अखिल भारतीय तकनीकी शिक्षा परिषद् (तकनीकी संस्थाओं के लिए अनुमोदन की मंजूरी )
विनियम , 2011
फा. सं. 37-3/विधि/2011.- अखिल भारतीय तकनीकी शिक्षा परिषद् अधिनियम, 1987 ( 1987 का 52 ) की धारा 10 और धारा 11 के साथ पठित धारा 23 की उप - धारा ( 1 ) के अंतर्गत प्रदत्त अपनी शक्तियों का प्रयोग करते हुए तथा अभातशिप द्वारा नई तकनीकी संस्थाओं को आरम्भ करने , पाठ्यक्रमों अथवा कार्यक्रम आरम्भ करने और पाठ्यक्रमों अथवा कार्यक्रमों के लिए सीटों की प्रवेश क्षमता में वृद्धि/परिवर्तन संबंधी अनुमोदन प्रदान करने तथा विद्यमान तकनीकी संस्थाओं के लिए अनुमोदन का विस्तार करने के बारे में विनियम फा. सं. 37-3/विधि/2010 , दिनांक 15 जनवरी , 2010 के अधिक्रमण में , अखिल भारतीय तकनीकी शिक्षा परिषद् निम्नलिखित विनियम बनाती है:-
1. संक्षिप्त नाम , प्रयोज्यता और प्रारम्भ:
1.1 इन विनियमों को अखिल भारतीय तकनीकी शिक्षा परिषद् ( तकनीकी संस्थाओं के लिए अनुमोदन की मंजूरी ) विनियम , 2010 कहा जाएगा ।
1.2 ये तकनीकी शिक्षा संचालित कर रही तकनीकी संस्थाओं तथा ऐसे अन्य पाठ्यक्रमों/कार्यक्रमों और क्षेत्रों पर लागू होंगे , जैसाकि परिषद्द्वारा समय - समय पर अधिसूचित किया जाएगा ।
1.3 ये राजपत्र में इनके प्रकाशन की तारीख से प्रवृत होंगे ।
2. परिभाषाएं:
इन विनियमों में, जब तक संदर्भ से अन्यथा अपेक्षित न हो ,
2.1 " शैक्षणिक वर्ष " से अभिप्रेत है संबंधित संबद्धक विश्वविद्यालय और/ अथवा तकनीकी संस्था का शैक्षणिक वर्ष ।
2.2 " अधिनियम " से अभिप्रेत है अखिल भारतीय तकनीकी शिक्षा परिषद् अधिनियम , 1987 ( 1987 का 52 ) 1
2.3 " अभातशिप के वेब पोर्टल " से अभिप्रेत है यूआरएल www.aicte-india.org पर परिषद्द्वारा होस्ट की गई वेबसाइट ।
2.4 " आवेदक" से अभिप्रेत है ऐसा आवेदक जो इन विनियमों के अंतर्गत किसी भी प्रकार का अनुमोदन प्राप्त करने के लिए परिषद् को आवेदन करता है ।

2.5 "अनुमोदित संस्था " से अभिप्रेत है परिषद् द्वारा अनुमोदित संस्था ।
2.6 "अध्यक्ष " से अभिप्रेत है अधिनियम की धारा 3 की उप-धारा (4)(क) के अंतर्गत यथावर्णित परिषद् का अध्यक्ष ।
2.7 "कम्पनी" से अभिप्रेत , कम्पनी अधिनियम 1956 की धारा 25 के अधीन स्थापित की गयी कम्पनी से है ।
2.8 "दाखिले के लिए सक्षम प्राधिकारी" से अभिप्रेत है ऐसा निकाय, जो संबंधित. राज्य/ संघ राज्यक्षेत्र में तकनीकी संस्थाओं में दाखिले के लिए उत्तरदायी है ।
2.9 " परिषद " से अधिनियम की धारा 3 के अंतर्गत स्थापित अखिल भारतीय तकनीकी शिक्षा परिषद अभिप्रेत . है ।
2.10 "पाठ्यक्रम" से कार्यक्रम में शिक्षण की शाखाओं की कोई शाखा अभिप्रेत है ।
2.11 "प्रभाग" से अभिप्रेत है ;
इंजीनियरी / प्रौद्योगिकी/ भेषजी / होटल प्रबंधन और खानपान प्रौद्योगिकी/अनुप्रयुक्त कला और शिल्प / वास्तुकला / नगर आयोजना में स्नातकपूर्व कार्यक्रम, डिप्लोमा तथा पीजीडीएम / एमबीए / एमसीए में स्नातकोत्तर कार्यक्रम में साठ सीटों का बैच, जिसमें अतिरिक्त सीटें, यदि कोई हों, शामिल नहीं हैं; इंजीनियरी / प्रौद्योगिकी/ भेषजी / होटल प्रबंधन और खानपान प्रौद्योगिकी/अनुप्रयुक्त कला और शिल्प / वास्तुकला / नगर आयोजना में स्नातकोत्तर कार्यक्रम में 18 सीटों का बैच ।
2.12 " ई- बैंकिंग " से अभिप्रेत है इंटरनेट बैंकिंग ।
2.13 " ई- रसीद " से अभिप्रेत है परिषद् के वेब पोर्टल पर इंटरनेट बैंकिंग का प्रयोग करते हुए किए गए भुगतान की प्राप्त हुई भुगतान - रसीद ।
2.14 "कार्यकारिणी समिति " से अभिप्रेत है परिषद् द्वारा अभातशिप अधिनियम की धारा 12 के अधीन गठित समिति ।
2.15. "विदेशी राष्ट्रिक" से अभिप्रेत है भारत के अतिरिक्त सभी देशों के नागरिक , जो भारतीय मूल के नहीं हैं, जैसाकि पीआईओ के अधीन परिभाषित है ।
2.16 " सरकार द्वारा सहायता प्राप्त संस्था से अभिप्रेत है ऐसी तकनीकी संस्था, जो अपने आवर्ती व्यय के 50 प्रतिशत अथवा अधिक भाग की पूर्ति सरकार अथवा सरकारी संगठनों से प्राप्त अनुदान से करती है ।
2.17 "सरकारी संस्था" से अभिप्रेत है सरकार द्वारा स्थापित और / अथवा अनुरक्षित तकनीकी संस्था ।

2.18 "संस्था का प्रमुख " से अभिप्रेत है किसी विश्वविद्यालय अथवा मानित विश्वविद्यालय के मामले में कुलपति/ निदेशकः प्राचार्य, निदेशक अथवा निर्दिष्ट तकनीकी संस्था के कार्यकारी संस्था प्रमुख के रूप में कोई अन्य पदधारी ।
2.19 "अनिवासी भारतीय (एनआरआई)" से अभिप्रेत है ऐसा भारतीय नागरिक, जो सामान्यतया भारत से बाहर रहता है और भारतीय पासपोर्ट धारण करता है ।
2.20 "भारतीय मूल के व्यक्ति (पीआईओ ) " से अभिप्रेत हैं ऐसे व्यक्ति, जो अन्य देशों के नागरिक हैं (पाकिस्तान एवं बंगलादेश को छोड़कर) , जिन्होंने किसी भी समय भारतीय पासपोर्ट धारण किया है, अथवा जो, या उनके माता- पिता अथवा उनके दादा-दादी, नाना-नानी में से कोई भारत के संविधान के उपबंधों अथवा नागरिकता अधिनियम, (1955 का 57 ) की धारा 2 (ख ) के उपबंधों के परिणामस्वरूप भारत के नागरिक थे ।
2.21 "निजी स्व-वित्तपोषित संस्था" से अभिप्रेत है किसी सोसाइटी/ न्यास / कंपनी द्वारा शुरू की गई कोई संस्था, जो अपने आवर्ती व्यय की पूर्ति के लिए केन्द्रीय और /अथवा राज्य सरकार और / अथवा संघ राज्यक्षेत्र प्रशासन से अनुदान / निधि प्राप्त नहीं करती है ।
2.22 "कार्यक्रम" से अभिप्रेत है तकनीकी शिक्षा का क्षेत्र, अर्थात इंजीनियरी, प्रौद्योगिकी, एमसीए , वास्तुकला, नगर आयोजना, प्रबंधन एमबीए , प्रबंधन-पीजीडीएम, भेषजी, होटल प्रबंधन और खानपान प्रौद्योगिकी, अनुप्रयुक्त कला एवं शिल्प अथवा ऐसे अन्य कार्यक्रम और विषय-क्षेत्र जो परिषद द्वारा समय- समय पर अधिसूचित किए जाएं ।
2.23 "क्षेत्रीय समिति" से अभिप्रेत है अधिनियम की धारा 14 के अंतर्गत स्थापित क्षेत्रीय समिति ।
2.24 "द्वितीय पाली " से अभिप्रेत है वह समयावधि, सामान्यतः दोपहर 1 बजे से सांय 9:00 बजे तक, जिसमें तकनीकी संस्था के शैक्षणिक क्रियाकलाप संचालित किए जाते हैं ।
2.25 " सोसाइटी" से अभिप्रेत है सोसाइटी पंजीकरण अधिनियम 1860 के अंतर्गत पंजीकृत सोसाइटी ।
2.26 "न्यास " से अभिप्रेत है परोपकारी न्यास अधिनियम , 1950 अथवा कोई अन्य प्रासंगिक अधिनियम के अंतर्गत पंजीकृत न्यास ।
2.27 इसमें प्रयुक्त अन्य सभी शब्दों एवं अभिव्यक्तियों, जिन्हें यहां परिभाषित नहीं किया गया है , परन्तु अखिल भारतीय तकनीकी शिक्षा परिषद् अधिनियम, 1987 (1987 का 52) में परिभाषित किया गया है, का वही तात्पर्य होगा, जो उन्हें क्रमशः उक्त अधिनियम में निर्दिष्ट किया गया है ।

