति इसके नवीकरण विधिमान्यकरण और रेटिंग या द्विप्रतिक अनुज्ञप्ति के लिए और ऐसी अनुज्ञप्ति व रेटिंग के हेतु परीक्षण तथा परीक्षण के लिए आवेदन करता है , उसे निम्नलिखित फीस का संदाय करेगा, अर्थातः--

500 / -रू. , प्रतिप्रश्नपत्र (i ) अनुज्ञप्ति और रेटिंग हेतु परीक्षणों एवं परीक्षा के लिए

1,000/-रू.

(ii ) छात्र हवाई यातायात नियंत्रक की अनुज्ञप्ति को जारी करने के लिए

500/-रू.

(iii ) छात्र हवाई यातायात नियंत्रक की अनुज्ञप्ति के नवीकरण के लिए

5,000/-रू.

(iv) छात्र हवाई यातायात नियंत्रक की अनुज्ञप्ति या रेटिंग के पृष्ठांकन से भिन्न अनुज्ञप्ति के जारी करने या किसी रेटिंग के विधिमान्यकरण के लिए

2,500/-रू.

(v) छात्र हवाई यातायात नियंत्रक की अनुज्ञप्ति या रेटिंग से भिन्न अनुज्ञप्ति के निर्गमन या विधिमान्यकरण के लिए

250/-रू.

(vi) छात्र हवाई यातायात नियंत्रक अनुज्ञप्ति की द्विप्रतीक के जारी करने के लिए

500/ -रू

(vii) छात्र हवाई यातायात नियंत्रक की

अनुज्ञप्ति से भिन्न अनुज्ञप्ति की अनुलिपि के जारी करने के लिए

500/-रू.

(viii) परीक्षा की द्विप्रतीक परिणाम सारिणी के जारी करने के लिए भारत का राजपत्र असाधारण

(2) आवेदक का निर्धारण, यदि कोई हो , के संबंध में सभी प्रभारों का संदाय करना होगा और निर्धारण के दौरान यदि कोई सरकारी परीक्षक सहयोजित है तो प्रत्येक निर्धारण के लिए दस हजार रू० फीस देय होगी ।

(3) इस फीस का संदाय वेतन और लेखा कार्यालय , महानिदेशक नागर विमानन, नागर व्वाईन मंत्रालय, नई दिल्ली के पक्ष में आहरित रेखित भारतीय पोस्टल आर्डर या डिमांड ड्राफ्ट द्वारा किया जाएगा ।

(4) उस मामले में जहां अनुज्ञप्ति या रेटिंग जारी नहीं की गई है, विधिमान्य नहीं की गई है या नवीकृत नहीं की गई है या द्विप्रतीक अनुज्ञप्ति या रेटिंग जारी नहीं की गई है, वहाँ केन्द्रीय सरकार फीस के रूप में संदत्त राशि का आनुपालिक अंश आवेदक को प्रतिदाय करने का आदेश दे सकती हैं या भावी परीक्षा के लिए अभ्यर्थी द्वारा संदेय अपेक्षित फीस में प्रतिदाय की जाने वाली राशि को समंजित कर सकती है ।

100. अनुज्ञप्ति प्राप्त करने के लिए न्यूनतम शैक्षिक अर्हता . इस भाग के अधीन किसी भी व्यक्ति को तब तक अनुज्ञप्ति प्रदान नहीं की जाएगी जब तक वह अनुसूची III में यथाविहित शैक्षिक अर्हता प्राप्त नहीं कर लेता ।

अर्हता प्राप्त हो 101. अनुज्ञप्ति प्राप्त करने के लिए न्यूनतम आयु . व्यक्ति जो अन्यथा और जिसे अनुज्ञप्ति प्रदान की जा सकती है, की न्यूनतम आयु अनुसूची III में निर्धारित के अनुसार होगी ।

102. अनुज्ञप्ति रेटिंग प्राप्त करने के लिए अधिकतम आयु सीमा कोई भी व्यक्ति साठ वर्ष की आयु पूरी करने के पश्चात्, इस भाग के अधीन अपनी अनुज्ञप्ति के विशेषाधिकारों का प्रयोग नहीं कर सकेगा।

103. चिकित्सा मानक ( 1 ) इस भाग के अधीन प्रदान की गई कोई अनुज्ञप्ति या रेटिंग जारी या नवीकृत नहीं की जाएगी यदि आवेदक के पास किसी अनुमोदित चिकित्सा प्राधिकारी से चिकित्सा कराने और इस प्रयोजनार्थ महानिदेशक द्वारा यथाविनिर्दिष्ट चिकित्सा मानक का समाधानप्रद होने के पश्चात् महानिदेशक द्वारा जारी किया गया चिकित्सा योग्यता मूल्यांकन नहीं है ।

परन्तु यदि अनुमोदित चिकित्सा प्राधिकारी की राय में आवेदक की दशा ऐसी नहीं है कि वह अपनी अनुज्ञप्ति या रेटिंग की विधिमान्यता की अवधि के दौरान अपनी ड्यूटियों को सफलतापूर्वक करने के लिए कोई खतरा या अचानक अशक्यता या असमर्थता प्रस्तुत करता है और प्रतिकारित होने के कारण शक्यता 8

की अपेक्षा प्राप्त करने में विफल हो जाता है एवं महानिदेशक के पास समाधानप्रद एक साक्ष्य है कि आवेदक पहले ही अपनी पात्रता, कौशल और अनुभव प्राप्त कर चुका है जो कि उसकी कमी को पूरा करते हैं , तो निर्धारण की कोई सीमा जिसे उचित समझी जाए , के साथ जारी किया जा सकेगा और ऐसी सीमा के साथ अनुज्ञप्ति या रेटिंग का नवीकरण या पृष्ठांकन किया जा सकेगा ।

स्पष्टीकरण.-- इस उप- नियम के प्रयोजनों के लिए अनुमोदित चिकित्सा प्राधिकारी से अभिप्रेत है महानिदेशक द्वारा अनुमोदित चिकित्सा प्राधिकारी ।

(2) महानिदेशक अनुज्ञप्ति धारक की किसी भी समय किसी चिकित्सा प्राधिकारी से चिकित्सा जाँच करवा सकते हैं यदि उनकी राय में प्रचालन सुरक्षा के हित में ऐसी जाँच आवश्यक है ।

104. अनुज्ञप्तियों की विधिमान्यता की अवधि और चिकित्सीय योग्यता निर्धारण

(1 ) छात्र विमान यातायात नियंत्रक की अनुज्ञप्ति की अधिकतम अवधि उसके जारी होने की तारीख से तीन वर्ष के लिए विधिमान्य होगी और इसे नवीकृत नहीं किया जा सकेगा।

(2) हवाई यातायात नियंत्रक की अनुज्ञप्ति की अधिकतम अवधि उसके जारी होने की तारीख से पाँच वर्ष के लिए विधिमान्य होगी और प्रत्येक बार उसे पाँच वर्ष की और अवधि के लिए नवीकृत किया जा सकेगा ।

(3) चिकित्सा दृष्टया योग्यता निर्धारण की विधिमान्यता की अधिकतम अवधि चिकित्सा परीक्षा की तारीख से दो वर्ष के लिए होगी

(4) अनुज्ञप्तिधारक की आयु 50 वर्ष पूरी होने के पश्चात् उपनियम (1 ) में विनिर्दिष्ट चिकित्सा दृष्टया योग्यता की विधिमान्यता की अवधि घटाकर आधी कर दी जाएगी ।

(5) (क) अनुज्ञप्ति की विधिमान्यता की अवधि उसके जारी करने की तारीख से प्रारंभ होगी ।

(ख) नवीकरण के मामले में विधिमान्यता की अवधि पूर्ववर्ती विधिमान्यता की समाप्ति की बाद वाली तारीख से प्रारंभ होगी भले ही नवीकरणं की तारीख कोई क्यों न हो बशर्ते कि नवीकरण के लिए आवेदन समाप्ति पूर्ववर्ती की तारीख के पश्चात तीस दिनों की अवधि के भीतर प्रस्तुत किया गया हो और नवीकरण के लिए आवेदन की तारीख को सभी अपेक्षाएं पूरी कर ली गई हों।

(ग) किसी अन्य मामले में , अनुज्ञप्ति के नवीकरण की विधिमान्यता नवीकरण की तारीख से प्रारंभ होगी ।

105. विधिमान्य चिकित्सा दृष्टया योग्यता निर्धारण के बिना अनुज्ञप्ति विधिमान्य नहीं. इस भाग के अधीन प्रदान की गई अनुज्ञप्ति विधिमान्य नहीं हो सकेगी यदि इसके साथ विधिमान्य चिकित्सा दृष्टया योग्यता निर्धारण नहीं होगा और धारक विधिमान्य चिकित्सा दृष्टया योग्यता निर्धारण के अभाव में अनुज्ञप्ति के विशेषाधिकारों का प्रयोग नहीं कर सकेगा।

106. चिकित्सा दृष्टया योग्यता में कमी. (1) अनुज्ञप्ति धारक किसी भी अवधि के दौरान अपनी अनुज्ञप्ति और रेटिंग के विशेषाधिकारों का प्रयोग नहीं कर सकेगा जब उसे लगे कि उसकी शारीरिक दशा बिगड़ गई है और चिकित्सा दृष्टयता योग्यता अनुज्ञप्ति की उस कोटि के लिए अपेक्षित मानक से नीचे गिर गई हैं ।

(2) अनुज्ञप्ति धारक अपनी बीमारी या चोट से पीड़ित होने जिसमें वह लगातार बीस दिन से अधिक अवधि तक अपने कर्तव्यों के निर्वहन में अपने को अशक्त पाता है या जिससे उसके कर्तव्यों के निवर्हन में उसकी कार्यक्षमता कम पड़ सकती है या वांछित हो सकती है, की स्थिति में दुबारा चिकित्सा जाँच के पश्चात् स्वस्थ घोषित हुए बिना अपनी अनुज्ञप्ति के विशेषाधिकारों का प्रयोग नहीं कर सकेगा ।

(3) अनुज्ञप्ति धारक या उसका नियोजक बीमारी या चोट का सुसंगत ब्यौरा तत्काल महानिदेशक को अधिसूचित करेगा।

(4) उपनियम (2) के अधीन प्रदर्शित किसी असमर्थ व्यक्ति की अनुज्ञप्ति तब तक अमान्य समझी जाएगी जब तक धारक दुबारा चिकित्सीय परीक्षा नहीं करा लेता।

107. रेटिंग और पृष्ठांकनों की विश्विमान्यता को बनाए रखना. (1 ) हवाई यातायात नियंत्रक अनुज्ञप्ति का धारक अनुज्ञप्ति के विशेषाधिकारों और अनुज्ञप्ति पर पृष्ठांकित रेटिंग का प्रयोग नहीं कर सकेगा यदि वह समक्षता और अभिनवता की अपेक्षाओं को पूरा नहीं कर लेता और यह रेटिंग निम्नलिखित के लिए विधिमान्य है-

(क) हवाई यातायात सेवा यूनिट या स्थान जिस पर वह ऐसा कार्य करता है

(ख ) सेक्टर जिस पर या प्रचालनात्मक पद जिस पर वह ऐसा कार्य करता है, और

(

ग) सर्विलांस उपकरण यदि कोई है, जिससे वह ऐसा कार्य करता है ।

(2) जब कोई व्यक्ति किसी विशिष्ट यूनिट में हवाई यातायात नियंत्रक के रूप में कार्य करना बंद कर देता है तो वह अनुसूची III में विनिर्दिष्ट अभिनवता अपेक्षा का अनुपालन करके अपनी नवीनतम रेटिंग को बनाए रख सकता है ।

108. यूनिट परिवर्तन को अधिसूचित करने के लिए अनुज्ञप्ति धारक की बाध्यता . जब रेटिंग किसी यूनिट या प्रचालनात्मक पद के लिए विधिमान्य नहीं रह जाती है तो अनुज्ञप्ति धारक उस स्थान की हवाई यातायात सेवा के प्रभारी व्यक्ति को तत्काल सूचित करेगा और उस पद पर तब तक कार्य नहीं करेगा जब तक ऐसी रेटिंग पुनः विधिमान्य नहीं हो जाती ।

109. अनुज्ञप्ति को धारण करने या प्राप्त करने से निरर्हता . ( 1 ) किसी व्यक्ति को सुने जाने का अवसर प्रदान करने के पश्चात् जहाँ अनुज्ञापन प्राधिकारी का यह समाधान हो जाता है कि कोई व्यक्ति

(क) महासारिक के सेवन में आदतन नशेड़ी है या स्वावक, औषधि और ऐसे पदार्थ का आदी है, या

