सा.का.नि. 974(अ). पशुओं में संक्रामक और संसर्गजन्य रोगों से बचाव और नियंत्रण अधिनियम , 2009 ( 2009 का 27 ) की धारा 42 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार निम्नलिखित नियम बनाती है , नामतः :---
1. संक्षिप्त शीर्षक और प्रारम्भ होने की तारीख.( 1 ) इन नियमों को पशुओं में संक्रामक और संसर्गजन्य रोगों से बचाव और नियंत्रण (टीकाकरण प्रमाणपत्र का प्रपत्र पोस्ट मार्टम परीक्षण और पशुशव के निपटारे की प्रक्रिया ) नियम 2010 कहा जाए ।
(2) सरकारी राजपत्र में प्रकाशित होने की तारीख से ये प्रवृत्त होंगे ।
2. परिभाषा ( 1 ) इन नियमों में यदि अन्यथा संदर्भित न किया जाए, .....
(क) " अधिनियम " का आशय है पशुओं में संक्रामक और संसर्गजन्य रोगों से बचाव और नियंत्रण अधिनियम , 2009 ( 2009 का 27);
( ख) " प्रपत्र " का आशय है इन नियमों के परिशिष्ट प्रपत्र;
( ग) धारा का आशय है , अधिनियम की एक धारा ।
(2 ) इन नियमों में प्रयोग किए गए शब्दों और अभिव्यक्तियों, जिन्हें स्पष्ट नहीं किया गया है परन्तु अधिनियम में स्पष्ट किया गया है , उनका अर्थ क्रमशः वही होगा , जैसा कि अधिनियम में बताया गया है ।
3. टीकाकरण प्रमाणपत्र का प्रपत्र. ( 1 ) निदेशक द्वारा नियंत्रित क्षेत्र , मुक्त क्षेत्र या संक्रमित क्षेत्र में अधिनियम की धारा 9 के अंतर्गत पशुओं को टीकाकृत करने और टीकाकरण प्रमाणपत्र जारी करने के लिए सक्षम संस्थानों या एजेंसियों और व्यक्तियों को अधिसूचित किया जाए ।
(2 ) टीकाकरण प्रमाणपत्र जारी करने के लिए उप - नियम ( 1 ) के अंतर्गत निदेशक द्वारा अधिसूचित व्यक्तियों द्वारा पशु मालिक को तत्काल टीकाकरण प्रमाणपत्र जारी किया जाये परन्तु जिसमें टीकाकरण की तारीख से तीन सप्ताह से अधिक नहीं हुआ हो और टीकाकरण का सही रिकार्ड बनाए रखा जाए ।
(3 ) कुक्कुट के अलावा पशुओं के लिए टीकाकरण प्रमाण पत्र को प्रपत्र " क " में विनिर्दिष्ट किया जाए ।

[PART II- SEC . 3 (1 ) ] (4 ) कुक्कुट के लिए टीकाकरण प्रमाणपत्र को प्रपत्र " ख " में विनिर्दिष्ट किया जाए ।
(5 ) टीकाकरण प्रमाणपत्र द्विभाषी हो जिसमें से एक स्थानीय भाषा हो ।
4. परीक्षण और पोस्ट मार्टम करने की प्रक्रिया ( 1 ) पशुचिकित्सक या पशुचिकित्सा अधिकारी को-
(क ) उपयुक्त रूप से प्रकाश युक्त स्थिति में जांच- पड़ताल और पोस्ट मार्टम का प्रबंध किया जाए और जो किसी एकांत स्थान पर या मालिक के परिसर में या आसपास के स्थान पर हो, सक्षम अधिकारी जैसा भी उपयुक्त समझे ।
(ख) अनुसूचित अधिसूचित रोग की पुष्टि करने के लिए उपयुक्त नमूना एकत्रीकरण का प्रबंध करें और नमूनों को उपयुक्त प्रयोगशाला में भेजें ।
(ग) पशु शव के निपटारे का प्रबंध जैसा कि इन नियम्तों के नियम 5 में विनिर्दिष्ट है ।
(घ) उस परिसर और स्थान को संक्रमण मुक्त करना जहां पर पोस्ट मार्टम जांच आयोजित की गई थी ।
( ङ ) पशु मालिक को प्रपत्र " ग " में पोस्ट मार्टम रिपोर्ट की प्रति प्रदान करें और यदि पशुचिकित्सक या पशुचिकित्सा अधिकारी की किसी अनुसूचित अधिसूचित रोग के कारण मृत्यु हुई है तो निदेशक को सूचित करें ।