3. तकनीकी संस्थाओं के प्रवर्त्तक
3.1 कोई तकनीकी संस्था निम्नलिखित द्वारा स्थापित और प्रशासित की जाएगी:-
क) सोसाइटी पंजीकरण अधिनियम 1860 के अंतर्गत पंजीकृत कोई सोसाइटी ।
ख) परोपकारी न्यास अधिनियम 1950 अथवा किसी अन्य प्रासंगिक अधिनियम के
अंतर्गत पंजीकृत कोई न्यास ।
ग) कम्पनी अधिनियम 1956 की धारा 25 के अधीन निगमित कम्पनी ।
घ) अधिनियम की उपधारा 2.7 में अनुबन्धित कम्पनी, जिनकी प्रत्यक्ष अथवा अप्रत्यक्ष
रूप से शेयर होल्डर के रूप में कोई भी विदेशी भागीदारी है , को शिक्षण संस्था
स्थापित करने हेतु आवेदन करने की अनुमति नहीं दी जाएगी ।
ड़) केन्द्रीय अथवा राज्य सरकार / संघ राज्यक्षेत्र प्रशासन अथवा उनके द्वारा पंजीकृत
सोसायटी अथवा न्यास (ट्रस्ट) अथवा कम्पनी अधिनियम 1956 की धारा 25 के
अधीन निगमित कम्पनी अथवा सार्वजनिक- निजी भागीदारी व्यवस्था के अंतर्गत
अथवा निर्मित प्रचालित एवं स्थानान्तरण (बी.ओ.टी. ) नीति के अधीन ।
4. तकनीकी संस्थाओं/ पॉलिटैक्निक (डिप्लोमा प्रदान करने वाली तकनीकी संस्था) के
लिए अनुमोदन की मंजूरी
4.1 तकनीकी संस्थाओं और / अथवा पॉलिटैक्निक (डिप्लोमा प्रदान करने वाली तकनीकी
संस्था) के सभी प्रवर्त्तकों को निम्न के लिए परिषद् का पूर्व अनुमोदन अपेक्षित होगा:-
क) कोई नई तकनीकी संस्था/ पॉलिटैक्निक (डिप्लोमा प्रदान करने वाली तकनीकी
संस्था) स्थापित करना अथवा नया तकनीकी परिसर स्थापित करना;
ख) भारत में विदेशी विश्वविद्यालयों का प्रवेश और प्रचालन तथा तकनीकी शिक्षा,
शोध और प्रशिक्षण के क्षेत्र में भारत और विदेशी विश्वविद्यालयों / संस्थाओं के
बीच सहयोग और भागीदारियां;
ग) विद्यमान अभातशिप अनुमोदित तकनीकी संस्थाओं को तकनीकी परिसर में
परिवर्तित करना;
घ) केवल महिलाओं हेतु संस्था को सह- शिक्षा संस्था में परिवर्तित करना;
ङ) प्रवर्त्तक सोसाइटी / न्यास / कंपनी / तकनीकी संस्था के नाम में परिवर्तन;
च) अभातशिप अनुमोदित तकनीकी संस्था को बंद करना ।
4.2 तकनीकी संस्थाओं / पॉलिटैक्निक (डिप्लोमा प्रदान करने वाली तकनीकी संस्था) को
निम्न के लिए परिषद् का पूर्व अनुमोदन अपेक्षित होगाः
क) विद्यमान अनुमोदन का विस्तार;
ख) नए पाठ्यक्रम (ओं) , प्रभाग(ओं) , कार्यक्रम(ओं) , द्वितीय पाली को शुरू करना;
ग) प्रवेश क्षमता में परिवर्तन;
घ) विदेशी छात्रों / भारतीय मूल के व्यक्तियों / खाड़ी देशों में भारतीय कर्मकारों के
बालकों के प्रवेश के लिए अतिरिक्त सीटों का सृजन;
ङ) अनिवासी भारतीयों के बालकों के लिए प्रवेश कोटा;
च) शिक्षण शुल्क माफी योजना के अंतर्गत अतिरिक्त सीटों का सृजन;
छ) अभातशिप अनुमोदित पाठ्यक्रम / कार्यक्रम / प्रभाग को बंद करना ।

5 4.3 परिषद्, समय- समय पर, अनुमोदन प्रक्रिया पुस्तिका प्रकाशित करेगी , जिसमें संस्थाओं और/अथवा प्रवर्त्तकों के आवेदनों के प्रक्रमण के लिए पद्धति का विवरण दिया जाएगा।
4.4 इन विनियमों के खंड 4.1 के उप- खंड (क), (ख), (ग) , (घ) और (ङ) के अंतर्गत सूचीबद्ध प्रयोजनों के लिए अनुमोदन हेतु आवेदन निम्न द्वारा किए जाएंगे:-
क) सोसाइटी/न्यास के मामले में अध्यक्ष अथवा सचिव;
ख) कंपनी अधिनियम 1956 की धारा 25 के अधीन स्थापित की गई कंपनी के मामले में प्रबन्ध निदेशक अथवा कोई प्राधिकृत अधिकारी तथा
ग) केन्द्रीय अथवा राज्य सरकार / संघ राज्यक्षेत्र प्रशासन के मामले में संबंधित केन्द्रीय सरकार/ राज्य सरकार/ संघ राज्यक्षेत्र द्वारा प्राधिकृत किया गया कोई अधिकारी अथवा उनके द्वारा सार्वजनिक- निजी भागीदारी व्यवस्था के अंतर्गत पंजीकृत, कोई सोसाइटी अथवा न्यास अथवा कम्पनी अधिनियम 1956 की धारा 25 के अधीन निगमित कम्पनी, जैसा भी मामला हो ।
4.5 इन विनियमों के खंड 4.2 के उप-खंड (क), (ख), (ग), (घ), (ङ), (च) और (छ) के अंतर्गत सूचीबद्ध प्रयोजनों के लिए अनुमोदन हेतु आवेदन तकनीकी संस्था के प्राचार्य /निदेशक अथवा संस्था के प्रमुख अथवा ऐसी संस्था के प्रवर्त्तक द्वारा विधिवत रूप से प्राधिकृत किसी अधिकारी द्वारा किया जाएगा ।
4.6 आवेदन का प्रपत्र तथा आवेदन के साथ संलग्न किए जाने वाले दस्तावेज तथा प्रेषित किया जाने वाला शुल्क, वह रीति जिसके द्वारा आवेदनों का प्रक्रमण किया जाएगा, मानकों और सन्नियमों, अपेक्षाओं तथा अनुमोदन प्रदान करने के लिए पद्धति को परिषद द्वारा समय - समय पर अनुमोदन प्रक्रिया पुस्तिका में निर्दिष्ट किया जाएगा ।
4.7 आवेदक को 4.1 और 4.2 में सूचीबद्ध प्रयोजनों के लिए आवेदन तथा निर्धारित किए गए शुल्क का भुगतान अभातशिप के वेब पोर्टल के माध्यम से ऑनलाइन अथवा परिषद् द्वारा समय- समय पर अधिसूचित किसी अन्य तंत्र के माध्यम से प्रस्तुत किया जाना अपेक्षित है ।
इस प्रकार के प्रत्येक मामले में, प्रणाली, आवेदन के अनुरूप , एक ट्रैकिंग संख्या प्रदान करेगी , जिसका उपयोग आवेदक द्वारा आगे उल्लेखन करने और संबंधित आवेदन की स्थिति का ऑनलाईन पता लगाने / जांच करने के लिए किया जा सकेगा ।
4.8 वेब पोर्टल पर दिए गए प्रपत्र में, 100/-रू० के गैर - न्यायिक स्टांप पेपर पर प्रथम श्रेणी मजिस्ट्रेट के समक्ष विधिवत रूप से शपथ ग्रहण किया गया यह शपथ - पत्र, जिसमें अन्य बातों के साथ- साथ यह कहा गया हो कि आवेदन में दी गई जानकारी सत्य है और यह कि यदि किसी भी अवस्था में यह पाया जाता है कि जानकारी अथवा जानकारी के किसी भाग को छिपाया गया है और / अथवा उसका गलत निर्वचन किया गया है और /अथवा आवेदन में दी गई जानकारी असत्य है, तो परिषद् कोई भी कार्रवाई करने के लिए स्वतंत्र होगी, जिसमें अनुमोदन का वापस लिया जाना और / अथवा ऐसी अन्य विधिक कार्रवाई, जो यह उपयुक्त समझे, करना शामिल है ।

