सा.का.नि. 1026(अ) महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 132 की उप - धारा ( 1 ) द्वारा पठित धारा 124 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार एतदद्वारा इस अधिसूचना का अधिसूची संलग्न में प्रदर्शित के रूप में कोलकाता पत्तन न्यास के न्यासी बोर्ड द्वारा बनाए गए कोलाकाता पत्तन न्यास कर्मचारी का ( पेंशन ) तीसरा संशोधन विनियम , 2010 स्वीकृत करता है ।
2. उक्त विनियम , सरकारी राजपत्र में इस अधिसूचना में प्रकाशित होने की दिनांक से लागू होगा ।
अनुसूची
कोलकाता पत्तन न्यास कर्मचारी ( पेंशन ) तृतीय संशोधन विनियम , 2010
महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 28 और इस अधिनियम की धारा 124 ( 1 ) के तहत केन्द्रीय सरकार के अनुमोदन सहित प्रदत्त शक्तियों का प्रयोग करते हुए, कोलकाता पत्तन का न्यासी मंडल , एतद्वारा कोलकाता पत्तन न्यास कर्मचारी (पेंशन ) विनियम , 1988 को संशोधन कर निम्नलिखित विनियम बनाता है :-
1. संक्षिप्त शीर्षक व प्रारम्भ:
( i ) इन विनियमों को " कोलकाता पत्तन न्यास कर्मचारी ( पेंशन ) तृतीय संशोधन विनियम , 2010 " के नाम से जाना जाएगा ।
( ii ) यह सरकारी राजपत्र में केन्द्रीय सरकार की अधिसूचना के प्रकाशन की तिथि से प्रभावी होगा।
2. विनियम 37 ( 1 ए) (डी ) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा-
" कर्मचारी के अदृश्य होने की तिथि से एक वर्ष बाद परिवार संबद्ध विभागाध्यक्ष/हल्दिया गोदी परिसर के प्रभाग को पारिवारिक पेंशन तथा ग्रेच्युटी अनुदान के लिए निर्धारित प्रक्रियानुसार पारिवारिक पेंशन तथा ग्रेच्युटी हेतु आवेदन करेगा । पारिवारिक पेंशन , लापता हुए व्यक्ति की छुट्टी पूरी होने अथवा एफ. आई. आर. दायर करने की तिथि जो भी अंतिम हो , की तिथि से प्रोद्भूत होगा । पारिवारिक पेंशन और मृत्यु/सेवानिवृति ग्रेच्यूटी का अनुमोदन तथा उनका भुगतान एफ. आई. आर. दायर करने की तिथि से एक वर्ष बाद किया जा सकता है । मृत्यु/ सेवानिवृति ग्रेच्यूटी और पारिवारिक पेंशन के भुगतान के मामले में, आवेदन की तिथि से तीन महीने के भीतर प्रभावी नहीं होता है , देय दर पर ब्याज का भुगतान किया जाएगा और दायित्व निर्धारित की जाएगी । " 3. विनियम 37 ( 1अ ) ( जी ) हटा दिया जाएगा ।

4. विनियम 37 (1 अ ) का उप- विनियम ( एच ) , ( आई ) , ( जे ) और ( के ) को क्रमशः उप- विनियम ( जी ) , ( एच ) , ( आई ) और (जे) के रूप में पुनरांकित की जाएगी ।

New Delhi , the 29th December , 2010
G.S.R. 1026 ( E). In exercise of the powers conferred by sub - section ( 1) of Section 124 read with sub - section ( 1 ) ofSection 132 of the Major Port Trusts Act, 1963 ( 38 of 1963 ) , the Central Government hereby approves the Kolkata Port Trust Employees ' (Pension ) Third Amemdment Regulations, 2010 made by the Board of Trustees of Kolkata Port Trust as set out in the Schedule annexed to this notification.
2.The said regulations shall come into force from the date of publication of this Notification in the Official Gazette .
SCHEDULE
Kolkata Port Trust Employees ' (Pension) Third Amendment Regulations , 2010
Inexercise ofpowers conferred by Section 28 ofthe Major Port Tursts Act , 1963 ( 38 of 1963 ) and with the sanction ofthe Central Government under Section 124 ( 1 ) of the said Act , the Board of Trustees for the Port of Kolkata hereby makes the following Regulations to amend the Kolkata Port Trust Empolyees ' ( Pension ) Regulations , 1988 .
1. Short title and commencement :
(i ) These Regulations may be called the " Kolkata Port Trust Employees ' (Pension ) Third Amendment Regulations , 2010" .
(ii) These shall come into force with effect from the date on which the Central Government's Notification is published in the Official Gazette.
2. Regulation 37 ( IA) ( d) shall be substituted by the following:-
"The family shall apply to the concerned Head of Department/ Division at Haldia Dock Complex for grant of Family Pension and Gratuity, after one year from the date of disappearance ofthe employee , in accordance with the prescribed procedure for sanction of Family Pension and Death / Retirement Gratuity. Family Pension will accrue from the date of lodging FIR or expiry of leave of the employee who has disappeared , whichever is later . The sanction of Family Pension and Death / Retirement Gratuity and payment thereof may be done after one year ofthe date of lodging FIR . In case the disbursement of the Death/Retirement Gratuity and Family Pension are noteffected within three months from the date of application, the interest shall be paid at the rate applicable and responsibility fixed . "
3. Regulation 37 ( 1A) (g ) shall be deleted .
4. Sub -Regulations ( h ) , (i ) , (j ) and (k ) of Regulation 37 ( 1A) shall be renumbered as Sub - Regulations ( g ) , ( h ) , ( i ) and (j) respectively.