( 2 ) यदि मृत्यु का कारण संभावित रूप से एन्थ्रेक्स है तो कोई पोस्ट मार्टम न किया जाए ।
5. किसी अनुसूचित अधिसूचित रोग से संक्रमित पशु शव का निपटारा.---( 1 ) किसी अनुसूचित अधिसूचित रोग से मृत्यु हुए किसी पशु शव को, या धारा 25 के अंतर्गत मारे गए पशु शव को , पशु मालिक शवाधान , भस्मीकरण द्वारा पशु शव रेंडरिंग का निपटारा करें ।
(2 ) पशुचिकित्सक द्वारा शवाधान या भस्मीकरण में पर्यवेक्षण किया जाए, जो पशु मालिक के परिसर में या आसपास के स्थान पर किया जाए, जैसा भी सक्षम अधिकारी उपयुक्त समझे ।
(3 ) सक्षम अधिकारी , आवश्यकता होने पर , किसी सुरक्षित वाहन में निपटारे के स्थान तक संक्रमित पशु शव को पहुंचाने का प्रबंध करे और मृत पशु को ले जाने के लिए प्रयोग किए जाने वाले वाहन को वाहन मालिक द्वारा उपयुक्त तरीके से सफाई और संक्रमण मुक्त किया जाए ।
(4 ) पशुचिकित्सक या पशुचिकित्सा अधिकारी द्वारा यह सुनिश्चित किया जाए कि पशु शव का निपटारा निम्नलिखित किसी एक प्रक्रिया से किया जाए नामतः :-
(क ) शवाधान. ( ⅰ ) दफन करने के लिए गड्ढे का आकार पशु के आकार से बड़ा होना चाहिएए जिससे कि दफनाए जाने वाले पशुशव के सभी अंग गड्ढे के अन्दर हों और गड्ढे को बंद करने के लिए कम से कम एक मीटर मिट्टी से भरी हो ।
(ii) मिट्टी भरने से पहले दफनाए जाने वाले गड्ढे के नीचे पांच से.मी. और मिट्टी भरने से पहले पशुशव के ऊपर भी चूने का परत होना चाहिए ।
( iii ) दफनाने के लिए गड्ढा जलक्षेत्र से कम से कम पच्चीस मीटर दूरी पर और कुआं, बोरवेल या पेयजल के स्त्रोत के रूप में उपयोग किए जाने वाले जल प्रपात से दो सौ पचास मीटर की दूरी पर हो ।
( iv ) दफन करने के लिए गड्ढा मौसमी जल भराव या बाढ़ सम्भावित क्षेत्र में नहीं हो ।
( v ) अधिक संख्या में दफनाने का क्षेत्र मानव आवास से कम से कम दो सौ पचास मीटर दूरी पर होना चाहिए ।
( ख ) भस्मीकरण. ( i ) भस्मीकरण को तब तक जारी रखा जाए जब तक पशु शव राख में परिवर्तित न हो जाए ।
( ii ) भस्मीकरण का स्थान मानव आवास से कम से कम दो सौ पचास मीटर दूरी पर होना चाहिए ।
( ग ) रेंडरिंग,-(i ) रेंडरिंग मात्र उसी निर्धारित स्थान पर उन एजेंसियों और संस्थानों द्वारा किया जाना चाहिए जिनके पास रेंडरिंग संयंत्र प्रचालित करने के लिए प्रशिक्षित मानवशक्ति हो ।
(ii ) संक्रमित पशु शव के निपटारे के लिए रेंडरिंग प्रक्रिया का प्रयोग करने वाले संस्थानों या एजेंसियों को प्रत्येक रेंडरिंग चक्र का पूरा - पूरा रिकार्ड रखा जाए ।
(iii ) रेंडरिंग उत्पाद को पशु आहार के रूप में उपयोग न किया जाए ।
6. यदि इन नियमों के भाव के संबंध में कोई शंका हो तो उस मामले को निर्णय के लिए पशुपालन आयुक्त, पशुपालन , डेयरी और मत्स्यपालन विभाग , भारत सरकार को संदर्भित किया जाए ।

NOTIFICATION
New Delhi , the 14th December , 2010
G.S.R. 974 ( E ) . In exercise ofthe powers conferred by section 42 of the Prevention and Control of Infectious and Contagious Diseases in Animals Act , 2009 (27 of 2009 ) , the Central Government hereby makes the following rules , namely: -..
