का.आ. 3045(अ) . केन्द्रीय सरकार ने , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है , की धारा 11 के अधीन जारी की गई भारत सरकार के पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय ( सडक परिवहन और राजमार्ग विभाग ) की अधिसूचना संख्यांक का. आ. 1399 ( अ ) , तारीख 27 सितम्बर, 2005 , और अधिसूचना संख्यांक का.आ. 797 ( अ ) , तारीख 1 अप्रैल , 2008 द्वारा तमिलनाडु राज्य और पुडुचेरी संघ राज्य क्षेत्र में राष्ट्रीय राजमार्ग सं. 66 के 3.520 कि.मी. से 214.200 कि.मी. ( तमिलनाडु/पोंडिचेरी बोर्डर - तिंदीवनम तिरूवनामलाई कृष्णागिरी सेक्शन ) और 0.000 कि.मी. से 3.520 कि.मी. ( पुडुचेरी- तिंदीवनम सेक्शन ) तक के खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् प्राधिकरण कहा गया है ) को सौंपा था;
और, उक्त अधिनियम की धारा 14 द्वारा प्रदत्त शक्तियों के अनुसरण में , प्राधिकरण ने पुडुचेरी संघ राज्य क्षेत्र और तमिलनाडु राज्य में राष्ट्रीय राजमार्ग संख्या 66 जिसकी लम्बाई 38.068 किलोमीटर के 0.000 कि.मी. से 37.920 कि.मी. ( पोंडिचेरी - तिंदीवनम सेक्शन ) ( जिसे इसमें इसके पश्चात् उक्त सेक्शन कहा गया है ) , तक के विद्यमान दो लेन वाली सड़क को चार लेन की सड़क बनाने विकास , प्रचालन और अनुरक्षण के लिए मैसर्स पोंडिचेरी - तिंदीवनम टोलवे लिमिटेड जिसका रजिस्ट्रीकृत कार्यालय , 6-3-1186 / 5 /A, तीसरा तल, अमोघ प्लाजा , बेगमपेट , हैदराबाद में है ( जिसे इसमें इसके पश्चात् रियायतग्राही कहा गया है ) के साथ करार किया है ।
अतः , अब , केंद्रीय सरकार राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्गों/ राष्ट्रीय राजमार्ग सेक्शन पर स्थायी पुल/ अस्थायी पुल के उपयोग के लिए किसी व्यक्ति द्वारा फीस का संग्रहण ) नियम , 1997 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा ४क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त सेक्शन के निर्माण , अनुरक्षण , प्रबंधन और प्रचालन में अन्तर्वलित व्यय , विनिधान की गई पूंजी पर ब्याज , युक्तियुक्त प्रत्यागम , यातायात की मात्रा और प्राधिकरण और रियायतग्राही के बीच किए गऐ करार की अवधि को ध्यान में रखते हुए, यह अधिसूचित करती है कि उक्त खंड के उपयोग के लिए नीचे की सारणी के स्तंभ ( 2 ) में विनिर्दिष्ट यानों के प्रकार पर उसके स्तंभ ( 3 ) में विनिर्दिष्ट फीस दरों पर फीस उग्रहीत और संगृहीत किया जाएगा और रियायतग्राही को वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से , इनमें से जो भी पश्चात्वर्ती हो , समाप्ति की तारीख तक उक्त फीस संगृहीत और प्रतिधारित करने के लिए प्राधिकृत करती है , अर्थात्:-