(ख ) हवाई यातायात नियंत्रक के रूप में अपने पूर्ववर्ती आचरण से प्रदर्शित किया है कि वह अपने नियोजन संबंधी अपनी ड्यूटियों का निर्वहन में जिम्मेदार नहीं है या उससे हवाई में या भू पर वायुमान या किसी व्यक्ति की सुरक्षा को जोखिम में डालने की संभावना है ; या

(

ग) आदतन अपराधी है या शैक्षिक भ्रष्टता या अपराध जो जघन्य अपराध की श्रेणी में आता है, में संलिप्त होने के कारण भारत में न्यायालय द्वारा दोषी करार दिया गया, या

(घ ) सारभूत सूचना को छिपा करके या गलत सूचना के आधार पर अनुज्ञप्ति या रेटिंग प्राप्त है, या

(ड. ) अनुज्ञप्ति या रेटिंग या किसी अन्य सुसंगत दस्तावेज में दर्ज विशिष्टियों में अनधिकृत रूप से हेर- फेर या छेड़छाड़ की है ।

अनुज्ञापन प्राधिकारी लिखित में अभिलेख किए जाने वाले कारणों के लिए इस भाग में अनुज्ञप्ति लेने या अनुज्ञप्ति प्राप्त करने से विनिर्दिष्ट अवधि के लिए उस व्यक्ति को निरर्हक करने का आदेश जारी कर सकता है ।

(2) यदि केन्द्रीय सरकार इस भाग में उल्लिखित किसी भी अनुज्ञप्ति को प्राप्त करने से किसी व्यक्ति को स्थाई रूप से या अस्थाई रूप से विवर्जित कर सकेगी यदि उसकी राय में लोकहित में ऐसा करना आवश्यक हैं ।

(3) (क) उपनियम (1 ) या उपनियम (2) के अधीन कोई आदेश जारी होने पर प्रभावित व्यक्ति यदि वह अनुज्ञप्ति धारक है तो वह तत्काल अपनी अनुज्ञप्ति अनुज्ञापन प्राधिकारी को अभ्यर्पित करेगा यदि अनुज्ञप्ति पहले से अभ्यर्पित नहीं की गई है ।

ठहराया (ख) अनुज्ञापन प्राधिकारी उस अवधि जिसके लिए व्यक्ति को अयोग्य गया है या उसे विवर्जित कर दिया गया है या यदि उसे स्थाई रूप से दिया गया है, की समाप्ति तक पाँच वर्ष की अवधि के लिए विवर्जित कर अनुज्ञप्ति को अपने पास रख सकेगा।

110. अवसित अनुज्ञप्ति या रेटिंग का नवीकरण . - यदि नवीकरण के लिए आवेदन - पत्र प्रस्तुत करने की तारीख को अनुज्ञप्ति या रेटिंग अवसित हो चुकी है तो आवेदक को कार्य पर प्रशिक्षण प्राप्त करना पड़ेगा और उस अनुज्ञप्ति या रेटिंग को प्राप्त करने के लिए आवेदक की सक्षमता के मूल्यांकन के लिए परीक्षाएं और कौशल मूल्यांकन परीक्षण जो महानिदेशक द्वारा विनिर्दिष्ट किया जाए, में अर्हता प्राप्त करनी होगी ।

111. सक्षमता का सबूत (1 ) किसी अनुज्ञप्ति या रेटिंग की मंजूरी और नवीकरण के लिए आवेदक को सक्षमता का सबूत पेश करना होगा और अनुज्ञप्ति या रेटिंग की बाबत अनुसूची III में विनिर्दिष्ट परीक्षणों और परीक्षाओं को संतोषप्रद रूप से उत्तीर्ण करना होगा ।

(2 ) महानिदेशक ऐसे व्यक्ति को छूट प्रदान कर सकते हैं जिसने भारतीय वायु सेना या भारतीय नौसेना से हवाई यातायात नियंत्रक की अर्हता प्राप्त कर ली हैं और जो प्रदर्शित करने के लिए समाधानप्रद रूप में प्रमाण प्रस्तुत करता है कि उसके लिए इन नियमों के अधीन अपेक्षित 'सभी या कोई परीक्षा एवं चिकित्सा या अन्य तकनीकी परीक्षाओं से आवश्यक अनुभव, सक्षमता और चिकित्सा दृष्टया योग्यता के मानक है ।

(3 ) महानिदेशक पाठ्यक्रमों की परीक्षा के आधार पर ऐसे आवेदकों को अनुसूची III के अधीन अपेक्षित परीक्षाओं को उत्तीर्ण करने से छूट प्रदान करने के लिए परीक्षाओं की सापेक्ष समतुल्यता विहित कर सकते हैं।

(4) महानिदेशक उस अभ्यर्थी जिसने ऐसे प्रशिक्षण संस्थान से प्रशिक्षण पाठ्यक्रम पूरा किया है, की बाबत पाठ्यक्रम, प्रमाणपत्र , अंकतालिका, कार्य पर 12

प्रशिक्षण परीक्षण रिपोर्ट, मूल्यांकन आदि सहित परीक्षा के सभी सुसंगत प्रशिक्षण रिकार्डो को प्रस्तुत करने के लिए किसी व्यक्ति या प्रशिक्षण संगठन को आदेश दे सकते हैं ।

112. परीक्षण, मूल्यांकन एवं परीक्षा ( 1 ) महानिदेशक अनुसूची III में विनिर्दिष्ट ज्ञान के स्तर का परीक्षण करने के लिए परीक्षाएं आयोजित कर सकते हैं। भारत में परीक्षा केन्द्रों को निर्धारित कर सकते हैं, अन्वीक्षकों की नियुक्ति कर सकते हैं और परीक्षाएं आयोजित करने की प्रक्रिया निर्धारित कर सकते हैं ।

(2) महानिदेशक अनुज्ञप्तियों और रेटिंग जारी करने के लिए परीक्षाओं के ब्यौरेवार पाठ्यक्रमों का निर्धारण कर सकेगें ।

(3) (क) महानिदेशक, अनुसूची III के अधीन परीक्षाएं तथा मूल्यांकन करने के लिए परीक्षकों की नियुक्ति कर सकेंगे और मौखिक परीक्षाएं तथा मूल्यांकन, जहां कहीं आवश्यक हो , करने के लिए बोर्ड का भी गठन कर सकेंगे ।

(ख) इस प्रयोजनार्थ , परीक्षकों का चयन महानिदेशक द्वारा विनिर्दिष्ट किए गए मानदंडों के आधार पर किया जाएगा और अनुज्ञप्ति के निर्गमन या नवीकरण या अनुज्ञप्ति पर रेटिंग के लिए आयोजित किसी परीक्षा और मूल्यांकन की बाबत परीक्षा तथा मूल्यांकन रिपोर्ट अनुज्ञापन प्राधिकारी को प्रस्तुत की जाएंगी।

(4) महानिदेशक वह रीति विहित कर सकेंगे जिसमें मूल्यांकन व दक्षता की जांच की जाएगी ।

(5) महानिदेशक , किसी व्यक्ति को किसी मूल्यांकन या परीक्षा से स्थायी अथवा अस्थायी रूप से विवर्जित कर सकते हैं, यदि उनकी राय में उस व्यक्ति ने मूल्यांकन या परीक्षा में अनुचित तरीका अपनाया है ।

(6) (क) महानिदेशक किसी प्राधिकृत व्यक्ति अथवा बोर्ड द्वारा आयोजित किसी परीक्षा या मूल्यांकन को बातिल और शून्य घोषित कर सकते हैं, यदि उनकी राय में आयोजित परीक्षा या मूल्यांकन उनके समाधानप्रद रूप में नहीं है, और किसी अन्य प्राधिकृत व्यक्ति अथवा बोर्ड द्वारा पुनः परीक्षा या मूल्यांकन किया जाना अपेक्षित है।

(ख) महानिदेशक , ऐसे अप्राधिकृत व्यक्ति या बोर्ड के खिलाफ़, ऐसी कार्रवाई , जैसा उन्हें उचित लगे, भी कर सकेगें ।

113. हवाई यातायात सेवा यूनिट में रेडियो कॉल साइनों का प्रयोग.- द्विमार्गी रेडियो संचार का प्रयोग करने वाला कोई अनुज्ञप्ति धारक उस प्रयोजन, जिसके लिए कॉल साइन अधिसूचित किए गए हैं, से भिन्न अन्य प्रयोजन के लिए प्रयुक्त किए भारत का राजपत्र असाधारण

जाने वाले किसी कॉल साइन का प्रयोग नहीं करेगा या निमित्त नहीं बनेगा या अनुज्ञा नहीं देगा ।

114. अनुमोदित प्रशिक्षण संगठन ( 1 ) महानिदेशक इस बात का समाधान हो जाने पर, छात्रों के लिए अनुमोदित प्रशिक्षण पाठ्यक्रम संचालित करने के लिए एक प्रशिक्षण संगठन का अनुमोदन कर सकेंगे ताकि छात्र नियम 95 में विनिर्दिष्ट अनुज्ञप्ति या रेटिंग प्राप्त करने के लिए अपेक्षित सक्षमता स्तर को प्राप्त कर सकें ।

(2 ) प्रशिक्षण संगठन एक प्रशिक्षण तथा प्रक्रिया नियमावली प्रस्तुत करेगा जिसमें अनुमोदन हेतु महानिदेशक द्वारा विनिर्दिष्ट सूचना विहित होगी और ऐसे संगठनों में वही सिम्यूलेटर प्रशिक्षण शुरू किया जाएगा जो महानिदेशक द्वारा अनुमोदित सिम्यूलेटरों पर आधारित होगा ।

विधिमान्य समय में दो (3) प्रशिक्षण संगठन का अनुमोदन पांच वर्ष तक की अवधि के लिए होगा और इसे महानिदेशक द्वारा निर्धारित निबंधन और शर्तों के अधीन एक वर्षों से अनधिक अवधि के लिए नवीकृत किया जा सकेगा ।

(4) (क) किसी प्रशिक्षण संगठन को अनुमोदन प्रदान करने के लिए फीस एक लाख रुपए तथा प्रत्येक बार नवीकरण के लिए पचास हजार रुपए देय होगी ।

(ख) यह फीस वेतन एवं लेखा कार्यालय , महानिदेशक नागर विमानन, नागर विमानन मंत्रालय , नई दिल्ली के पक्ष में आहरित डिमांड ड्राफ्ट द्वारा संदेय होगी ।

(5) अनुमोदित प्रशिक्षण संगठन कोई ऐसा प्रशिक्षण जो उसके कार्य-क्षेत्र में नहीं है और महानिदेशक द्वारा विधिवत अनुमोदित नहीं है, नहीं प्रदान करेगा ।

(6 ) संगठन के प्रशिक्षण संबंधी अभिलेख महानिदेशक द्वारा विनिर्दिष्ट रीति में रखे जाएंगे और मांग किए जाने पर इन्हें महानिदेशक या इस संबंध में उनकी ओर से प्राधिकृत किसी अन्य अधिकारी को प्रस्तुत किया जाएगा ।

115. अनुभव को दर्ज करना और वॉच पीरियड को लॉग ऑन करना (1 ) प्रत्येक अनुज्ञप्ति धारक महानिदेशक द्वारा विहित प्ररूप में निजी लॉग बुक रखेगा और वास्तविक वॉच पीरियड , जिसके दौरान उसने अपनी अनुज्ञप्ति या रेटिंग के विशेषाधिकारों का प्रयोग करने के लिए या ऑन - द - जॉब ट्रेनिंग के लिए कोई ड्यूटी निष्पादित की है, को लागू मिलेगा ।

(2) लॉग बुक में सभी प्रविष्टियां स्याही में दर्ज की जाएंगी या इलेक्ट्रानिक रूप में लॉग की जाएंगी ।

(3) लॉग बुकें उसमें दर्ज की गई अंतिम प्रविष्टि की तारीख के पश्चात् कम से कम पांच वर्ष के लिए सुरक्षित रखी जाएंगी ।

(4) (क) प्रत्येक अनुज्ञप्ति धारक प्रत्येक कैलेंडर माह की समाप्ति से कम से कम वॉच पीरियड की बाबत अपनी लॉग बुक में प्रविष्टियों की सत्यता प्रमाणित करेगा ।

(ख) प्रत्येक तिमाही की समाप्ति पर इन लॉग बुकों में दर्ज की गई सत्यता हवाई यातायात सेवा यूनिट प्रभारी अथवा महानिदेशक द्वारा ऐसा करने के लिए प्राधिकृत किसी अन्य व्यक्ति द्वारा प्रमाणित की जाएगी ।

(5) वह वॉच टाइम जिसके दौरान अनुज्ञप्ति धारक ऑन- द- जॉब ट्रेनिंग पर है, उसकी लॉग बुक में ' ऑन - द- जॉब ट्रेनिंग ' के रूप में दर्ज की जाएगी और अनुज्ञप्ति धारक की लॉग बुक में दर्ज की गईं प्रविष्टियां अनुदेशक द्वारा प्रतिहस्ताक्षरित की जाएंगी जिसमें दिए गए प्रशिक्षण की प्रकृति दर्शाई गई हो ।

