का.आ. 976( अ).- केन्द्रीय सरकार, राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) (जिसे इरागें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा उक की उप धारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने के पश्चात् कि केरल राज्य में राष्ट्रीय राजमार्ग संख्या - 47 के 270.000 कि 0मी 0 से 332.600 कि0 मी 0 (मान्नुथी अलुवा खण्ड) तक के भूखण्ड पर जिसमें बाईपासों , यदि कोई हैं, का निर्माण भी शामिल है, संनिर्माण (चौड़ा करने) के संबंध में वह भूमि अपेक्षित है, जिनका संक्षिप्त वर्णन इससे उपाबद्ध अनुसूची में दिया गया है, ऐसी भूमि का अर्जन करने के अपने आशय की घोषणा करती है ;
भूमि में हितबद्ध कोई व्यक्ति, राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से इक्कीस दिन के भीतर उक्त अधिनियम की धारा 3 ग की उप- धारा (1 ) के अधीन पूर्वोक्त प्रयोजन के लिए ऐसी भूमि के उपयोग पर आक्षेप कर सकेगा ;
उक्त अधिनियम की धारा उग की उप-धारा ( 1 ) के अधीन ऐसा प्रत्येक आक्षेप सक्षम प्राधिकारी अर्थात्, विशेष उप कलक्टर, त्रिसूर, जिला त्रिसूर, केरल को लिखित रूप में किया जाएगा और उसमें उसके आधार उपवर्णित किए जाएंगे और सक्षम प्राधिकारी आक्षेपकर्ता को व्यक्तिगत रूप में या किसी विधि व्यवसायी द्वारा सुने जाने का अवसर देगा और ऐसे सभी आक्षेपों की सुनवाई के पश्चात् तथा ऐसी और जाँच करने के पश्चात् , यदि कोई हो, जिसे सक्षम प्राधिकारी आवश्यक समझे, आदेश द्वारा या तो आक्षेपों को अनुज्ञात कर सकेगा या अननुज्ञात कर सकेगा ;
सक्षम प्राधिकारी द्वारा उक्त अधिनियम की धारा 3 ग की उप धारा (2) के अधीन किया गया कोई आदेश अंतिम होगा ;
इस अधिसूचना के अंतर्गत आने वाली भूमि के भू- रेखांक और अन्य ब्यौरे उपलब्ध हैं और उनका पूर्वोक्त सक्षम प्राधिकारी के कार्यालय में हितबद्ध व्यक्तियों द्वारा निरीक्षण किया जा सकता है ।

NOTIFICATION
New Delhi , the 4th July, 2005
S.O. 976 (E ) .- Whereas , by the notification of the Government of India , in the Ministry of Shipping , Road Transport and Highways , number S.O. 1242 ( E) , dated the 5th November 2004 issued under sub -section ( 1 ) of section 3A of the National Highways Act , 1956 (48 of 1956) ( hereinafter referred to as the said Act ) , the Central Government declared its intention to acquire the land specified in the Schedule appended to that notification for the public purpose of building (widening ) of National Highway No. 5, including construction of Bypass on the stretch from Km.319.600 to Km . 328.800 (Visakhapatnam - Bhubaneswar Section ) in District Khurda in the State of Orissa;
And whereas , the substance of the said notification was published in " The Samaj " dated the 16th February, 2004 and in " The Dharitri " dated the 16th February 2004;
And whereas objections received have been considered and disallowed by the competent authority.

And whereas , in pursuance of sub-section ( 1 ) of section 3D of the said Act, the competent authority has submitted its report to the Central Government ;
/ Now, therefore , upon receipt of the said report of the competent authority and in exercise of the powers conferred by sub - section ( 1 ) of section 3D of the said Act , the Central Government hereby declares that the land specified in the Schedule annexed hereto , are to be acquired for the aforesaid purpose;
And further , in pursuance of sub-section (2) of section 3D of the said Act, the Central Government hereby declares that on the publication of this notification in the Official Gazette , the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances .

का.आ. 977( अ ).- केन्द्रीय सरकार ने राष्ट्रीय राजमार्ग अधिनियम 1956 ( 1956 का 48 ) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा उक की उपधारा (1 ) के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं. का.आ. 1243 (अ) तारीख 5 नवम्बर, 2004 द्वारा , जो भारत के राजपत्र, असाधारण , भाग 2 , खण्ड 3 , उपखण्ड ( ii ) तारीख 5 नवम्बर, 2004 में प्रकाशित की गई थी, उड़ीसा राज्य के खुर्दा और नयागढ़ जिले में 338.000 कि 0 मी0 से 388.000 कि० मी० ( विशाखापटनम भुवनेश्वर सैक्शन) तक के भूखंड पर बाईपास का निर्माण (अर्थात निर्माण ) , अनुरक्षण , प्रबन्ध और प्रचालन करने सहित विद्यमान राष्ट्रीय राजमार्ग सं. 5 का निर्माण करने (चौड़ा करने) के लोक प्रयोजन के लिए उस अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि का अर्जन करने के अपने आशय की घोषणा की थी ;
था: और , उक्त अधिसूचना का सार 28 जनवरी , 2004 के "संवाद " और " प्रगतिवादी " दोनों में प्रकाशित किया गया
और, प्राप्त आक्षेपों पर सक्षम प्राधिकारी द्वारा विचार किया गया और उन्हें अननुज्ञात कर दिया गया है ;
और, सक्षम प्राधिकारी ने, उक्त अधिनियम की धारा उघ की उपधारा (1 ) के अनुसरण में केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ;
अतः अब, केन्द्रीय सरकार, सक्षम प्राधिकारी की उक्त रिपोर्ट के प्राप्त हो जाने पर और उक्त अधिनियम की धारा उघ की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इससे संलग्न अनुसूची में विनिर्दिष्ट भूमि का पूर्वोक्त प्रयोजन के लिए अर्जन किया जाना चाहिए ;
और, केन्द्रीय सरकार, उक्त अधिनियम की धारा उघ की उपधारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशन पर, उक्त अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त आत्यन्तिक रूप से केन्द्रीय सरकार में निहित हो जाएगी ।

And whereas the substance of the said notification was published in " Sambad " and in " Pragatibadi " both dated the 28th January 2004;
And whereas the objections received have been considered and disallowedby the competent authority;
And whereas in pursuance of sub- section ( 1 ) of section 3D of the said Act , the competent authority has submitted its report to the Central Government;
Now, therefore, upon receiptof the said report of the competent authority and in exercise of the powers conferred by sub- section (1 ) of section 3D of the said Act, the Central Government hereby declares that the land specified in the Schedule annexed hereto should be acquired for the aforesaid purpose;
And further, in pursuance of sub-section ( 2) of section 3D of the said Act , the Central Government hereby declares that, on the publication of this notification in the Official Gazette , the land specified in the said Schedule shall vest absolutely in the Central Government free from all encumbrances .