4.9 सभी आवेदनों का मूल्यांकन , अभातशिप के वेब पोर्टल द्वारा उपलब्ध कराई गई स्वचालित चयन प्रक्रिया का प्रयोग करते हुए चयनित किये गये सदस्यों के माध्यम से अध्यक्ष, क्षेत्रीय समिति द्वारा गठित एक संवीक्षा समिति द्वारा किया जाएगा ।
4.10 संबंधित क्षेत्रीय अधिकारी अथवा परिषद् का कोई अन्य अधिकारी संबंधित समितियों की सहायता करेगा तथा संबंधित समितियों के समक्ष प्रासंगिक अभिलेख और दस्तावेज रखेगा तथा बैठकों के आयोजन के लिए आवश्यक व्यवस्था करेंगा; तथापि, वह समितियों का भाग नहीं होगा ।
4.11 संवीक्षा समिति, आवेदकों को, जिन्होंने खंड 4.1 के उप- खंड (क), (ख), (ग) और (घ) के अंतर्गत अपने आवेदन प्रस्तुत किए हैं (यथा प्रकरण ), स्कैन किए गए सभी दस्तावेजों की मूल-प्रतियों तथा नई संस्थाओं के लिए सृजित सभी सुविधाओं की वीडियो सीडी के साथ उनके प्रस्तावों के प्रस्तुतीकरण के लिए आमंत्रित करेगी । खंड 4.1 और 4.2 में सूचीबद्ध अन्य आवेदकों के संबंध में, संवीक्षा समिति आवेदकों द्वारा उपलब्ध कराई गई जानकारी / दस्तावेजों के आधार पर प्रस्तावों का प्रक्रमण करेगी ।
4.12 संवीक्षा समिति की सिफारिशों के आधार पर, संबंधित क्षेत्रीय अधिकारी आवेदकों को समय अनुसूची में यथावर्णित तारीख तक कमियाँ, यदि कोई हैं, की सूचना देगा । आवेदक सोसाइटी/ न्यास / कंपनी, कमियों को दूर करेंगे तथा संवीक्षा समिति द्वारा पुनर्विचार के लिए समय- अनुसूची में उल्लिखित तिथि तक अनुपालन प्रस्तुत करेंगे , कमियों की सूची जानकारी के लिए अभातशिप के वेब पोर्टल पर दर्शाई जाएगी ।
4.13 विशेषज्ञ समिति उन संस्थाओं का निरीक्षण करेगी, जिनके आवेदन इन विनियमों के खंड 4.1 के उप- खंड (क), (ख), (ग) और (घ) हेतु तथा खण्ड 4.2 के (ख) के अन्तर्गत द्वितीय पाली हेतु प्राप्त हुए हैं, जो कि अनुमोदन की मंजूरी हेतु आगे प्रक्रमण के लिये संवीक्षा समिति द्वारा अनुशंसित किये गये हैं ।
4.14 राज्य सरकार / संघ राज्यक्षेत्र प्रशासन तथा संबद्धक विश्वविद्यालय , इन विनियमों के खंड 4.1 और 4.2 के अधीन प्राप्त आवेदनों पर अपने दृष्टिकोण परिषद् के संबंधित क्षेत्रीय कार्यालय को अग्रेषित करेंगे, जैसाकि अनुमोदन प्रक्रिया पुस्तिका में निर्दिष्ट किया गया है ।
4.15 इन विनियमों के यथालागू खंड 4.1 और 4.2 के अंतर्गत प्राप्त आवेदनों के मामलों में, राज्य सरकार / संघ राज्यक्षेत्र प्रशासन, संबद्धक विश्वविद्यालयों के दृष्टिकोणों पर, यदि वे अनुमोदन प्रक्रिया पुस्तिका और विशेषज्ञ समिति की सिफारिशों में निर्दिष्ट समय-अनुसूची के अनुसार समय पर प्राप्त हो जाते हैं, अनुमोदन की मंजूरी हेतु आगे प्रक्रमण के लिए क्षेत्रीय समिति द्वारा विचार किया जाएगा । यदि राज्य सरकार / संघ राज्यक्षेत्र प्रशासन तथा संबद्धक विश्वविद्यालय के दृष्टिकोण अनुमोदन प्रक्रिया पुस्तिका में निर्दिष्ट समय अनुसूची में यथाउल्लिखित तारीख तक राज्य सरकार / संघ राज्यक्षेत्र प्रशासन और / अथवा संबद्धक विश्वविद्यालय से प्राप्त नहीं होते हैं, तो परिषद् अनुमोदन प्रक्रिया को पूर्ण करने पर आगे कार्रवाई करेगी ।

4.16 संबंधित क्षेत्रीय अधिकारी आवेदकों को, जिनके प्रस्तावों पर खंड 4.1 के उप-खंड (क) और (ख) में दर्शाए गए अनुमोदन के लिए क्षेत्रीय समिति द्वारा अनुमोदन की मंजूरी के लिए सिफारिश कर दी गई है, अनुमोदन प्रक्रिया पुस्तिका में उल्लिखित प्रक्रिया के अनुरूप वेब पोर्टल पर दिए गए प्रपत्र के अनुसार एक शपथ - पत्र के साथ अपेक्षित राशि सदस्य सचिव, अभातशिप के नाम पर जमा करने का अनुरोध करेगा ।
4.17 सभी विद्यमान तकनीकी संस्थाएं शेष यथा लागू अवधि के लिए, सदस्य- सचिव, अभातशिप के नाम पर विद्यमान एफडीआर के स्थान पर विद्यमान एफडीआर की राशि के समकक्ष, राशि जमा करेंगी ।
4.18 संबंधित क्षेत्रीय अधिकारी , कार्यकारिणी समिति के समक्ष रखने के लिए क्षेत्रीय समिति की सिफारिशों को अभातशिप मुख्यालय अग्रेषित करते समय यह सत्यापित करेगा कि संवीक्षा समिति तथा क्षेत्रीय समिति द्वारा , इन विनियमों और अनुमोदन प्रक्रिया के अंतर्गत निर्दिष्ट प्रक्रियाओं और मापदण्डों का अनुपालन किया गया है ।
अभातशिप मुख्यालय में सम्बन्धित ब्यूरो भी क्षेत्रीय समिति तथा संवीक्षा समिति द्वारा विनियमों और अनुमोदन प्रक्रिया पुस्तिका के अन्तर्गत निर्दिष्ट प्रक्रियाओं और मापदण्डों के अनुपालन किये जाने के सम्बन्ध में सत्यापन करेगा ।
4.19 क्षेत्रीय समिति की सिफारिशें अभातशिप की कार्यकारिणी समिति के समक्ष रखी जाएंगी । कार्यकारिणी समिति, क्षेत्रीय समिति की सिफारिशों पर विचार करने तथा एक शपथ-पत्र के साथ राशि जमा कर दिए जाने की पुष्टि करने के उपरान्त अनुमोदन की मंजूरी अथवा अन्यथा के लिए अपनी बैठक में निर्णय लेगी ।
4.20 परिषद्, स्वयं को इस बात से संतुष्ट कर लेने के पश्चात् कि आवेदक उसके द्वारा निर्दिष्ट सभी मानकों और सन्नियमों की पूर्ति करता है, अपेक्षित अनुमोदन की मंजूरी प्रदान करेगी ।
4.21 इसके पश्चात्, कार्यकारिणी समिति के निर्णय के आधार पर अभातशिप द्वारा अभिहित प्राधिकारी द्वारा अनुमोदन पत्र अथवा अस्वीकृति पत्र जारी किया जाएगा । एक समय में अधिकतम 2 वर्ष की अवधि के लिए ही अनुमोदन पत्र जारी किया जाएगा ।
4.22 नई संस्थाएं, जिन्हें अनुमोदन-पत्र प्रदान किया गया है तथा विद्यमान संस्थाएं, जिन्हें नए पाठ्यक्रम (ओं) , प्रभाग (ओं), कार्यक्रम (ओं) , द्वितीय पाली और प्रवेश क्षमता में परिवर्तन के लिए अनुमोदन प्रदान किया गया है, न्यूनतम अर्हताओं तथा वेतनमान के सम्बन्ध में बनाई गई नीति, परिषद् द्वारा निर्दिष्ट मानकों के अनुसार, शिक्षण कर्मियों तथा प्राचार्य/ निदेशक (यथा प्रकरण ) और अनुमोदन प्रक्रिया पुस्तिका में निर्दिष्ट अनुसूची के अनुसार अन्य तकनीकी सहायक स्टाफ और प्रशासनिक स्टाफ की नियुक्तिका अनुपालन करेंगी ।
अल्पसंख्यक संस्थाओं को छोडकर, शेष सभी शिक्षण संस्थाएं शिक्षण कर्मियों /प्राचार्य /निदेशक तथा अन्य तकनीकी सहायक स्टाफ और प्रशासनिक स्टाफ की नियुक्ति पूर्णतयः सम्बन्धित विश्वविद्यालय की पद्धति तथा प्रक्रिया (विशेषतयः चयन प्रक्रिया एवं चयन समिति के सम्बन्ध में) के अनुरूप ही करेंगी ।

