का.आ. 3059(अ) .-केन्द्रीय सरकार, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना संख्यांक का.आ. 1585 ( अ ) , तारीख 10 नवम्बर , 2005 द्वारा महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग सं. 6 के 9.200 कि.मी. से 100.000 कि.मी. नागपुर कोधाली तालेगांव सेक्शन को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात " प्राधिकरण " कहा गया है ) को सौंपा है ;
और उक्त अधिनियम की धारा 14 के उपबंधों के अनुसरण में, प्राधिकरण ने 9 दिसम्बर, 2005 को सुधार , प्रचालन और अनुरक्षण जिसमें विद्यमान 2 लेन की रोड के सुदृढ़ीकरण और चौड़ा करके 4 लेन का करने के लिए राष्ट्रीय राजमार्ग संख्या 6 के 9.200 कि.मी. से 50.000 कि.मी. सेक्शन ( नागपुर कोंधाली सेक्शन ) को ( जिसे इसमें इसके पश्चात " उक्त सेक्शन " कहा गया है) मैसर्स बालाजी टोलवे लिमिटेड जिसका रजिस्ट्रीकृत कार्यालय 101 , श्री अम्बा शांति चेम्बर, अपोजिट होटल लीला , अंधेरी- कुरला रोड, अंधेरी ( पूर्व ), मुम्बई -400059 भारत है ( जिसे इसमें इसके पश्चात् " रियायतग्राही " कहा गया है ) के साथ करार किया है;
:
अतः, अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग सेक्शन/राष्ट्रीय राजमार्गों पर स्थायी पुल/ अस्थायी पुल के उपयोग के लिए किसी व्यक्ति द्वारा फीस का संग्रहण ) नियम , 1997 के अनुसरण में और राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 48 ) की धारा 8क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त सेक्शन के निर्माण , अनुरक्षण , प्रबंध और प्रचालन में अन्तर्वलित व्यय , विनिधान की गई पूंजी पर ब्याज , युक्तियुक्त प्रत्यागम , यातायात की मात्रा और प्राधिकरण तथा रियायतग्राही के बीच किए गए करार की ऐसी अवधि को ध्यान में रखते हुए , यह अधिसूचित करती है कि उक्त सेक्शन के उपयोग के लिए इससे उपाबद्ध स्तंभ ( 2 ) में विनिर्दिष्ट यांत्रिक यानों पर फीस निम्नलिखित सारणी के स्तंभ ( 3 ) में विनिर्दिष्ट दरों पर उद्गृहीत और संगृहीत की जाएगी और उक्त रियायतग्राही को वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से इनमें से जो भी पश्चात्वर्ती हो , उक्त करार में यथाविनिर्दिष्ट समाप्ति तक फीस संगृहीत और प्रतिधारित करने के लिए प्राधिकृत करती है ।

टिप्पणः-
1 ) इस अधिसूचना के प्रयोजन के लिए , -
(i) " वास्तविक फीस " से निम्नलिखित आधार पर फीस . प्लाजा पर उक्त सेक्शन के उपयोक्ताओं से निम्नलिखित आधार पर प्रभारित वास्तविक फीस अभिप्रेत है ;
(क) परियोजना राजमार्ग की लम्बाई , और :
(ख) इस अधिसूचना की उपर्युक्त सारणी में दी गई आधार फीस सम्यक रूप से सूचीबद्ध और जो एक रूपए के निकटतम पूर्णांक में होगी । ii) " वाणिज्यिक प्रचालन की तारीख " से वह तारीख अभिप्रेत है जब उक्त सेक्शन पर वाणिज्यिक प्रचालन ( स्वतन्त्र सलाहकार द्वारा , प्राधिकरण और रियायतग्राही के बीच किए गए करार के उपबन्धों के अनुसार उक्त सेक्शन को पूरा होने पर, यथास्थिति, पूर्णता प्रमाणपत्र अथवा अनंतिम प्रमाणपत्र, जारी किए जाने के पश्चात् प्रारंभ होता है ।
(iii) " स्थानीय निजी यातायात " से ऐसा यान अभिप्रेत है , जिसमें व्यक्तिगत यान (कार या यात्री वैन या जीप भी सम्मिलित है), जो ऐसे व्यक्ति जो सामान्यतया ऐसे स्थान पर निवास करता हो या कार्य करता है जहाँ सामान्यतया उक्त सेक्शन के केवल एक भाग का उपयोग करके या एक से अधिक टोल प्लाजा पार किए बिना पहुँचा जा सकता है और इसलिए ऐसे व्यक्ति अपने कार्य स्थल या निवास से आने या जाने के सामान्य अनुक्रम में उक्त सेक्शन के किसी भाग पर यात्रा करने के लिए ऐसे यान का उपयोग करना अपेक्षित है।
(iv) " स्थानीय वाणिज्यक यातायात " से ऐसे वाणिज्यक यान अभिप्रेत हैं, जिसके अन्तर्गत रियायतग्राही रजिस्ट्रीकृत यात्रियों या सामान को लाने या ले जाने में लगे बस , ट्रक या हल्के मोटर यान या टैक्सी भी हैं, जो उक्त सेक्शन पर नियत रूप से चलती हैं ।
(v) " समाप्ति की तारीख " से वह तारीख अभिप्रेत हैं जब प्राधिकरण और रियायतग्राही के बीच किया गया उक्त करार, उक्त करार के उपबंधों के अनुसरण में समाप्त होता है या समाप्ति की सूचना द्वारा समाप्त किया जाता है ।

