सा.का.नि. 969(अ) .- संयुक्त समिति, संसद सदस्य वेतन , भत्ता और पेंशन अधिनियम, 1954 ( 1954 का 30) की धारा 9 की उपधारा (3 ) के खंड ( गग ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार से परामर्श करने के पश्चात् संसद सदस्य ( यात्रा और दैनिक भत्ता) नियम , 1957 में ऐसे और संशोधन करने के लिए, जिन्हें उक्त धारा की उपधारा (4 ) के अधीन यथाअपेक्षित राज्य सभा के सभापति और लोक सभा के अध्यक्ष द्वारा अनुमोदित और पुष्ट कर दिया गया है, निम्नलिखित नियम बनाती है, अर्थात्ः-
1. ( 1 ) इन नियमों का संक्षिप्त नाम संसद सदस्य (यात्रा और दैनिक भत्ता) ( संशोधन) नियम , 2010 है ।
(2) ये 1 अक्तूबर, 2010 को प्रवृत्त हुए समझे जाएंगे ।
2. संसद सदस्य, (यात्रा और दैनिक भत्ता) नियम , 1957 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 4क में " तेरह रुपये प्रति किलोमीटर " शब्दों के स्थान पर , " सोलह रुपये प्रति किलोमीटर " शब्द रखे जाएंगे ।
3. उक्त नियमों के नियम 5 में, टिप्पण में " एक हजार रुपये प्रतिदिन" शब्दों के स्थान पर "दो हजार रुपये प्रतिदिन" शब्द रखे जाएंगे ।

G.S.R. 969(E ) . In exercise of the powers conferred by clause (cc) of sub-section (3 ) of section 9 of the Salary , Allowances and pension of Members of Parliament Act, 1954 (30 of 1954), the Joint Committee , after consultation with the Central Government , hereby makes the following rules further to amend the Members of Parliament (Travelling and Daily Allowances ) Rules , 1957 , which have been approved and confirmed by the Chairman of the Council of States and the Speaker of the House of the People, as required under sub- section (4) of that section , namely:
1. (1) These rules may be called the Members of Parliament (Travelling and Daily Allowances) (Amendment) Rules , 2010.
(2) They shall be deemed to have come into force on the 1st day of October , 2010.
2. In the Members of Parliament (Travelling and Daily Allowances ) Rules , 1957 ( hereinafter referred to as the said rules ) , in rule 4A, for the words " rupees thirteen per kilometer " , the words " rupees sixteen per kilometer " shall be substituted.
3. In the said rules , in rule 5, in the Note , for the words " one thousand rupees per diem " , the words " rupees two thousand per diem " shall be substituted.

2. In rule 2 of the Members of Parliament ( Constituency Allowance) Rules , 1986, for the words " rupees twenty thousand per mensem" , the words " rupees forty- five thousand per mensem " shall be substituted .

सा.का.नि. 971(अ) .- संयुक्त समिति, संसद सदस्य वेतन , भत्ता और पेंशन अधिनियम, 1954 ( 1954 का 30) की धारा 9 की उपधारा (3 ) के खंड (चच) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार से परामर्श करने के पश्चात्, संसद सदस्य (वाहन क्रय करने के लिए अग्रिम) नियम , 1986 में ऐसे और संशोधन करने के लिए , जिन्हें उस धारा की उपधारा (4) के अधीन यथाअपेक्षित राज्य सभा के सभापति और लोक सभा के अध्यक्ष द्वारा अनुमोदित और पुष्ट कर दिया गया है, निम्नलिखित नियम बनाती है, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम संसद सदस्य (वाहन क्रय करने के लिए अग्रिम) ( संशोधन) नियम, 2010 है ।
(2 ) ये 1 अक्तूबर , 2010 को प्रवृत्त हुए समझे जाएंगे ।
2. संसद सदस्य, ( वाहन क्रय करने के लिए अग्रिम) नियम, 1986 के नियम 2 के उपनियम ( 1 ) में " एक लाख रुपये से अधिक नहीं होगा" शब्दों के स्थान पर " चार लाख रुपये से अधिक नहीं होगा" शब्द रखे जाएंगे ।

G.S.R. 971 (E ). In exercise of the powers conferred by clause ( ff) of sub-section (3) of section 9 of the Salary , Allowances and pension of Members of Parliament Act, 1954 (30 of 1954) , the Joint Committee , after consultation with the Central Government , hereby makes the following rules further to amend the Members of Parliament ( Advance for the Purchase of Conveyance ) Rules , 1986, which have been approved and confirmedby the Chairman of the Council of States and the Speaker of the House of the People , as required under sub- section (4) of that section , namely:
1.
These rules may be called the Members of Parliament (Advance for the Purchase of Conveyance ) (Amendment) Rules , (1) 2010.
(2) They shall be deemed to have come into force on the 1st day of October, 2010.
2. In rule 2 of the Members of Parliament ( Advance for the Purchase of Conveyance) Rules , 1986 , in sub- rule ( 1 ) for the words "shall not exceed rupees one lakh" , the words " shall not exceed rupees four lakhs " shall be substituted.

