सं. 1 ( 5 )/2010-एसपीएस.- केंद्र सरकार एतद्वारा पूर्वोत्तर क्षेत्र के लिए लागू पूर्वोत्तर औद्योगिक एवं निवेश नीति 2007 के तहत केंद्रीय पूंजी निवेश राजसहायता योजना 2007 के संबंध में भारत सरकार की अधिसूचना संख्या 10(3 )/ 2007-डीबीए -II/एनईआर , दिनांक 27 जुलाई , 2007 में निम्नलिखित संशोधन अधिसूचित करती हैः
2. "परिभाषाएं " शीर्षक संबंधी पैरा 4 के तहत उप पैरा ( च) के बाद निम्नलिखित उप पैरा जोड़ा जाएगा , नामतः
(छ) " सूक्ष्म, लघु एवं मध्यम उद्यम" से अभिप्रेत है समय - समय पर यथासंशोधित सूक्ष्म , लघु एवं मध्यम उद्यम विकास अधिनियम , 2006 के खंड 7 के उप खंड ( I ) के तहत वर्गीकृत उद्यम ।
3. पैरा 5 में "या संयंत्र एवं मशीनरी में अतिरिक्त निवेश " शब्दों के बाद वाक्य के साथ निम्नलिखित जोड़ा जाएगा , नामतः
" सूक्ष्म, लघु एवं मध्यम उद्यम क्षेत्र की औद्योगिक इकाइयां , जिन्होंने 6 जनवरी , 2011 या इसके बाद वाणिज्यिक उत्पादन शुरू किया हो या कार्यात्मक/ कार्यशील हुई हों , जैसी भी स्थिति हो , प्रथम एवं उसके बाद के प्रत्येक व्यापक विस्तार पर विनिर्माण एवं सेवा क्षेत्र में क्रमशः 3 करोड़ एवं 1.5 करोड़ रुपए की अधिकतम सीमा के शर्त के अधीन संयंत्र एवं मशीनरी में अतिरिक्त निवेश पर भी राजसहायता उपलब्ध होगी" ।

4. पूर्वोत्तर क्षेत्र के लिए ऊपर परिकल्पित लाभ/प्रोत्साहन मौजूदा योजना के स्वीकार्य रहने तक अर्थात् 27 जुलाई , 2017 तक लागू रहेंगे ।

No. 1 (5)/2010- SPS . The Central Government hereby notifies the following amendment to the Government of India Notification No. 10(3 ) 2007 DBA - II /NER, dated the 27th July, 2007 in regard to the Central Capital Investment Subsidy Scheme, 2007 under the North East Industrial and Investment Policy, 2007 applicable to the North Eastern Region with immediate effect :
2. Under para 4 titled ' Definitions' , after sub - para ( f) , the following sub - para shall be inserted , namely: -
(g) "Micro, Small and Medium Enterprises ' means enterprises as classified under sub- section ( 1) of section 7 of the Micro , Small and Medium Enterprises Development Act, 2006 , as amended from time to time : "
3. In para 5, after the sentence ending with the words " or additional investment in Plantand Machinery " , the following shall be inserted , namely : -
' For the industrial units in the Micro , Small and Medium Enterprises sector , subsidy will be available also on additional investment in plant and machinery in respect of the first and every subsequent substantial expansion and on commencing commercial production or becoming operational/functional thereafter , as the case may be , on or after 6th January 2011; subject to a ceiling of Rs.3.00 crore and Rs . 1.50 crore for manufacturing and services sector respectively .
4. The benefits / incentives envisaged above shall be admissible till the existing scheme is in operation , i.e. 31st March 2017 for the North Eastern Region .