टिप्पणः-
1. इस अधिसूचना के प्रयोजनों के लिए : -
(क) " वास्तविक फीस " से उक्त खंड के उपयोक्ताओं से निम्नलिखित के आधार पर प्रभारित वास्तविक फीस अभिप्रेत है :--
(क) इसकी लम्बाई किलोमीटर में ; और (ख) उपर्युक्त सारणी के स्तंभ ( 3) में यथादर्शित आधार दर पर फीस और वह एक रूपये के निकटतम पूर्णांकित की जाएगी ।
(ख) " वाणिज्यिक प्रचालन की तारीख " से वह तारीख अभिप्रेत है जिसको उक्त सेक्शन की बाबत उक्त सेक्शन पर वाणिज्यिक प्रचालन प्राधिकरण और रियायतग्राही के बीच किए गए करार ( जिसे इसमें इसके पश्चात् उक्त करार कहा गया है ) के उपबन्धों के अनुसार उक्त सेक्शन के पूरा होने पर, स्वतंत्र परामर्शी द्वारा यथास्थिति, पूर्णता प्रमाणपत्र अथवा अनंतिम पूर्णता प्रमाणपत्र, जारी किए जाने के पश्चात् प्रारंभ होता है ।
(ग) "दिन से 24 घंटे की निरंतर अवधि अभिप्रेत है ।
(घ) "स्थानीय यातायात से ऊपर सारणी के क्र. सं . 1 के सामने विनिर्दिष्ट यान के प्रवर्ग के लिए संदेय फीस के सम्बंध में स्थानीय यातायात के निम्नलिखित प्रवर्ग अभिप्रेत हैं, अर्थात्: -
(i) "स्थानीय यातायात प्रवर्ग ।" जिसमें वे उपयोक्ता सम्मिलित हैं जो --
(अ) ऐसे ग्रामों, नगरों या शहरों के निवासी हैं जिनकी सीमा टोल प्लाजा के दस कि.मी. के घेरे के भीतर आती है ;
(आ) टोल प्लाजा के दस कि.मी. के घेरे के भीतर अवस्थित स्थापन या औद्योगिक इकाइयाँ हैं ;
ऐसे स्थापनों या औद्योगिक इकाइयों के कर्मचारी हैं , जो टोल प्लाजा के दस कि.मी. के घेरे के भीतर अवस्थित हैं या उनके कार्यालय हैं ; और (इ)
(ई) स्वनियोजित व्यक्ति या व्यवसायी हैं जिनका कार्य स्थल टोल प्लाजा के दस कि.मी. के घेरे के भीतर अवस्थित है ।

(ii) " स्थानीय यातायात प्रवर्ग II जिसमे वे उपयोक्ता सम्मिलित है जो -
(अ) ऐसी ग्रामों, नगरों या शहरों के निवासी हैं जिनकी सीमा टोल प्लाजा के दस कि.मी. से अधिक किन्तु बीस कि.मी. तक के घेरे के भीतर आती है ;
(आ) टोल प्लाजा के दस कि.मी. से अधिक परन्तु बीस कि.मी. तक के घेरे के भीतर अवस्थित या स्थापन औद्योगिक इकाइयां है ;
(इ) ऐसे स्थापनों या औद्योगिक इकाइयों के कर्मचारी हैं जो टोल प्लाजा के दस कि.मी. से अधिक किन्तु बीस कि.मी. तक के घेरे के भीतर अवस्थित है या जिनका कार्यालय स्थित है ।
(ई) ऐसे स्वनियोजित व्यक्ति या व्यवसायी हैं जिनका कार्य स्थल टोल प्लाजा के दस कि.मी. से अधिक किन्तु बीस कि.मी. तक के घेरे के भीतर है ;
(ड) " समाप्ति की तारीख " से वह तारीख अभिप्रेत है जिसको उक्त करार, उक्त करार के उपबंधों के अनुसरण में समाप्त होता है या समाप्ति की सूचना द्वारा समाप्त किया जाता है;
(च) उन शब्दों और पदों के जो इस अधिसूचना में प्रयुक्त है और परिभाषित नहीं है किन्तु उक्त करार में परिभाषित हैं वही अर्थ होंगे जो उक्त करार, में हैं ।
2. वास्तविक फीस तथा उसका पुनरीक्षण जो कि प्रत्येक वर्ष 1 सितम्बर से प्रभावी होगा की संगणना निम्नानुसार की जाएगीः-

जहां
(i) थो.की.सू. से आर्थिक सलाहकार, वाणिज्यिक और उद्योग मंत्रालय , भारत सरकार के कार्यालय द्वारा जारी थोक कीमत सूचकांक अभिप्रेत है ।
( ii) थो.की.सू. क = जून 1997 ( 131.4) को थोक कीमत सूचकांक है ;
(iii) थो.की.सू.- ख = फीस पुनरीक्षण की तारीख से पूर्ववर्ती वित्तीय वर्ष की समाप्ति के 31 मार्च को उपलब्ध औसत थोक कीमत सूचकांक है ।
3. जब किसी यान को किसी दिन उक्त सेक्शन को एक दिन में एक से अधिक बार पार करना हो , तो उपयोक्ता के पास यह विकल्प होगा कि वह पहले ही चक्कर में पथकर प्लाजा को पार करते समय उपरोक्त सारणी के स्तम्भ (3) में यथा विनिर्दिष्ट आधार दरों पर अनेक चक्करों के लिए फीस का डेढ़ गुना संदाय कर दे और जहाँ ऐसा यान को उक्त सेक्शन का पूरे मास में निरंतर और बार- बार प्रयोग करना हो तो उपयोक्ता उपरोक्त सारणी के स्तंभ (3) में यथाविनिर्दिष्ट एकल चक्कर को लागू दर के तीस गुना के संदाय के बराबर पर मासिक पास प्राप्त कर सकता है।