1. Short title and commencement.---( 1 ) These rules may be called the Prevention and Control of Infectious and Contagious Diseases in Animals (Form of Vaccination Certificate , Manner of Post Mortem Examination and Disposal of Carcass) Rules , 2010 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Definitions . ( 1 ) In these rules unless the context otherwise required ;
(a) Act' means the Prevention and Control of Infectious and Contagious Diseases in Animals Act , 2009 (27 of2009);
(b) ' Form' means Form appended to these rules ;
( c) section means a section of the Act.
(2) Words and expressions used in these rules and not defined but defined in the Act shall have the same meaning as respectively assigned to them in the Act .
3. Form of vaccination certificate .( 1 ) The Director shall notify the institutions for agencies and persons competent to vaccinate the animals and issue vaccination certificate under section 9 of the Act in the controlled area , free area or infected area .
(2) The persons notified by the Director under sub - rule ( 1 ) for issuing vaccination certificate shall issue a vaccina- tion certificate to the owner of the animal as early as possible but not exceeding three weeks from the date of vaccination and shall maintain proper record of vaccination .

(3) The vaccination certificate for animals other than poultry shall be specified in Form A.
(4) The vaccination certificate for poultry shall be as specified in Form B.
(5) The vaccination certificate shall be bi - lingual of which one language shall be vernacular .
4.Manner ofconducting examination and post mortem . ( 1 ) The veterinarian or the veterinary officer shall-...
(a) arrange the examination and post mortem in proper lighting condition and at a secluded place either at the owner's premises or the nearest location , as considered appropriate by the competent officer .
(b) arrange collection of appropriate samples for confirmation of the scheduled notified disease and dispatch the samples to appropriate laboratories .
(c) arrange disposal of carcass as specified in rule 5 of these rules .
(d) arrange disinfection of the premises and the place where post mortem examination was conducted.
(e) provide a copy of the post mortem report to the owner of the animal in Form C , and inform the Director if in the opinion ofthe Veterinarian or the Veterinary Officer , the death is caused by a scheduled notified disease .
(2) No post mortem shall be conducted when the cause of death is suspected to be Anthrax .
5.Disposal of the carcass of an animal infected with a scheduled notified disease .( 1 ) The carcass of an animal thathas died of a scheduled notified disease , or the carcass of the animal cuthanized under section 25 , the owner of the animal shall dispose off the carcass either by burial, incineration or rendering .
(2) The veterinarian shall supervise the burial or incineration, which shall be performed preferably at the premises of the owner of the animal or the nearest location , as considered appropriate by the competent officer .
(3)The competent officer , if required , shall arrange transportation of the carcass of the infected animal in a secured vehicle to the site of the disposal and the vehicle used for transportation of the dead animal shall be properly cleaned and disinfected by the vehicle owner .
(4) The veterinarian or the Veterinary Officer shall ensure that the disposal of carcass is by any one of the following methods , namely:
(a) Burial. ( i ) the size of the pit for the burial shall be bigger than the size of the animal that allows all parts of the animal carcass to be buried in the burial pit and at least one metre of covering soil shall be used to cap the pit .
(ii) a layer of five - centimetre lime shall be put at the bottom of the burial pit and again over the carcass before filling the soil .
(iii) the pit for burial shall be at least twenty metres away from watercourse and two hundred and fifty metres away from well , bore - well or water spring used as a source of drinking water.
(iv) the pit for burial shall not be in a seasonal water - logged or flood prone area .
(v) for mass burial , the site shall be at least two hundred fifty metres away from human habitat .
) Incineration . ( i ) incineration shall be continued till the animal carcass is reduced to ashes .
(b
(ii) the site identified for incineration shall be at least two hundred fifty metres away from human habitat .
(c) Rendering . ( i ) rendering shall be practiced only on - site by agencies and institutes that have adequate trained manpower in operating the rendering plant .
(ii) the agency or the institute using rendering as a method of infected animal carcass disposal shall maintain proper records of each rendering cycle .
(iii) the rendered product shall not be used as ingredient of animal feed .
6. If any question of interpretation or doubt arises in relation to these rules , the matter shall be referred to the Animal Husbandry Commissioner , Department of Animal Husbandry , Dairying and Fisheries , Government of India , for decision.