(6) अनुदेशक उस अवधि को उसकी लॉग बुक में वॉच पीरियड के रूप में लॉग करेगा जिसके दौरान वह अनुदेशक के रूप में कार्य करता है और अभ्युक्ति स्तंभ में लॉग की गई प्रविष्टियों को दर्शाएगा कि उस समय को अनुदेशात्मक प्रयोजन के लिए लॉग किया गया था ।

116. निगरानी ड्यूटी समय सीमाएं . इस भाग के अधीन जारी प्रत्येक अनुज्ञप्ति धारक महानिदेशक द्वारा विनिर्दिष्ट निगरानी ड्यूटी समय सीमाओं का अनुपालन करेगा ।

117. वैमानिक स्टेशन प्रचालक. उड़ान सूचना सेवा का हिस्सा बनने वाला प्रत्येक वैमानिक स्टेशन प्रचालक महानिदेशक द्वारा विनिर्दिष्ट अपेक्षाओं के अनुसार प्रचालन करेगा ।

118. विदेशी अनुज्ञप्तियों की विधिमान्यकरण ( 1 ) जहां कोई अनुज्ञप्ति किसी संविदाकारी राज्य के सक्षम प्राधिकारी द्वारा प्रदान की गई है और उस समय प्रवृत्त है, वहां केन्द्रीय सरकार ऐसी शर्तों एवं सीमाओं और ऐसी अवधि जिसे वह उचित समझती है, के अधीन ऐसी अनुज्ञप्ति को भारत में हवाई यातायात सेवा उपलब्ध कराने के प्रयोजनार्थ वही विधिमान्यता प्रदान कर सकेगी जो इन नियमों के अधीन प्रदान की गई है ।

उप - नियम (1 ) के अधीन प्रदत्त विधिमान्यकरण -

(क) अनुज्ञप्ति की विधिमान्यता की अवधि के पश्चात विस्तारित नहीं होगा ।

(ख) वैध नहीं होगा यदि जारी की गई अनुज्ञप्ति प्रतिसंहरित अथवा निलंबित हो जाती है , और

(ग) इन नियमों के नियम 19 के उपबंधों के अधीन होगा । "

4. अनुसूची III का अंतःस्थापन उक्त नियमों में अनुसूची II के पश्चात निम्नलिखित अनुसूची अन्तःस्थापित की जाएगी , अर्थात्: -

सामान्य

1. पृष्ठभूमि जांच .- प्रशिक्षण संगठन किसी व्यक्ति को हवाई यातायात नियंत्रण प्रशिक्षण हेतु नामांकित करने से पूर्व, संबंधित सहकारी एजेन्सी से पृष्ठभूमि जांच संबंधी रिपोर्ट प्राप्त करेगा और अनुज्ञप्ति जारी करने के आवेदन को प्रस्तुत करते समय पृष्ठभूमि जांच या सबूत अनुज्ञापन प्राधिकारी को सौंपेगा ।

2. अनुज्ञप्ति अथवा रेटिंग प्रदान करने के लिए आवेदन (क ) अनुज्ञप्ति या रेटिंग को जारी करने के लिए या विधिमान्यकरण या नवीकरण के लिए आवेदन विहित प्ररूप में महानिदेशक को किया जाएगा और उसके साथ निम्नलिखित होंगे -

(i ) अनुमोदित चिकित्सः प्राधिकारी या महानिदेशक द्वारा जारी चिकित्सकीय दृष्ट्या योग्यता का निर्धारण ;

(ii ) आवेदक के सिर ( अनावृत) और सामने के कंधों का 3 से.मी. x 4 से.मी. आकार के तीन अनारुढ़ फोटो चित्र;

( iii ) किसी मान्यता प्राप्त बोर्ड की दसवीं कक्षा के या उसके समतुल्य प्रमाणपत्र या नगर निगम अथवा समिति द्वारा जारी आयु के सबूत के रूप में जन्म प्रमाणपत्र ;

(iv) विहित फीस के संदाय के लिए बैंक ड्राफ्ट ;

(v) अपेक्षित शैक्षिक योग्यता, ज्ञान और अनुभव को पूरा करने का सबूत; और

(vi ) कोई अन्य जानकारी जिसकी महानिदेशक द्वारा अपेक्षा की जाए ।

(ख) आवेदन की तारीख वह तारीख होगी जिसको आवेदन महानिदेशक के कार्यालय में प्राप्त होंगे ।

(ग) इस अनुसूची में विनिर्दिष्ट अनुज्ञप्ति और रेटिंग उस नाम में जारी की जाएंगी , जो मान्यताप्राप्त बोर्ड की दसवीं कक्षा के या उसके समतुल्य प्रमाणपत्र में दर्ज है ।

3. अनुज्ञप्ति के नवीकरण के लिए आवेदन.- ( क) अनुज्ञप्ति अथवा रेटिंग के नवीकरण के लिए आवेदन महानिदेशक या उनके द्वारा इस निमित्त अभिहित किसी अन्य प्राधिकारी को विहित प्ररूप में किया जाएगा, और इसमें निम्नलिखित शामिल हैं -

(i) नियम 103 में उल्लिखित महानिदेशक द्वारा जारी चिकित्सक दृष्टया योग्यता का निर्धारण;

( ii) संबंधित हवाई यातायात सेवा यूनिट के प्रभारी व्यक्ति द्वारा सम्यक रूप से अधिप्रमाणित अभिनव अनुभव का विवरण;

(iii ) विहित फीस के संदाय के लिए बैंक ड्राफ्ट ; और

(iv ) कोई अन्य जानकारी जिसकी महानिदेशक द्वारा अपेक्षा की जाए ।

(ख) आवेदन की तारीख वह तारीख होगी जिसके आवेदन महानिदेशक के कार्यालय में या उनके द्वारा इस निमित्त अभिहित किसी अन्य कार्यालय में प्राप्त हो ।

4. परीक्षा.- ( क) छात्र हवाई यातायात नियंत्रक की अनुज्ञप्ति या हवाई यातायात नियंत्रक की अनुज्ञप्ति या रेटिंग जारी करने के लिए आवेदक को महानिदेशक द्वारा विनिर्दिष्ट रीति में आयोजित परीक्षा उत्तीर्ण करनी होगी ।

(ख) अभ्यर्थी परीक्षक द्वारा मांगे जाने पर, परीक्षा से पूर्व पहचान का सबूत पेश करेगा ।

(ग) कोई आवेदक, जो किसी परीक्षा में असफल होता है, उसे परीक्षा की तारीख से कम से कम दो सप्ताह की अवधि के भीतर पुनः परीक्षा में शामिल होने की अनुमति नहीं दी जाएगी ।

5. परीक्षक या बोर्ड द्वारा निर्धारण. पृष्ठांकन प्राप्त करने के लिए, छात्र हवाई यातायात नियंत्रक की अनुज्ञप्ति अथवा हवाई यातायात नियंत्रक की अनुज्ञप्ति धारक का महानिदेशक द्वारा विधिवत् प्राधिकृत परीक्षक या अनुज्ञप्ति प्राधिकारी द्वारा इस प्रयोजनार्थ गठित परीक्षक बोर्ड द्वारा निर्धारण किया जाएगा ।

6. परीक्षा की विधिमान्यता और निर्धारण (क) अनुज्ञप्ति अथवा रेटिंग जारी करने के लिए परीक्षा अनुज्ञप्ति जारी करने के लिए दिए गए आवेदन की तारीख से पूर्व तीन वर्ष की अन्यून अवधि के भीतर उत्तीर्ण की गई हो ।

(ख ) अनुज्ञप्ति पर पृष्ठांकन के प्रयोजनार्थ निर्धारण की विधिमान्यता छह माह की अवधि के लिए होगी ।

(ग) यदि कोई परीक्षा अथवा निर्धारण का अवशान अवकाश के दिन होता है, तो उसे आगामी कार्यकरण दिन तक विधिमान्य समझा जाएगा ।

7. ऑन- द- जॉब प्रशिक्षण आवश्यकता छात्र हवाई यातायात नियंत्रक अनुज्ञप्ति अथवा हवाई यातायात नियंत्रक अनुज्ञप्ति धारक को किसी विशेष रेटिंग प्रदान किए जाने हेतु इस अनुसूची में विनिर्दिष्ट अवधि के लिए किसी प्राधिकृत अनुदेशक के अधीन ऑन- द- जॉब प्रशिक्षण करना होगा ।

परंतु जब अनुज्ञप्ति प्राधिकारी , व्वाई यातायात यूनिट, जिसके लिए रेटिंग मांगी गई है, की यातायात मात्रा और अनुज्ञप्ति धारक के अनुभव के संबंध में , संतुष्ट है, तो कम अवधि के लिए ऑन- द - जॉब प्रशिक्षण अनुमोदित कर सकता है ।

8. विशेषाधिकारों के प्रयोग से पहले की शर्ते (क) कोई भी व्यक्ति जो वर्तमान में हवाई यातायात नियंत्रक अनुज्ञप्ति धारक है, विशेषाधिकार का प्रयोग नहीं कर सकता जब तक वह सक्षमता , अभिनवता तथा भाषा निपुणता आवश्यकता और चिकित्सा मानकों को पूरा न करता हो, जो इन नियमों के तदनुसार उस पर लागू होते हैं ।

(ख ) अनुज्ञप्ति धारक शराब अथवा किसी साकोएक्टिव पदार्थ के प्रभाव के अधीन अपनी अनुज्ञप्ति और संबंधित रेटिंगों के विशेषाधिकार का प्रयोग नहीं करेगा , जिसके कारण वह अनुज्ञप्ति और रेटिंग के विशेषाधिकारों के सुरक्षित और सही प्रयोग में असमर्थ हो।

9. अभिनवता अपेक्षा - एक अनुज्ञप्ति धारक अपनी अनुज्ञप्ति पर रेटिंग और पृष्ठांकन के संबंध में अभिनव समझा जाएगा यदि उसने पूर्ववर्ती छह महीनों के दौरान किसी विशेष रेटिंग के संबंध में 3 दिन की अवधि में न्यूनतम 10 घंटों की अवधि के लिए कार्य किया हो ।

10. भाषा प्रवीणता - ( क) छात्र हवाई यातायात नियंत्रक अनुज्ञप्ति अथवा हवाई यातायात नियंत्रक अनुज्ञप्ति प्राप्त करने के लिए आवेदक को महानिदेशक द्वारा विनिर्दिष्ट दक्षता के स्तर तक रेडियोटेलीफोनी संचार में प्रयुक्त अंग्रेजी भाषा को बोलने और समझने की क्षमता प्राप्त करनी होगी ।

(ख ) प्रवीणता के स्तर का मूल्यांकन महानिदेशक द्वारा विहित प्रक्रियाओं के अनुसार होगा ।

(ग) अनुज्ञप्ति प्राधिकारी अनुज्ञप्ति में प्रवीणता स्तर को इंगित करेगा ।

खंड ख

छात्र हवाई यातायात नियंत्रक अनुज्ञप्ति

1. अनुज्ञप्ति जारी करने के लिए अपेक्षाएं . छात्र हवाई यातायात नियंत्रक अनुज्ञप्ति जारी करने के लिए आवेदक निम्नलिखित अपेक्षाओं का समाधान करेगा, अर्थातः-

होगी । (क) आयु . आवेदन की तारीख को उसकी आयु बीस वर्ष से कम नहीं

(ख) शैक्षिक अर्हता.- उसने किसी मान्यता प्राप्त विश्वविद्यालय से भौतिक विज्ञान और गणित विषयों के साथ विज्ञान में डिग्री या कोई समतुल्य परीक्षा उत्तीर्ण की होगी या उसके पास कोई विधिमान्य भारतीय वाणिज्यिक पायलट अनुज्ञप्ति होगी ।

(ग) चिकित्सा दृष्ट्या योग्यता. उसके पास नियम 103 में उल्लिखित महानिदेशक द्वारा जारी किया गया विधिमान्य चिकित्सा दृष्ट्या योग्यता निर्धारण होगा ।

(घ) ज्ञान. - उसके निम्नलिखत विषयों में लिखित परीक्षा उत्तीर्ण करके ज्ञान के अपेक्षित स्तर का प्रदर्शन करना होगा , अर्थातः--

(i ) हवाई संबंधी कानून वायुयान नियम , 1937 के उपबंध , नागर विमानन अपेक्षाएं और हवाई यातायात नियंत्रण से संबंधी कोई अन्य परिपत्र या अनुदेश ;

(ii ) हवाई यातायात नियंत्रण उपकरण - हवाई यातायात नियंत्रण में प्रयुक्त उपकरणों के सिद्धांत, प्रयोग और सीमाएं ;

