पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड अधिसूचना

सा.का.नि. 986(अ). पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड अधिनियम , 2006 ( 2006 का 19 ) की धारा 61 द्वारा प्रदत्त शक्तियोंका प्रयोग करते हुए पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड एतद्वारा पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड (प्राकृतिक गैस पाइपलाइन प्रशुल्क का निर्धारण ) विनियम , 2008 में संशोधन करने के लिए निम्नलिखित विनियम बनाता है , अर्थात्:-
1. लघु शीर्ष और प्रारंभण
( 1 ) इन विनियमों को पेट्रोलियम और प्राकृतिकं गैस विनियामक बोर्ड ( प्राकृतिक गैस पाइपलाइन प्रशुल्क का निर्धारण ) संशोधन विनियम , 2010 कहा जाएगा ।
(2 ) ये विनियम सरकारी राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. अनुसूची 'क ' में संशोधन
पेट्रोलियम और प्राकृतिक गैस विनियामक बोर्ड ( प्राकृतिक गैस पाइपलाइन प्रशुल्क का निर्धारण ) विनियम, 2008 की अनुसूची ' क' में खण्ड 9 के बाद निम्नलिखित खण्ड को शामिल किया जाए , अर्थात्:--
" 10. प्रारंभिक इकाई प्राकृतिक गैस पाइपलाइन प्रशुल्क की अंतिम गणना के बाद प्रशुल्क गणना में मात्रां अंतर कासमायोजन
( 1 ) कंपनी द्वारा वर्ष दर वर्ष के आधार पर खंड 9 के उप - खंड ( 5 ) के अंतर्गत निर्धारित अंतिम इकाई प्राकृतिक गैस पाइपलाइन प्रशुल्क में समायोजन किया जाएगा जिसमें ग्राहकों द्वारा

प्राकृतिक गैस पाइपलाइन प्रचालनों के पहले पांच वर्षों में से किसी वर्ष में वास्तविक मात्रा पर विचार किया जाएगा जब-
(क ) खंड 6 के उप -खंड ( 1 ) की मंद ( क ) में विनिर्दिष्ट आधार पर अंतिम इकाई प्राकृतिक गैस पाइपलाइन प्रशुल्क के निर्धारण के लिए विभाजकों के रूप में विचार करते हुए वास्तविक मांत्रा , मानकीय मात्रा से अधिक हो; या
( ख ) खण्ड 6 के उप- खंड ( 1 ) की मद ( क ) में विनिर्दिष्ट आधार पर अंतिम इकाई प्राकृतिक गैस पाइपलाइन प्रशुल्कके निर्धारण के लिए विभाजकों के रूप में विचार करते हुए वास्तविक मात्रा, मानकीय मात्रा से अधिक हो , लेकिन जो अंतिम इकाई प्राकृतिक गैस पाइपलाइन प्रशुल्क के निर्धारण के लिए विचार की गई मात्रा से कम हो ।
(2 ) जब वास्तविक मात्रा प्राकृतिक गैस पाइपलाइन प्रचालनों के पहले पांच वर्षों में से किसी वर्ष में मानकीय मात्रा से कम होती है, तो ऐसी कम मात्रा के प्रभाव के विस्तार की अनुमति दी जाएगी । ऐसे विस्तार की अनुमति पहले पांच वर्षों में से किसी एक वर्ष में अग्रेनीत अधि क वास्तविक मात्रा के प्रभाव तक ही दी जाएगी और बकाया विस्तार , यदि कोई हो , बाद के वर्षों में अग्रेनीत किया जाएगा , लेकिन यह प्राकृतिक गैस पाइपलाइन प्रचालन के पहले पांच वर्षों के बाद नहीं होगा , इसकी केवल अधिक वास्तविक मात्रा होने के मामले में ही समायोजन के लिए अनुमति दी जाएगी ।
(3 ) प्राकृतिक गैस पाइपलाइन प्रचालनों के पहले पांच वर्षों के प्रत्येक वर्ष की समाप्ति के बाद बोर्ड को कंपनी द्वारा

