विषय : कॉटन यार्न के निर्यात पर प्रतिबंध के संबंध में ।
का.आ. 3017(अ)...विदेश व्यापार नीति , 2009-2014 के पैरा 2.1 के साथ पठित विदेश व्यापार ( विकास एवं विनियमन ) अधिनियम, 1992 ( 1992 की संख्या 22 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार एतद्वारा , अधिसूचना संख्या 38/2009-2014 दिनांक 9-4-2010 की क्रम संख्या 161 ख [ आई टी सी ( एच एस ) वर्गीकरण ] के संबंध में निम्नलिखित संशोधन करती है ।
2. अधिसूचना संख्या 38 /2009-2014 दिनांक 9-4-2010 की मौजूदा प्रविष्टियां दिनांक 1-12-2010 से निम्नानुसार प्रतिस्थापित की जाती हैं :

3. इस अधिसूचना के तहत अन्तर्वर्ती व्यवस्था :-
( i ) विदेश व्यापार नीति , 2009-2014 के पैरा 1.4 और 1.5 के तहत यथा उपलब्ध अन्तर्वर्ती व्यवस्थाएं कॉटन यार्न के निर्यात पर लागू नहीं होंगी ।

(ii ) तथापि, ज़िनःनिर्यातकों ने 1 दिसम्बर, 2010 से पहले वस्त्र आयुक्त , मुम्बई से पंजीकरण प्रमाण-पत्र प्राप्त कर लिया है , उन्हें ऐसे जारी किए गए पंजीकरण प्रमाण-पत्रःकी मान्य सीमा और ऐसे पंजीकृत करार की वैधता अवधि के भीतर कॉटन यार्न का निर्यात. करने की अनुमति होगी ।
(iii) यदि ऐसे पंजीकृतः करारः की वैधता समाप्त हो गयी है तब पंजीकृत करार धारक को ऐसे पंजीकृत करार के तहत निर्यात करने का अधिकार नहीं होगा ।
4. इस अधिसूचना का प्रभाव:
कॉटन यार्न ( प्रशुल्कः कोड -5205, 5206 और 5207 ) का निर्यात पहले वस्त्र आयुक्त, मुम्बई के पास निर्यात करारों के पंजीकरण के मद्दे था । अब कॉटनःयार्नः का निर्यात, प्रतिबंधित कर दिया गया है और अब निर्यात लाइसेंस के तहत अनुमत होगा ।

Subject : Restriction on export of cotton yarn-regarding .
S.O. 3017 (E) . In exercise of the powers conferred by Section 5 of the Foreign Trade ( Development and Regula- tion ) Act, 1992 (No. 22 of 1992) read with Para 2.1 of the Foreign Trade Policy, 2009-2014 , the Central Government hereby makes the following amendments in respect of Sl . No. 161B [ ITC ( HS ) Classification] in the Notification No. 38/2009-2014 dated 9-4-2010 .
2. The existing entries of Notification No. 38/2009-2014 dated 9-4-2010 are substituted as follows with effect from 1-12-2010 :-

3. Transitional Arrangement :--
(i) The Transitional Arrangements as available under Para 1.4 and 1.5 of FTP , 2009-2014 will not be applicable to the export of Cotton Yarn , under this notification.
(ii) However, Exporters who have obtained Registration Certificate from Textile Commissioner , Mumbai before 1st December, 2010 would be permitted to export Cotton Yarn within the quantity limit for which such registration certificate has been issued and within the validity of such registered contract.
(iii) If the validity of such registered contract has expired then the registered contract holder will have no right to export under such registered contract .
3. The effect of this notification :-
Theexport ofcotton yarn (Tariff Codes 5205 , 5206 and 5207) was earlier subject to registration of export contracts withTextile Commissioner , Mumbai . Now, the export of cotton yarn has been restricted and expo : t will now be permitted under licence .