(iii) सामान्य ज्ञान.- हवाई यातायात नियंत्रण संबंधी प्रकाश के सिद्धांत , वायुयान प्रचालन के सिद्धांत और कार्यकरण , विद्युत संयंत्रों की कार्यप्रणाली , हवाई यातायात नियंत्रण के सुसंगत वायुयान कार्य निष्पादन ;

(

iv) मानव निष्पादन. हवाई यातायात नियंत्रण से संबद्ध मान कार्य

निष्पादन ;

(v) मौसम विज्ञान. वैमानिक मौसम विज्ञान, मौसम विज्ञान संबंधी कागज़ातों और सूचना का उपयोग और मूल्यांकन , उड़ान प्रचालनों , सुरक्षा और तुंगतामापी को प्रभावित करने वाले मौसम परिघटनाओं का उद्गम और विशिष्टताएं ;

(vi) दिक्चालन.- हवाई दिक्चालन का सिद्धांत , दिक्चालन प्रणाली का सिद्धांत , सीमा और परिशुद्धता एवं दृश्य सहायक ;

(vii) प्रचालनात्मक प्रक्रियाएं. हवाई यातायात नियंत्रण संचार, रेडियोटेलीफोनी और वाक्य रचना प्रक्रिया नेमी, मार्गस्थ और आपातकालीन संगत वैमानिक प्रलेखन के प्रयोग , उड़ान संबंधी सुरक्षा पद्धति ;

(ङ) अनुभव - उसने किसी अनुमोदित प्रशिक्षण संगठन से सिग्यूलेटर प्रशिक्षण सहित , अनुमोदित प्रशिक्षण सफलतापूर्वक पूरा किया हो और संबंधित परीक्षा उत्तीर्ण की हो और किसी अनुमोदित संगठन से किसी रेटिंग संबंधी अथवा विषय में अनुमोदित प्रशिक्षण पाठ्यक्रम पूरा किया हो ।

2. विधिमान्यता. - अनुज्ञप्ति नियम 104 को विनिर्दिष्ट अवधि के लिए विधिमान्य होगी और धारक के हवाई यातायात नियंत्रक अनुज्ञप्ति प्राप्त करने पर वह समाप्त हो जाएगी ।

3. विशेषाधिकार. - अनुज्ञप्ति की विधिमान्यता के अधीन रहते हुए , छात्र हवाई यातायात नियंत्रक अनुज्ञप्ति का धारक अपनी अनुज्ञप्ति पर ऐसी रेटिंग के पृष्ठांकन को अर्हित करने के प्रयोजनार्थ कार्य पर प्रशिक्षण की अपेक्षा को पूरा करने के लिए उस हवाई यातायात सेवा यूनिट में किसी रेटिंग प्राधिकृत अनुदेशक के प्रत्यक्ष पर्यवेक्षणाधीन किसी विशिष्ट हवाई यातायात सेवा यूनिट में हवाई यातायात नियंत्रक के रूप में कार्य कर सकेगा ।

अनुभाग ग

हवाई यातायात नियंत्रक अनुज्ञप्ति

1. अनुज्ञप्ति जारी किए जाने के लिए अपेक्षाएं. हवाई यातायात नियंत्रक अनुज्ञप्ति जारी किए जाने के लिए आवेदक को निम्नलिखित अपेक्षाओं की पूर्ति करनी होगी , अर्थातः--

(क) आयु - आवेदन की तारीख को उसकी आयु इक्कीस वर्ष से कम नहीं होगी ।

(ख) शैक्षिक योग्यता. उसने किसी मान्यताप्राप्त विश्वविद्यालय से भौतिक विज्ञान और गणित विषयों के साथ विज्ञान में डिग्री या समतुल्य परीक्षा उत्तीर्ण की हो , या उसके पास कोई विधिमान्य भारतीय वाणिज्यिक पायलट अनुज्ञप्ति होगी ।

(ग) चिकित्सा दृष्ट्या योग्यता उसके पास नियम 103 में उल्लिखित महानिदेशक द्वारा जारी किया गया विधिमान्य चिकित्सा दृष्ट्या योग्यता निर्धारण होगा ।

(घ) ज्ञान.- ( i ) वह वैध छात्र हवाई यातायात नियंत्रक की अनुज्ञप्ति का धारक हो ।

( ii ) उसने इस अनुसूची के अनुभाग घ, ड. , च, छ, ज , झ , और ञ में विनिर्दिष्ट किसी विशेष विमान यातायात सेवा यूनिट के लिए कम से कम एक रेटिंग प्राप्त करने की परीक्षा उत्तीर्ण की हो ।

(ड.) अनुभव. उसने किसी प्राधिकृत अनुदेशक के तहत अनुज्ञप्ति पर पृष्ठांकन के लिए वांछित यूनिट अथवा यूनिटों के संबंध में निर्धारित अवधि के लिए आन - द - जॉब प्रशिक्षण प्राप्त किया है और कथित यूनिट अथवा यूनिटों के लिए परीक्षक अथवा बोर्ड द्वारा सफल घोषित किया गया हो ।

2. विधिमान्यता. अनुज्ञप्ति नियम 104 को विनिर्दिष्ट अवधि के लिए विधिमान्य होगी ।

3. पुनः विधिमान्य करणः रेटिंग का पुनः विधिमान्यकरण नियम 104 में किए गए उपबंध के अनुसार होगा जो आवेदक द्वारा वैध चिकित्सा दृष्टया योग्यता और कम से कम एक वैध रेटिंग धारण करने के अधीन होगा ।

4. विशेषाधिकार.- अनुज्ञप्ति की विधिमान्यता के अधीन रहते हुए , व्वाई यातायात नियंत्रक अनुज्ञप्ति का धारक अपनी अनुज्ञप्ति पर ऐसी रेटिंग को सम्मिलित करने के लिए किसी विशिष्ट वाई यातायात सेवा यूनिट में वाई यातायात नियंत्रक के रूप में कार्य कर सकेगा ।

अनुभाग घ

एरोड्रोम नियंत्रण रेटिंग

1. रेटिंग जारी करने हेतु अपेक्षाएं . एरोड्रोम नियंत्रण रेटिंग जारी करने के लिए आवेदक, निम्नलिखित अपेक्षाओं का समाधान करेगा, अर्थातः--

(क) ज्ञान. वह छात्र विमान यातायात नियंत्रक की अनुज्ञप्ति या हवाई यातायात नियंत्रक की अनुज्ञप्ति का धारक हो और उसने संबंधित एरोड्रोम नियंत्रण टॉवर से निम्नलिखित विषयों की परीक्षा उत्तीर्ण करके ज्ञान के अपेक्षित स्तर को प्रदर्शित किया हो , अर्थातः--

(i) एयरोड्रोम ले-आउट, भौतिक विशेषताएं और दृश्य सहायक (ii ) एयरस्पेस संरचना

(iii ) प्रयोज्य नियम, प्रक्रिया और सूचना का स्त्रोत

(iv) हवाई दिक्चालन सुविधा

(v) हवाई यातायात नियंत्रण उपकरण और उनका उपयोग

(vi) भू- भाग और प्रमुख सीमा चिह्न

(vii) हवाई यातायात के लक्षण

(viii ) मौसम संवृति

(ix) आपातकालीन एवं तलाश तथा बचाव योजनाएं

(x) कोई अन्य विषय जिसे विशिष्ट स्थान के लिए उचित समझा गया हो ।

(ख) अनुभव. वह किसी अनुदेशक या किसी प्राधिकृत हवाई यातायात नियंत्रक अनुज्ञप्ति धारक के पर्यवेक्षणाधीन ऑन-द-जॉब प्रशिक्षण प्राप्त करने का प्रमाण - पत्र प्रस्तुत करेगा जिसकी अवधि डेढ़ माह से अन्यून नहीं थी, उस दौरान उसने उस यूनिट में कम से कम नब्बे घंटे का प्रशिक्षण पूरा किया हो जिसके लिए उससे रेटिंग मांगी गई है ।

परन्तु, महानिदेशक इस संबंध में विनिर्दिष्ट शर्तों के अधीन किसी अन्य एयरोड्रोम के लिए हवाई यातायात नियंत्रण धारक या जिसने एयरोड्रोम नियंत्रण रेटिंग धारण किया हो, के लिए ऑन- द- जॉब प्रशिक्षण की अवधि को कम कर सकते हैं।

(ग) कौशल.- सुरक्षित, सुव्यवस्थित तथा त्वरित एरोड्रोम नियंत्रण सेवा प्रदान करने के लिए उसके कौशल, निर्णय और कार्य निष्पादन की बाबत उसका सफल मूल्यांकन कराया गया हो और ऑन-द-जॉब प्रशिक्षण की अपेक्षा को पूरा करने के बाद यथाशीघ्र उसका मूल्यांकन किया जाएगा किन्तु किसी मामले में यह मूल्यांकन उससे दो माह अधिक विलम्ब से नहीं होगा ।

2. विधिमान्यता.- यदि किसी हवाई यातायात नियंत्रक ने रेटिंग विशेषाधिकारों का प्रयोग छह माह से अधिक समय के लिए नहीं किया है, तो उसकी रेटिंग अमान्य हो जाएगी ।

3. पुनः विधिमान्यकरण . रेटिंग का पुनः विधिमान्यकरण नियम 110 में किए गए उपबंध के अनुसार होगा ।

4. विशेषाधिकार.- (क ) रेटिंग धारक का विशेषाधिकार उस महासागरीय नियंत्रण सेवा या उसके भाग के आकाशी क्षेत्र अधिकार क्षेत्र के भीतर महासागरीय में क्षेत्र नियंत्रण सेवा प्रदान करने या पर्यवेक्षण के लिए होगा जहाँ उसे रेटिंग प्रदान की गई है ।

अनुभाग - ड.

पहुंच नियंत्रण प्रक्रियात्मक रेटिंग

1. रेटिंग जारी करने के लिए अपेक्षाए. पहुंच नियंत्रण प्रक्रियात्मक रेटिंग जारी करने के लिए आवेदक निम्नलिखित अपेक्षाओं का समाधान करेगा, अर्थातः--

(क) ज्ञान.- वह हवाई यातायात नियंत्रक की अनुज्ञप्ति या छात्र हवाई यातायात नियंत्रक की अनुज्ञप्ति का धारक हो और उसने किसी विशिष्ट स्थान पर पहुंच नियंत्रण यूनिट के लिए कम से कम निम्नलिखित विषयों में परीक्षा उत्तीर्ण करके ज्ञान के अपेक्षित स्तर का प्रदर्शित किया हो , अर्थातः--

(i) . विमानक्षेत्र संरचना

(ii) प्रयोज्य नियम, प्रक्रिया और सूचना का स्त्रोत

(iii ) हवाई दिक्चालन सुविधा 24

(iv) हवाई यातायात नियंत्रण उपकरण और उनका उपयोग

(v) भू- भाग और सीमा चिह्न

(viii ) आपातकालीन एवं तलाश तथा बचाव योजनाएं

(ix) कोई अन्य विषय जिसे विशिष्ट स्थान के लिए उचित समझा गया हो ।

(ख) अनुभव. वह किसी अनुदेशक या किसी प्राधिकृत हवाई यातायात नियंत्रक अनुज्ञप्ति धारक के मार्गदर्शन में कार्य पर प्रशिक्षण प्राप्त करने का ऐसा प्रमाण पत्र प्रस्तुत करेगा जिसकी पर्यवेक्षणाधीन अवधि तीन माह से अन्यून नहीं होगी , उस दौरान उसने उस यूनिट में कम से कम एक सौ अस्सी घंटे का प्रशिक्षण पूरा हो , जिसके लिए उससे रेटिंग मांगी गई है।

परन्तु, महानिदेशक इस संबंध में विनिर्दिष्ट शर्तों अधीन किसी अन्य विमानक्षेत्र के लिए पहुंच नियंत्रण प्रक्रियात्मक रेटिंग धारण करने वाले या जिन्होंने धारण किया है, विमान यातायात नियंत्रक से कार्य पर प्रशिक्षण की अवधि को कम कर सकते हैं।

(ग) कौशल.- सुरक्षित, सुव्यवस्थित तथा त्वरित पहुंच नियंत्रण सेवा प्रदान करने के लिए उसके कौशल , निर्णय और कार्य निष्पादन की बाबत किसी परीक्षक द्वारा उसका सफल मूल्यांकन कराया गया हो और कार्य पर प्रशिक्षण की अपेक्षा को पूरा करने के पश्चात यथाशीघ्र उसका मूल्यांकन किया जाएगा किन्तु किसी मामले में यह मूल्यांकन उससे तीन माह अधिक विलम्ब से नहीं होगा ।