(vi) उन शब्दों और पदों के जो इस अधिसूचना में प्रयुक्त है और परिभाषित नहीं है किन्तु उक्त खंड के सम्बन्ध में प्राधिकरण और रियायतग्राही के बीच किए गए करार में परिभाषित है क्रमशः वहीं अर्थ होंगे जो उक्त करार, में हैं ।
.2. फीस की दर तथा उसका पुनरीक्षण जो कि प्रत्येक वर्ष 1 सितम्बर से प्रभावी होगा की संगणना निम्नानुसार की जाएगीः-

(क) थो.की.सू.- क = जून 1997 (131.4) को थोक कीमत सूचकांक है ;
(ख) थो.की.सू.- ख = फीस- पुनरीक्षण तारीख के पूर्ववर्ती 31 मार्च को थोक कीमत सूचकांक है
3. 20.612 कि.मी पर स्थित फीस प्लाजा पर संदत फीस संग्रहित की जाएगी ।
निम्नलिखित प्रकार के यानों के संबंध में कोई फीस प्रभारित या संग्रहीत नहीं की जाएगी , अर्थात्ः- 4.
ऐसे यान - (i)
(अ) जो " अति महत्वपूर्ण व्यक्ति " प्रतीक वाले हैं या शासकीय रूप से निम्नलिखित के हैं : - (क) भारत के राष्ट्रपति;
(ख) भारत के उपराष्ट्रपति;
(ग) राज्य के राज्यपाल या संघ राज्य क्षेत्र के उप- राज्यपाल;
(घ) भारत के राजकीय दौरे पर उच्च पदस्थ विदेशी व्यक्ति;
(ड़) " सी डी" । " सी सी" नंबर प्लेटों वाली कारों का उपयोग करने वाले भारत में रह रहे विदेशी राजनयिक;
(च) राज्य सभा के सभापति या लोक सभा के अध्यक्ष या राज्य विधान परिषद का सभापति यां राज्य विधान सभा के अध्यक्ष या संध अथवा राज्य के मंत्री अथवा लोक सभा या राज्य सभा या राज्य विधान मंडलों के विपक्ष के नेतां जिनकी हैसियत कैबिनेट मंत्री की है, यदि वे स्वयं यान में बैठें हों; या
(छ) सम्पूर्ण देश के संसद सदस्य, या अपने राज्य किसी राज्य की विधान सभा का सदस्य या राज्य की विधान परिषद का सदस्य, यदि वह, यथास्थिति, संसद अथवा राज्य के संबंधित विधान मंडल द्वारा जारी किया गया पहचान पत्र प्रस्तुत करता है;
(आ) शौर्य पुरस्कारों अर्थात् परमवीर चक्र, अशोक चक्र, महावीर चक्र, कीर्ति चक्र, वीर चक्र और शौर्य चक्र के विजेता यदि ऐसा पुरस्कार प्राप्तकर्ता ऐसे पुरस्कार के लिए सक्षम प्राधिकारी द्वारा सम्यक् रूप से अधिप्रमाणित किया गया अपना फोटो पहचान पत्र प्रस्तुत करता है.;