स्टाफ की इन नियुक्तियों के बारे में सूचना, निर्धारित प्रपत्र पर अनुमोदन प्रक्रिया पुस्तिका में निर्दिष्ट अनुसूची के अनुसार अभातशिप के वेब पोर्टल पर भी अपलोड की जाएगी ।
किन्हीं भी परिस्थितियों में शिक्षण कर्मियों तथा अन्य स्टाफ की अपेक्षित नियुक्ति किए बिना, संस्थाएं अनुमोदित तकनीकी पाठ्यक्रम शुरू नहीं करेंगी ।
4.23 इन विनियमों के खंड 4.1 और 4.2 के अंतर्गत प्राप्त आवेदनों का प्रक्रमण अनुमोदन प्रक्रिया पुस्तिका में विनिर्दिष्ट पद्धतियों और अनुसूची के अनुसार अथवा परिषद् द्वारा समय- समय पर अधिसूचित किए गए अनुसार किया जाएगा ।
4.24 आवेदक तकनीकी संस्था के नाम का इस प्रकार प्रयोग नहीं करेगी कि तकनीकी संस्था के नाम का संक्षिप्त रूप आईआईएम अथवा आईआईटी अथवा आईआईएससी अथवा एनआईटी अथवा एआईसीटीई अथवा यूजीसी अथवा एमएचआरडी अथवा जीओआई बनता हो । आवेदक सरकार, भारत, भारतीय , राष्ट्रीय, अखिल भारतीय, अखिल भारतीय परिषद्, आयोग शब्दों का अथवा संप्रतीक और नाम (अनुचित प्रयोग का निवारण) अधिनियम , 1950 के अंतर्गत निषिद्ध अन्य नामों का प्रयोग तकनीकी संस्था के नाम में कही भीं नहीं करेगा । परंतु यह भी कि, उपर्युक्त प्रतिबंध उस दशा में लागू नहीं होंगे , यदि तकनीकी संस्था भारत सरकार द्वारा स्थापित की गई है अथवा इसका नाम भारत सरकार द्वारा अनुमोदित किया गया है ।
4.25 दाखिले के लिए सक्षम प्राधिकारी ऐसी तकनीकी संस्थाओं में विद्यार्थियों के दाखिले को अनुमति नहीं देगा, जिन्हें परिषद् का अपेक्षित अनुमोदन प्राप्त नहीं है ।
4.26 संबद्धक विश्वविद्यालय ऐसी तकनीकी संस्थाओं में दाखिल विद्यार्थियों का नामांकन नहीं करेगा , जिनके पास परिषद् का अपेक्षित अनुमोदन नहीं है । यह भी कि, स्नातकोत्तर (पी.जी. ) डिप्लोमा पाठ्यक्रम चलाने वाली सभी संस्थाएं प्रवेश वर्ष के, 31 मार्च से पूर्व दाखिला प्रक्रिया आरंभ नहीं करेंगी ।
4.27 संबंधित केन्द्रीय / राज्य सरकार / संघ राज्यक्षेत्र प्रशासन परिषद् के अपेक्षित अनुमोदन के बिना किसी तकनीकी संस्था को विद्यार्थियों के दाखिले के लिए अनुमति नहीं देगी ।
4.28 आवेदक प्रवर्त्तकों / तकनीकी संस्थाओं से परिषद् को विभिन्न प्रयोजनों के लिए अपेक्षित जानकारी तथा दस्तावेज सही तथा पूर्ण प्रदान करने की अपेक्षा की जाती है । यदि, दी गई जानकारी अथवा परिषद् को प्रदान किए गए दस्तावेज गलत, अपूर्ण पाए जाते हैं, और / अथवा आवेदक प्रवर्त्तक / तकनीकी संस्थाएं वास्तविक जानकारी को प्रकट करने में असफल रहती हैं और / अथवा उन्होंने जानकारी छिपाई है/ उसका गलत निर्वचन किया है , तो परिषद् इस संबंध में कार्रवाई करेगी , जिसमें अनुमोदन वापस लेना और/ अथवा ऐसी अन्य कार्रवाई करना शामिल है, जो, आवेदक प्रवर्त्तकों / तकनीकी संस्थाओं के विरूद्ध किए जाने के लिए आवश्यक समझी जाए ।

4.29 अभातशिप , ऐसे मामलों में, जहां दस्तावेजों के गलत होने, गलत निर्वचन किए जाने, मानकों और सन्नियमों के उल्लंघन, कदाचार की विशिष्ट शिकायतें हैं, तारीखों को अधिसूचित करके अथवा इसके बिना, समय - समय पर निरीक्षण भी कर सकेगी तथा उपयुक्त कार्रवाई कर सकेगी, जिसमें अनुमोदन वापस लेना तथा ऐसी अन्य कार्रवाई शामिल है, जो, यथा प्रकरण , आवेदक प्रवर्त्तकों/ तकनीकी संस्थाओं के विरूद्ध किए जाने के लिए आवश्यक समझी जाए ।
4.30 तकनीकी संस्था द्वारा अखिल भारतीय तकनीकी शिक्षा परिषद् के पास जमा की गई राशि को 10 वर्ष की अवधि के पश्चात् ही वापिस लिए जाने की अनुमति दी जाएगी तथापि, किसी मानक, शर्त और अपेक्षा के किसी उल्लंघन और / अथवा संस्था द्वारा गैर-निष्पादन और/ अथवा संस्था के विरूद्ध शिकायतों के मामले में, जमा की अवधि, मामला- दर- मामला आधार पर यथानिर्णित, आगे और अवधि के लिए बढ़ाई जा सकती है और / अथवा उसे जब्त किया जा सकता है ।
4.31 इन विनियमों के खण्ड 4.28 और 4.29 के अधीन विद्यमान पाठ्यक्रमों के अनुमोदन के विस्तार अथवा अनुमोदन के विस्तार की मंजूरी से इंकार किए जाने के मामले में, ऐसी संस्थाओं से इन विनियमों के खण्ड 4.1 (ग) और 4.2 में ऊपर उल्लिखित किसी प्रयोजन के लिए अनुमोदन हेतु प्राप्त किसी आवेदन पर तब तक विचार नहीं किया जाएगा, जब तक ऐसी कार्रवाई का निपटारा न कर लिया गया हो तथा प्रवर्त्तकों/ संस्थाओं को उल्लंघनों के आरोपों से मुक्त न कर दिया गया हो ।
4.32 संबद्धक विश्वविद्यालय ऐसी संस्थाओं के छात्रों को, जिसके कार्यक्रमों / पाठ्यक्रमों को परिषद् द्वारा समाप्त कर दिया गया है अथवा जिनका अनुमोदन वापस ले लिया गया है अथवा जिन्हें निलंबित कर दिया गया है , उसके साथ संबद्ध अन्य निकटवर्ती अभातशिप अनुमोदित तकनीकी संस्थाओं में स्थानान्तरित करेगा और परिषद् स्थानान्तरित हुए छात्रों को, उनके कार्यक्रमों / पाठ्यक्रमों की समाप्ति तक, ऐसी संस्थाओं में उपयुक्त रूप से खपाने के लिए ऐसी संस्थाओं में अतिरिक्त सीटों की अनुमति देगी ।
4.33 परिषद् के अनुमोदन के बिना तकनीकी कार्यक्रम / पाठ्यक्रम प्रदान करने वाली किसी भी संस्था को गैर-अनुमोदित घोषित किया जाएगा, यदि वहः-
क) परिषद् के अनुमोदन के बिना आरंभ हुई है ।
ख) किसी अस्थायी स्थान / या ऐसे स्थान पर कार्य कर रही है, जिसे परिषद् द्वारा अनुमोदन नहीं दिया गया है ।
ग) परिषद् द्वारा "गैर-अनुमोदित" घोषित की गई है ।
परंतु आगे यह भी कि, अस्थायी स्थानों और परिषद् द्वारा गैर-अनुमोदित स्थानों पर तकनीकी शिक्षा में पाठ्यक्रम / कार्यक्रम संचालित करने वाली संस्थाएं उन्हें बंद किए जाने के लिए कार्रवाई की दायी होगीं, जिसमें , दोषी सोसाइटियों /न्यासों / कंपनियों / सहयोजित व्यक्तियों के विरूद्ध , यथा प्रकरण, उपयुक्त कार्रवाई भी शामिल है ।