2. विधिमान्यता.- यदि किसी व्वाई यातायात नियंत्रक ने रेटिंग विशेषाधिकारों का प्रयोग छह माह से अधिक समय के लिए नहीं किया है तो उसकी रेटिंग अमान्य हो जाएगी ।

3. पुनः विधिमान्यकरण . - रेटिंग का पुनः विधिमान्यकरण नियम 110 में किए गए उपबंध के अनुसार होगा ।

4. विशेषाधिकार.- (क ) रेटिंग धारक का विशेषाधिकार उस व्वाई क्षेत्र में वाईक्षेत्र नियंत्रण सेवा प्रदान करने या पर्यवेक्षण के लिए होगा जहाँ उसे रेटिंग प्रदान की गई है ।

(ख ) विशेषाधिकारों का प्रयोग करने से पूर्व , रेटिंग धारक सभी सुसंगत और मौजूदा जानकारी से परिचित होगा ।

अनुभाग च

पहुंच नियंत्रण सर्विलांस रेटिंग

1. रेटिंग जारी करने के लिए अपेक्षाएं. पहुंच नियंत्रण सर्विलांस रेटिंग जारी करने के लिए आवेदक निम्नलिखित अपेक्षाओं का समाधान करेगा, अर्थातः--

(क) ज्ञान.- वह हवाई यातायात नियंत्रक की अनुज्ञप्ति या छात्र व्वाई यातायात नियंत्रक की अनुज्ञप्ति का धारक हो और उसने किसी विशिष्ट स्थान पर दायित्व के क्षेत्र से संबंधित निम्नलिखित विषयों में परीक्षा उत्तीर्ण करके ज्ञान के अपेक्षित स्तर को प्रदर्शित किया हो , अर्थातः--

(i) हवाई क्षेत्र संरचना

(ii ) प्रयोज्य नियम, प्रक्रिया और सूचना का स्त्रोत

(iii ) हवाई दिक्चालन सुविधा

(iv) हवाई यातायात नियंत्रण उपकरण और उनका उपयोग

भू- भाग और सीमा चिह्न

(v)

(vi) हवाई यातायात और यातायात प्रवाह के लक्षण

(vii) मौसम संवृति

(viii) आपातकालीन एवं तलाश तथा बचाव योजनाएं

(ix) प्रयोज्य हवाई यातायात सेवाएं सर्विलांस प्रणालियों तथा संबंधित उपस्करों के सिद्धांत, उपयोग और सीमाएं ।

) यथोचित, हवाई यातायात सेवाएं सर्विलांस सेवा उपलब्ध कराने की प्रक्रियाएं, उचित भूभाग क्लीयरेंस सुनिश्चित करने हेतु प्रक्रियाओं सहित।

(

xi ) कोई अन्य विषय जिसे किसी विशिष्ट स्थान के लिए उपयुक्त समझा गया हो ।

(

ख) अनुभव. वह प्रमाण पत्र प्रस्तुत करेगा जिसमें -

(i) कि उसने सर्विलांस प्रणाली पर अनुमोदित प्रशिक्षण पाठ्यक्रम सफलतापूर्वक पूर्ण किया है; और

(ii) कि उसने किसी अनुदेशक या किसी प्राधिकृत हवाई यातायात नियंत्रक अनुज्ञप्ति धारक के पर्यवेक्षणाधीन कार्य पर प्रशिक्षण प्राप्त किया है जिसकी अवधि तीन माह से अन्यून नहीं थी , उस दौरान उसने उस यूनिट में कम से कम एक सौ अस्सी घंटे का प्रशिक्षण पूरा किया हो जिसके लिए उससे रेटिंग मांगी गई है ।

परन्तु, महानिदेशक इस संबंध में विनिर्दिष्ट शर्तों के अधीन किसी अन्य विमानक्षेत्र के लिए पहुंच नियंत्रण सर्विलांस रेटिंग धारण करने वाले या जिसने धारण किया है , व्वाई यातायात नियंत्रक से कार्य पर प्रशिक्षण की अवधि को कम कर सकते हैं ।

(ग) कौशल. - सुरक्षित , सुव्यवस्थित तथा त्वरित पहुंच नियंत्रण सेवा प्रदान करने के लिए उसके कौशल, निर्णय और निष्पादन की बाबत किसी परीक्षक द्वारा उसका सफल मूल्यांकन कराया गया हो और कार्य परं प्रशिक्षण की अपेक्षा को पूरा करने के बाद यथाशीघ्र उसका मूल्यांकन किया जाएगा किन्तु किसी मामले में यह मूल्यांकन उससे तीन माह अधिक विलम्ब से नहीं होगा।

2. विधिमान्यता . यदि किसी व्वाई यातायात नियंत्रक ने रेटिंग विशेषाधिकारों का प्रयोग छह माह से अधिक समय के लिए नहीं किया है तो उसकी रेटिंग अमान्य हो जाएगी ।

4. विशेषाधिकार .- (क ) रेटिंग धारक का विशेषाधिकार, पहुंच नियंत्रण सेवा प्रदान करने वाली यूनिट के अधिकारक्षेत्र में आने वाले एयरस्पेस या उसके भाग के भीतर विमान यातायात सेवाएं सर्विलांस प्रणालियों के उपयोग से पहुंच नियंत्रण सेवा के प्रावधान प्रदान करना या पर्यवेक्षण के लिए होगा जहाँ उसे रेटिंग प्रदान की गई है ।

(ख) विशेषाधिकारों का प्रयोग करने से पूर्व, रेटिंग धारक सभी सुसंगत और प्रचालित जानकारी से परिचित होगा ।

क्षेत्रीय नियंत्रण प्रक्रियात्मक रेटिंग

रेटिंग जारी करने के लिए अपेक्षाएं . क्षेत्र नियंत्रण प्रक्रियात्मक रेटिंग जारी करने के लिए , आवेदक निम्नलिखित अपेक्षाओं का समाधान करेगा , अर्थातः--

(क) ज्ञान.- वह विमानयातायात नियंत्रक की अनुज्ञप्ति या छात्र हवाई यातायात नियंत्रक की अनुज्ञप्ति का धारक हो और वह क्षेत्र नियंत्रण यूनिट से संबंधित निम्नलिखित विषयों की परीक्षा उत्तीर्ण करके ज्ञान के अपेक्षित स्तर को प्रदर्शित किया हो, अर्थातः--

(i ) हवाई क्षेत्र संरचना

प्रयोज्य नियम , प्रक्रिया और सूचना का स्त्रोत

(ii )

iii ) हवाई दिक्चालन सुविधा

(iv) हवाई यातायात नियंत्रण उपकरण और उनका उपयोग

(v) भू- भाग और सीमा चिह्न

हवाई यातायात और यातायात प्रवाह के लक्षण

(vii ) मौसम संवृति

आपातकालीन एवं तलाश तथा बचाव योजनाएं

(ix) कोई अन्य विषय जिसे किसी विशिष्ट स्थान के लिए उपयुक्त समझा गया हो ।

(ख ) अनुभवः- वह किसी अनुदेशक या किसी प्राधिकृत विमान यातायात नियंत्रक अनुज्ञप्ति धारक के पर्यवेक्षणाधीन कार्य पर प्रशिक्षण प्राप्त करने का ऐसा प्रमाण पत्र प्रस्तुत करेगा जिसकी अवधि तीन माह से अन्पून नहीं होगी , उसके दौरान उसने उस यूनिट में कम से कम एक सौ अस्सी घंटे का प्रशिक्षण पूरा हो , जिसके लिए उससे रेटिंग मांगी गई है:

परन्तु, महानिदेशक इस संबंध में विनिर्दिष्ट शर्तों के अधीन किसी अन्य विमान यातायात सेवा यूनिट में क्षेत्रीय नियंत्रण प्रक्रियात्मक रेटिंग धारण करने वाले या जिसने धारण किया है, विमान यातायात नियंत्रक से कार्य पर प्रशिक्षण की अवधि को कम कर सकते हैं ।

(ग) कौशलः- सुरक्षित , सुव्यवस्थित तथा त्वरित पहुंच नियंत्रण सेवा प्रदान करने के लिए उसके कौशल, निर्णय और कार्य निष्पादन की बाबत किसी परीक्षक द्वारा उसका सफल मूल्यांकन करना होगा और कार्य पर प्रशिक्षण की अपेक्षा को पूरा करने के बाद यथाशीघ्र उसका मूल्यांकन किया जाएगा किन्तु किसी मामले में यह मूल्यांकन उससे तीन माह अधिक विलम्ब से नहीं होगा ।

2. विधिमान्यताः- यदि किसी व्वाई यातायात नियंत्रक ने रेटिंग विशेषाधिकारों का प्रयोग छह माह से अधिक समय के लिए नहीं किया है तो उसकी रेटिंग अमान्य हो जाएगी ।

3. पुनः विधिमान्यकरण: रेटिंग का पुनः विधिमान्यकरण नियम 110 में किए गए उपबंध के अनुसार होगा ।

4. विशेषाधिकारः- (क) रेटिंग धारक का विशेषाधिकार उस नियंत्रण सेवा या उसके भाग के हवाई क्षेत्र अधिकारक्षेत्र में क्षेत्र नियंत्रण सेवा प्रदान करने या पर्यवेक्षण के लिए होगा जहाँ उसे रेटिंग प्रदान की गई है।

(ख) विशेषाधिकारों का प्रयोग करने से पूर्व , रेटिंग धारक सभी सुसंगत और मौजूदा जानकारी से परिचित होगा ।

अनुभाग ज

क्षेत्र नियंत्रण सर्विलांस रेटिंग

रेटिंग जारी करने के लिए अपेक्षाएं. क्षेत्र नियंत्रण सर्विलांस रेटिंग जारी 1. करने के लिए , आवेदक निम्नलिखित अपेक्षाओं का समाधान करेगा, अर्थातः--

(क) ज्ञान.- वह हवाई यातायात नियंत्रक की अनुज्ञप्ति या छात्र वाई यातायात नियंत्रक की अनुज्ञप्ति का धारक हो और वह किसी विशिष्ट यूनिट के दायित्व क्षेत्र के संबंधित कम से कम निम्नलिखित विषयों की परीक्षा उत्तीर्ण करके ज्ञान के अपेक्षित स्तर को प्रदर्शित किया हो , अर्थातः--

(i) हवाई क्षेत्र संरचना

(ii) प्रयोज्य नियम, प्रक्रिया और सूचना का स्त्रोत

(iii ) हवाई दिक्चालन सुविधा

(iv) विमान यातायात नियंत्रण उपकरण और उनका उपयोग

(ix ) प्रयोज्य व्वाई यातायात सेवाएं सर्विलांस प्रणालियों तथा संबंधित उपस्करों के सिद्धांत , उपयोग और सीमाएं ।

(x) यथोचित , व्वाई यातायात सेवाएं सर्विलांस सेवाएं उपलब्ध कराने की प्रणाली , उचित भूभाग क्लीयरेंस सुनिश्चित करने हेतु प्रक्रियाओं सहित ।

(xi ) कोई अन्य विषय जिसे किसी विशिष्ट स्थान के लिए उचित समझा गया हो ।

(ख ) अनुभव.- वह प्रमाण पत्र प्रस्तुत करेगा , जिसमें -

(i ) कि उसने सर्विलांस प्रणाली पर अनुमोदित प्रशिक्षण पाठ्यक्रम सफलतापूर्वक पूर्ण किया है; और

(ii ) कि उसने किसी अनुदेशक या किसी प्राधिकृत विमान यातायात नियंत्रक अनुज्ञप्ति धारक के पर्यवेक्षणाधीन कार्य पर प्रशिक्षण प्राप्त किया है जिसकी अवधि तीन माह से अन्यून नहीं थी , उस दौरान उसने उस यूनिट में कम से कम एक सौ अस्सी घंटे का प्रशिक्षण पूरा किया हो जिसके लिए उससे रेटिंग मांगी गई है ।

उड़ान सूचना सेवा रेटिंग

1. रेटिंग जारी करने के लिए अपेक्षाएं किसी को उड़ान सूचना सेवा रेटिंग जारी करने के लिए , आवेदक निम्नलिखित अपेक्षाओं का समाधान करेगा , अर्थातः--

(क) ज्ञान.- वह हवाई यातायात नियंत्रक की अनुज्ञप्ति या छात्र व्वाई यातायात नियंत्रक की अनुज्ञप्ति का धारक हो और वह किसी विशिष्ट यूनिट के दायित्व क्षेत्र के संबंधित कम से कम निम्नलिखित विषयों की परीक्षा उत्तीर्ण करके ज्ञान के अपेक्षित स्तर को प्रदर्शित किया हो: -

परन्तु, महानिदेशक इस संबंध में विनिर्दिष्ट शर्तों के अधीन किसी अन्य विमान यातायात सेवाएं यूनिट हेतु क्षेत्र नियंत्रण सर्विलांस रेटिंग धारण करने वाले या जिसने धारण किया है, विमान यातायात नियंत्रक से कार्य पर प्रशिक्षण की अवधि को कम कर सकते हैं ।