वास्तविक मात्रा दर्शाने वाला एक लेखा परीक्षित विवरण प्रस्तुत किया जाएगा ताकि बोर्ड आवश्यक समायोजन पर सलाह दे सकेः ।
(4) पेट्रोलियम और प्राकृतिक गैस विनायमक बोर्ड (प्राकृतिक गैस,पाइपलाइन प्रशुल्क का निर्धारणः) विनियम, 2008 'की अनुसूची ' क' के खंड 8 के अंतर्गत बोर्ड द्वारा निर्धारित सभी प्रशुल्क क्षेत्रों की तुलना में इकाई प्राकृतिक गैस पाइपलाइन: प्रशुल्क के विभाजन का इस खंड के अंतर्गत बोर्ड द्वारा निर्धारितःअंतिम इकाई प्राकृतिक गैस पाइपलाइन: प्रशुल्क में किए गए समायोजन की सीमा तक ग्राहकों के साथ भी यथानुपात समायोजन किया जाएगा ।
(5 ) इस प्रकार समायोजित प्रशुल्क बाद की अवधि, जब तक कि इसका संशोधन , समायोजन , या समीक्षा नहीं करःली जाती , के लिए भी लागू रहेगा । "

PETROLEUM AND NATURAL GAS REGULATORY BOARD
NOTIFICATION
New Delhi , the 20th December , 2010
G.S.R. 986 (E ) .-In exercise of the powers conferred by Section 61 of the Petroleum and Natural Gas Regulatory Board Act , 2006 ( 19 of 2006) , the Petroleum and Natural Gas Regulatory Board hereby makes the following regulations to amend the Petroleum and Natural Gas Regulatory Board ( Determination of Natural Gas Pipeline Tariff) Regulations, 2008 , namely :-
1. Short title and commencement
(1) These regulations may be called the Petroleum and Natural Gas Regulatory Board (Determination ofNatural GasPipeline Tariff) Amendment Regulations , 2010.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Amendment of Schedule A
In Schedule A of the Petroleum and Natural Gas Regulatory Board ( Determination of Natural Gas Pipeline Tariff) Regulations, 2008 , after clause 9, the following clause shall be inserted , namely :-
"10. Adjustment of volume variation in Tariff computation after final computations of initial unit natural gas pipeline tariff.
(1) Adjustments shall be carried out in the final unit natural gas pipeline tariff determined under sub-

clause(5) of clause 9 on a year -to-year basis by the entity with the customers considering actual volumes in any of the first five years of natural gas pipeline operations when-
(a) the actual volumes are higher than the normative volume considered as divisors for determination of the final unit natural gas pipeline tariff on the basis specified in item (a) of sub -clause ( 1) of clause 6 ; or
(b) the actual volumes are higher than the normative volume considered as divisors for determination of the final unit natural gas pipeline tariff on the basis specified in item (a) ofsub-clause ( 1 ) of clause 6 but are lower than that considered for determination of the final unit natural gas pipeline tariff.
(2) When the actual volumes are lower than the normative volumes in any of the first five years of natural gas pipeline operations , a set- off of the impact of such lower volumes shall be permitted. Such set- off shallbe allowed only to the extent of the impact ofhigher actual volumes passed on in any of the first five years and the balance set- off, if any, shallbe carried over to subsequent years , but not beyond the first five years of natural gas pipeline operation , to be allowed for adjustment only in case there are higher actual volumes .
(3) An audited statement showing actual volume shall be submitted by the entity to the Board after the conclusion of each year of the first five years of natural gas pipeline operations to enable the Board to advise the necessary adjustments .
(4) A pro- rata adjustment in apportionment of the unit natural gas pipeline tariff over all the tariff zones determined by the Board under clause 8 ofSchedule A to the Petroleum and Natural Gas Regulatory Board ( Determination of Natural Gas PipelineTariff) Regulations , 2008 shall also be made with customers to the extent of adjustment in the final unit natural gas pipeline tariff determined by the Board under this clause .
(5) The tariff so adjusted shall also be applicable for the subsequent period till the same is modified, adjusted or reviewed. "