4. निम्नलिखित प्रकार के यानों के संबंध में कोई फीस प्रभारित या संगृहीत नही की जाएगी, अर्थातः-
(i) ऐसे यान-
(क) जो " अति महत्वपूर्ण व्यक्ति " प्रतीक वाले हैं या शासकीय रूप से निम्नलिखित के हैं: - (क) भारत के राष्ट्रपति;
(ख) भारत के उपराष्ट्रपति;
(ग) (घ) राज्य के राज्यपाल या संघ राज्य क्षेत्रों के उप- राज्यपाल; भारत के राजकीय दौरे पर उच्च पदस्थ विदेशी व्यक्ति;
(ड़) "सी डी" । " सी सी" नंबर प्लेटों वाली कारों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक;
(च) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद के सभापति या राज्य विधान सभा के अध्यक्ष या केंद्रीय अथवा राज्य मंत्री अथवा लोक सभा या राज्य सभा या राज्य विधान मंडलों के विपक्ष के नेता जिनकी हैसियत कैबिनेट मंत्री की है, यदि वे स्वयं यान में बैठें हों ;
(छ) सम्पूर्ण देश में संसद सदस्य , या अपने राज्य किसी राज्य की विधान सभा का सदस्य या राज्य की विधान परिषद का सदस्य , यदि वह, यथास्थिति, संसद अथवा राज्य के संबंधित विधान मंडल द्वारा जारी किया गया पहचान पत्र प्रस्तुत करता है;
(ख) शौर्य पुरस्कारों जैसे परमवीर चक्र, अशोक चक्र, महावीर चक्र, कीर्ति चक्र , वीर चक्र और शौर्य चक्र के विजेता यदि ऐसा पुरस्कार प्राप्तकर्ता ऐसे पुरस्कार के लिए सक्षम प्राधिकारी द्वारा सम्यक् रूप से अधिप्रमाणित किया गया अपना फोटो पहचान पत्र प्रस्तुत करता है ;
(ख) रक्षा यान, जिनके अतंर्गत वे यान भी है जो भारतीय पथकर (सेना और वायुसेना) अधिनियम 1901 और उसके अधीन बनाए गए नियमों (नौसेना को यथाविस्तारित ) के उपबन्धों के अनुसार छूट के पात्र हैं ।
(ग) पुलिस यान, अग्नि शमन यान, एम्बुलेंस, अन्त्येष्टि यान, डाक और तार विभाग के यान , केंद्रीय सरकार और राज्य सरकार के कर्त्तव्यारूढ़ यान ।
5. रियायतग्राही स्थानीय यातायात से निम्नलिखित छूट दरों से अधिक फीस वसूल नहीं करेगा
कार , जीप या वैन के लिए
(क)
(i) स्थानीय यातायात प्रवर्ग 1 : 150.00 रूपये का मासिक पास
स्थानीय यातायात प्रवर्ग 2 :
300.00 रूपये का मासिक पास
(ii)
(ख) स्कूल बसें
स्कूली छात्रों को ले जाने वाली स्कूल बसों के लिए पथकर प्लाजा पार करने के लिये स्कूल के प्राचार्य के लिखित अनुरोध के साथ स्कूल की मान्यता तथा बस का रजिस्ट्रीकरण दर्शाने वाले दस्तावेजों की प्राप्ति पर 1000 रू. (एक हजार रूपये) की दर से मासिक पास जारी किये जायेंगे [भाग II-खण्ड 3 (ii) ]