(ग ) कौशल.- सुरक्षित, सुव्यवस्थित तथा त्वरित पहुंच नियंत्रण सेवा प्रदान करने के लिए उसके कौशल , निर्णय और कार्य निष्पादन की बाबत किसी परीक्षक द्वारा उसका सफल मूल्यांकन कराया गया हो और कार्य पर प्रशिक्षण क़ी अपेक्षा को पूरा करने के बाद यथाशीघ्र उसका मूल्यांकन किया जाएगा किन्तु किसी मामले में यह मूल्यांकन उससे तीन माह अधिक विलम्ब से नहीं होगा ।

3. पुनः विधिमान्यकरण , रेटिंग का पुनः विधिमान्यकरण नियम 110 में किए गए उपबंध के अनुसार होगा ।

अनुभाग ञ

महासागरीय नियंत्रण रेटिंग

1. रेटिंग जारी करने हेतु अपेक्षाएं . महासागरीय नियंत्रण सर्विलांस रेटिंग जारी करने के लिए आवेदक, निम्नलिखित अपेक्षाओं का समाधान करेगा, अर्थातः--

(क) ज्ञान.- वह विमान यातायात नियंत्रक की अनुज्ञप्ति या छात्र हवाई यातायात नियंत्रक की अनुज्ञप्ति का धारक हो और वह किसी विशिष्ट यूनिट के दायित्व क्षेत्र के संबंधित कम से कम निम्नलिखित विषयों की परीक्षा उत्तीर्ण करके ज्ञान के अपेक्षित स्तर को प्रदर्शित किया हो, अर्थातः--

(i) हवाई क्षेत्र संरचना

(ii ) प्रयोज्य नियम, प्रक्रिया और सूचना का स्त्रोत

NOTIFICATION

New Delhi , the 8th December , 2010

G.S.R. 960 ( E ) . The following draft of certain rules further to amend the Aircraft Rules , 1937 , which the Central Government proposes to make in exercise of the powers conferred by section 5 of the Aircraft Act , 1934 ( 22 of 1934) , is hereby published as required by section 14 of the said Act , for information of all persons likely to be affected thereby , and notice is hereby given that the said draft will be taken into consideration after a period of thirty days from the date on which the copies of the Gazette of India in which this notification is published , are made available to the public ;

Objections or suggestions , if any , may be addressed to the Director - General of Civil Aviation , Opposite Safdarjung Airport , New Delhi – 110 003;

Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the period specified above will be considered by the Central Government.

Draft rules

1. Short title and commencement.- These rules may be called the Aircraft ( ...... Amendment ) Rules , 2010 .

2. Amendment of rule 3. - In the Aircraft Rules , 1937 ( hereinafter referred to as the said rules ) , in rule 3 ,

(i ) after clause ( 1B ) , the following clauses shall be inserted , namely: -

( 1C) " air traffic " means all aircraft in flight or operating on the manoeuvring area of an aerodrome ;

( 1D) " Air Traffic Controller " means a person on duty in an air traffic services unit and entrusted with the task of giving instructions or advice to aircraft by means of radio telephony in the interest of safety of aircraft operations;

( 1E) "Air Traffic Controller's Licence " means a licence granted under these rules certifying the competence of the holder to perform the duties of an air traffic controller and containing his personal details including ratings, endorsements and validity of the licence ;

( 1F) " air traffic service " means the flight information service , alerting service and air traffic advisory service and air traffic control service ( area control service , approach control service or aerodrome control service ) ;

( 1G) "Air traffic services unit " means the air traffic control unit , flight information centre or air traffic services reporting office;

( 1H) " approved training " means a training the curriculum of which has been approved by the Director- General ; "

(ii) after clause ( 19 ) , the following clause shall be inserted , namely: -

" ( 19A) " endorsement " with respect to a licence means an entry in the licence indicating the privileges which the licence holder is entitled to exercise , including any observation impacting the exercise of such privileges ; "

(iii ) after clause ( 21A) , the following clauses shall be inserted , namely: -

" ( 21B ) " flight information region " means an airspace of defined dimension within which flight information service and alerting service are provided;

(21C) " flight information service " means a service provided for the purpose of giving advice and information useful for the safe and efficient conduct of flights ; "

(iv) after clause ( 37) , the following clause shall be inserted , namely: -

" (37A) " on- the-job training " means integration in practice of previously acquired job related qualifications and skills in a live job situation under the supervision of a qualified and experienced person already employed for that job."

3. Insertion of Part XII . -In the said rules , after Part XI , the following Part shall be inserted , namely: -

" PART XII – PERSONNEL OF AIR TRAFFIC SERVICES

93. Requirement of a licence for air traffic services personnel.- ( 1 ) No person shall engage himself in the provision of air traffic services in the Indian airspace or in any airspace outside the Indian territory for which India has , in pursuance of any international arrangement , undertaken to provide air traffic services , unless he holds a valid air traffic controller's licence issued under these rules .

(2) The designated military authority may provide the air traffic services to the civil aircraft in the airspace designated for military use in accordance with the provisions of this part and subject to the conditions specified by the Director-General:

Provided that any person already engaged in the provision of air traffic services before the commencement of the Aircraft ( ...... Amendment) Rules , 2010 , may continue to provide such services in accordance with the procedure specified by the Director-General till such person obtains the licence or till a date to be notified by the Central Government , whichever is earlier.

94. Provision of Air Traffic Services at an aerodrome.- The Director- General may direct an aerodrome operator to make provision for air traffic services , aerodrome flight information service or a means of two -way radio communication or any other service , as deemed fit in the interest of safety of aircraft operations .

95. Licensing Authority.- ( 1 ) Subject to fulfilment of the requirements specified in this Part and Schedule III , the Central Government may grant or renew the following licences and ratings , namely: -

(a)

Student Air Traffic Controller's Licence

(b) AirTraffic Controller's Licence

(d) Approach Control Procedural Rating

(e)

Approach Control Surveillance Rating

(f) Area Control Procedural Rating

(g) Area Control Surveillance Rating

(h) Flight information Service Rating

(i) Oceanic Control Rating

(2) Before grant or renewal of a licence or rating , the licensing authority shall satisfy itself that the applicant meets the requirements of age , qualification , medical standard , knowledge , experience , training and skill , asspecified in Schedule III .

(3) The licence shall not be valid unless it bears the signature of the holder .

(4) The licence shall remain valid for the period indicated therein which shall not exceed the period specified in rule104 unless suspended or cancelled earlier .

(5) The Central Government may withhold the grant or renewal of a licence or rating and may cancel , suspend or vary any licence or rating if it is satisfied that there is a reasonable ground to do so:

Provided that no such licence or rating shall be cancelled or suspended without giving a show cause notice , in writing , informing the भारत का राजपत्र असाधारण

holder or the licence or rating the ground on which it is proposed to suspend or cancel the licence or rating and giving him a reasonable opportunity of making a representation in writing within such reasonable time as may be specified in the notice and , if that person so desires , of being heard.

(6) Notwithstanding anything contained in sub - rule ( 5) , if the Central Government is of the opinion that in the interest of public safety it is necessary so to do, it may, for the reasons to be recorded in writing , summarily suspend the licence or rating with a view to making further enquiry.

96. Requirement for Radio Telephony Operator's Certificate.- A Student Air Traffic Controller's or an Air Traffic Controller's License shall be valid only if the licence holder possesses a certificate or authorisation for operating the radio telephony equipment in accordance with the provisions ofthe Indian Telegraph Act , 1885 ( 13 of 1885 ) and rules made thereunder .

97. Requirement of rating and unit endorsement.- ( 1 ) No person shall perform duty as an air traffic controller in an air traffic services unit unless his licence contains the ratings for the said purpose ;

Provided that the holder of an Student Air Traffic Controller's Licence or an Air Traffic Controller's Licence may perform duty in a particular air traffic services unit without the relevant rating , for the purpose of qualifying for endorsement of such rating in his licence , under the direct supervision of a person holding the rating for that particular air traffic services unit and authorised by the Director General to act as an instructor .

(2) A licence may contain ratings for one or more air traffic services units .

( 3) Notwithstanding any thing contained in sub - rule ( 1 ) , the Director- General may authorise deployment of an air traffic controller to perform air traffic control duties temporarily at an airport without endorsement of that airport on his licence , provided he holds similar ratings for another airport with higher air traffic density and is assessed as fit for such duties by an air traffic controller holding the rating for the airport of temporary duty.

98. Unit Training Plan.- Every air traffic service unit shall prepare a Unit Training Plan , detailing the syllabus for on the job training , examination and procedures to meet the requirement for ratings as specified in Schedule III and obtain the approval of the licensing authority for the same .

99. Fees and other charges.- ( 1 ) The candidate who applies for the licence , its renewal , validation and ratings or the issue of duplicate licence and for the test and examination for such licence and ratings shall pay the followingfees , namely: -

: Rs . 500/- per paper ( i ) for tests and examination for licence and ratings

: Rs . 1,000/- (ii ) for issue of a Student Air Traffic Controller's Licence

: Rs . 500/- ( iii ) for renewal of a Student Air Traffic Controller's Licence

: Rs . 5,000/ - (iv) for issue or validation of a licence other than Student Air Traffic Controller's Licence or endorsement of a rating

: Rs. 2,500/ - (v) for renewal of a licence other than Student Air Traffic Controller's Licence or a rating.

: Rs. 250/- ( vi ) for issue of duplicate Student Air Traffic Controller's Licence

: Rs. 500/- ( vii ) for issue of duplicate licence other than Student Air Traffic Controller's Licence .

: Rs. 500/- ( viii ) for issue of duplicate result sheet of examination

(2) The applicant shall be required to bear all charges in respect of the assessment , if any , and if a government examiner is associated during the assessment , a fee of ten thousand rupees shall be payable for each assessment .

( 3) The fee shall be paid by crossed Indian Postal Order or Demand Draft drawn in favour of the Pay and the Accounts Office , Director General of Civil Aviation , Ministry of Civil Aviation , New Delhi .

(4) When in any case the licence or rating is not issued , validated or renewed or a duplicate licence or rating is not issued , the Central Government may order the refund to the applicant of a proportionate part of the sum paid as fees , or adjust the amount to be refunded against fees required to be paid by the candidate for a future examination .

100. Minimum educational qualification for holding a licence.- No person shall be granted a licence under this Part unless he possesses the educational qualification as specified in Schedule III .

101. Minimum age for holding a licence.- The minimum age of a person who is otherwise qualified and to whom a licence may be granted shall be as specified in Schedule III .

102. Maximum age limit for holding licence or rating.- No person shall exercise the privileges of the licence granted under this Part after he has attained the age of sixty years .

103. Medical standards- ( 1 ) No licence or rating granted under this Part shall be issued or renewed unless the applicant holds a medical fitness assessment issued by the Director- General after undergoing a medical examination with an approved medical authority and satisfying the medical standards as specified by the Director- General for the purpose:

Provided that if in the opinion of the approved medical authority , the condition of the applicant is not such as to introduce any hazard either of sudden incapacity or of inability to perform his duties safely during the period of validity of his licence or rating and failure to attain the requirement is capable of being compensated and the Director - General has satisfactory evidence that the applicant has already acquired and demonstrated his ability , skill and experience which compensate for his deficiency , the assessment may be issued with any limitation as deemed fit , and the licence or rating may be renewed or endorsed with such limitation .

Explanation.- For the purposes of this sub- rule , approved medical authority means a medical authority approved by the Director -General .

(2) The Director- General may require the holder of a licence to undergo a medical examination by any medical authority at any time if, in his opinion , such examination is necessary in the interest of safety of operations.

104. Period of validity of licences and medical fitness assessment.- (1 ) A Student Air Traffic Controller's Licence shall remain valid for a maximum period of three years from the date of issue and shall not be renewed .

( 2) An Air Traffic Controller's Licence shall be valid for maximum period of five years from the date of issue and may be renewed for a further period of five years on each occasion .

( 3 ) The maximum period of validity of a medical fitness assessment shall be two years from the date of medical examination .

(4) The period of validity of medical fitness specified in sub - rule ( 1 ) , shall be reduced to half after the holder of the licence has attained the age of fifty years.

(5) ( a) The period of validity of a licence shall commence from the date of issue .

(b) In case of renewal , the period of validity shall commence from the date following the date of expiry of the previous validity, irrespective of the date of renewal , provided the application for renewal has been submitted within a period of thirty days preceding the date of expiry and all the requirements for renewal are met on the date of application .

(6) ( a) The period of validity of initial medical fitness assessment shall commence from the date of the medical examination .