2. संसद सदस्य , ( कार्यालय व्यय भत्ता) नियम, 1988 के नियम 3 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्: -
"3. कार्यालय व्यय भत्ते की रकम कोई सदस्य अधिनियम की धारा 8 के अधीन पैंतालीस हजार रुपये प्रति मास की दर से कार्यालय व्यय भत्ता प्राप्त करने का हकदार होगा , जिसमें से-
(क) पंद्रह हजार रुपये , लेखन सामग्री मदों और डाक महसूल संबंधी व्यय को पूरा करने के लिए होंगे; और
(ख) लोक सभा या राज्य सभा सचिवालय ऐसे व्यक्ति (व्यक्तियों) को, जो सचिवालीय सहायता प्राप्त करने के लिए किसी सदस्य द्वारा नियोजित किया जाए ( किए जाएं) , तीस हजार रुपये तक का संदाय कर सकेगा और ऐसा एक व्यक्ति सदस्य द्वारा सम्यक् रूप से प्रमाणित किया गया कम्प्यूटर साक्षर होगा । " ।
[फा. सं. आरएस 8/ एमएसए/2010 ] दीपक गोयल , संयुक्त सचिव टिप्पण : मूल नियम सा.का.नि. संख्यांक 1098 (अ) , दिनांक 25 नवम्बर, 1988 द्वारा प्रकाशित किए गए थे और अंतिम बार सा.का.नि. सं. 461 (अ), दिनांक 3 जुलाई , 2007 द्वारा संशोधित किए गए थे ।
स्पष्टीकारक ज्ञापन
संसद सदस्य वेतन, भत्ता और पेंशन अधिनियम, 1954 को संसद सदस्य वेतन, भत्ता और पेंशन (संशोधन ) अधिनियम, 2010 (2010 का 37) द्वारा संशोधित किया गया है । उक्त संशोधन अधिनियम के उपबंधों को, उनमें अन्यथा उपबंधित के सिवाय , 1 अक्तूबर, 2010 से प्रवृत्त किया गया है । उक्त संशोधनों के अनुसरण नें, संसद सदस्य (यात्रा और दैनिक भत्ता) नियम , 1957 और संसद सदस्य (वाहन क्रय करने के लिए अग्रिम) नियम, 1986 में अब यथासंशोधित संसद सदस्य वेतन, भत्ता और पेंशन अधिनियम, 1954 के उपबंधों के अनुरूप कुछ पारिणामिक संशोधन किए जाने अपेक्षित है । इन नियमों के संशोधन का प्रयोजन वर्धित दैनिक भत्ता, सड़क मील और वाहन अग्रिम प्रदान करना है, इन नियमों को भूतलक्षी प्रभाव देने से किसी व्यक्ति पर प्रतिकूल प्रभाव पड़ने की संभावना नहीं है ।

इसके अतिरिक्त, संसद सदस्य (निर्वाचन क्षेत्र भत्ता) नियम, 1986 और संसद सदस्य (कार्यालय व्यय भत्ता ) नियम, 1988 को भी, अन्य बातों के साथ संसद सदस्यों के निर्वाचन क्षेत्र भत्ते और कार्यालय व्यय भत्ते में वृद्धि करने के लिए, संशोधित किया जा रहा है और इन नियमों को भूतलक्षी प्रभाव देने से किसी व्यक्ति पर प्रतिकूल प्रभाव पड़ने की संभावना नहीं है ।

(2) They shall be deemed to have come into force on the 1st day of October, 2010 .
2. In the Members of Parliament ( Office Expense Allowance) Rules , 1988 , for rule 3 , the following rule shall be substituted namely:
" 3. Amount of Office Expense Allowance. A member shall be entitled to receive the office expense allowance under section 8 of the Act , atthe rate of rupees forty - five thousand per mensem , out of which-
(a) Rupees fifteen thousand shall be for meeting expenses on stationery items and postage ; and
(b) the Lok Sabha or the Rajya Sabha Secretariat may pay upto rupees thirty thousand to the person ( s) as may be engaged by a THE GAZETTE OF INDIA : EXTRAORDINARY

Member for obtaining secretarial assistance and one such person shall be computer literate duly certified by the Member . "

Note: The principal rules were published vide G.S.R. 1098 (E) dated the 25th November , 1988 and last amended vide notification G.S.R. 461 ( E) dated the 3rd July, 2007.
EXPLANATORY MEMORANDUM
The Salary, Allowances and Pension of Members of Parliament Act, 1954 has been amended vide the Salary, Allowances and Pension of Members of Parliament (Amendment ) Act , 2010 ( 37 of 2010) . The provisions of the said Amendment Act, save otherwise provided therein , have been brought into force with effect from 1st day of October , 2010. Pursuant to the said amendments , some consequential amendments are required to be made in the Members of Parliament (Travelling and Daily Allowances ) Rules , 1957, and the Members of Parliament (Advance for the Purchase of Conveyance ) Rules , 1986 in conformity with the provisions of the Salary , Allowances and Pension of Members of Parliament Act , 1954 as now amended . As the purpose of the amendment of these rules is to give increased Daily Allowance, Road Mileage and Conveyance Advance, none is, likely to be adversely affectedby giving these rules retrospective effect.
In addition , the Members of Parliament (Constituency Allowance ) Rules , 1986 and the Members of Parliament ( Office Expense Allowance ) Rules , 1988 are also being amended , inter alia, to increase the Constituency Allowance and the Office Expense Allowance of the Members ofParliament and none is likely to be adversely affected by giving these rules retrospectively effect.
