5 का.आ. 3015(अ) .-यतः , मै. गोल्डसुक इन्टरनेशनल जेम्स एवं ज्वैलरी एसईजेड प्राइवेट लिमिटेड ने , जो हरियाणा में गाँव भोंडसी , तहसील सोहना , गुड़गाँव जिला में जेम्स एवं ज्वैलरी सेवाओं हेतु एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना हेतु विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28 ) ( जिसे एतद्दश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 के अंतर्गत प्रस्ताव किया है;

और यतः , केन्द्र सरकार इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप- धारा ( 8 ) के अंतर्गत अपेक्षाओं तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने उपर्युक्त विशिष्ट विशेष आर्थिक जोन के विकास , प्रचालन एवं रखरखाव हेतु उक्त अधिनियम की धारा 3 की उप- धारा ( 10 ) के अंतर्गत गाँव भोंडसी , तहसील सोहना , गुडगाँव जिला , हरियाणा में जेम्स एवं ज्वैलरी एसईजेड के लिए दिनांक 6 फरवरी , 2008 को अनुमोदन पत्र प्रदान कर दिया है;

अब विशेष आर्थिक जोन अधिनियम, 2005 की धारा 4 की उप- धारा ( 1 ) , धारा 13 की उप - धारा ( 1 ) , धारा 53 की उप- धारा ( 2 ) तथा धारा 11 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विशेष आर्थिक जोन नियम, 2006 के नियम 8 के अनुसरण में :-

( i ) केन्द्र सरकार एतद्वारा हरियाणा राज्य में गांव भोंडसी , तहसील सोहना , गुडगाँव जिला में निम्नलिखित क्षेत्र को एक विशेष आर्थिक जोन के रूप में अधिसूचित करती है जिसमें निम्नलिखित तालिका में उल्लिखित सर्वेक्षण किला नम्बर और क्षेत्र शामिल हैं , 4862 GI/2010

( ii ) केन्द्र सरकार एतद्वारा उक्त अधिनियम की धारा 14 के प्रयोजनार्थ उपर्युक्त विशेष आर्थिक जोन के लिए एक समिति, जिसे अनुमोदन समिति कहा जाएगा , गठित करती है , जिसके अध्यक्ष और सदस्य निम्नानुसार हैं , अर्थात :-

-सदस्य, पदेन 6. निदेशक ( बैंकिंग ) , वित्त मंत्रालय , बैंकिंग प्रभाग , भारत सरकार
-सदस्य, पदेन 7. हरियाणा सरकार द्वारा नामित किए जाने वाले दो अधिकारी जिनका स्तर संयुक्त सचिव से कम नहीं होगा
-विशेष आमंत्रिती 8. मै . गोल्डसुक इन्टरनेशनल जेम्स एवं ज्वैलरी एसईजेड प्राइवेट लिमिटेड (जोन के विकासकर्ता ) का प्रतिनिधि
( iii ) केन्द्रीय सरकार एतद्वारा दिनांक 22 दिसम्बर , 2010 को उस तारीख के रूप में निर्धारित करती है जिस तारीख से उक्त क्षेत्र विशिष्ट विशेष जोन को सीमा शुल्क अधिनियम, 1962 (1962 का 52 ) की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा।

S.O. 3015 (E ) . Whereas , M/s . Goldsouk Inter- national Gems & Jewellery SEZ Private Limited , has proposed under Section 3 of the Special Economic Zones Act, 2005 (28 of 2005) , ( hereinafter referred to as the said Act), to set up a sector specific Special Economic Zone for Gems and Jewellery Sector at Village Bhondsi , Tehsil- Sohna, District-Gurgaon in the State of Haryana;

2. निदेशक अथवा उप- सचिव , भारत सरकार, वाणिज्य एवं उद्योग मंत्रालय , वाणिज्य विभाग या उसका नामिती जिसका स्तर अवर सचिव , भारत सरकार से कम नहीं होगा

3. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाला क्षेत्रीय संयुक्त विदेश व्यापार महानिदेशक
And whereas , the Central Government is satisfied that requirements under sub - section (8) of Section 3 of the said Act, and other related requirements are fulfilled and it has granted letter of approval under sub - section ( 10 ) of Section 3 of the said Act for development , operation and maintenance of the sector specific Special Economic Zone for Gems and Jewellery sector at Bhondsi , Tehsil - Sohna , District-Gurgaon , Haryana on 6th February, 2008;

4. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले सीमा शुल्क आयुक्त या केन्द्रीय उत्पाद शुल्क आयुक्त अथवा उनका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा
Now, therefore, in exercise of the powers conferred by sub - section ( 1) of Section 4 , sub - section ( 1 ) of Section 13 , sub- section (2 ) of Section 53 and sub - section ( 1) of Section 11 of the Special Economic Zones Act , 2005 and in pursuance of rule 8 of the Special Economic Zones Rules, 2006:

5. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले आयकर आयुक्त अथवा उसका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा
(i) the Central Government hereby notifies the following area at Village Bhondsi , Tehsil - Sohna, District-Gurgaon in the State of Haryana , comprising ofthe Killa numbers and the area given below in the table , as a Special Economic Zone , namely:-

(ii) the Central Government hereby also constitutes a Committee to be called the Approval Committee for the above Special Economic Zone for the purposes of the said Act consisting of the following Chairperson and Members , namely :-
-Chairperson ex officio 1. Development Commissioner ofthe Special Economic Zone
---Member , ex officio 2. Director or Deputy Secretary to the Government of India , Ministry of Commerce and Industry , Department of Commerce or his nominee not below the rank of Under Secretary to the Government of India
-Member, ex officio 3. Joint Director General of Foreign Trade , having territorial jurisdiction over the Special Economic Zone
-Member, ex officio 4. Commissioner of Customs or Central Excise having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner
-Member ,
ex officio 5. Commissioner of Income Tax having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank ofJoint Commissioner
-Member ,
ex officio 6. Director (Banking) in the Ministry ofFinance, Banking Division , Government of India
-Members , ex officio 7. Two Officers , not below the rank ofJoint Secretary, to be nominated by the Government of Haryana
-Special
Invitee 8. Representative of M/s . Goldsouk International Gems & Jewellery SEZ Private Limited (Developer)
(iii) the Central Government hereby also appoints the 22nd day of December , 2010 as the date from which the above sector specific Special Economic Zone shall be deemed to be Inland Container Depot/Port under Section 7 of the Customs Act, 1962 .