(b) In case of renewal , the period of validity shall commence from the date following the date of expiry of the previous validity , irrespective of the date of renewal , provided the application for renewal has been submitted within a period of thirty days preceding the date of expiry and all the requirements for renewal are met on the date of application .

105. Licence not valid without valid medical fitness assessment.- A licence granted under this Part shall not be valid unless it is accompanied by a valid medical fitness assessment and the holder shall not exercise the privileges of the licence in the absence of a valid medical fitness assessment .

106. Decrease in medical fitness ( 1 ) The holder of a licence shall not exercise the privileges of his licence and ratings during any period when he is aware that his physical condition has deteriorated and the medical fitness has decreased below the standard required for that category of licence.

(2) The holder of a licence shall not exercise the privileges of his licence without being declared fit after a fresh medical examination in the event of his having suffered from a sickness or injury rendering him incapable of discharging his duties for a continuous period of more than twenty days , or which is likely to cause incapacity or impair his efficiency in the discharge of hisduties .

(3) The licence holder or his employer shall immediately notify all the relevant details of the sickness or injury to the Director-General .

(vii) Operational procedures. Air traffic control , communication , radio- telephony and phraseology procedure ( routine , non- route and emergency) , use of relevant aeronautical documentation , safety practices associated with flight .

(e) Experience . He shall have successfully completed an approved training course including simulator training from an approved training organization and pass the relevant examination , and also completed an approved course of initial training in the rating or discipline relating to any of the rating from an approved organization.

2. Validity.- The licence shall be valid for the period specified in rule 104 and shall lapse on the holder acquiring an Air Traffic Controller's Licence.

3. Privileges.- Subject to the validity of licence , the holder of a Student Air Traffic Controller's Licence may perform duty as an air traffic controller in a particular air traffic service unit under the direct supervision of an authorised instructor rated on that air traffic service unit , in order to complete the requirement ofon- the -job-training for the purpose of qualifying for endorsement of such rating on his licence .

SECTION C

AIR TRAFFIC CONTROLLER'S LICENCE

1. Requirements for issuing licence.- An applicant for an Air Traffic Controller's Licence shall satisfy the following requirements , namely: -

(a) Age. He shall not be less than twenty one years of age on the date of application.

(b) Educational qualification.- He shall have passed a degree in Science or an equivalent examination with Physics and Mathematics , from a recognized University, or shall hold a valid Indian Commercial Pilot's Licence .

(c) Medical fitness.- He shall hold a valid medical fitness assessment issued by the Director- General as referred to in rule 103.

(d) Knowledge.- ( i) He shall hold a valid Student Air Traffic Controller's Licence.

(ii ) He shall have passed the examination for obtaining at least one rating for a particular air traffic services unit as specified in Sections D, E, F, G , H , I and J of this Schedule.

(e) Experience. He shall have undergone on - the -job training under an authorised instructor for the specified period in respect of the unit or units desired to be endorsed on the licence and shall have been assessed as successful by an examiner or board for the said unit or units .

2. Validity.- The licence shall be valid for a period as specified in rule 104 .

3. Renewal.- The licence shall be renewed for a period specified in rule 104 subject to the applicant holding a valid medical fitness assessment and at least one valid rating .

4. Privileges.- Subject to the validity of licence , the holder of an Air Traffic Controller's Licence may perform duty as an air traffic controller in any air traffic services unit which is included in his licence as rating.

SECTION D

AERODROME CONTROL RATING

1. Requirements for issuing rating.- An applicant for an Aerodrome Control Rating shall satisfy the following requirements , namely: -

(a) Knowledge .- He shall hold either a Student Air Traffic Controller's Licence or an Air Traffic Controller's Licence and shall have demonstrated a level of knowledge by passing the examination in the following subjects in relation to the relevantAerodrome Control Tower, namely : -

(i ) Aerodrome lay out , physical characteristics and visual aids ,

( ii ) Airspace structure ,

( iii ) Applicable rules , procedures and source of information ,

(iv) Air navigation facilities ,

(v) Air traffic control equipment and its use ,

(vi ) Terrain and prominent land marks ,

(vii ) Characteristics of air traffic ,

(viii ) Weather phenomena ,

( ix) Emergency , search and rescue plans and

(x) Any other subject considered appropriate for the particular place .

(b) Experience.- He shall produce a certificate of his having undergone on-the- job training under the supervision of an instructor or authorised Air Traffic Controller's Licence holder for a period of not less than one and a half month , during which at least ninety hours of training has been completed , at the unit for which the rating is sought:

Provided that the Director- General may reduce the period of on- the-job- training , subject to the conditions specified in this regard , for an air traffic controller holding or having held an Aerodrome Control rating for any other aerodrome .

( c) Skill . He shall have been assessed successful in his skill , judgement and performance to provide a safe , orderly and expeditious aerodrome control service and the assessment shall be conducted as soon as possible after the completion of on - the-job training requirement but in any case not later than two months therefrom.

(4) The licence of a person rendered incapable under sub- rule (2) , shall be deemed to be invalid until the holder undergoes a fresh medical examination .

107. Maintenance of validity of ratings and endorsements.- ( 1 ) The holder of an Air Traffic Controller's Licence shall not exercise the privileges of the licence and the rating endorsed on the licence unless he meets the competency and recency requirements and the rating is valid for-

( a) the air traffic services unit or place at which he so acts;

(b) the sector on which or the operational position at which he so acts; and

(2) Even when a person ceases to act as an air traffic controller at a particular unit , he may keep his rating current by complying with the recency requirement specified in Schedule III .

108. Licence holder's obligation to notify change of unit.- When a rating ceases to be valid for a unit or operational position , the holder of the licence shall forthwith inform the person - in - charge of the air traffic service of that place and shall not work in that position till such rating is revalidated .

109. Disqualification from holding or obtaining a licence .-( 1 ) Where the licensing authority is satisfied , after giving him an opportunity of being heard , that any person

(a) is habitually intemperate in the use of alcohol , or is addict of narcotics , drugs and the like , or

(b) has, by his previous conduct as Air Traffic Controller , shown that he is irresponsible in the discharge of his duties connected with his employment or is likely to endanger the safety of the aircraft or any person , in the air or on ground ; or

(c) is a habitual criminal or has been convicted by a court in India for anoffence involving moral turpitude or an offence which amounts to heinous crime ; or

(d ) has obtained the licence or rating , by suppression of material information or on basis of wrong information , or

(e) has unauthorisedly varied or tampered with the particulars entered in a licence or rating or any other relevant document,

the licensing authority may, for reasons to be recorded in writing , make an order disqualifying that person for a specified period from holding a licence or from obtaining a licence under this Part.

(2) The Central Government may , debar a person permanently or temporarily from holding any licence mentioned in this Part if in its opinion it is necessary to do so in the public interest .

( 3) ( a) Upon the issue of any order under sub - rule ( 1 ) or sub- rule ( 2 ) , the person affected , if he is the holder of a licence , shall forthwith surrender his licence to the licensing authority , if the licence has not already been surrendered .

(b ) The licensing authority shall keep the licence until the expiry of the period for which the person has been disqualified or debarred , or if he has been debarred permanently , for a period of five years.

110. Renewal of expired licence or rating.-If, on the date of application for renewal , the licence or rating has expired , the applicant shall be required to undergo on the job training and qualify the examinations and skill assessment tests as may be specified by the Director- General to assess the applicant's competency to hold that licence or rating.

( 1 ) An applicant for grant and renewal of 111. Proof of competency-

any licence and ratings shall produce proof of having acquired the competency and having passed satisfactorily the tests and examinations specified in Schedule III in respect of the licence or rating.

(2 ) The Director General may , exempt a person who is a qualified Air Traffic Controller from Indian Air force or Indian Navy and who produces satisfactory evidence to show that he possesses the necessary experience , competency and standard of physical fitness as required under these rules from all or any of the examinations and medical or other technical examinations .

( 3 ) The Director- General may , on examination of the syllabi , determine the relative equivalence of examinations for granting exemptions to such applicants from passing the examinations required under Schedule III .

(4) The Director - General may , require any candidate or training organisation to produce for examination all relevant training records , including the syllabi , certificates , mark - sheets , on- the - job training test reports , assessments , etc. , in respect of the candidate who has undergone a course of training , with such training establishment .

112. Tests , assessment and examination ( 1 ) The Director- General may, conduct examinations to test the level of knowledge specified in Schedule III , fix examination centres within India , appoint invigilators and specify the procedure for conducting the examinations .

( 2) The Director- General shall , specify the detailed syllabi for the examinations for issue of the licences and ratings .

(3) ( a) The Director- General may , appoint examiners for carrying out examinations and assessment required under Schedule Ill and may also appoint a Board to conduct oral examinations and assessment , wherever necessary .

( b) The examiners shall be selected on the basis of criteria specified for the purpose by the Director- General and the examination and assessment reports shall be submitted to the licensing authority in respect of any examination and assessment conducted for issue or renewal of a licence or endorsement of a rating on a licence .

(4) The Director- General may determine the manner in which the assessment and proficiency checks shall be carried out .

( 5 ) The Director- General may , debar permanently or temporarily a person from any assessment or examination if , in his opinion , the person has adopted unfair means during the assessment or examination .

(6) ( a ) The Director- General may , declare any examination or assessment conducted by an authorised person or a Board null and void , if in his opinion , the examination or assessment has not been carried out to his satisfaction , and require the examination or assessment to be carried cut again by another authorised person or a Board.

( b) The Director-General may also take such action against such authorised person or Board as he may deem fit.

113. Use of radio call signs of air traffic services units.- A licence holder using two - way radio communication shall not use or cause or permit to be used any call sign for a purpose other than the purpose for which that call sign has been notified .

114. Approved training organization.- ( 1 ) The Director-General , on being satisfied , may approve a training organisation for conducting an approved training course for students to enable them to attain the level of competency required for obtaining a licence or rating specified in rule 95.

( 2) The training organisation shall submit a Training and Procedures Manual containing the information spécified by the Director- General for approval and the simulator training in such organisations shall be undertaken only on the simulators approved by the Director -General .

( 3) Approval of a training organisation shall be valid for a period of five years and may be renewed for a period not exceeding two years at a time subject to the terms and conditions specified by the Director-General .

(4) ( a) For the grant of approval , a training organization shall pay, a fee of one lakh rupees and fifty thousand rupees for renewal on each occasion .

(b) The fee shall be paid by a demand draft drawn in favour of the Pay and Accounts Office , Director General of Civil Aviation , Ministry of Civil Aviation , New Delhi .

(5) The approved training organisation shall not impart any training which is not included in its scope and has not been duly approved by the Director-General .

(6) The training records of the organisation shall be maintained in a manner specified by the Director- General and shall be produced on demand to the Director- General or any other officer authorised by him in this behalf.

115. Record of experience and logging of on - watch period - ( 1 ) Every licence holder shall maintain a personal log book in the form specified by the Director-General and log the actual watch period during which he has performed any duty for exercising the privileges of his licence or ratings, or for on-the-job -training .

(2) All entries in log books shall be made either in ink or logged electronically.

(3) Log books shall be preserved for not less than five years after the date of the last entry therein .

(4) (a ) Every licence holder shall certify the accuracy of the entries in his log book with respect to the watch period at least at the end of each calendar month .

(b) At the end of every quarter , the log books shall be certified for correctness of entries therein by the in - charge of the air traffic services unit, or any other person authorised to do so by the Director-General .

(5) The watch time during which a licence holder is under on -the -job training shall be entered in his log book as " on the job training " and the instructor shall also countersign the entries in the log book of the licence holder indicating the nature of the training given .

(6) The instructor shall log as watch period in his log book the period during which he acts as an Instructor and the log entries shall indicate in the remarks column that the time was logged for instructional purpose.

116. Watch duty time limitations.- Every holder of a licence issued under this Part shall follow the watch duty time limitations specified by the Director- General .

117. Aeronautical station operator.- Every aeronautical station operator forming a part of Flight Information Service shall operate in accordance with the requirements specified by the Director -General .

118. Validation of foreign licences .- ( 1 ) When a licence has been granted by the competent authority of a Contracting State and is for the time being in force, the Central Government may, subject to such conditions and limitations and for such period as it shall think fit , confer on such licence the same validity for the purpose of provision of air traffic service in India as if it had been granted under these rules .

( 2) The validation granted under sub - rule ( 1 ) shall

(a) not extend beyond the period of validity of the licence

(b) cease to be valid if the licence upon which it was issued is revoked or suspended; and

4. Insertion of Schedule III . In the said rules , after Schedule II , the following Schedule shall be inserted , namely : -

AIR TRAFFIC SERVICES PERSONNEL

(SeePart XII)

SECTION A

GENERAL

1. Background Check.- Before enrolling a person for undergoing the air traffic control training , the training organisation shall obtain a report on the background check from the concerned government agency and the proof of the background check shall be submitted to the licensing authority at the time ofsubmission of the application for issue of the licence .