(ii) रक्षा यान, जिनके अतंर्गत वे यान भी हैं जो भारतीय पथकर ( सेना और वायुसेना) अधिनियम 1901 और उसके अधीन बनाए गए नियमों (नौसेना को यथा विस्तारित) के उपबन्धों के अनुसार छूट के पात्र हैं ;
(iii ) पुलिस यान, अग्नि शमन यान, एम्बुलेंस, अन्त्येष्टि यान, डाक और तार विभाग के यान , केंद्रीय सरकार और राज्य सरकार के कर्त्तव्यारूढ़ यान ।
5. रियायतग्राही स्थानीय यातायात से निम्निलिखित छूट. प्राप्त दरों से अधिक कोई फीस वसूल नहीं करेगा अर्थात्ः-
(क) कार/जीप/ वैन के लिए
विशिष्टियां
यान के विनिर्दिष्ट प्रवर्ग के लिए दी गई फीस की प्रतिशत
स्थानीय निजी यातायात
विनिर्दिष्ट प्रवर्ग के यान की लागू फीस का 25 प्रतिशत (i)
स्थानीय वाणिज्यिक यातायात विनिर्दिष्ट प्रवर्ग के यान की लागू फीस का 50 प्रतिशत (ii)
परन्तु, जहां स्थानीय यातायात द्वारा उपयोग के लिए पृथक सेवा लेन मुफ्त उपलब्ध है , वहाँ रियातग्राही ऐसे स्थानीय यातायात से फीस उद्ग्रहीत और संग्रहीत करेगा , यदि वे उक्त सेक्शन का उपयोग करते हैं ।
6. जो उपयोक्ता 24 घंटे के भीतर परियोजना राजमार्गों के एक पूरे चक्कर की यात्रा करना चाहते हों उनसे रियायतग्राही उपयोक्ता शुल्क की एक तरफ की पूरी यात्रा का डेढ़ गुणा शुल्क लेगा । स्थानीय यातायात के लिए इस मामले में, ऊपर पैराग्राफ 5 पर उल्लिखित उपबंध लागू नहीं होंगे ।
7. जो उपयोक्ता नियमित आधार पर परियोजना राजमार्गों का उपयोग करना चाहते हैं रियायतग्राही उन्हें मासिक पास जारी करेगा । स्थानीय यातायात सहित ऐसे उपयोक्ताओं को मासिक पास जारी करने की दर एक चक्कर के लिए किए जाने वाले शुल्कं का 30 गुणा होगी । ऊपर पैराग्राफ 5 पर उल्लिखित उपबंध स्थानीय यातायात के मामले में लागू नहीं होंगे ।
8. रियायतग्राही, इस अधिसूचना का सार, वाणिज्यिक प्रचालन की तारीख सहित कम से कम दो स्थानीय समाचार पत्रों में ( जिनमें से एक स्थानीय भाषा में होगा) वाणिज्यिक प्रचालन की तारीख से कम से कम दस दिन पहले और पुनरीक्षित फीस को भी प्रभावी बनाने के दस दिन पहले प्रकाशित करेगा ।
9. फीस की दर, फीस के संदाय से छूट प्राप्त यानों के प्रवर्ग और रियायतग्राही का नाम , पता और टेलीफोन संख्या, जिसे शिकायत, यदि कोई हो , संबोधित की जा सकेगी और फीस प्लाजा से 500 मी. आगे , फीस प्लाजा से 100 मी . आगे और फीस प्लाजा पर सहज रूप से और प्रमुख रूप से संप्रदर्शित की जाएगी और संप्रदर्शन बोर्ड की ऊंचाई और अक्षरों का आकार इस प्रकार का होगा कि चालकों के लिए संप्रदर्शन बोर्ड का पढना आसान हो सकें ।