(ग) हल्के वाणिज्यिक यान और ट्रक ( स्थानीय परिवहन प्रचालक ):
स्थानीय परिवहन प्रचालकों को बीस किलोमीटर के घेरे के भीतर उन्हें चलाने का सबूत अर्थात् स्पष्ट रूप से वाहन की वापसी के ब्योरे विनिर्दिष्ट करते हुए प्रारम्भिक और अन्तिम स्थान के लिए माल का चालान प्रस्तुत करने पर प्रत्येक प्रवेश पर ट्रकों के लिये 25 रु. (पच्चीस रूपये ) और हल्के वाणिज्यिक वाहनों के लिये 15 रु. ( पन्द्रह रूपये ) दर पर रियायत फीस दी जाएगी ।
परन्तु, जहां स्थानीय यातायात द्वारा स्वतंत्र उपयोग के लिए पृथक सेवा लेन खुली हुई है वहाँ रियायतग्राही ऐसे स्थानीय यानों से फीस उद्ग्रहीत और संग्रहीत तभी करेगा यदि वे उक्त सेक्शन का उपयोग करते है ।
6. किसी ऐसे यांत्रिक यान से कोई फीस उदगृहीत और संग्रहीत नहीं की जाएगी जो उक्त सारणी में विनिर्दिष्ट नहीं है ।
7. रियायतग्राही, वाणिज्यिक प्रचालन की तारीख से कम से कम दस दिन पहले इस अधिसूचना का सार वाणिज्यिक प्रचालन की तारीख सहित दो स्थानीय समाचार पत्रों में ( जिनमें से एक स्थानीय भाषा में होगा ) प्रकाशित करेगा, और पुनरीक्षित फीस को प्रभाव देने से दस दिन पहले सार को पुनः प्रकाशित करेगा ।
8. रियायतग्राही ऐसे किसी अधिकारी को फीस संग्रहण के भार साधक के रूप में नामनिर्दिष्ट करेगा जो रियायतग्राही के साथ संयुक्त और गंभीर रूप से यह सुनिश्चित करने के लिए कि फीस का संग्रहण विनिर्दिष्ट दरों पर सड़क उपयोक्ताओं को असम्यक् कठिनाई पहुँचाए बिना सहज रूप से हो रहा है तथा उससे संबंधित अन्य विषयों के लिए उत्तरदायी होगा ।
9. फीस की दर, फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और रियायतग्राही का नाम, पता और टेलीफोन संख्या , जिसे शिकायत, यदि कोई हो, संबोधित की जा सकेगी पथकर चौकी से 500 मी . आगे , पथकर चौकी से 100 मी. आगे और पथकर चौकी पर भी सहजदृश्य रूप से और प्रमुख रूप से प्रदर्शित की जाएगी और प्रदर्शित बोर्ड की ऊंचाई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए प्रदर्शित बोर्ड का पढ़ना आसान हो सके ।
10. उपयोक्ताओं से प्रभारित की जाने वाली वास्तविक फीस की संगणना रियायतग्राही द्वारा की जाएगी और प्रतिवर्ष 31 मार्च के बाद किंतु पुनरीक्षित दर प्रभावी होने से कम से कम 45 दिन पहले , यथासम्भव शीघ्र विधिमान्यता के लिए प्राधिकरण को भेजी जाएगी जिससे कि प्राधिकरण , उक्त प्रस्ताव की प्रप्ति की तारीख से पन्द्रह दिन के भीतर कोई टिप्पणियां कर सके या स्पष्टीकरण , यदि कोई हो , मांग सके और यदि प्राधिकरण इस अवधि के दौरान कोई टिप्पणी नहीं करता है या स्प्ष्टीकरण नहीं मांगता है तो रियायतग्राही द्वारा यथा प्रस्तावित पुनरीक्षित फीस प्राधिकरण द्वारा पुष्टि की गई समझी जाएगी ।

