सं. टीएएमपी/69/ 2005 के पी टी. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38वाँ ) की धारा 49 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , महापत्तन प्रशुल्क प्राधिकरण एतद्वारा कंडला पत्तन न्यास के द्वारा पट्टे पर दी गई लवणिक भूमि से संबंधित दरमान संरचना की वैधता को संलग्न आदेशानुसार विस्तारित करता है ।

कंडला पत्तन न्यास के द्वारा पट्टे पर दी गई लवणिक भूमि की दर संरचना को, इस प्राधिकरण ने 17 जनवरी , 2006 को संशोधित किया था । कथित आदेश को अधिसूचना संख्या 15 के द्वारा भारत के राजपत्र में 3 फरवरी , 2006 को अधिसूचित किया गया था । प्राधिकरण के द्वारा अनुमोदित पट्टा किराये 5 जुलाई, 2005 के पूर्वव्यापी प्रभाव से कार्यान्वित किए गए थे । निर्धारित आधार दरें 5 जुलाई, 2005 से पाँच वर्षों के लिए वैध थीं ।
2. अनुमोदित दरों की वैधता 4 जुलाई , 2010 को समाप्त हो चुकी है । केपीटी ने दिनांक 23 जुलाई , 2010 के अपने पत्र में, यह बताते हुए कि उसने लवणिक भूमि के पट्टेधारी किराये का संशोधन कार्य पहले ही प्रारंभ कर दिया है, 17 जनवरी , 2006 के पारित आदेश की वैधता छह माह और बढ़ाने हेतु इस प्राधिकरण से अनुरोध किया है ।
3. चूँकि के पी टी के द्वारा आंबटित भूमि के प्रचलित पट्टे- किराये की वैधता 4 जुलाई , 2010 को समाप्त हो गई है , यह अब आवश्यक हो गया है कि प्रचलित पट्टे- किराये की वैधता को इस तिथि से आगे विस्तारित किया जाए । महापत्तनों की भूमि संबंधित नीति पर भारत सरकार

द्वारा फरवरी/मार्च, 2004 में जारी किए गए मार्ग- निर्देशों में समाविष्ट है कि जब तक पट्टा किराए सक्षम अधिकारी द्वारा संशोधित नहीं किए जाते तब तक उनमें प्रतिवर्ष 2 प्रतिशत की दर से वृद्धि होती रहेगी । जनवरी , 2006 में प्राधिकरण के द्वारा अनुमोदित आदेश भी भारत सरकार के मार्ग- दर्शियों के अनुसार यह शर्त प्रदान करता है । पट्टे किराओं की प्रचलित अनुसूची पहले से ही पट्टे किराए में 2 प्रतिशत की वृद्धि तव तक प्रदान करती है जब तक कि प्राधिकरण के द्वारा दरों में संशोधन नहीं कर दिया जाता ।
4. परिणामस्वरूप और उपरोक्त कारणों से एवं समग्र विचार- विमर्श के आधार पर, यह प्राधिकरण कंडला पत्तन न्यास द्वारा आबंटित भूमि पट्टे - वैधता किरायों की वैद्यता को 4 जुलाई, 2010 से छह महिने के लिए या के पी टी द्वारा दाखिल किए जाने वाले प्रशुल्क प्रस्ताव पर संशोधति पट्टा किराए की अधिसूचना के प्रभावी होने की तिथि, इनमें से जो भी पहले हो , तक विस्तारित करता है ।

NOTIFICATION
Mumbai , the 15th December, 2010
No. TAMP/69 /2005 - KPT.-In exercise of the powers conferred by Section 49 of the Major Port Trusts Act , 1963 ( 38 of 1963 ), the Tariff Authority for Major Ports hereby extends the validity of rate structure pertaining to salt land leased out by the Kandla Port Trust ( KPT) as in the Order appended hereto.

The rate structure pertaining to salt land leased outby the Kandla Port Trust ( KPT ) was revised by this Authority on 17th January , 2006. The said Order was notified in the Gazette of India on 3rd February, 2006 vide Gazette No. 15. The lease rentals approved by this Authority were implementable with retrospective effect from 5th July, 1999. The base rates prescribed were valid for a period of five years with effect from 5th July, 2005.
2. The validity of the rates approved has expired on 4th July, 2010 KPT by its letter dated 23rd July, 2010 has requested this Authority to extend the validity of the Order passed on 17th January, 2006 by six months stating that it has already initiated action for the revision of lease rentals of its salt land.
3. The validity of the existing lease rentals for lands allotted by KPT expired on 4th July, 2010, it is necessaryto extend the validity of the existing lease rentals beyond that date. The guidelines issued by the Government in February/ March, 2004 on land policy of major ports stipulates that the lease rentals shall be escalated by 2 % per annum till they are revised by the Competent Authority. The Order approved by this Authority in January 2006 also prescribes this condition in terms with the Government guidelines . The existing Schedule of lease rentals already provides for an annual escalation of2% in the lease rentals till the rates are revised by this Authority.
4. In the result, and for the reasons given above , and based on a collective application of mind, this Authority extends the validity of the existing lease rentals for land allotted by the Kandla Port Trust from 4th July 2010 for a period of six months or date of effect of notification of the revised lease rentals on the tariff proposal (to be) filed by the KPТ, whichever is earlier.
