सा.का.नि. 975 (अ) . संगम ज्ञापन की धारा 3(ज) और राष्ट्रीय औद्योगिक इंजीनियरी संस्थान , मुम्बई के नियमों के खण्ड 12( ix) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद् द्वारा निम्नलिखित नियम निरूपित करती है, अर्थात्
1. लघु शीर्ष तथा प्रारंभ ( 1 ). ये नियम राष्ट्रीय औद्योगिकी इंजीनियरी संस्थान, मुम्बई (निदेशक) भर्ती नियम , 2010 कहे जाए ।
(2 ) ये नियम इसके राजकीय राजपत्र में प्रकाशित होने की तिथि से प्रवृत्त होंगे ।
2. परिभाषाएं:- इन नियमों में , जब तक अन्यथा अपेक्षित न हो;
(क) "संगम ज्ञापन तथा नियम' से संगम ज्ञापन तथा राष्ट्रीय औद्योगिक इंजीनियरी संस्थान, मुम्बई अभिप्रेत है.
(ख) 'सेवा नियम' से राष्ट्रीय औद्योगिक इंजीनियरी संस्थान , मुम्बई के सेवा नियम अभिप्रेत है ।
(ग) 'निदेशक' से संगम ज्ञापन के खंड 3(ज) और राष्ट्रीय औद्योगिक इंजीनियरी संस्थान , मुम्बई के नियम के खंड 12(ix ) के अध्यधीन केन्द्र सरकार द्वारा नियुक्त राष्ट्रीय औद्योगिक इंजीनियरी संस्थान , मुम्बई का निदेशक अभिप्रेत है ।

3. भर्ती रीति और अन्य मामले निदेशक के पद से संबंधित भर्ती रीति और अन्य मामले इन नियमों के साथ संलगन कॉलम 3 से 13 में विनिर्दिष्ट किए गए हैं।
4. अयोग्यता - कोई व्यक्ति
(i ) जिसने ऐसे व्यक्ति से विवाह किया हो अथवा विवाह का करार किया हो जिसका पति/पत्नी जीवित हो;
(ii ) जिसने अपने पति/ पत्नी के जीवित रहते किसी अन्य व्यक्ति से विवाह किया हो अथवा विवाह का करार हो; उक्त पद पर नियुक्ति के लिए पात्र नहीं होगा।
बशर्ते कि केन्द्र सरकार यदि वह इस बात से संतुष्ट हो कि इस प्रकार का विवाह ऐसे किसी व्यक्ति तथा अन्य पक्ष हेतु प्रयोज्य व्यक्तिगत कानून के तहत अनुमत्य है तथा ऐसा करने के अन्य आधार हैं , किसी भी व्यक्ति को इस नियम के प्रचालन से छूट दे सकती है।
5. छूट प्रदान करने की शक्ति जहां केन्द्र सरकार का यह मत हो कि ऐसा करना अपेक्षित अथवा समयोचित है, वह लिखित में दर्ज किए जाने वाले कारणों से, आदेश जारी करके किसी भी दर्ज अथवा श्रेणी अथवा व्यक्ति के संबंध में इन नियमों के किसी भी उपबंध में छूट दे सकती है।
6. अपवाद - इन नियमों में से कोई भी नियम इस संबंध में केन्द्र सरकार द्वारा समय समय पर जारी आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति , अन्य पिछड़े वर्गों भूतपूर्व सैनिकों तथा अन्य विशेष श्रेणी वाले व्यक्तियों हेत अपेक्षित आरक्षणों, आयु सीमा में छूट तथा अन्य छूटों को प्रभावित नहीं करेंगे।
7. अन्य सेवा शर्ते निदेशक की अन्य सेवा शर्ते जिनके संबंध में इन नियमों में कोई विशिष्ट उपबंध नहीं किए गए हैं , ऐसे नियमों के अनुरूप विनियमित होंगे जो समय -समय पर सदृश वेतनमान में वेतन एवं भत्ते प्राप्त करने वाले केन्द्र सरकार श्रेणी-क के अधिकारियों पर लागू हो ।