NOTIFICATION
New Delhi , the 24th December , 2010
S.O. 3045 ( E) .- Whereas , vide notifications of the Government of India in the erstwhile Ministry of Shipping , Road Transport and Highways ( Department of Road Transport and Highways ) number S.O.1399 ( E) , dated the 27th September , 2005 and number S.O. 797 ( E) , dated the 1st April , 2008 , issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988 ) , hereinafter referred to as the said Act , the Central Government had entrusted the stretches from Km . 3.520 Km 214.200 ( Tamil Nadu / Pondicherry Border - Tindivanam Thiruvannamalai Krishnagiri section ) and 0.000 to Km. 3.520 (Puducherry Tindivanam section) of National Highway No. 66 in the State of Tamil Nadu and the Union territory of Puducherry respectively to the National Highways Authority of India ( hereinafter referred to as the Authority) ;
And Whereas , pursuant to the powers conferred by section 14 of the said Act , the Authority has entered into an agreement with M / s Pondicherry Tindivanam Tollway Limited , having its registered office at 6-3-1186 / 5 /A , III Floor , Amogh Plaza , Begumpet , Hyderabad - 500016 (hereinafter referred to as the Concessionaire) , for the development , operation and maintenance of the existing two lane section into four lane divided carriageway section from Km . 0.000 to Km . 37.920 ( Pondicherry Tindivanam section ) of National Highway No. 66 having length of 38.608 Kilometer . ( hereinafter referred to as the said section ) in the Union territory of Puducherry and the State of Tamil Nadu ;
Now, therefore , in exercise of the powers conferred by section 8A of the National Highways Act , 1956 (48 of 1956 ) , read with the National Highways (Collection of Fees by any Person for the Use of Section of National Highways / Permanent Bridge / Temporary Bridge on National Highway ) Rules , 1997 , the Central Government , having regard to the expenditure involved in building , maintenance , management and operation of the said section , interest on the capital invested , reasonable return , the volume of traffic and the period of the agreement entered into between the Authority and the Concessionaire , hereby notifies that there shall be levied and collected fee at the base rate specified in column (3 ) of the following Table , on the category of vehicles specified in column (2) thereof, for the use of the said section and authorises the Concessionaire to collect and retain the said fee from the date of commercial operation or publication of this notification in the Official Gazette , whichever is later , till the termination date , namely: - [ भाग II-खण्ड 3 ( ii) ]

Notes: -
1. For the purposes of this notification , -
(a) " actual fee" means the fee actually charged from the users of the said section on the basis of-
(i) its length in kilometers; and
( ii) fee at the base rate as shown in column (3 ) of the above Table duly indexed ,
and shall be rounded off to nearest one rupee ;
(b) "date of commercial operation " means the date on which commercial operation of the said section begins after issue of the completion certificate or the provisional completion certificate , as the case may be , by the Independent Consultant , upon completion of the said section in accordance with the provisions of the agreement entered into between the Authority and the Concessionaire in respect of the said section ( hereinafter referred to as the said agreement)
(c) " day" shall mean a continuous period of twenty - four hours ;
(d) " local traffic" , in relation to the fee payable for the category of vehicles specified against S.No.1 of the above Table , means the following categories of local traffics , namely : -
(i ) " local traffic category I " which shall include users being-
(A) residents of villages , towns or cities , the boundaries of which are within a radius of ten kilometers from the toll plaza;
(B) establishments or industrial units which are located within a radius of ten kilometers from the toll plaza ;

( C) employees of establishments or industrial units which are located or which have their offices within a radius of ten kilometers from the toll plaza ; and
(D) self employed persons or businessmen having their place of work within a radius of ten kilometers from the toll plaza ;
( ii) " local traffic category II " which shall include users being-
(A) residents of villages , towns or cities , the boundaries of which are within a radius of more than ten kilometers but within twenty kilometers from the toll plaza ;
(B) establishments or industrial units which are located within a radius of more than ten kilometers but within twenty kilometers from the toll plaza ;
(C) employees of establishments or industrial units which are located or have their offices within a radius of more than ten kilometers but within twenty kilometers from the toll plaza ; and
(D) self employed persons or businessmen having their place of work within a radius of more than ten kilometers but within twenty kilometers from the toll plaza ;
(e) " termination date" means the date on which the said agreement expires pursuant to the provisions of the said agreement or is terminated by termination notice ;
( f) words and expressions used herein and not defined but defined in the said agreement shall have the meaning respectively assigned to them in the said agreement .
2. The actual fee and revision thereof effective from the 1st September every year shall be computed as follows: -