10. उपयोक्ताओं से प्रभारित की जाने वाली वास्तविक फीस की संगणना रियायतग्राही द्वारा प्रतिवर्ष 31 मार्च के बाद, किंतु पुनरीक्षित दर प्रभावी होने से कम से कम पैंतालीस दिन पहले, प्राधिकरण को यथासम्भव शीघ्र विधिमान्यता के लिए भेजेगा ताकि प्राधिकरण , उक्त प्रस्ताव की प्राप्ति की तारीख से पंद्रह दिन के भीतर कोई टीका टिप्पणी कर सके या स्पष्टीकरण , यदि कोई हो, मांग सके और यदि प्राधिकरण इस अवधि के दौरान कोई टीका टिप्पणी नहीं करता है या स्प्ष्टीकरण नहीं मांगता है तो रियायतग्राही द्वारा यथा प्रस्तावित पुनरीक्षित फीस प्राधिकरण द्वारा पुष्टि की गई मानी जाएगी ।

NOTIFICATION
New Delhi , the 30th December , 2010
S.O. 3059 (E) . Whereas , the Central Government, by notification of the Government of India in the erstwhile Ministry of Shipping , Road Transport and Highways ( Department of Road Transport and Highways ) number S.O. 1585 ( E) , dated the 10th November, 2005 , issued under section 11 of the National Highways Authority of India Act, 1988 ( 68 of 1988) , had entrusted the Nagpur - Kondhali - Talegaon section from Km 9.200 to Km 100.000 of the National Highway number 6 in the State of Maharashtra to the National Highways Authority of India ( hereinafter referred to as the " Authority ") ;
And whereas , pursuant to the provisions of section 14 of the said Act, the Authority has entered into an agreement with M/ s Balaji Tollways Limited , having it's registered office at 101 , Shree Amba Shanti Chambers , opposite . Hotel Leela , Andheri - Kurla Road , Andheri ( East ) , Mumbai - 400059 , India ( hereinafter referred to as the " Concessionaire" ) on 9th December 2005 for the improvement , operation and maintenance including strengthening and widening of existing 2 lane road to 4 lane dual carriageway from Km 9.200 Km 50.000 section (Nagpur - Kondhali section) of the National Highway Number 6 ( hereinafter referred to as the " said section" ) on Build Operate and Transfer basis .
Now , therefore , in exercise of the powers conferred by section 8A of the National Highways Act , 1956 (48 of 1956) , and in pursuance of the National Highways ( Collection of Fees by any person for the Use of Section of National Highways/ permanent bridge / temporary bridge on National Highway) Rules , 1997, the Central Government , having regard to the expenditure involved in building , maintenance , management and operation of the said section , interest on the capital invested , reasonable return , the volume of traffic and the period of such agreement entered into between the Authority and the Concessionaire , hereby notifies that there shall be levied and collected fees at the base rates specified in column ( 3) of the following Table on mechanical vehicles specified in column ( 2) thereof, for the use of the said section , and authorises the said Concessionaire to collect and retain the fees on and from the date of commercial operation of the said section or publication of this notification in the Official Gazette , whichever is later , till the termination date.

Notes: -
For the purposes of this notification , -
(i) " actual fees" means the fees actually charged from the road users of the said section at the fee plaza on the basis of, -
(i ) length of the project Highway , and
(ii ) base fee given in the Table to this notification duly indexed , and rounded off to the nearest one rupee ;
(ii) "date of commercial operation " means the date on which commercial operation of the said section begins after issue of the completion certificate or the provisional completion certification as the case may be , by the independent consultant , upon completion of the said section in accordance with the provisions of the agreement entered into between the Authority and the Concessionaire ;
(iii) " local personal traffic" means and includes a personal vehicle ( car or passenger van or jeep) which is registered with the Concessionaire by any person who normally resides or works at a place that can normally be approached only by using a part of the said section and such person is , therefore , required to use such vehicle for commuting on a part of the said section in the course of normal travel to and from his place of work or residence;
" (iv) " local commercial traffic means any commercial vehicle including buses , trucks , light motor vehicles or taxies engaged in carrying goods and passengers registered with the Concessionaire as plying routinely on the said section;

