सं. भा० आ० प० 18 ( 1 )/2010- मेडि./49070- भारतीय आयुर्विज्ञान परिषद् अधिनियम , 1956 ( 1956 का 102 ) की धारा 33 द्वारा प्रदत्त शक्तियों का इस्तेमाल करते हुए "स्नातकोत्तर चिकित्सा शिक्षा विनियमावली, 2000 " में पुनः संशोधन करने हेतु भारतीय आयुर्विज्ञान परिषद्, केन्द्रीय सरकार के पूर्व अनुमोदन से एतद् द्वारा निम्नलिखित विनियम बनाती है , नामतः
1. (i ) इन विनियमों को "स्नातकोत्तर चिकित्सा शिक्षा विनियमावली ( संशोधन) , 2010 ( भाग II ) " कहा जाए ।
(ii ) ये विनियम सरकारी राजपत्र में उनके प्रकाशन की तारीख से प्रवृत होगें ।
2. "स्नातकोत्तर चिकित्सा शिक्षा विनियमावली , 2000 " में निम्नलिखित परिवर्धन / संशोधन / विलोप / प्रतिस्थापन दर्शाए जाएंगे ।
3. "स्नातकोत्तर छात्रों का चयन " शीर्षक के अतंगर्त खण्ड 9 को निम्नलिखित रूप में प्रतिस्थापित किया जाएगा।
" 9. स्नातकोत्तर पाठ्यक्रम के लिए अभ्यर्थियों के चयन की प्रक्रिया निम्नलिखित होगीः
I. प्रत्येक अकादमिक वर्ष में एकल पात्रता व प्रवेश परीक्षा अर्थात स्नातकोत्तर चिकित्सा पाठ्यकम में दाखिले के लिए एक "राष्ट्रीय पात्रता व प्रवेश परीक्षा" होगी । राष्ट्रीय पात्रता व प्रवेश परीक्षा का समग्र प्रर्यवेक्षण, निर्देशन और नियंत्रण भारतीय आयुर्विज्ञान परिषद् द्वारा किया जाएगा । तथापि, केन्द्रीय सरकार के पूर्व अनुमोदन से भारतीय आयुर्विज्ञान परिषद् 4905 GI/2010