( iii ) WPI - B is the average Wholesale Price Index available for the year ending March 31st preceding the fee revision date .
3. When a vehicle has to cross the said section more than once in a day , the user shall have the option to pay fee for multiple trips at one and half times the rate as specified in column (3) of the above Table while crossing the toll plaza in the first trip itself, and where a vehicle has to use the said section continuously and frequently for the entire month , then the user may have a monthly pass on payment of charges equal to thirty times the rate applicable for single trip as specified in column (3) of the aforesaid Table .
4. No fee shall be charged or collected in respect of the following vehicles , namely: -
(a) vehicles-
( i) having VIP symbols or officially belonging to-
(A) the President of India;
(B) the Vice- President of India ;
(C) the Governor of a State and the Lieutenant Governor of a Union territory;
(D) a Foreign dignitary on State visit to India;
(E) a Foreign Diplomat stationed in India using cars with " CD " / " CC " number plates;
(F) the Chairman of Rajya Sabha , the Speaker of Lok Sabha , the Chairman of State Legislative Council , the Speaker of State Legislative Assembly , a Minister for the Union , State , the Leader of Opposition in Lok Sabha , Rajya Sabha , State Legislatures having the Status of Cabinet Minister, if he is sitting in the vehicle;
(G) a Member of Parliament in the entire country , a Member of Legislative Assembly of a State , a Member of Legislative Council of a State , in the respective State , if he produces his identity card issued by the Parliament or concerned Legislature of a State , as the case may be ;
(ii) belonging to winner of Gallantry award such as Param Vir Chakra, Ashok Chakra , Maha Vir Chakra , Kirti Chakra , Vir Chakra and Shaurya Chakra , if such awardee produces his photo identity card duly authenticated by the Competent Authority for such award;
(b) Defence vehicles , including those eligible for exemption in accordance with the provisions of the Indian Toll (Army and Air Force) Act, 1901 and the rules made there under ( as extended to Navy) ;

(c) Police vehicles , Fire fighting vehicles , Ambulances , Funeral vans , Post and Telegraph Department's vehicles , Central and State Government vehicles on duty .
5. Concessionaire shall not collect fees from local traffic in the excess of the following discounted rates : --
(a) car, van and jeep :
( i) Local Traffic Category I: Monthly pass of Rs . 150.00 ( ii) Local Traffic Category II : Monthly pass of Rs.300.00
(b) School Buses Monthly passes at the rate of Rs.1000 ( rupees one thousand) for school buses carrying school students crossing the toll plaza may be given after obtaining written request of the school principal along with the document showing recognition of the school and the registration of the school bus.
(c) Light Commercial Vehicles and Trucks ( Local Transport Operators ) :
Concession fee to Local Transport Operators at the rate of Rs.25 ( rupees twenty - five) for trucks for each entry and Rs.15 ( rupees fifteen) for Light Commercial Vehicles for each entry shall be given on production of proof for plying within a radius of twenty kilometers such as goods challan showing its origin and destination and clearly specifying the return details of the vehicle :
Provided that where a separate service lane is opened for free use by local traffic , the Concessionaire shall levy and collect fee from such local traffic only if they use the said section .
6. No fee shall be levied and collected from a mechanical vehicle which is not specified in the above Table .
7 . The Concessionaire shall publish the substance of this notification including the date of commercial operation in two local newspapers ( one of which shall be in vernacular language) at least ten days prior to the date of commercial operation and also ten days prior to giving effect to revised fee .
8. The Concessionaire shall nominate an officer as in- charge of fee collection and the Concessionaire as well as the said officer shall be jointly and severally responsible for ensuring that fee is collected at the specified rates smoothly , without causing undue hardship to the road users and also for all matters connected therewith .
9. The rate of fee , the category of vehicles exempted from payment of fee and the name , address and telephone number of Concessionaire to whom [ भाग II-खण्ड 3( ii) ]

complaints , if any , should be addressed , shall be conspicuously and prominently displayed 500 meters ahead of the toll plaza , 100 meters ahead of the toll plaza and at the toll plaza also , the height of display boards and size of letters being such that the driver can easily read the display boards .
10. The actual fee to be charged from users shall be computed by the Concessionaire and sent to Authority for validation as soon as possible after 31st March in every year but at least forty- five days before the revised rate is to be effective so as to enable the Authority to provide any comments or seek clarifications , if any , within a period of fifteen days from the date of receipt of the said proposal and if the Authority does not offer comments or seek clarifications during this period, the revised fee , as proposed by the Concessionaire , shall be deemed to have been confirmed by the Authority .
