और जबकि आवेदक ने अब सरकार द्वारा स्थापित या देख-रेख अथवा इस प्रकार स्थापित अथवा देख- रेख किए जाने वाले टेलीग्राफ के उद्देश्य हेतु टेलीग्राफ लाइनों और पोस्टों को लगाने के संबंध में विद्युत अधिनियम , 2003 की धारा 164 के अंतर्गत सभी शक्तियां , जो कि भारतीय टेलीग्राफ अधिनियम , 1885 के अंतर्गत टेलीग्राफ प्राधिकरण के पास है , उसे प्रदान करने का अनुरोध किया है ।
का.आ. 2980 (अ). जबकि मैसर्स अदानी पावर लिमिटेड, आवेदक, जिनका पंजीकृत कार्यालय अदानी हाउस , मीठाखाली सर्किल के निकट, नवरंगपुरा , अहमदाबाद -380009 , गुजरात में है, ने अपनी समर्पित मोहिंदरगढ़ ( एचवीडीसी ) भिवानी ( पीजीसीआईएल ) 400 केवी डी/सी पारेषण लाइन के लिए विद्युत अधिनियम , 2003 की धारा 164 के अंतर्गत अनुमोदन हेतु आवेदन किया है ।
इसलिए अब सावधानीपूर्वक विचार करने के पश्चात् भारत सरकार, विद्युत मंत्रालय , विद्युत अधिनियम , 2003 की धारा 164 के अंतर्गत अन्तर्राज्यीय पारेषण लाइनों हेतु उपर्युक्त उल्लिखित संस्थापना के लिए निम्नलिखित शर्तों एवं निबंधनों के अधीन सरकार द्वारा स्थापित या देख- रेख या इस प्रकार स्थापित या देख - रेख किए जाने वाले टेलीग्राफ के उद्देश्य से टेलीग्राफ लाइनों और पोस्ट लगाने के संबंध में भारतीय टेलीग्राफ अधिनियम , 1885 के अंतर्गत टेलीग्राफ प्राधिकरण के पास जो शक्तियां हैं उन सभी शक्तियों को आवेदक को प्रदान करती हैं, अर्थात्:-
(i ) यह अनुमोदन 25 वर्ष के लिए प्रदान किया जाता है;
और जबकि 31-7-2009 को, पत्र सं. 11/4/2007 पीजी के माध्यम से , भारत सरकार , विद्युत मंत्रालय ने हरियाणा में निम्नलिखित मार्ग से गुजरने वाली उनकी समर्पित मोहिन्दरगढ़ ( एचवीडीसी) भिवानी ( पीजीसीआईएल ) ) 400 केवी डी/सी पारेषण लाइन की संस्थापना के लिए विद्युत अधिनिमय , 2003 की धारा 68 के अंतर्गत मैसर्स अदानी पावर लिमिटेड को अनुमोदन प्रदान किया था :

(ii ) आवेदक को प्रस्तावित लाइनों के निर्माण से पूर्व संबंधित प्राधिकरणों अर्थात् स्थानीय निकायों, नेशनल रेलवे , राष्ट्रीय राजमार्गों, राज्य राजमार्गों आदि की स्वीकृति प्राप्त करनी होगी;
( iii ) आवेदक को पारेषण , ओ एंड एम , खुली पहुँच आदि के संबंध में उपयुक्त आयोग के विनियमों/कोडों का पालन करना होगा ।

(iv) आवेदक को अन्तर्राज्यीय समर्पित मोहिन्दरगढ़ (एचवीडीसी)-भिवानी ( पीजीसीआईएल ) 400 केवी डी/सी पारेषण लाइनों को बिछाने का दायित्व सौंपा गया है । इस लाइन का ब्यौरा 24 अक्तूबर , 2009 के भारत के राजपत्र में प्रकाशित किया गया है ।

( v ) आवेदक संबंधित राज्यों के मुख्य वैद्युत निरीक्षक के अनुमोदन के पश्चात् लाइनों का प्रचालन करेगा ।
(vi ) यह अनुमोदन विद्युत अधिनियम , 2007 के प्रावधानों और उसके अंतर्गत बनाए गए नियमावली की आवश्यकता के अनुसार आवेदक द्वारा अनुपालन के अधीन है ।

S.O. 2980 (E).-Whereas M/s. Adani Power Limited, the applicant, with its Registered Office at Adani House , Near Mithakhali Circle, Navrangpura, Ahmedabad-380009, Gujarat, has applied for approval under Section 164 of the Electricity Act, 2003 for its dedicated Mohindergarh (HVDC) -Bhiwani (PGCIL) 400 kV D /C Transmission line .
Andwhereas on 31-7-2009 , vide letter No. 11/4/2007-PG, the Government of India, Ministry of Power , had granted toM/s .Adani Power Limited, approval under Section 68 of the Electricity Act, 2003 for installation of its dedicated Mohindergarh (HVDC) - Bhiwani (PGCIL) 400 kV D / C Transmission line, passing through the following route in Haryana:

And whereas the applicant has now requested to confer upon him all the powers under Section 164 of the Electricity Act , 2003 which telegraph authority possess under the Indian Telegraph Act , 1885 with respect to the placing of telegraph lines and posts for the purposes of a telegraph established or maintained , by the Government or to be so established or maintained.
Now , therefore , after careful consideration , Government of India, Ministry of Power , confers , under Section 164 of the Electricity Act, 2003 , all the powers on theApplicant which telegraph authority possesses under the Indian Telegraph Act , 1885 with respect to the placing oftelegraph lines and posts for the purposes of a telegraph established or maintained , by the Government or to be so established or maintained subject to following terms and conditions for installing the above - mentioned inter - state transmission lines for inter - state transmission of electricity, namely:---
(i) the approval is granted for 25 years ;
(ii) the Applicant shall have to seek the consent of the concerned authorities i.e. local bodies , Railways , National Highways , State Highways , etc.before erection of proposed lines ;
(iii) the Applicant shall have to follow regulations/ codes of the appropriate commission regarding transmission , O& M , open access , etc ;
(iv) the Applicant has been entrusted with the responsibility of laying the inter - state dedicated Mohindergarh ( HVDC ) -Bhiwani ( PGCIL ) 400 kV D / C transmission line . The details of the line are published in the Gazette of India of October 24 , 2009 .
(v) the Applicant shall operate the lines after approval of Chief Electrical Inspector of respective States ;
(vi) the approval is subject to compliance by the Applicant to the requirement of the provisions oftheElectricity Act, 2003 and the rules made thereunder.