(v) " termination date " means the date on which the said agreement entered into between the Authority and the Concessionaire expires pursuant to the provisions of the said agreement or is terminated by termination notice ;
(vi ). words and expressions used in this notification and not defined but defined in the agreement entered into between the Authority and the Concessionaire in respect of the said section shall have the same meaning as assigned to them respectively in the said Agreement.
2. The actual amount of fee and the revision thereof effect from 1st September every year shall be computed as follows: -

(a) WPI - A is the Wholesale Price Index of June , 1997 (131.4);
(b) WPI - B = is the Average Wholesale Price Index for the year ending March , 31st preceding the fee revision date .
3. The fee shall be collected at the fee plaza situated at Km 20.612 .
4. No fee shall be charged or collected in respect of the following vehicles , namely: -
(i ) vehicles-
(A) having VIP symbols or officially belonging to-
(a) the President of India;
(b) the Vice - President of India;
(c) the Governor of a State and Lieutenant Governor of a Union territory;
(d) a Foreign dignitary on State visit to India;
(e) a Foreign Diplomat stationed in India using cars with " CD " / " CC " number plates ;
(f) the Chairman of Rajya Sabha or Speaker of Lok Sabha or Chairman of a State Legislative Council or Speaker of a State Legislature Assembly or a Minister for the Union or State or Leader of Opposition in Lok Sabha or Rajya Sabha or State Legislatures having the Status of Cabinet Minister if he is sitting in the vehicle ; or
(g) a Member of Parliament in the entire country or a Member of Legislative Assembly of a State or a Member

of Legislative Council of a State , in the respective State if he produces his identity card issued by the Parliament or concerned Legislature of a State , as the case may be ;
(B) belonging to winner of Gallantry awards such as Param Vir Chakra, Ashok Chakra , Maha Vir Chakra , Kirti Chakra , Vir Chakra and Shaurya Chakra , if such awardee produces his photo identity card duly authenticated by the Competent Authority for such award ;
(ii) defence vehicles , including those eligible for exemption in accordance with the provisions of the Indian Toll (Army and Air Force) Act , 1901 and the rules made thereunder ( as extended to Navy) ;
( iii ) police vehicles , fire fighting vehicles , ambulances , funeral vans , Post and Telegraph Department's vehicles , Central and State Government vehicles on duty .
5. The Concessionaire shall not collect fees from local traffic in excess of the following discounted rates , namely:
Particulars
Percentage of discounted fee for the specified category of vehicle .
(i ) local personal traffic
Twenty five per cent of the applicable fee for the specified category of vehicle .
(ii) local commercial traffic Fifty per cent of the applicable fee for the specified category of vehicle.
Provided that where a separate service lane is opened for free use by local traffic , the Concessionaire shall levy and collect fee from such local traffic if they use the said section .
6. The Concessionaire shall charge 1.5( one and a half) times the full applicable fee for one way trip for users who intend to complete a round trip on the project Highways within 24 hours . For local traffic , the provisions mentioned at paragraph 5 above shall not be applicable in this case.

7. The Concessionaire shall issue monthly pass to users intending to user the project Highways on regular basis . The rate of issuing such monthly passes to such users including local traffic shall be 30 times the full applicable fee for one way trip . For local traffic the provisions mentioned at paragraph 5 above shall not be applicable in this case
8. The Concessionaire shall publish substance of this notification in two local newspapers (one of which shall be in vernacular language) , which shall also state the date of commercial operation as per the provisions of this notification , at least ten days prior to the date of commercial operation and such substance shall also be repeated , ten days prior to giving effect to revised fees as per this notification .
9. The rate of fee , the categories of vehicles exempted from payment of fee and the name , address and telephone number of Concessionaire to whom complaints , if any , should be addressed , shall be conspicuously and prominently displayed 500 meters ahead of the toll booths , 100 meters ahead of the toll booths and at the toll booths also , the height of the display boards and size of letters being such that the driver can easily read the display boards .
10. The actual fee to be charged from users shall be computed by the Concessionaire and sent to Authority for validation as soon as possible after 31st March of every year but at least forty- five days before the revised rate is to be effected so as to enable the Authority to provide any comments or seek clarifications , if any , within a period of fifteen days from the date of receipt of the said proposal and if the Authority does not offer comments or seek clarifications during this period , the revised fee , as proposed by the Concessionaire, shall be deemed to have been confirmed by the Authority.