2. Application for grant of a licence or rating.- ( a ) The application for issue or validation or renewal of a licence or rating shall be made to the Director-General on a specified proforma , and shall be accompanied by

(i ) an assessment of medical fitness issued by the approved medical authority or Director- General ;

( ii ) Three unmounted photographs of size 3 cms X 4 cms of the applicant's head ( uncovered ) and shoulders in front view;

(iii ) Class X certificate of a recognized Board or its equivalent or the Birth Certificate issued by a Municipal Corporation or Committee as proofof age;

( iv) A bank draft towards the payment of the specifiedfee;

(v) Proof of meeting the educational qualification , knowledge and experience requirements; and

( vi ) Any other information required by the Director-General .

(b) The date of application shall be the date on which the application is received in the office of the Director-General .

( c) The licences and ratings specified in this Schedule shall be issued in the name as entered in the Class X certificate of a recognised Board or its equivalent.

3. Application for renewal of licence . ( a ) The application for renewal of a licence or rating shall be made on a specified proforma to the Director- General or to any other authority designated by him in this behalf , and shall be accompanied by

(i) an assessment of medical fitness issued by the Director - General referred to in rule 103;

( ii ) a statement of the recency experience duly authenticated by the person in - charge of the concerned Air Traffic Services Units ;

( iii ) a bank draft towards the payment of the specified fee ; and

(iv) any other information required by the Director- General .

(b) The date of application shall be the date on which the application is received in the office of the Director - General , or in any other office designated for this purpose by the Director- General .

4. Examination.- ( a ) The applicant for issue of a Student Air Traffic Controller's Licence or Air Traffic Controller's Licence or a rating shall be required to pass the examinations conducted in the manner specified by the Director-General .

(b) The candidate shall , on demand by the examiner , furnish proof for his identification before the examination .

(c) An applicant who fails in any examination shall not be permitted to appear for re - examination within a period of at least two weeks from the date of examination .

5. Assessment by the examiner or board . For getting an endorsement , the holder of a Student Air Traffic Controller's Licence or an Air Traffic Controller's Licence shall be assessed by an examiner duly authorised by the Director- General or by a board of examiners constituted for the purpose by the licensing authority.

6. Validity of examination and assessment.-( a ) The applicant for a licence or rating shall have passed the examination for issuing a licence or rating within a period of not more than three years preceding the date of application .

(b) The validity of the assessment for the purpose of endorsement on the licence shall be for a period of six months .

7. On - the- job training requirement . The holder of a Student Air Traffic Controller's Licence or an Air Traffic Controller's Licence shall be required to undergo the on- the - job training under an authorised instructor for a period specified in this Schedule for grant of a particular rating:

Provided that where the licensing authority , having regard to the traffic volume of the air traffic unit for which the rating is being sought and experience of the licence holder , is satisfied , it may approve the on - the - job training of a shorter period than the one specified in the Schedule .

8. Conditions precedent to exercise of privileges.- ( a) No person holding a current Air Traffic Controller's Licence shall exercise the privileges of his licence or rating unless he meets competency , recency and language proficiency requirement and medical standards , as applicable to him in accordance with these rules .

(b) The holder of a licence shall not exercise the privilege of their licence and related ratings while under the influence of alcohol or any psychoactive substance, which might render him unable to safely and properly exercise the privileges of the licences and ratings .

9. Recency requirement.- A licence holder is considered to be recent in respect of rating and endorsement on his licence if he has worked for a period of minimum ten hours in a period of three days in respect of a particular ratings during preceding six months .

10. Language proficiency .- ( a) An applicant for grant of Student Air Traffic Controller's Licence or Air Traffic Controller's Licence shall have the ability to speak and understand the English language used for radiotelephony communications to the level of proficiency specified by the Director - General .

( b) The level of proficiency shall be evaluated in accordance with the procedures specified by the Director- General .

( c) The licencing authority shall indicate the level of proficiency in the licence.

SECTION B

STUDENT AIR TRAFFIC CONTROLLER'S LICENCE

1. Requirements for issuing licence .--- An applicant for a Student Air Traffic Controller's Licence shall satisfy the following requirements , namely :-

( a) Age. He shall not be less than twenty years of age on the date of application .

( b) Education qualification.- He shall have passed a degree in Science or an equivalent examination with Physics and Mathematics , from a recognized University or shall hold a valid Indian Commercial Pilot's Licence .

( c) Medical fitness . He shall hold a valid medical fitness assessment issued by the Director- General as referred to in rule 103.

(d) Knowledge.- He shall have demonstrated the required level of knowledge by passing a written examination in the following subjects , namely: -

(i) Air law. The provisions of the Aircraft Rules , 1937 , civil aviation requirements and any other circulars or instructions relevant to the air traffic control ;

(ii) Air traffic control equipment. Principles , use and limitations of equipment used in air traffic control ;

( iii ) General knowledge . Principles of light , principles of operation and functioning of aircraft , power plants and systems , aircraft performances relevant to air traffic control ;

(iv) Human performance . - Human performance relevant to air traffic control ;

( v) Meteorology.- Aeronautical meteorology , use and appreciation of meteorological documentation and information , origin and characteristic of weather phenomena affecting flight operations and safety , altimetry;

( vi ) Navigation.- Principles of air navigation , principles , limitation and accuracy of navigation systems and visual aids ; and POKL

2. Validity . The rating shall become invalid if an air traffic controller has hot exercised the privileges of the rating for a period exceeding six months.

3. Revalidation.- The rating shall be revalidated as provided in rule 110.

4. Privileges.- ( a) The privileges of the holder of the rating shall be to provide or to supervise the provision of Aerodrome Control Service at the aerodrome for which he is rated .

(b) Before exercising the privileges , the holder of the rating shall be familiar with all pertinent and current information .

SECTION E

APPROACH CONTROL PROCEDURAL RATING

1. Requirements for issuing rating.- An applicant for an Approach Control Procedural Rating shall satisfy the following requirements , namely: -

(a) Knowledge.- He shall hold an Air Traffic Controller's Licence or a Student AirTraffic Controller's Licence and shall have demonstrated the required level of Knowledge by passing the examination at least in the following subjects for Approach Control Unit at a particular place , namely: -

(i ) Airspace structure

( ii ) Applicable rules , procedures and source of information

(iii) Air navigation facilities

(iv) Air traffic control equipment and its use

Terrain and prominent land marks

(v)

(vi) Characteristics of air traffic and trafficflow

(vii ) Weather phenomena

(viii) Emergency and search and rescue plans

(ix) Any other subject considered appropriate for the particular place .

(b ) Experience.- He shall produce a certificate of his having undergone on-the- job training under the supervision of an instructor or an authorised Air Traffic Controller's Licence holder for a period of not less than three months , during which atleast one hundred and eighty hours of training has been completed , at the unit for which the rating is sought :

Provided that the Director- General may reduce the period of on - the -job- training , subject to the conditions specified in this regard , for an air traffic controller holding or having held an Approach Control Procedural Rating for any other aerodrome.

(c) Skill. He shall have been assessed successful by an examiner in respect of his skill , judgement and performance to provide a safe , orderly and expeditious approach control service and the assessment shall be conducted as soon as possible after the completion of on - the-job training requirement , but in any case not later than three months therefrom.

2. Validity. The rating shall become invalid if an air traffic controller has not exercised the privileges of the rating for a period exceeding six months.

3. Revalidation.- A rating shall be revalidated as provided in rule 110.

4. Privileges.- ( a) The privileges of the holder shall be to provide or to supervise the provision of Approach Control Service within the airspace jurisdiction ofthe unit for which he is ra ted .

(b) Before exercising the privileges , the holder of the rating shall be familiar with all pertinent and current information.

SECTION F

APPROACH CONTROL SURVEILLANCE RATING

1. Requirements for issuing rating . An applicant for an Approach Control Surveillance Rating shall satisfy the following requirements , namely:-

(a) Knowledge. He shall hold an Air Traffic Controller's Licence or a Student AirTraffic Controller's Licence and shall have demonstrated the required level of knowledge by passing examination in at least the following subjects in relation to the area of responsibility at a particular place , namely: -

(i) Airspace structure

(ii )

Applicable rules , procedures and source of information

(iii) Air navigation facilities

(iv) Air traffic control equipment and its use

(v) Terrain and prominent land marks

(vi ) Characteristics of air traffic and traffic flow

(vii ) Weather phenomena

(viii ) Emergency and search and rescue plans

(ix) Principles , use and limitations of applicable Air Traffic Services Surveillance Systems and associated equipment

(x) Procedures for the provision of Air Traffic Services Surveillance Service , as appropriate , including procedures to ensure appropriate terrain clearance

(xi ) Any other subject considered appropriate for the particular place .

(b) Experience.- He shall produce a certificate of his

(i ) having satisfactorily completed an approved training course on the surveillance system ; and 53

(ii ) having undergone on- the-job training under the supervision of an instructor or authorised Air Traffic Controller's Licence holder for a period of not less than three months , during which at least one hundred and eighty hours of training has been completed , at the unit for which the rating is sought :

( c) Skill . He shall have been assessed successful regarding his skill , judgment and performance to provide a safe , orderly and expeditious approach control service and the assessment shall be conducted as soon as possible after the completion of on the job training requirement , but in any case not later than three months therefrom .

( b) Before exercising the privileges , the holder of the rating shall be familiar with all pertinent and current information .

SECTION G

AREA CONTROL PROCEDURAL RATING

1.   Requirements for issuing rating.- An applicant for an Area Control
Procedural Rating shall satisfy the following requirements , namely: -
   ( a) Knowledge.- He shall hold an Air Traffic Controller's Licence or a Student
AirTraffic Controller's Licence and shall have demonstrated the required level of
knowledge by passing the examination in the following subjects in relation to the
 relevant Area Control Unit , namely: -
      ( i ) Airspace structure
       ( ii ) Applicable rules , procedures and source of information
       ( iii ) Air navigation facilities
      (iv)  Air traffic control equipment and its use

(i ) Airspace structure

( ii ) Applicable rules , procedures and source of information

1. Requirements for issuing rating.- An applicant for a Flight Information Service Rating shall satisfy the following requirements , namely:-

(a) Knowledge. He shall be the holder of an Air Traffic Controller's Licence or a Student Air Traffic Controller's Licence and shall have demonstrated a level of knowledge by passing the examination at least in the following subjects for an FlightInformation Region in relation to the area of his responsibility, namely:-

Airspace structure

(i)

Applicable rules , procedures and source of information

(ii )

Air navigation facilities

(iii )

(iv) Air traffic control equipment and its use

Terrain and prominent land marks

(v)

(vi ) Characteristics of air traffic and traffic flow

(vii ) Weather phenomena

(viii) Emergency and search and rescue plans

(ix) Any other subject considered appropriate for the particular place .

(b) Experience.- He shall produce a certificate of his having undergone on the job training under the supervision of an instructor or authorised Air Traffic Controller's Licence holder for a period of not less than three months , during which at least one hundred and eighty hours of training has been completed , at the unit for which the rating is sought :

OCEANIC CONTROL RATING

1. Requirements for issuing rating.- An applicant for an Oceanic Control Rating shall satisfy the following requirements , namely: -

(a) Knowledge.- He shall be the holder of an Air Traffic Controller's Licence or a Student Air Traffic Controller's Licence and shall have demonstrated a level of knowledge by passing the examination at least in the following subjects for an Oceanic Control Unit in the area of his responsibility at a particular place , namely: -

(i ) Airspace structure

(ii )

Applicable rules , procedures and source of information

Air navigation facilities

( iii )

Air traffic control equipment and its use

(iv)

(v) Principles , uses and limitations of surveillance systems if any and associated equipment

Terrain and prominent land marks

(vi )

( vii ) Characteristics of air traffic and traffic flow

(viii ) Weather phenomena

(ix) Emergency and search and rescue plans

(x) Any other subject considered appropriate for the particular place .

( b) Experience . - He shall produce a certificate of his having

( i ) satisfactorily completed an oceanic control training course;

( ii ) undergone on - the - job training under the supervision of an instructor or authorised Air Traffic Controller for a period of not less than three months during which at least one hundred and eighty hours of training has been completed , at the unit for which the rating is sought :

Provided that the Director- General may reduce the period of on - the- job-training , subject to the conditions specified in this regard , for an air traffic controller holding or having held an Oceanic Control Rating for any other air traffic services unit .

( c) Skill .- The applicant shall have been assessed successful in respect of his skill , judgement and performance to provide a safe , orderly and expeditious air traffic control service in the Oceanic Control Centre and the assessment has to be conducted as soon as possible after the completion of on - the -job training requirement , but in any case not later than three months therefrom .

2. Validity . The rating shall become invalid when an air traffic controller has not exercised the privileges of the rating for a period exceeding six months.
