का.आ. 3016(अ).-यतः, मै. उप्पल हाउसिंग लिमिटेड , जो उत्तर प्रदेश राज्य में एक निजी संगठन है , ने उत्तर प्रदेश राज्य में नोलेज पार्क- V, ग्रेटर नोएडा, जिला गौतमबुद्ध नगर में इलेक्ट्रोनिक हार्डवेयर एवं सोफ्टवेयर सहित सूचना प्रौद्योगिकी एवं सूचना प्रौद्योगिकी समर्थित सेवाओं के लिए एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना हेतु विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28) (जिसे एतपश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 के अंतर्गत प्रस्ताव किया है ;
और यतः , केन्द्र सरकार इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप- धारा ( 8 ) के अंतर्गत अपेक्षाओं तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने उपर्युक्त विशेष आर्थिक जोन के विकास, प्रचालन एवं रखरखाव हेतु उक्त अधिनियम की धारा 3 की उप - धारा ( 10 ) के अंतर्गत दिनांक 15 फरवरी , 2008 को अनुमोदन पत्र प्रदान कर दिया है;
अतः अब , विशेष आर्थिक जोन अधिनियम, 2005 की धारा 4 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और विशेष आर्थिक जोन नियम , 2006 के नियम 8 के अनुसरण में , केन्द्र सरकार एतद्वारा निम्नलिखित तालिका में उल्लिखित सर्वेक्षण संख्या और क्षेत्र को उपर्युक्त स्थान पर विशेष आर्थिक जोन के रूप में अधिसूचित करती है , अर्थात्:-

और यतः , विशेष आर्थिक जोन अधिनियम , 2005 ( 2005 का 28 ) की धारा 13 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार एतद्वारा उक्त अधिनियम की धारा 14 के प्रयोजनार्थ उपर्युक्त विशेष आर्थिक जोन के लिए एक समिति , जिसे अनुमोदन समिति कहा जाएगा , गठित करती है, जिसके अध्यक्ष और सदस्य निम्नानुसार हैं, अर्थात्ः-
-अध्यक्ष , पदेन 1. विशेष आर्थिक जोन का विकास आयुक्त
सदस्य, पदेन 2. निदेशक अथवा उप- सचिव , भारत सरकार,
वाणिज्य एवं उद्योग मंत्रालय, वाणिज्य विभाग या उसका नामिती जिसका स्तर अवर सचिव , भारत सरकार से कम नहीं होगा
-सदस्य, पदेन 3. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाला क्षेत्रीय संयुक्त विदेश व्यापार महानिदेशक
-सदस्य, पदेन 4. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले सीमा- शुल्क आयुक्त या केन्द्रीय उत्पाद शुल्क आयुक्त अथवा उनका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा

-सदस्य, पदेन 5. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले आयकर आयुक्त अथवा उसका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा
-सदस्य, पदेन 6. निदेशक ( बैंकिंग ) , वित्त मंत्रालय , बैंकिंग प्रभाग , भारत सरकार
-सदस्य, पदेन 7. उत्तर प्रदेश सरकार द्वारा नामित किए जाने वाले दो अधिकारी जिनका स्तर संयुक्त सचिव से कम नहीं होगा
-विशेष आमंत्रिती 8. मै. उप्पल हाउसिंग लिमिटेड (जोन के विकासकर्ता ) का प्रतिनिधि
और यतः विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28 ) की धारा 53 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार एतद्वारा दिनांक 22 दिसम्बर , 2010 को उस तारीख के रूप में निर्धारित करती है जिस तारीख से उपर्युक्त विशेष आर्थिक जोन को सीमा शुल्क अधिनियम , 1962 (1962का 52 ) की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा ।

New Delhi, the 22nd December , 2010 S.O. 3016(E) . Whereas , M/ s . Uppal Housing Limited a private organization in the State ofUttar Pradesh has proposed under Section 3 of the Special Economic Zones Act, 2005 ( 28 of2005 ), (hereinafter referred to as the said Act ) , to set up a sector specific Special Economic Zone for electronic hardware and software including information technology and information technology enabled services at Knowledge Park - V, Greater Noida , District Gautam Budh Nagar in the State ofUttar Pradesh;
And whereas , the Central Government is satisfied that requirements under sub - section (8 ) of Section 3 of the said Act, and other related requirements are fulfilled and it has granted letter of approval under sub - section ( 10) of Section 3 of the said Act for development, operation and maintenance of the above sector specific Special Economic Zone on 15th February , 2008;
Now, therefore , the Central Government, in exercise ofthe powers conferred by sub - section ( 1 ) of Section 4 of the Special Economic Zones Act , 2005 , and in pursuance of rule 8 of the Special Economic Zones Rules , 2006, hereby notifies the following area at above location with survey numbers given below in the table , as a Special Economic Zone, namely :---

And therefore, the Central Government, in exercise ofthe powers conferred by sub - section ( 1 ) of Section 13 of the Special Economic Zones Act, 2005 (28 of 2005 ) , hereby constitutes a Committee to be called the Approval Committee for the above Special Economic Zone for the purposes of Section 14 of the said Act consisting of the following Chairperson and Members , namely:-
1. Development Commissioner of the Special Economic Zone -Chairperson ex officio
-Member , ex officio 2. Director or Deputy Secretary to the Government of India , Ministry of Commerce and Industry, Department of Commerce or his nominee not below the rank of Under Secretary to the Government of India
3. Zonal Joint Director General of Foreign Trade, having territorial jurisdiction over the Special Economic Zone -Member, ex officio
4. Commissioner of Customs or --Member,
ex officio Central Excise having territorial
jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner
5. Commissioner of Income Tax ---Member ,
ex oflicio having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner
6. Director(Banking) in the Ministry of Finance, Banking Division, Government of India -Member, ex officio
-Member , ex officio 7. Two Officers , not below the rank ofJoint Secretary, to be nominated by the Government of Uttar Pradesh
-Special Invitee 8. Representative of M/ s . Uppal Housing Limited (Developer of the Zone)
And, therefore, the Central Government , in exercise of the powers conferred by sub - section (2 ) of Section 53 of the Special Economic Zones Act, 2005 (28 of 2005 ) , hereby appoints the 22nd day of December , 2010 as the date from which the above Special Economic Zone shall be deemed to be Inland Container Depot under Section 7 of the Customs Act , 1962 ( 52 of 1962) :