4.34 परिषद् किसी संस्था को कोई सशर्त अनुमोदन नहीं देगी ।
4.35 डिप्लोमाधारक तथा बी.एससी. डिग्री धारक द्वितीय वर्ष इंजीनियरी डिग्री पाठ्यक्रमों में संस्वीकृत प्रवेश क्षमता के अधिकतम 20 प्रतिशत तक प्रवेश के लिए पात्र होंगे, जबकि अंडमान निकोबार , लक्षद्वीप , दीव एवं दमन में संस्वीकृत प्रवेश क्षमता के अधिकतम 30 प्रतिशत तक प्रवेश के लिए पात्र होंगे, जोकि अनुमोदित प्रवेश क्षमता से अतिरिक्त होगा ।
परंतु यह कि, ऐसे विद्यार्थी, जिन्होंने वास्तुकला सहायकवृत्ति तथा नगर आयोजना में डिप्लोमा पाठ्यक्रम पूरा किया है, वे द्वितीय वर्ष वास्तुकला डिग्री पाठ्यक्रमों में संस्वीकृत प्रवेश क्षमता के अधिकतम 20 प्रतिशत तक प्रवेश के लिए पात्र होंगे, जबकि अंडमान निकोबार, लक्षद्वीप, दीव एवं दमन में संस्वीकृत प्रवेश क्षमता के अधिकतम 30 प्रतिशत तक प्रवेश के लिए पात्र होंगे, जोकि अनुमोदित प्रवेश क्षमता से अतिरिक्त होगा ।
परंतु यह और कि, ऐसे विद्यार्थी, जिन्होंने भेषजी में डिप्लोमा पाठ्यक्रम पूरा किया है , वे द्वितीय वर्ष भेषजी डिग्री पाठ्यक्रमों में संस्वीकृत प्रवेश क्षमता के अधिकतम 20 प्रतिशत तक प्रवेश के लिए पात्र होंगे, जबकि अंडमान निकोबार , लक्षद्वीप , दीव एवं दमन में संस्वीकृत प्रवेश क्षमता के अधिकतम 30 प्रतिशत तक प्रवेश के लिए पात्र होंगे, जोकि अनुमोदित प्रवेश क्षमता से अतिरिक्त होगा ।
4.36 कंपनी अधिनियम 1956 की धारा 25 के अधीन स्थापित की गई कंपनी अथवा सार्वजनिक-निजी भागीदारी अथवा बी.ओ.टी. मॉडल द्वारा स्थापित कार्यरत् तकनीकी संस्थाएं निम्नलिखित सुनिश्चित करेंगी :-
क) लाभान्वयन हेतु कार्य न करें (लाभार्थ कार्य प्रणाली नहीं)
ख) तकनीकी संस्थाओं के प्रचालन द्वारा सृजित की गई आय को तकनीकी संस्था के कार्यों तथा विकास पर ही खर्च करेंगे ।
ग) अप्रत्यक्ष रूप से घृति (होल्डिंग ) नहीं होगी ।
5. अपीलीय समिति के समक्ष अपील
5.1 परिषद् की कार्यकारिणी समिति के निर्णय से व्यथित किसी संस्था को अपीलीय समिति के समक्ष केवल एक बार अपील करने की अनुमति होगी । अपीलीय समिति का गठन अध्यक्ष, अभातशिप द्वारा किया जाएगा ।
5.2 परिषद् का एक अधिकारी अपीलीय समिति के समक्ष दस्तावेज प्रस्तुत करेगा । संस्था के एक प्रतिनिधि को अपीलीय समिति के समक्ष संस्था का दृष्टिकोण प्रस्तुत करने के लिए आमंत्रित किया जाएगा ।
5.3 अपीलीय समिति की सिफारिशें अभातशिप की परिषद् के समक्ष रखी जाएंगी , जिसका निर्णय अंतिम होगा ।

5.4 परिषद् का निर्णय , अनुमोदन पत्र अथवा अस्वीकृति पत्र के रूप में अथवा एक उपयुक्त संप्रेषण के रूप में, आवेदक को सूचित किया जाएगा । प्रस्ताव की अस्वीकृति के मामले में , आवेदनकर्ता इस बात के लिए स्वतंत्र होगा कि वह नया आवेदन कर सकता है ।
6. भूमि की आवश्यकता
किसी नई तकनीकी संस्था की प्रवर्त्तक सोसाइटी/ न्यास / कंपनी अधिनियम 1956 की धारा 25 के अधीन स्थापित की गई कंपनी के पास अपने विधिसम्मत कब्जे में, प्रवर्तक सोसाइटी / न्यास / कंपनी अधिनियम 1956 की धारा 25 के अधीन स्थापित की गई कंपनी के नाम पर प्रस्ताव जमा करने की तिथि तक या उससे पूर्व, स्पष्ट हक के साथ , यथाअपेक्षित और निर्दिष्ट भूमि होनी चाहिए ।
परंतु यह भी कि, प्रवर्त्तक सोसाइटी / न्यास / कंपनी अधिनियम 1956 की धारा 25 के अधीन स्थापित की गई कंपनी की प्रस्तावित संस्था के लिए यह बात खुली होगी कि वह केवल अनुमोदन पत्र की प्राप्ति के पश्चात् ही उस भूमि पर स्थित तकनीकी शिक्षा संस्थान के विकास के प्रयोजनार्थ संसाधन जुटाने के लिए उस भूमि को रेहन रख सकेगी ।
7. निदेशक/ प्राचार्य और संकाय सदस्यों के संबंध में जानकारी
सभी तकनीकी संस्थाएं उनके निदेशक/ प्राचार्य और संकाय सदस्यों के संबंध में जानकारी परिषद् के वेब पोर्टल पर उपलब्ध प्रपत्र में अपलोड करेंगी तथा समय- समय पर इस सूचना का अद्यतन करती रहेंगी ।
8. सामाजिक दायित्व
सामाजिक दायित्व की पूर्ति के क्रम में प्रत्येक अभातशिप अनुमोदित तकनीकी संस्था से यह अपेक्षा की जाती है कि वह पूरे वर्षभर में तकनीकी कौशल अभिवृद्धि हेतु 400 घंटे के कार्यक्रम चलाए (इन कार्यक्रमों में सप्ताह में तीन दिन, तीन से चार घंटे के कार्यक्रम, सांय 5 बजे से 8 बजे तक, 2 बैचों के लिए, जिनमें प्रत्येक बैच में 40 से 50 विद्यार्थी हों , शामिल होंगे ) । ये कार्यक्रम उस स्थान के स्थानीय समुदाय की आवश्यकताओं पर आधारित होने चाहिएं, जहाँ पर वह संस्थान स्थापित है ।
9. अंशकालीन / सांय कालीन कार्यक्रम
परिषद् किसी भी तकनीकी संस्था में तकनीकी शिक्षा कार्यक्रमों को, सांयकालीन कार्यक्रमों अथवा अंशकालीन कार्यक्रमों के रूप में चलाने की अनुमति नहीं देगी ।
10. निर्वचन
इन विनियमों के निर्वचन के संबंध में उठने वाले किसी भी प्रश्न का निर्णय परिषद् द्वारा किया जाएगा तथा परिषद् का निर्णय अंतिम तथा बाध्यकारी होगा ।

