वाणिज्य और उद्योग मंत्रालय (औद्योगिक नीति और संवर्धन विभाग )
(क) खंड ( ख ) में " व्या.चि. - 54" अक्षरों और अंकों का लोप किया जाएगा;

(ख) खंड ( ग ) में " व्या.चि. - 71 में त्वरित खोज रिपोर्ट या प्ररूप " शब्दों, अक्षरों और अंकों का लोप किया जाएगा । 3. उक्त नियमों के नियम 24 में उप - नियम (1 ) और उप-नियम
(2) का लोप किया जाएगा ।
4. उक्त नियमों के नियम 32 का लोप किया जाएगा ।
5. उक्त नियमों की प्रथम अनुसूची में,-
(क) स्तंभ ( 3 ) के अधीन प्रविष्टि संख्या 1 , 2 , 3 , 4, 5, 6, 7 और 10 से संबंधित विद्यमान प्रविष्टि के लिए, प्रविष्टि" 3500.00 " क्रमशः अंतःस्थापित की जाएगी ।
( ख ) प्रविष्टि संख्या 49 और उससे संबंधित प्रविष्टियों का लोप किया जाएगा ।
सा.का.नि. 1024(अ) .-व्यापार चिन्ह नियम, 2002 का और संशोधन करने के लिए , कतिपय नियमों का प्रारूप व्यापार चिन्ह अधिनियम , 1999 ( 1999 का 47 ) की धारा 157 की उप - धारा ( 1 ) की अपेक्षानुसार भारत के राजपत्र , असाधारण में भारत सरकार के वाणिज्य और उद्योग मंत्रालय ( औद्योगिक नीति और संवर्धन विभाग ) की अधिसूचना संख्यांक सा.का.नि. 731 ( अ ) , तारीख 7 सितम्बर, 2010 द्वारा प्रकाशित की गई थी जिससे ऐसे व्यक्तियों से , जिनके उससे प्रभावित होने की संभावना थी , उस तारीख से जिसको अधिसूचना से युक्त राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थीं, पैंतालीस दिन की अवधि समाप्त होने के पूर्व आक्षेप और सुझाव मांगे गए थे;
(ग ) प्रविष्टि संख्या 60 में स्तंभ ( 2 ) के अधीन मद (ख ) और उससे संबंधित प्रविष्टियों का लोप किया जाएगा ।
और , उक्त अधिसूचना जनता को 13 सितम्बर , 2010 को उपलब्ध करा दी गई थी;
(घ) प्रविष्टि संख्या 75 और उससे संबंधित प्रविष्टियों का लोप किया जाएगा ।
और केन्द्रीय सरकार द्वारा जनता से प्राप्त आक्षेपों और सुझावों पर विचार कर लिया गया है;
6. उक्त नियमों की दूसरी अनुसूची में , प्ररूप व्या.चि. - 11 , व्या.चि. - 54 , व्या चि. -71 और व्या. चि. -75 का लोप किया जाएगा ।

वी. भास्कर, संयुक्त सचिव अतः , अब, केन्द्रीय सरकार, व्यापार चिन्ह अधिनियम , 1999 ( 1999 का 47) की धारा 157 की उप- धारा ( 1 ) और उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए व्यापार चिन्ह नियम, 2002 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्
1. ( 1 ) इन नियमों का संक्षिप्त नाम व्यापार चिन्ह ( दूसरा संशोधन ) नियम , 2010 है ।
टिप्पण.-मूल नियम भारत के राजपत्र , असाधारण , भाग II , खंड 3 , उप - खंड ( i ) में अधिसूचना संख्यांक सा.का.नि. 114 ( अ ) , तारीख 26 फरवरी , 2002 द्वारा प्रकाशित किए गए थे और तत्पश्चात् सा.का.नि. 428( अ ), तारीख 20 मई, 2010 द्वारा संशोधन किए गए ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे । 2. व्यापार चिन्ह नियम , 2002 (जिसमें इसे इसके पश्चात् उक्त नियम कहा गया है ) के नियम 8 के उप - नियम (2 ) में ,- 4926 GI/2010

NOTIFICATION
New Delhi , the 29th December , 2010
G.S.R. 1024( E ).----Whereas certain draft rules further to amend the Trade Marks Rules , 2002 were published, as required under sub - section ( 1 ) of Section 157 of the Trade Marks Act , 1999 (47 of 1999 ) , vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion ) number G.S.R. 731 (E) , dated the 7th September, 2010 in the Gazette of India, Extraordinary , inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty - five days from the date on which copies of the Gazette containing notification were made available to the public;
And whereas the said notification were made available to the public on the 13th September , 2010;
And whereas the objections and suggestions received from the public have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by sub - sections ( 1 ) and (2 ) of Section 157 of the Trade Marks Act , 1999 (47 of 1999 ) , the Central Government hereby makes the following rules further to amend the Trade Marks Rules , 2002 , namely:---
1. (1) These Rules may be called the Trade Marks (Second Amendment) Rules , 2010.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Trade Marks Rules . 2002 ( hereinafter referred to as the said rules ) , in sub - rule (2 ) of rule 8 ,- (a) in clause (b ), the letters and figure " TM - 54 " shall be omitted;
(b) in clause ( c) , the words , letters and figure " or for expedited search report in form TM - 71 " shall be omitted.
3. In rule 24 of the said rules , sub - rule ( 1 ) and sub- rule(2) shall be omitted.
4. Rule 32 of the said rules shall be omitted .
5. In the First Schedule to the said rules.-
(a) under column (3 ) relating to entry numbers 1, 2, 3, 4, 5, 6 , 7 and 10 , for the existing entry, the entry " 3500.00 " shall respectively be substituted:
(b) entry number 49 and the entries relating thereto shall be omitted;
(c) in entry number 60 , item ( b) under column (2) and the entries relating thereto shallbe omitted;
(d) entry number 75 and the entries relating thereto shall be omitted.
6. In the Second Schedule to the said rules , Forms TM- 11 , TM- 54 , TM - 71 and TM - 75 shall be omitted .

Foot Note. The principal rules were published in the Gazette of India . Extraordinary , Part II . Section 3 , Sub - section ( i ) vide notification number G.S.R. 114( E ) , dated, the 26th February, 2002 and subsequently were amended vide notification number G.S.R. 428 (E) , dated the 20th May , 2010 .