सं. 1 ( 5 )/2010 - एसपीएस.- केंद्र सरकार एतद्वारा जम्मू एवं कश्मीर राज्य के लिए लागू तथा केंद्रीय पूंजी निवेश राजसहायता योजना , 2002 के संबंध में भारत सरकार की अधिसूचना संख्या 1 ( 11 ) /2002 - एनईआर , दिनांक 22 अक्टूबर , 2002 में निम्नलिखित संशोधन अधिसूचित करती हैः
2. " परिभाषाएं " शीर्षक संबंधी पैरा 5 के तहत उप पैरा (च) के बाद निम्नलिखित उप पैरा जोड़ा जाएगा , नामतः
(छ) " सूक्ष्म, लघु एवं मध्यम उद्यम " से अभिप्रेत है समय- समय पर यथासंशोधित सूक्ष्म , लघु एवं मध्यम उद्यम विकास अधिनियम , 2006 के खंड 7 के उप खंड ( 1 ) के तहत वर्गीकृत उद्यम । '
3. पैरा 6 में विद्यमान प्रविष्टियों के बाद निम्नलिखित परन्तुक जोड़ा जाएगा नामतः-
" बशर्ते कि सूक्ष्म, लघु एवं मध्यम उद्यम क्षेत्र की औद्योगिक इकाइयों को , जिन्होंने 6 जनवरी 2011 को अथवा इसके पश्चात् वाणिज्यिक उत्पादन शुरू किया है अथवा * कार्यात्मक/ कार्यशील हुई हैं जैसी भी स्थिति हो , नई इकाइयों की दशा में अथवा प्रथम और उसके बाद के प्रत्येक व्यापक विस्तार के लिए संयंत्र और मशीनरी में उनके निवेश के 30 प्रतिशत की दर से पूंजी निवेश राजसहायता दी जाएगी , जो विनिर्माण एवं सेवा क्षेत्र के लिए क्रमशः 3.00 करोड़ रुपये और 1.50 करोड़ रुपये की अधिकतम सीमा के शर्त के अध्यधीन होगा । इस दर से राजसहायता की स्वतःअनुमोदन की सीमा 1.5 करोड़ रुपये होगी । 1.5 करोड़ रुपये से अधिक किन्तु ऊपर उल्लिखित अधिकतम सीमा तक की पूंजी निवेश राजसहायता प्रदान करने के लिए अनुबंध- I में दिए गए अनुसार एक अधिकार प्राप्त समिति होगी " ।
4. जम्मू एवं कश्मीर के लिए ऊपर परिकल्पित लाभ/ प्रोत्साहन मौजूदा योजना के स्वीकार्य रहने तक अर्थात् 14 जून , 2012 तक लागू रहेंगे ।

NOTIFICATION

The Central Government hereby notifies the following amendment to the Government of India Notification No. 1 ( 11 ) 2002 - NER , dated the 22 Oct , 2002 in regard to the Central Capital Investment Subsidy Scheme, 2002 applicable to the State ofJammu & Kashmir, with immediate effect :
2. Under para 5 titled ' Definitions ' , after sub -para ( f) , the following sub - para shall be inserted , namely: -
(g) "Micro , Small and Medium Enterprises ' means enterprises as classified under sub- section ( 1 ) of section 7 of the Micro , Small and Medium Enterprises Development Act , 2006, as amended from time to time" .
3. After the existing entries against para 6, the following proviso shall be inserted, namely: -
'Provided that the industrial units in the Micro , Small and Medium Enterprises sector commencing commercial production or becoming operational/functional , as the case may be, on or after the 6th day of January , 2011 ; shall be given capital investment subsidy at the rate of 30% of their investment in plant and machinery in respect of new units or additional such investment in respect of the first and every subsequent substantial expansion , subject to a ceiling of Rs.3.00 crore and Rs . 1.50 crore for manufacturing and services sector respectively . The limit for automatic approval of subsidy at this rate would be Rs.1.5 crore . For grant of capital investment subsidy higher than Rs.1.5 crore but to a maximum of the above mentioned ceiling , there will be an Empowered Committee as in Annexure - l' .
