सा.का.नि. 3 (अ).-बैंकों और वित्तीय संस्थाओं को शोध्य ऋण वसूली अधिनियम , 1993 ( 1993 का 51 ) की धारा 36 की उप - धारा ( 2 ) के खंड ( ङ ) के साथ पठित धारा 4 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार, एतद्वारा , ऋण वसूली अधिकरण ( अधिकरण के पीठासीन अधिकारी के रूप में नियुक्ति हेतु प्रक्रिया ) विनियम , 1998 में संशोधन करने के लिए निम्नलिखित नियम बनाती है , नामतः :-
1. (61 ) इन नियमों को ऋण वसूली अधिकरण ( अधिकरपा के पीठासीन अधिकारी के रूप में नियुक्ति हेतु प्रक्रिया) विनियम, 2010 कहा जा सकता है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. ऋण वसूली अधिकरण ( अधिकरण के पीठासीन अधिकारी के रूप में नियुक्ति हेतु प्रक्रिया ) विनियम , 1998 में खंड ( v ) के लिए नियम 3 में, उप- नियम ( 1 ) में निम्नलिखित खंड प्रतिस्थापित होंगे , नामतः:-
" ( v ) भारत सरकार , वित्त मंत्रालय , वित्तीय सेवाएं विभाग में सचिव अथवा अपर सचिव । "

पाद टिप्पणी. प्रधान विनियम भारत के राजपत्र , असाधारण , के भाग II , खंड 3 , उप-खंड ( i ) में सा.का.नि. 32 (अ ) , द्वारा दिनांक 19 जनवरी , 1998 को प्रकाशित हुए थे और तत्पश्चात् सा.का.नि. 646( अ ) , दिनांक 2 अगस्त, 2000 द्वारा संशोधित हुए थे ।

NOTIFICATION
New Delhi , the 4th January, 2011
GS.R. 3 (E).-In exercise of the powers conferredby sub- section ( 1 ) of Section 4 read with clause (e) of sub- section (2) of Section 36 of the Recovery of Debts Due to Banks and Financial Institutions Act, 1993 (51 of 1993 ), the Central Government hereby makes the following rules further to amend the Debts Recovery Tribunal ( Procedure for appointment as Presiding Officer of the Tribunal ) Rules , 1998, namely:-
1.( 1 ) These rules may be called the Debts Recovery Tribunal (Procedure for Appointment as Presiding Officer ofthe Tribunal) Amendment Rules, 2010.
(2) They shall come into force on the date oftheir publication in the Official Gazette .
2. In the Debts Recovery Tribunal (Procedure for Appointment as Presiding Officer of the Tribunal ) Rules , 1998, in rule 3 , in sub - rule ( 1 ) , for clause (v) , the following clause shall be substituted, namely: -
"(v) Secretary or Additional Secretary to the Government of India in the Ministry of Finance , Department of Financial Services , "