' स्नातकोत्तर पाठ्यक्रम में दाखिले के लिए राष्ट्रीय पात्रता व प्रवेश परीक्षा " आयोजित करने के लिए संगठन (नों) का चयन करेगी । '
II. स्वीकृत वार्षिक प्रवेश क्षमता की 3 % (तीन प्रतिशत) सीटें 50 % (पचास प्रतिशत ) से 70 % (सत्तर प्रतिशत ) के बीच निचले अंगों की गतिक विकलांगता वाले अभ्यर्थियों द्वारा भरी जाएगी ।
बशर्ते कि यदि 50 % (पचास प्रतिशत) से 70 % ( सत्तर प्रतिशत ) के बीच निचले अंगों की गतिक विकलांगता वाले अभ्यर्थियों की अनुपलब्धता के कारण इस 3 % (तीन प्रतिशत) कोटे में कोई सीट खाली रह जाती है, तो इस 3 % (तीन प्रतिशत) कोटे में भरी न गई कोई सीट, सामान्य श्रेणी के अभ्यर्थियों के लिए वार्षिक स्वीकृत सीटों में उन्हें शामिल करने से पहले , 40% (चालीस प्रतिशत) से 50% (पचास प्रतिशत) के बीच निचले अंगों की गतिक विकलांगता वाले व्यक्तियों द्वारा भरी जाएगी ।
पुनः बशर्ते कि यह सम्पूर्ण कार्य , दाखिलों के लिए सांविधिक समय सूची के अनुसार प्रत्येक मेडिकल कालेज / संस्थान द्वारा पूरा किया जाएगा ।
किसी अकादमिक वर्ष विशेष के लिए किसी स्नातकोत्तर पाठ्यक्रम में दाखिले हेतु पात्र होने के लिए अभ्यर्थी के लिए यह आवश्यक होगा कि वह उक्त अकादमिक वर्ष के लिए आयोजित की गई राष्ट्रीय पात्रता व प्रवेश परीक्षा के में न्यूनतम 50 % ( पचास प्रतिशत) अंक प्राप्त करे । जबकि अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछडे वर्गों से संबंधित अभ्यर्थियों
के मामले में , ' स्नातकोत्तर पाठ्यक्रम में दाखिले के लिए राष्ट्रीय पात्रता व प्रवेश परीक्षा में न्यूनतम 40% ( चालीस प्रतिशत) अंक प्राप्त करना आवश्यक होगा और निचले अंगों की गतिक विकलांगता वाले ऊपर खण्ड 9 ( 11 ) मे दिए गए अभ्यर्थियों के मामले में स्नातकोत्तर पाठ्यक्रम में दाखिले के लिए राष्ट्रीय पात्रता व प्रवेश परीक्षा में न्यूनतम अंक 45% (पैंतालीस प्रतिशत) होने चाहिये ।
बशर्ते कि जब पर्याप्त संख्या में सम्बन्धित श्रेणियों के अभ्यर्थी स्नातकोत्तर पाठ्यक्रम में दाखिले के लिए किसी अकादमिक वर्ष में राष्ट्रीय पात्रता व प्रवेश परीक्षा में यथा विनिर्धारित न्यूनतम अंक प्राप्त करने में विफल रहते हैं तो भारतीय आयुर्विज्ञान परिषद् के परामर्श से केन्द्रीय सरकार अपने विवेक पर संबंधित श्रेणियों के अभ्यर्थियों के लिए स्नातकोत्तर पाठ्यक्रम में दाखिले हेतु अपेक्षित न्यूनतम अंक कम कर सकती है और केन्द्रीय सरकार द्वारा इस प्रकार कम किए गए अंक केवल उसी अकादमिक वर्ष के लिए लागू होंगे ।
IV. राज्य /संघ राज्य में वर्तमान में लागू नियमों के अनुसार ही मेडिकल कॉलेजों / संस्थानों में सम्बन्धित श्रेणियों की सीटों का आरक्षण होगा। राष्ट्रीय पात्रता व प्रवेश परीक्षा में प्राप्त किए गए अंकों के आधार पर पात्र अभ्यर्थियों की एक अखिल भारतीय मेरिट [ भाग III-खण्ड 4]

सूची और राज्य - वार मेरिट सूची तैयार की जाएगी और केवल उक्त सूची में से ही अभ्यर्थियों को स्नातकोत्तर पाठ्यक्रम में दाखिला दिया जाएगा ।
V. ऊपर उप-खण्ड II यथा विनिर्धारित न्यूनतम अंक प्राप्त करने में विफल रहने वाले किसी भी अभ्यर्थी को उक्त अकादमिक वर्ष में किसी स्नातकोत्तर पाठ्यक्रम में दाखिला नहीं दिया जाएगा ।
VI . गैर- सरकारी मेडिकल कालेजों/ संस्थानों में कुल सीटों की 50 % (पचास प्रतिशत) सीटें केन्द्रीय / राज्य सरकार या उनके द्वारा नियुक्त प्राधिकारी द्वारा भरी जाएंगी और बाकी बची 50% (पचास प्रतिशत ) सीटें राष्ट्रीय पात्रता व प्रवेश परीक्षा में प्राप्त किए गए अंकों के अनुसार तैयार की गई मेरिट सूची के आधार पर सम्बन्धित मेडिकल कालेजों / संस्थानों द्वारा भरी जाएगी ।"