11. छूट देने की शक्ति
परिषद् अपवादस्वरूप मामलों में, किसी कठिनाई के निवारण के लिए अथवा ऐसे अन्य कारणों से जिन्हें लिखित में अभिलेखित किया जाएगा, संस्था के किसी भी वर्ग अथवा श्रेणी के संबंध में इन विनियमों के किसी भी उपबंध में छूट दे सकेगी ।
12. अनुमोदन वापस लेना
यदि कोई तकनीकी संस्था इन विनियमों के उपबंधों में से किसी का उल्लंघन करती है, तो परिषद्, ऐसी जांच करने के पश्चात, जो यह उपयुक्त समझे तथा संबंधित तकनीकी संस्था को सुने जाने का अवसर देने के पश्चात् इन विनियमों के अंतर्गत प्रदान किए गए अनुमोदन को वापस ले सकेगी ।
13. शास्ति
इन विनियमों के उल्लंघन करते हुए चल रही तकनीकी शिक्षा प्रदान करने वाली कोई संस्था, विधिक सिविल कार्रवाई के लिए दायी होगी, जिसमें अनुमोदन, यदि कोई है, को वापस लिया जाना और /अथवा परिषद् द्वारा , इसके और / अथवा इसकी प्रवर्तक सोसाइटी /न्यास/ कंपनी अथवा इससे सहयोजित व्यक्तियों के विरूद्ध यथा प्रकरण, विधिक आपराधिक कार्रवाई भी शामिल है ।
परंतु यह और भी कि, यदि कोई तकनीकी संस्था इन विनियमों के किसी भी उपबंध का उल्लंघन करती है, तो परिषद् ऐसी जांच करके, जो यह उपयुक्त समझे तथा संबंधित तकनीकी संस्था को मामले को स्पष्ट करने का अवसर प्रदान करने के पश्चात, नीचे निर्दिष्ट, यथा प्रकरण , कोई एक अथवा सभी कार्रवाईयां कर सकेगी:-
14. अनुपालन रिपोर्टों को प्रस्तुत न करना / अधूरा प्रस्तुत किया जाना
14.1 विनिर्दिष्ट समय- सीमा तक अनुपालन रिपोर्ट के प्रस्तुत न किए जाने / अधूरा प्रस्तुत किए जाने पर, संबंधित संस्था अथवा इसके प्रवर्तकों पर निम्न कार्रवाईयों में से कोई एक अथवा अधिक अधिरोपित की जाएंगी:-
क) अतिरिक्त सीटों के लिए अनुमोदन का निलंबन
एक/ अधिक पाठ्यक्रमों में प्रवेश नहीं (नो एडमीशन) स्थिति ख)
ग) कार्यक्रम / पाठ्यक्रम के लिए अनुमोदन वापस लेना
घ) संस्था के अनुमोदन को वापस लेना।
14.2 अधिक प्रवेश
यदि किसी संस्था द्वारा अधिक प्रवेश की सूचना दी जाती है / परिषद् द्वारा ऐसा पाया जाता है , तो संस्था पर निम्न में से एक अथवा अधिक कार्रवाई की जाएगी:-
क) अनुमोदित क्षमता से अधिक प्रवेश किए गये प्रत्येक छात्र से वसूले गए कुल शुल्क के पांच गुना के समकक्ष का सरचार्ज
अतिरिक्त सीटों के लिए अनुमोदन का निलंबन ख)
ग) एक / अधिक पाठ्यक्रमों में प्रवेश नहीं (नो एडमीशन) स्थिति
प) कार्यक्रम/पाठ्यक्रम के लिए अनुमोदन वापस लेना
ड़) संस्था के अनुमोदन को वापस लेना ।

14.3 अर्हक प्राचार्य / निदेशक की अपेक्षा की पूर्ति न किया जाना
ऐसी संस्था, जिनके पास 18 माह से अधिक की अवधि के लिए पद के लिए यथानिर्धारित अर्हता के अनुसार प्राचार्य / निदेशक नहीं होंगे , उन्हें प्रवेश नहीं (नो एडमीशन) श्रेणी में रखा जाएगा ।
14.4 संकाय : छात्र अनुपात की पूर्ति न होना, शिक्षण स्टाफ के लिए निर्दिष्ट वेतनमानों और / अथवा अर्हताओं का अनुपालन न किया जाना
ऐसी संस्थाएं , जो 18 माह से अधिक के लिए यथानिर्दिष्ट संकाय : छात्र अनुपात का अनुरक्षण नहीं कर रही हैं, शिक्षण स्टाफ के लिए निर्दिष्ट वेतनमानों और /अथवा अर्हताओं का अनुपालन नहीं कर रही हैं, वे निम्न कार्रवाईयों में से किसी एक अथवा अधिक की दायी होंगी :-
क) अतिरिक्त सीटों, यदि कोई हैं, के लिए अनुमोदन का निलंबन
ख) संबंधित पाठ्यक्रमों में प्रवेश नहीं (नो एडमीशन) स्थिति
ग) संबंधित पाठ्यक्रम के लिए अनुमोदन वापस लेना
घ) संस्था के अनुमोदन को वापस लेना
14.5 कम्प्यूटर, सॉफ्टवेयर, इंटरनेट, प्रिंटरों, प्रयोगशाला उपस्करों, पुस्तकों, जर्नलों, पुस्तकालय सुविधाओं की अपेक्षाओं की पूर्ति न किया जाना

Regulations , 2011
F. No. 37-3/Legal/2011 . In exercise of it's powers conferred under sub - section ( 1 ) of Section 23 read with Section 10 and Section 11 of the All India Council for Technical Education Act , 1987 ( 52 of 1987 ) and in supersession ofthe Regulations F. No. 37-3 /Legal/2010 , dated 15th January , 2010 regarding grant of approval for starting new technical institutions , introduction of courses or programs and increase/variation of intake capacity of seats for the courses or programs and extension of approval for the existing technical institutions , the All India Council for Technical Education makes the following Regulations:

Short Title , Application and Commencement :
1.1 These Regulations may be called the All India Council for Technical Education (Grant of Approvals for Technical Institutions ) Regulation , 2010 .
1.2 They shall apply to technical institutions conducting technical education and such other programs and areas as notified by the Council from time to time .
1.3 They shall come into force with effect from the date of their publication in the Official Gazette .

Definitions: In these Regulations , unless the context otherwise requires 2.1
"Academic year " means Academic Year of the concerned affiliating University and / or technical institution .
2.2
"Act" means the All India Council for Technical Education Act 1987 (52 of 1987) .
2.3
"AICTE web - portal " means web site hosted by the Council at URL www.aicte-india.org .
2.4 "Applicant" means an applicant that makes an application to the Council for seeking any kind of approval under these Regulations .
2.5 "Approved Institution " means the Institute approved by Council.
2.6
" Chairman " shall means Chairman of the Council as described under sub - section (4)( a) of section 3 of the Act .
2.7
"Company " means the company established under section 25 of 15

the Company Act 1956.
2.8 "Competent Authority for Admission " means a body responsible for admission to technical institutions in the State/UT concerned .
2.9
" Council" Means All India Council for Technical Education establish under Section 3 of the Act .
2.10 "Course " means one of the branches of learning in Program .
2.11 "Division" shall mean;
a batch of sixty seats in Under Graduate Program and Diplomas in Engineering / Technology / Pharmacy / Hotel Management & Catering Technology / Applied Arts & Crafts , Architecture / Town Planning & post graduate program in PGDM / MBA / MCA, excluding supernumerary seats , if any ; A batch of 18 seats in Post Graduate program in Engineering / Technology / Pharmacy / Hotel Management & Catering Technology / Applied Arts & Crafts / Architecture / Town Planning .
2.12 " E- Banking " means the internet banking.
2.13 "E- Receipt " means the payment receipt received on payment using internet banking on web - portal of AICTE .
2.14 "Executive Committee " means the Committee constituted by the Council under Section 12 of the AICTE Act .
2.15 "Foreign National " means the citizen of all countries other than India who are not of Indian origin as defined under PIO .
2.16 " Government Aided Institution " means technical institution that meets 50% or more of its recurring expenditure out of the grant received from Government or Government organizations .
2.17 "Government Institution " means technical institution established and / or maintained by the Government .
2.18 "Head of the institution" means the Vice - Chancellor /Director in case of a university or a deemed to be university , the Principal or the Director or such other designation as the executive head ofthe institution of the technical institution referred .
2.19 "Non-Resident Indian (NRI ) " means an Indian citizen who is ordinarily residing outside India and holds an Indian Passport .
2.20 "Persons of Indian origin (PIO ) " shall mean the Persons who are citizens of other countries ( except Pakistan & Bangladesh ) who at any time held an Indian Passport , or who or either of his /her parents or any of his /her grand parents was a citizen of India by virtue of the provisions of the Constitution of India of Sec.2 (b ) of the Citizenship Act, ( 57 of 1955 ) .
2.21 "Private-Self Financing Institution " means an Institution started by a Society/ Trust/ Company and does not received grant/ fund [PART III- SEC. 4] THE GAZETTE OF INDIA : EXTRAORDINARY

from Central and / or State Government and /or Union Territory Administration for meeting its recurring expenditure.
2.22 "Program" means the field of Technical Education , i.e. Engineering, Technology , MCA, Architecture , Town Planning , Management-MBA, Management- PGDM, Pharmacy , Hotel Management & Catering Technology , Applied Arts & Crafts and such other programs and areas as notified by the Council from time to time .
2.23 "Regional Committee " means a Regional Committee established under Section 14 of the Act .
2.24 " Second Shift " means shift generally from 1pm to 9 pm in which educational activities of the technical institution are conducted.
2.25 "Society" means a Society registered under Society Registration Act 1860.
2.26 "Trust " means a Trust registered under Charitable Trust Act 1950 or any other relevant Act .
2.27 Any other words and expressions used herein and not defined but defined in the All India Council for technical Education Act , 1987 (52 of 1987) , shall have the same meanings respectively assigned to them in the said Act ;
Promoters of the Technical Institutions