पदोन्नति/प्रतिनियुक्ति/समावेशन के मामले में ग्रेड जिनसे पदोन्नति/ प्रतिनियुक्ति/ समावेशन की जाएगी ।

कोई व्यक्ति जिसने किसी विश्वविद्यालय , स्नातकोत्तर इंजीनियरीं कालेज अथवा संस्थान में कुलपति, निदेशक अथवा प्रिंसिपल के रूप में सेवा की हो या सेवा कर रहे हों अथवा किसी विश्वविद्यालय अथवा किसी उच्चतर तकनीकी शिक्षा अथवा अनुसंधान संस्था में प्रोफेसर जिसने 18400-22400(संशोधन पूर्व ) वेतनमान में प्रोफेसर के ग्रेड में कम से कम 10 वर्षों की नियमित सेवा की हो ।
अथवा
केन्द्र सरकार/राज्य सरकार/संघ राज्य क्षेत्र प्रशासन अथवा सार्वजनिक उद्यमों के ऐसे अधिकारी जो भारत सरकार के संयुक्त सचिव की रैंक से कम न हों अथवा उनके समकक्ष अधिकारी जिन्होंने ग्रेड में कम से कम 5 वर्ष नियमित सेवा की हो तथा उन्हें तकनीकी शिक्षा प्रणाली के प्रबंधन का अनुभव हो
नोट 1 - निदेशक के पद पर नियुक्ति हेतु विचार के लिए आवेदन खुले विज्ञापन के जरिए आमंत्रित किए जाएंगे तथा केन्द्रीय विश्वविद्यालयों के सभी कुलपतियों, भारतीय प्रौद्योगिकी संस्थानों, भारतीय प्रबंधन संस्थानों के निदेशकों , अध्यक्ष , विश्वविद्यालय अनुदान आयोग, अध्यक्ष , अखिल भारतीय तकनीकी शिक्षा परिषद , महानिदेशक, सी.एस.आई.आर तथा अन्य विख्यात व्यक्तियों से भी नामांकन आमंत्रित किए जाएंगे ।

सामान्यतः निदेशक की सेवानिवृत्ति आयु 65 वर्ष है। आवेदकों/नामितों की आयु अधिमानतः आदेवन/ मनोनयन की अंतिम तारीख के समय 60 वर्ष से कम होनी चाहिए । नियक्ति को संविदा आधार पर 5 वर्षों (अथवा अगले आदेश तक जो भी पहले हो) के लिए की जाएगी जिसे ए.सी.सी. के अनुमोदन से बढ़ाया जा सकता है ।
निदेशक के पद के लिए अतिरिक्त प्रभार/मौजूदा प्रभार ए.सी.सी. के अनुमोदन से दिया जाएगा।
नोट 2- चयन केन्द्र सरकार द्वारा इस उद्देश्य हेतु उच्चतर शिक्षा विभाग द्वारा गठित खोज-व - चयन समिति द्वारा अनुशंसित अभ्यर्थी के नाम के आधार पर किया जाएगा।
खोज-व-चयन समिति में निम्नलिखित सदस्य शामिल होंगे : -
1. सचिव, उच्चतर शिक्षा विभाग , मानव संसाधन विकास मंत्रालय अध्यक्ष
2. अध्यक्ष, शासी बोर्ड , एन.आई.टी.आई.ई. , मुम्बई सदस्य
3. मानव संसाधन विकास मंत्री द्वारा नामित भारत सरकार के सदस्य सचिव के स्तर के दो बाहर के सुविख्यात तकनीकी विशेषज्ञ
4. संयुक्त सचिव/अपर सचिव ( तकनीकी शिक्षा) , उच्चतर शिक्षा विभाग , मानव संसाधन विकास मंत्रालय संयोजक
खोज- व- चयन समिति द्वारा सुझाया गया नाम/पैनल एक साल के लिए वैध होगा । यदि एक वर्ष की अवधि के भीतर पैनल से कोई चयन नहीं किया जाता तो खोज- व-चयन समिति नया पैनल तैयार करने हेतु गठित की जाऐगी। इस प्रकार की खोज- व- चयन समिति प्रथम पैनल में अनुशंसित व्यक्तियों के नामों पर भी विचार करेगी।
यदि कोई विभागीय पदोन्नति समिति मौजूद है , तो इसका संघटन क्या है
वे परिस्थितियां जिनमें भर्ती करने के लिए केन्द्रीय लोक सेवा आयोग के साथ परामर्श करना है

