प्रतिभूति संविदा (विनियमन ) अधिनियम, 1956 की धारा 11 ( 3 ) के अधीन भुवनेश्वर स्टॉक एक्सचेंज के प्रबंध- परिषद् के अधिक्रमण की कालावधि को बढ़ाने के लिए अधिसूचना
का.आ. 935 ( अ ) .- फा.सं. भाप्रविबो/ विधि/ 29081 / 2004 तारीख 30 दिसम्बर, 2004 की अधिसूचना (" उक्त अधिसूचना ") द्वारा भुवनेश्वर स्टॉक एक्सचेंज के प्रबंध -परिषद् ( " प्रबंध- परिषद्" ) के अधिक्रमण को भारतीय प्रतिभूति और विनिमय बोर्ड (" भाप्रविबो" ) द्वारा छह मास की अतिरिक्त कालावधि के लिए बढ़ाया गया था और श्री जय प्रकाश वर्मा , आई.पी.एस. (सेवानिवृत्त) प्रबंध- परिषद् की समस्त शक्तियों और कर्तव्यों का प्रयोग करने और पालन करने के लिए प्रशासक के तौर पर बने रहे। प्रबंध - परिषद् के अधिक्रमण की अवधि 02 जुलाई 2005 को समाप्त होने वाली है ।

मैंने नोट किया है कि प्रशासक ने एक्सचेंज की कार्यप्रणाली में विभिन्न सुधारात्मक उपाय शुरु किये हैं , जिनमें से कुछ पर अविरत अनुवर्ती कार्रवाई अपेक्षित है । आगे , मेरा विचार है कि एक्सचेंज की कार्यप्रणाली को आगे सुचारू बनाने के लिए, नये प्रबंध- परिषद् के निर्वाचन तथा गठन की प्रक्रिया को पूरा करने के लिए अपेक्षित समय , और निगमीकरण ( कॉर्पोरेटाइजेशन) तथा अपरस्परीकरण (डीम्युचुअलाइजेशन) की प्रक्रिया को पूरा करने के लिए भी, प्रबंध- परिषद् के अधिक्रमण की कालावधि को 31 मार्च 2006 तक की अतिरिक्तकालावधि के लिए बढ़ाया जाना अपेक्षित है ।
पूर्वोक्त को ध्यान में रखते हुए , प्रतिभूति संविदा ( विनियमन) अधिनियम, 1956 की धारा 11 और केंद्रीय सरकार द्वारा जारी तारीख 30 जुलाई 1992 की अधिसूचना सं. एस.ओ.573 के साथ पठित भारतीय प्रतिभूति और विनिमय बोर्ड अधिनियम, 1992 की धारा 4(3) के अधीन मुझे प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिसूचना में यथा आदिष्ट भुवनेश्वर स्टॉक एक्सचेंज के प्रबंध- परिषद्के अधिक्रमण को एतद्वारा 03 जुलाई 2005 से प्रभावी 31 मार्च 2006 तक की अतिरिक्त कालावधि के लिए बढ़ाया जाता है । श्री जय प्रकाश वर्मा, आई.पी.एस. (सेवानिवृत्त) प्रशासक के तौर पर बने रहेंगे और प्रबंध- परिषद् की समस्त शक्तियों और कर्तव्यों का प्रयोग और पालन करेंगे, इस प्रकार बढ़ायी गयी कालावधि के दौरान । श्री जय प्रकाश वर्मा ऐसे व्यक्तियों की सहायता ले सकेंगे जैसा वे प्रशासक के तौर पर अपने कर्तव्यों के निर्वहन में आवश्यक समझें ।

NOTIFICATION

Notification under Section 11 (3 ) of the Securities Contracts (Regulation ) Act, 1956 for Extending the Period of Supersession of the Council of Management of Bhubaneswar Stock Exchange
S.O. 935( E) .- Vide notification F. No. SEBI /LE/29081 /2004 dated December 30, 2004 ( " said notification " ) the supersession of the Council of Management of the Bhubaneswar Stock Exchange (" Council of Management " ) was extended by the Securities and Exchange Board of India ( "SEBI " ) for a further period of six months and Shri Jai Prakash Verma , IPS ( Retd. ) continued as an Administrator to exercise and perform all the powers and duties of the Council of Management . The term of supersession of the Council of Management is due to expire on juiy 02, 2005.
I have noted that the Administrator has initiated various corrective measures in the functioning of the Exchange , some of which require sustained follow up action . Further, I am of the view that in order to further streamline the functioning of the Exchange, time required to complete the process of election and constitution of the new Council of Management and also to complete the process of corporatisation and demutualisation , theperiod of supersession of the Council of Management is required to be extended for a further period upto March 31 , 2006.
In view of the aforesaid , in exercise of the powers conferred upon me under Section 4(3 ) of the Securities and Exchange Board of India Act, 1992 read with Section 11 of the Securities Contracts (Regulation ) Act , 1956 and Notification no. S.O.573 dated July 30, 1992 issuedby Central Government , the supersession of the Council of Management of theBhubaneswar Stock Exchange as ordered in the said notification is hereby extended for a further period upto March 31 , 2006 with effect from July 03 , 2005. Shri Jai Prakash Verma , IPS (Retd. ) shall continue as the Administrator and shall exercise and perform all the powers and duties of the Council of Management , during the period so extended. Shri Jai Prakash Verma may take assistance of such persons as he deems necessary in discharge of his duties as Administrator.
