का.आ. 12(अ).-यतः , उड़ीसा इंडस्ट्रियल इन्फ्रास्ट्रक्चर डेवेलपमेंट कोपर्पोरेशन, जो उड़ीसा राज्य सरकार का एक उपक्रम है , ने उड़ीसा राज्य में ग्राम अरीसल, एवं गौडाकाशीपुर, तहसील जतनी , जिला खुरदा में सूचना प्रौद्योगिकी ( नोलेज पार्क ) के लिए एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना हेतु विशेष आर्थिक जोन अधिनियम, 2005 ( 2005 का 28 ) ( जिसे एतपश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 के अंतर्गत प्रस्ताव किया है;
और यतः , केन्द्र सरकार इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप - धारा ( 8 ) के अंतर्गत अपेक्षाओं तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने उपर्युक्त विशेष आर्थिक जोन के विकास , प्रचालन एवं रखरखाव हेतु उक्त अधिनियम की धारा 3 की उप - धारा ( 10 ) के अंतर्गत दिनांक 25 अक्तूबर , 2006 को अनुमोदन पत्र प्रदान कर दिया है ;
अतः अब, विशेष आर्थिक जोन अधिनियम, 2005 की धारा 4 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विशेष आर्थिक जोन नियम , 2006 के नियम 8 के अनुसरण में , केन्द्र सरकार एतद्वारा निम्नलिखित तालिका में उल्लिखित सर्वेक्षण संख्या और क्षेत्र को उपर्युक्त स्थान पर विशेष आर्थिक जोन के रूप में अधिसूचित करती है , अर्थात्

और यतः , विशेष आर्थिक जोन अधिनियम, 2005 (2005 क़ा. 28 ) की धारा 13 की. उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार एतद्वारा उक्त अधिनियम की धारा 14 के प्रयोजनार्थ उपर्युक्त विशेष आर्थिक जोन के लिए एक समिति, जिसे अनुमोदन समिति कहा जाएगा, गठित करती है , जिसके अध्यक्ष और सदस्य निम्नानुसार हैं, अर्थात्ः-
अध्यक्ष , पदेन विशेष आर्थिक जोन का विकास आयुक्त
1.
सदस्य, पदेन 2. निदेशक अथवा उप- सचिव , भारत सरकार, वाणिज्य एवं उद्योग मंत्रालय , वाणिज्य विभाग या उसका नामिती जिसका स्तर अवर सचिव , भारत सरकार से कम नहीं होगा
सदस्य, पदेन 3. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाला क्षेत्रीय संयुक्त विदेश व्यापार महानिदेशक
सदस्य, पदेन 4. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले सीमाशुल्क आयुक्त या केन्द्रीय उत्पाद शुल्क आयुक्त अथवा उनका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा
सदस्य, पदेन 5. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले आयकर आयुक्त अथवा उसका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा
सदस्य, पदेन 6. निदेशक (बैंकिंग ) , वित्त मंत्रालय , बैंकिंग प्रभाग , भारत सरकार
सदस्य, पदेन 7. उड़ीसा सरकार द्वारा नामित किए जाने वाले दो अधिकारी जिनका स्तर संयुक्त सचिव से कम नहीं होगा
विशेष आमंत्रिती 8. उड़ीसा इंडस्ट्रियल इन्फ्रास्ट्रक्चर डेवेलपमेंट कोपेरिशन (जोन के विकासकर्ता ) का प्रतिनिधि
और यतः विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28) की धारा 53 की उप- धारा (2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा दिनांक 4जनवरी , 2011 को उस तारीख के रूप में निर्धारित करती है जिस तारीख से उपर्युक्त विशेष आर्थिक जोन को सीमा- शुल्क अधिनियम , 1962 (1962 का 52) की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा ।

NOTIFICATION
New Delhi, the 4th January, 2011
S.O. 12 (E) . Whereas , Orissa Industrial Infrastructure Development Corporation , a Government of Orissa Undertaking, has proposed under section 3 ofthe Special Economic Zones Act, 2005 (28 of 2005) , (hereinafter referred to as the said Act ) to set up a sector specific Special Economic Zone for information technology (Knowledge Park) at villages Gaudakashipur and Arisal, Tehsil Jatni , District Khurda in the State of Orissa ;
AND WHEREAS, the Central Government is satisfied that requirements under sub - section (8) of section 3 of the said Act, and other related requirements are fulfilled and it has granted letter of approval under sub - section (10) of section 3 ofthe said Act for development , operation and maintenance of the above Special Economic Zone on the 25th October, 2006;
NOW , THEREFORE , the Central Government , in exercise of the powers conferred by sub - section ( 1) of section 4 of the Special Economic Zones , Act 2005 and in pursuance of rule 8 of the Special Economic Zones Rules , 2006 , hereby notifies the following area at above location with survey numbers given below in the table, as a Special Economic Zone, namely: -

AND , THEREFORE, the Central Government , in exercise of the powers conferred by sub-section (1 ) of section 13 of the Special Economic Zones Act , 2005 (28 of 2005) , hereby constitutes a Committee to be called the Approval Committee for the above Special Economic Zone for the purposes of section 14 of the said Act consisting of the following Chairperson and Members , namely: -
1. Development Commissioner of the Special Economic Zone Chairperson ex officio;
2.
Member ex officio;
Director or Deputy Secretary to the Government of India , Ministry of Commerce and Industry , Department of Commerce or his nominee not below the rank of Under Secretary to the Government of India
3.
Member ex officio ;
Zonal Joint Director General of Foreign Trade having territorial jurisdiction over the Special Economic Zone
4.
Member ex officio ;
territorial jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner Commissioner of Customs or Central Excise having
Member ex officio;
5. Commissioner of Income Tax having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner
Member ex officio;
6. Director (Banking) in the Ministry of Finance , Banking Division, Government of India
Member ex officio;
7. Two officers, not below the rank of Joint Secretary, to be nominated by the Government of Orissa
8.
Special Invitee Representative of Orissa Industrial Infrastructure Development Corporation (Developer of the zone)
AND , THEREFORE , the Central Government, in exercise of the powers conferred by sub - section (2) of section 53 of the Special Economic Zones Act, 2005 (28 of 2005 ) , hereby appoints the 4th day of January , 2011 as the date from which the above Special Economic Zone shall be deemed to be Inland Container Depot under section 7 of the Customs Act, 1962 (52 of 1962) .