3.1 A technical institution may be established and administered by the following:
a A Society registered under the Registration of Societies Act 1860
b A Trust registered under the Charitable Trusts Act 1950 or any other relevant Act .
c A company incorporated under section 25 of the Companies Act 1956.
d A Company as stipulated in Regulations sub clause 2.7, having any foreign equity directly or indirectly as share holding shall not be permitted from applying for setting up an educational Institution
e. Central or State Government / UT Administration or by a Society or a Trust registered or a company incorporated under section 25 of the Companies Act 1956 or under Public Private Partnership mode by them or under Build Operate and Transfer mode
4
Grant of Approvals for Technical Institution/Polytechnic (Technical Institution offering Diplomas )
4.1 All promoters of technical institutions and or Polytechnic 17

(Technical Institution offering Diplomas ) shall require prior approval of the Council for
a Establishing a new Technical Institution / Polytechnic (Technical Institution offering Diplomas ) , or establishing a Technical Campus .
b Entry and operation of foreign Universities in India and collaborations and partnerships between Indian and foreign universities / institutions in the field of technical education , research and training .
Converting existing AICTE approved Technical Institutions into a Technical Campus ;
d Conversion from women only Institution to Co - Ed Institution .
e Change of the name of the promoter society / trust / company / Technical institution
f Closure of AICTE approved technical institution
4.2 The Technical Institution / Polytechnic (Technical Institution offering Diploma) shall require prior approval of the Council for:
a Extension of existing approval ;
b Introduction of new course/s , division/ s , program/s , second shift;
c Change in intake capacity;
d Creation of supernumerary seats for admitting foreign students / persons of Indian origin/children of Indian workers in gulf countries;
e Admission quota for children of Non Resident Indians ;
f Creation of supernumerary seats under tuition fee waiver scheme
g Closure of AICTE approved course /program/division .
4.3 The Council shall publish , from time to time , Approval process Hand Book , detailing the procedure to process the applications of Institutions and / or promoters .
4.4 The applications for approval for the purposes listed under clause 4.1 (a) , (b) , (c) , (d) and (e) of these Regulations shall be made by: -
a The Chairman or Secretary in case of the Society / Trust
b Managing Director or any authorized officer in case of company established under section 25 of the Company Act 1956 and
An officer authorized by the concerned Central Government /State Government /UT in case of Central or State Government / UT Administration or a Society or a Trust registered or a

company incorporated under section 25 of the Companies Act 1956 or under Public Private Partnership mode by them , as the case may be .
4.5 The applications for approval for the purposes listed under clause 4.2 (a) , (b ) . ( c ) , ( d) , ( e) , ( f) and (g ) of these regulations shall be made by Principal / Director of the technical institution or head of the institution or an officer of the institution duly authorized by the promoter of such institutions .
4.6 The formats of the application and the documents to be attached to the application and the fee to be remitted, the manner by which the applications are processed , the norms and standards , requirements and the procedures for grant of approval shall be prescribed in the Approval Process Hand Book by the Council from time to time .
4.7 The applicant may be required to submit the application for purposes listed in 4.1 and 4.2, and pay prescribed fee online through AICTE's web - portal or any other mechanism notified by the Council from time to time .
In such a case , the system may generate a tracking number , specific to the application , which may be used by the applicant for making further references and to track / check the status of the application , concerned , online .
4.8 An affidavit, in the format as given on the web portal , on a Non Judicial Stamp paper of Rs . 100/- duly sworn before a first class Magistrate inter alia stating that the information given in the application is true and that if it is found at any stage that any or part of the information had been suppressed and / or misrepresented and / or the information given in the application is false, the Council will be free to take action including withdrawal of approval and / or any other legal action as it may deem fit .
4.9 All applications shall be evaluated by a Scrutiny Committee constituted by the Chairman , Regional Committee by selecting members using automated selection process provided by the AICTE web - portal
4.10 Regional Officer or an Officer of the Council concerned shall assist the respective committees and place relevant records and documents before the respective committees and make necessary arrangements for conduct of the meetings ; however , he shall not be part of the committees .
4.11 The Scrutiny Committee shall invite applicants of (a) , (b) , (c) and ( d ) of clause 4.1 , for presentation of their proposals along [ भाग III-खण्ड 4]

with originals of all scanned documents and a video CD of all facilities created for new Institutions as the case may be . As regards the other applications listed at 4.1 and 4.2 the Scrutiny Committee will process the proposals based on the information / documents provided by the applicant.
4.12 Based on the recommendations of the Scrutiny Committee , the Regional Officer concerned shall communicate deficiencies , if any , to the applicants as stated in time schedule . The Applicant Society/Trust/Company may rectify the deficiencies and submit compliance as stated in time schedule for reconsideration by the Scrutiny Committee. The list of deficiencies shall also be posted in the AICTE web - portal for information .
4.13 Expert Committee shall visit the Institutions in respect of the applications received under sub clause (a) , (b) , (c) and (d) of clause 4.1 and under clause 4.2 [ b ] for the second shift of these regulations which are recommended by the scrutiny committee for further processing for grant of approval .
4.14 The State Government/UT and the affiliating university may forward their views on the applications received under clause 4.1 and 4.2 of these Regulations to the concerned regional Office of the Council as prescribed in the approval process hand book.
4.15 The views of the State Government/UT, administration, the affiliating University, if received in time as per schedule prescribed in the approval process hand book and Expert Committee recommendations , in case of applications received under clause 4.1 and 4.2 as applicable , of these Regulations shall be considered by the Regional Committee for further processing for grant of approval . If the views of the State Government/UT and the affiliating university are not received from the State Government/ UT and/ or the affiliating University as mentioned in time schedule prescribed in the approval process hand book, the Council will proceed further for completion of approval process .
4.16 The Regional Officer concerned shall request the applicants , whose proposals seeking approval for cases as indicated in sub clause (a) , (b ) of clause 4.1 , are recommended by the Regional Committee for grant of approval , to deposit the prescribed amount in the name of member secretary , AICTE along with an affidavit , in the prescribed format given on the web portal , as per the procedure mentioned in the approval process hand book .
4.17 All existing Technical Institutions shall deposit money in place of existing FDR of the amount equal to the FDR in the name of [PART III-SEC. 4] THE GAZETTE OF INDIA EXTRAORDINARY

Member Secretary, AICTE , for the remaining period as applicable to them .
4.18 Regional Officer concerned, while forwarding the recommendations of the Regional Committee to AICTE head quarters , for placing before the Executive Committee shall verify that the processes and parameters prescribed under these regulations and approval process hand book are followed by the scrutiny committee and the regional committee .
The bureau concerned at AICTE head quarters shall also verify that the processes and parameters prescribed under these regulations and approval process hand book are followed by the scrutiny committee and the regional committee .
4.19 The recommendations of the Regional Committee shall be placed before the Executive Committee of AICTE . Executive Committee after considering the recommendations of the Regional Committee and on confirmation of deposit of Money, along with the affidavit , shall take a final decision at its meeting on grant of approval or otherwise.
4.20 The council shall grant the desired approvals only after satisfying itself that the applicant meets all the norms and standards prescribed by it .
4.21 Further based on the decision of the Executive Committee , Letter of Approval for a maximum period of two years at a time or Letter of Rejection shall be issued by the designated authority of the AICTE .
4.22 New Institutions granted Letter of Approval and the existing Institutions granted approval for introduction of new course/s division/ s program/ s second shift and change in intake capacity , shall comply with appointment of teaching staff and Principal/Director as the case may be , as per policy regarding minimum qualifications pay scale etc , norms prescribed by the Council and other technical supporting staff & administrative staff as per the schedule prescribed in the approval process hand book.
Institutions other than minority Institutions shall appoint teaching staff / Principal / Director and other technical supporting staff and administrative staff strictly in accordance with the methods and procedures of the concerned affiliating university particularly in case of selection procedures and selection committees .

