सा.का.नि. 1003(अ).अखिल भारतीय सेवा अधिनियम, 1951 (1951 का LXI ) की धारा 3 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार, संबंधित राज्यों की सरकारों के साथ विचार-विमर्श के बाद, अखिल भारतीय सेवा ( कार्य निष्पादन मूल्यांकन रिपोर्ट) नियमावली , 2007 में आगे और संशोधन करते हेतु एतदद्वारा निम्नलिखित नियम बनाती है अर्थात्:-
1. ( 1 ) इन नियमों का अखिल भारतीय सेवा ( कार्य निष्पादन मूल्यांकन रिपोर्ट) संशोधन नियम , 2010 कहा जाएगा ।
(2) ये सरकारी राजपत्र में इनके प्रकाशन की तिथि से प्रभाव
में आएंगे ।
2. अखिल भारतीय सेवा ( कार्य निष्पादन मूल्यांकन रिपोर्ट) नियमावली, 2007 ( इसके बाद उक्त नियमावली के रूप में संदर्भित ) में नियम 5 में-
(क) उप- नियम 7 के लिए , निम्नलिखित उप- नियम को प्रातिस्थापित किया जाएगा , अर्थात्: -
नियमावली ( 1 ) , ( 2 ) , ( 4 ) और ( 5) में किसी बात के निहित होने के बावजूद भी , रिपोर्टिंग प्राधिकारी , समीक्षा प्राधिकारी या स्वीकारकर्त्ता प्राधिकारी कार्य निष्पादन मूल्यांकन रिपोर्ट लिखेगा ।
(क ) जहां कि कार्य निष्पादन मूल्यांकन रिपोर्ट की रिपोर्टिंग करने वाला प्राधिकारी एक सरकारी सेवक है , उसके सेवा से सेवानिवृत होने के एक माह के बाद और अन्य मामलों में, उसके कार्यालय छोड़ने की तिथि के एक माह के बाद;
(ख) स्पष्टीकरण को पुनः उसके स्पष्टीकरण -1 के रूप में अंकित किया जाएगा , और इस प्रकार पुनः अंकित स्पष्टीकरण -1

के बाद , निम्नलिखित स्पष्टीकरण को अंतःस्थापित किया जाएगा अर्थात्:-
स्पष्टीकरण- II जहां नए चुनावों के अनुसरण में एक नयी मंत्री परिषद् का गठन हो चुका है वहां यह माना जाएगा कि किसी मंत्री ने पद छोड दिया है चाहे उसी मंत्री जोकि पिछली मंत्री परिषद् में था, नई मंत्री परिषद् में समान अथवा भिन्न पोर्टफोलियो के साथ स्थान मिल जाए ।
3. उक्त नियम के नियम 6 में, स्पष्टीकरण को हटा दिया जाएगा ।

टिप्पणी. मुख्य नियमावली सं. सा.का.नि. 197 ( अ ) दिनांक 14 मार्च , 2007 द्वरा प्रकाशित की गई थी और तत्पश्चात् निम्नलिखित संख्याओं द्वारा संशोधित की गई थी :-

G.S.R. 1003( E) .---- In exercise of the powers conferred by sub - section ( 1 ) of Section 3 of the All India Service Act , 1951 ( LXI of 1951 ) , the Central Government , after consultation with the Governments of the States concerned , hereby makes the following rules further to amend the All Inia Services ( Performance Appraisal Report) Rules, 2007 namely: ---
1. (1) These rules may be called the All India Services (Performance Appraisal Report) Amendments Rules , 2010.

(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the All India Services ( Performance Appraisal Report) Rules , 2007 ( hereinafter referred to as the siad rules) inRules 5,
(a) for sub - rule (7 ) the following sub - rule shall be substitued, namely :----
Notwithstanding anything contained in sub -rules ( 1) , (2), (4) and (5) it shall not be competent for the reporting authority, the reviewing authority or the accepting authority to write a performance appraisal report .
(a) Where the authority reporting the performance appraisal report is a government servant, after one month of his retirement from service ; and in other cases , after one month of the date on which he demits office;
(b) The explanation shall be renumbered as explanation - I thereof and after the explanation - I as so renumber , the following explanation shall be inserted, namely:

Explanation - II A Minister shall be deemed to have demitted the office where pursuant to fresh elections, a new Council of Ministers has been reconstituted, evenif the Minister who was in the earlier Council of Ministers finds a place in the new Council of Ministers with the same or different portfolio .
3. In rule 6 of the siad rule , the explanation shall be omitted.