पाद टिप्पणीः- प्रधान विनियमावली नामतः " स्नातकोत्तर चिकित्सा विनियमावली, 2000 " को भारत के राजपत्र के भाग III , खण्ड (IV) में दिनांक 7 अक्टूबर , 2000 को प्रकाशित किया गया था और भारतीय आयुर्विज्ञान परिषद् की दिनांक 03.03.2001 , 06.10.2001 , 16.03.2005, 23.03.2006 , 20.10.2008 , 25.03.2009 , 21.07.2009, 17.11.2009, 09.12.2009 और 16.04.210 की अधिसूचना के अतंर्गत संशोधित किया गया था ।

No. MCI.18 ( 1 ) /2010-Med./49070 . In exercise of the powers conferred by Section 33 of the Indian Medical Council Act , 1956 (102 of 1956) , the Medical Council of India with the previous approval of the Central Government hereby makes the following regulations to further amend the "PostgraduateMedical Education Regulations , 2000 ", namely: -
1. (i ) These Regulations may be called the " Postgraduate Medical Education (Amendment ) Regulations , 2010 (Part - II ) " .
(ii ) They shall come into force from the date of their publication in theOfficial Gazette .
2. In the " Postgraduate Medical Education Regulations , 2000 ", the following additions / modifications / deletions / substitutions , shall be as indicated therein : -

"9. Procedure for selection of candidate for Postgraduate courses shall be as follows:
I. There shall be a single eligibility cum entrance examination namely ' National Eligibility- cum-Entrance Test for admission to Postgraduate Medical Courses' in each academic year . The overall superintendence , direction and control of National Eligibility- cum- Entrance Test shall vest with Medical Council of India . However , Medical Council of India with the previous approval of the Central Government shall select organization/ s to conduct ' National Eligibility-cum-Entrance Test for admission to Postgraduate courses' .
II . 3% seats of the annual sanctioned intake capacity shall be filled up by candidates with locomotory disability of lower limbs between 50 % to 70 % .
Provided that in case any seat in this 3 % quota remains unfilled on account of unavailability of candidates with locomotory disability of lower limbs between 50% to 70% then any such unfilled seat in this 3 % quota shall be filled up by persons with locomotory disability of lower limbs between 40% to 50% -before they are included in the annual sanctioned seats for General Category candidates .
Provided further that this entire exercise shall be completed by each medical college / institution as per the statutory time schedule for admissions .
In order to be eligible for admission to any postgraduate course in a particular academic year , it shall be necessary for a candidate to obtain minimum of 50% (Fifty Percent ) marks in 'National Eligibility- cum-Entrance Test for Postgraduate courses' held for the said academic year . However , in respect of candidates belonging to Scheduled Castes , Scheduled Tribes , Other Backward Classes , the minimum percentage marks shall be 40% (Forty Percent) and in respect of candidates as provided in clause 9 (II ) above with locomotory disability of lower limbs, the minimum percentage marks shall be 45% ( Forty Five Percent) in theNational Eligibility- cum- Entrance Test :
Provided when sufficient number of candidates in the respective categories fail to secure minimum marks as prescribed in National Eligibility - cum- Entrance Test held for any academic year for admission to Post Graduate Courses , the Central Government in consultation with Medical Council of India may at its discretion lower the minimum marks required for admission to Post Graduate Course for candidates belonging to respective categories and marks so lowered by the Central Government shall be applicable for the said academic year only.

IV. The reservation of seats in medical colleges/institutions for respective categories shall be as per applicable laws prevailing in States/ Union Territories . An all India merit list as well as State- wisemerit list of the eligible candidates shall be prepared on the basis of the marks obtained in National Eligibility- cum-Entrance Test and candidates shall be admitted to Post Graduate courses from the said merit lists only.
V. No candidate who has failed to obtain the minimum eligibility marks as prescribed in Sub Clause ( II ) above shall be admitted to any Postgraduate courses in the said academic year.
VI. Innon-Governmental medical colleges/ institutions , 50% ( Fifty Percent) of the total seats shall be filled by State Government or the Authority appointed by them , and the remaining 50% ( Fifty Percent) of the seats shall be filled by the concerned medical colleges/institutions on the basis of the merit list prepared as per themarks obtained in National Eligibility- cum- Entrance Test."