NOTIFICATION
NewDelhi , the 2nd December, 2010
G.S.R. 975 (E). In exercise of the powers conferred by clause 3 (h) of the Memorandum of Association ( MOA) and clause 12 (ix) of the Rules of the National Institute of Industrial Engineering (NITIE) , Mumbai , the Central Government hereby makes the following rules , namely: -
1 . Short title and commencement (1 ) . These rules may be called the National Institute of Industrial Engineering (NITIE) , Mumbai (Director ) Recruitment Rules , 2010 .
(2) They shall come into force on the date of their publication in the Offical Gazette .
2. Definitions : - In these rules, unless the context otherwise requires ;
(a) "Memorandum of Association and Rules " means Memorandum of Association and Rules of National Institute of Industrial Engineering (NITIE ) , Mumbai ;
(b) " Service Rules " means Service Rules of National Institute of Industrial Engineering (NITIE ) , Mumbai ;
(c) "Director means the Director of the National Institute of Industrial Engineering (NITIE) , Mumbai - appointed by the Central Government under clause 3 ( h ) of the Memorandum of Association ( MOA) and clause 12 ( ix) of the Rules of the National Institute of Industrial Engineering (NITIE) , Mumbai ,
3 . Method of recruitment and other matters : The method of recruitment and other matters relating to the post of Director has been specified in columns 3 to 13 of the Schedule annexed to these rules .
4. Disqualification - No person, -
(i) who has enterned into or contracted a marriage with a person having a spouse living ; or
(ii) who having a spouse living, has entered into or contracted a marriage with any person shall be eligible for appointment to the said post ;
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such a person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5 . Power to relax Where the Central Government is of the opinion that it is necessary or expedient to do so , it may, by order, for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category or persons .
6. Saving Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
7 . Other conditions of service The other conditions of service of the Director for which no specific provisions have been provided in these rules , shall be regulated in accordance with such rules as are, from time to time, applicable to officers of the Central Government Group- A drawing the pay and allowances in corresponding scale of pay.

A person who has served or is serving as a Vice- Chancellor , Director or Principal of a University , Post- Graduate Engineering College or Institute or a Professor in a University or an Institution of Higher Technical Education or Research with at least 10 years regular service in the grade of Professor in the scale of pay of Rs . 18400-22400 (pre- revised) .
or
Officers under the Central Government/ State Government/Union Territory Administrations or Public Enterprises not below the rank of Joint Secretary to the Government of India or equivalent with at least 5 years regular service in the grade and with experience of managing technical education system .
Note 1 -Applications for consideration for appointment to the post of Director shall be invited through open advertisement and also by inviting nominations from all the Vice- Chancellors of Central Universities , Directors of IITs , IIMs , Chairman UGC , Chairman AICTE , DG CSIR and other eminent personalities .
The normal retirement age for Director is 65 years . Applicants /nominees should preferably be below the age of 60 years at the time of closing date of applications / nominations . Appointment shall be made on a contract basis for 5 years ( or until further order whichever is earlier) , which can be extended with the approval ofACC .
The additional charge/current charge for the post of Director shall be given with the approval of ACC .
Note 2 - Selection shall be made by the Central Government based on the name (s ) of candidate recommended by a Search- cum - Selection Committee constituted for this purpose by the Department of Higher Education. The Search- cum- Selection Committee shall consist of the following members namely: -
Chairman 1 . Secretary, Department of Higher Education, Ministry of HRD
2. Chairman , BOG, NITIE , Mumbai

- Members 3. Two outside eminent technical experts of the level of Secretary to the Government of India to be nominated by Minister of Human Resource Development .

The name/panel suggested by the Search- cum- Selection Committee shall be valid for one year. If no selection is made from the panel within a period of one year , then a fresh Search- cum- Selection Committee shall be constituted to prepare a fresh panel . Such Search- cum- Selection Committee shall also consider the names of persons recommended in the first panel .