The information about these appointments of staff in the prescribed format shall also be uploaded on the web - portal of AICTE as per the schedule prescribed in the approval process hand book .
In no circumstances unless the appointment of all teaching and other staff is in place , the Institutes shall start the approved Technical Courses .
4.23 The applications received under clause 4.1 and 4.2 of these Regulations will be processed as per the procedures and schedule prescribed in the approval process hand book or as notified by the Council from time to time .
4.24 The applicants shall not use name the technical institution in such a way that the abbreviated form of the name of the technical institution becomes IIM or IIT or II Sc or NIT or AICTE or UGC or MHRD or GOI . The applicant shall also not use the word( s ) Government , India, Indian , National , All India , All India Council , Commission anywhere in the name of the technical institution and other names as prohibited under the Emblems And Names (Prevention of Improper Use) Act , 1950 . Provided that the restrictions mentioned above shall not be applicable , if the technical institution is established by Government of India or its name is approved by the Government of India .
4.25 Competent Authorities for Admissions shall not allow admission of students in those technical institutions , which do not have requisite prior approval of the Council .
4.26 Affiliating universities shall not enroll students admitted in such technical institutions , which do not have requisite prior approval of the council . Further, all Technical Institutions conducting PG Diploma courses shall not initiate admission process before 31st March of the admission Year .
4.27 Central / State Government / UT Administration concerned shall not permit any technical institution without requisite prior approval of the Council to admit students .
4.28 The applicant promoters/technical institutions are expected to provide to the Council true and complete information and documents required for various purposes . If, the information given and or the documents provided to the Council are found to be false , incomplete and/or the applicant promoters /technical institutions have failed to disclose factual information and / or suppressed/misrepresented the information , the Council shall take action including withdrawal of approval and/ or any other

action as deemed necessary against the applicant promoters /technical institutions .
4.29 AICTE may also conduct from time to time inspections with or without notifying dates in such cases where specific complaints of falsification of documents , misrepresentation , violation of norms and standards , mal - practices and take appropriative actions , including withdrawal of approval and any other action deemed necessary against the applicant promoters /technical institutions , as the case may be.
4.30 The Money Deposited by the Technical Institution with AICTE may be permitted to be withdrawn after a term of ten years . However, the term of the Money deposited could be extended for a further period as may be decided on case to case basis and/or forfeited in case of any violation of norms , conditions , and requirements and/ or non -performance by the Institution and/or complaints against the Institution.
4.31 In the event of denial of extension of approval for the existing courses or grant of extension of approval under clause 4.28 and 4.29 of these Regulations , any application received for approval for any of the purposes mentioned above at clause 4.1 (c) and 4.2 of these Regulations from such institutions shall not be considered till such proceedings are settled and the promoters /institutions are cleared of the charges of violations .
4.32 The affiliating universities shall transfer the students of the institutions , whose programs / courses have been discontinued by the Council or approval is withdrawn or suspended, to other nearby AICTE approved technical institutions affiliated to it and the Council shall allow supernumerary seats in such institutions to accommodate the transferred students appropriately till they complete the programs / courses .
4.33 Any Institution offering technical programs/ Courses without approval of the Council , shall be termed as unapproved if a Started without approval by the Council .
b Working in temporary location / at location not approved by the Council .
Declared as "Unapproved" by the Council .

Provided further, the Institutions conducting courses /programs in technical education, in temporary location / at location not approved by the Council , shall be liable for action for closure including appropriate action against defaulting Societies / Trusts / Companies / associated Individuals as the case may be .
4.34 The Council shall not grant any conditional approval to any Institution 23

4.35 Diploma holders and B. Sc Degree holders shall be eligible for admission to second year engineering degree courses up to a maximum of 20% of sanctioned intake, except Andaman , Nicobar , Lakshadweep , Diu and Daman where it shall be 30% , which will be the supernumerary of the approved intake .
Provided that Students who have completed Diploma course in Architectural Assistantship & Town Planning shall be eligible for admission to second year Architecture degree courses up to a maximum of 20% of sanctioned intake except Andaman , Nicobar, Lakshadweep , Diu and Daman where it shall be 30% , which will be the supernumerary of the approved intake .
Provided further that students who have completed Diploma course in Pharmacy shall be eligible for admission to second year Pharmacy degree courses up to a maximum of 20 % of sanctioned intake except Andaman , Nicobar, Lakshadweep , Diu and Daman where it shall be 30% , which will be the supernumerary to the approved intake .
4.36 Working of Technical Institution set up by the company established under section 25 of the Company Act 1956 or PPP or BOT model shall ensure the following:
a No profit working
b Income generated through operations of Technical Institution shall be utilized for working and development of the Technical Institution
c There shall be no indirect holding
5
Appeal before Appellate committee :
5.1 An Institution aggrieved by the decision of the Executive Committee of the Council may be permitted only one opportunity to file appeal before an appellate committee. The appellate committee shall be constituted by the Chairman , AICTE.
5.2 An officer of the Council shall place the records before the appellate Committee . A representative of the Institute shall be invited to place the point of view of the Institute before the appellate committee .
5.3 The recommendations of appellate committee shall be placed before the Council of the AICTE whose decision shall be final .
5.4
The decision of the Council shall be communicated to the applicant in the form of a letter of approval or rejection or in the form of an appropriate communication . In case of rejection of the proposal, it shall be open for the applicant to make a fresh [PART III--SEC . 4]

Requirement of land :
The promoter society / trust / company established under section 25 of the Company Act 1956 of a new technical Education Institution shall have the land as required and prescribed in its lawful possession with clear title in the name of the promoter society / trust / company established under section 25 of the Company Act 1956 on or before the date of submission of application .
Provided that it shall be open for the promoter society / trust / company established under section 25 of the Company Act 1956 proposed institution to mortgage the land only after the receipt of letter of approval , only for raising the resources for the purpose of development of the Technical Education institute situated on that land

Information in respect of Director / Principal and Faculty members .
All Technical Education institutions shall upload the information in respect of their director / Principal and faculty members in the format available on the web portal of the Council and update the information from time to time .
8
Social responsibility
As a part of discharging social responsibility , all Technical Institutions approved by the Council are expected to conduct a 400 hour technical skills value added programs spread over a year (programs will include 3 - 4 hours three days a week , two batches of 40 50 students per batch, 5pm to 8 pm) . These Programs may be based on the needs of the local community where the Institute is located .

Part Time / Evening Programs
The council shall not permit any Technical Education program to be run as either evening or part Time program in any Technical Institution

Interpretation
Any question arising out of the interpretation of these Regulations , shall be decided by the Council and the decision of the Council shall be binding and final.

Power to relax
The Council may in exceptional cases , for removal of any hardship or such other reasons to be recorded in writing, relax any of the provisions of these Regulations in respect of any class or category of institutions .

Withdrawal of approval
If any technical institution contravenes any of the provisions of these Regulations , the Council may , after making such inquiry , as it may consider appropriate and after giving the technical institution concerned an opportunity of being heard , withdraw the approval granted under these Regulations .
13
Penalty
An institution running any technical education in violation of these Regulations , shall be liable for initiation of legal civil action including withdrawal of approval , if any , and / or legal criminal action by the Council against the Institution and/or its promoter Society /Trust/ Company and Individuals associated as the case may be .
Provided further that if any technical institution contravenes any of the provisions of these Regulations , the Council after making such inquiry as it may consider appropriate and after giving technical institution concerned , an opportunity to clarify the matter , may take any or all action as specified below and as the case may be.

Non - submission / Incomplete submission of Compliance Report
14.1 In case of non- submission / incomplete submission of Compliance Report by the prescribed time limit , the concerned shall be imposed any one or institution or its promoters more of the following actions :
a Suspension of approval for supernumerary seats
b No admission status in one/more courses
Withdrawal of approval for program/course
d Withdrawal of approval of the Institution .
14.2 Excess admissions
In case any excess admission by an Institute is reported to / noted by the Council , the Institution shall attract any one or more of the following actions ;
a Surcharge on fee equivalent to five times of the total fee collected per student admitted in excess to approved strength

b Suspension of approval for supernumerary seats
No admission status in one/more courses
c
d Withdrawal of approval for program /course
e Withdrawal of approval of the Institution
14.3 Non fulfillment of requirement of qualified Principal / Director
The Institution which does not have qualified Principal/Director as prescribed in position , for a period, more than 18 months shall be liable to be placed under no admission status .
14.4 Non fulfillment in Faculty : Student Ratio , not adhering to pay - scales and / or qualifications prescribed for teaching staff
The Institutions not maintaining prescribed Faculty : Student ratio as prescribed for more than 18 months , not adhering to pay-scales and / or qualifications prescribed for teaching staff shall be liable to any one or more of the following action:
a Suspension of approval for supernumerary seats , if any b No admission status in respective courses
Withdrawal of approval of the respective course
d Withdrawal of approval of the Institution
14.5 Non fulfillment in Computer , Software , Internet , Printers , Laboratory Equipments , Books , Journals , Library facilities requirement
Institutions not maintaining prescribed Computer , Software , Internet , Printers , Laboratory Equipments and Books , Journals , Library facilities as prescribed shall be liable to any one or more of the following actions :
a Suspension of approval for supernumerary seats , if any b No admission status in respective courses
Withdrawal of approval of the respective course
Withdrawal of approval of the Institution

14.6 Non fulfillment in additional Essential requirements for Technical Institution
Institution not maintaining prescribed requirement shall be liable to any one or more of the following actions by the Council :
a Suspension of approval for supernumerary seats , if any No admission status in one / more courses

14.7 Non fulfillment in Built up Area
Institutions not fulfilling prescribed built up area requirement shall be liable to any one or more of the following actions :
a Suspension of approval for supernumerary seats , if any
b No admission status in respective courses
c Withdrawal of approval of the respective course
d Withdrawal of approval of the Institution
14.8 Refund cases
Institutions not following AICTE guidelines /Regulations regarding refund of fees on cancellations of admissions or delaying refunds shall be liable to any one or more of the following actions :
a Surcharge equivalent to two times of the total fee collected per student shall be levied against each case of refund of fee
b Suspension of approval for supernumerary seats , if any
