सा.का.नि. 9 (अ). केन्द्रीय सरकार, कर्मचारी भविष्य निधि एवं प्रकीर्ण उपबंधअधिनियम , 1952 ( 1952 का 19 ) की धारा 7 की उप- धारा ( 1 ) के साथ पठित धारा 6ग द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , कर्मचारी जमा संबद्ध बीमा योजना , 1976 में आगे संशोधन करने के लिए निम्नलिखित योजना बनाती है , अर्थात्:-
1. ( 1 ) यह योजना कर्मचारी जमा संबद्ध बीमा ( संशोधन ) योजना , 2011 कहलाएगी ।
( 2) यह सरकारी राजपत्र में इसे प्रकाशित किए जाने की तारीख से प्रवर्तन में आएगी ।
2. कर्मचारी जमा संबद्ध बीमा योजना , 1976 में, पैराग्राफ 22 में, उप-पैराग्राफ ( 2 ) के उपरान्त निम्नलिखित उप - पैराग्राफ प्रतिस्थापित किया जाएगा , अर्थात्:-
" ( 22क ) किसी ऐसे कर्मचारी , जो इस अधिनियम की धारा 17 के अंतर्गत छूट प्राप्त निधि अथवा भविष्य निधि, जैसी भी स्थिति हो , का सदस्य हो, की मृत्यु होने पर , जिस माह उसकी मृत्यु हुई हो उससे पूर्ववर्ती बारह माह की अवधि के दौरान लगातार एक ही स्थापना में नियोजित रहा हो, मृतक की संचयी भविष्य निधि राशियों को प्राप्त करने के लिए पात्र व्यक्तियों को ऐसी संचित राशियों के अतिरिक्त:-

( i ) जिस माह उसकी मृत्यु हुई हो उससे पूर्ववर्ती बारह माह के दौरान आहरित औसत मासिक मजदूरी (अधिकतम छः हजार पांच सौ रुपये के अध्यधीन ) से बीस गुना धनराशि के बराबर अथवा;
(ii ) उप-पैराग्राफ ( 1 ) के अंतर्गत लाभ की राशि, जो भी उच्चतर हो;
धनराशि प्राप्त करने का हकदार होगा । "
"स्पष्टीकरण, अंशकालिक कर्मचारी के मामले में जो निधि अथवा इस अधिनियम की धारा 17 के अंतर्गत छूट प्राप्त भविष्य निधि , जैसी भी स्थिति हो , का सदस्य हो , जो जिस माह उसकी मृत्यु हुई हो उससे पूर्ववर्ती बारह माह की अवधि के दौरान लगातार एक से अधिक कारखाने अथवा स्थापना में सेवा कर रहा हो , इस योजना के अंतर्गत लाभ की मात्रा, जहां वह लगातार बारह माह से अधिक की अवधि के लिए कार्यरत रहा हो , के संदर्भ में सभी मजदूरियों के योग की औसत मजदूरी , अधिकतम छः हजार पांच सौ रुपये की मजदूरी सीमा के अध्यधीन निर्धारित की जाएगी । "

टिप्पण :-कर्मचारी जमा संबद्ध बीमा योजना , 1976 की सं. सा.का.नि. 488 ( अ ) , दिनांक 28 जुलाई , 1976 द्वारा भारत के राजपत्र , भाग II , खंड 3 , उप - खंड ( i ) में प्रकाशित किया गया था तथा पिछली बार सं. सा.का.नि. 523 ( अ ) , दिनांक 18 जून, 2010 द्वारा संशोधित किया गया था ।

GS.R. 9(E) -In exercise of the powers conferred by Section 6C, read with sub - section ( 1 ) of Section 7 of the Employees ' Provident Funds and Miscellaneous Provisions Act, 1952 ( 19 of 1952) , the Central Government hereby makes the following Scheme , further to amend the Employees ' Deposit Linked Insurance Scheme, 1976 , namely:--
1. (1 ) This Scheme may be called the Employees ' Deposit Linked Insurance (Amendment ) Scheme , 2011 .
(2) It shall come into force from the date of its publication in the Official Gazette .
2. In the Employees ' Deposit . Linked Insurance Scheme, 1976, in paragraph 22, after sub- paragraph (2), the following sub-paragraph shall be substituted , namely :--
" (22A) On the death of an employee , who is a member ofthe Fund or ofa provident fund exempted under Section 17 of the Act, as the case may be , who was in the employment of the same establishment for a continuous period of twelve months , preceding the month in which he died, the persons entitled to receive the provident fund accumulations ofthe deceased shall, in addition to such accumulations be paid an amount , equal to :---
[ PART 11-SEC . 3 ( i ) ]
(i) the average monthly wages drawn ( subject to a maximum ofrupees six thousand five hundred), during the twelve months preceding the month inwhich he died, multiplied by twenty times or;
(ii) the amount of benefit under sub- paragraph ( 1 ) , whichever is higher . "
"Explanation . In the case of a part- time employee who is a member of the Fund or of a provident fund exempted under Section 17 of the Act , as the case may be , who was serving in more than one factory or establishment for a continuous period of twelve months , preceding the month inwhich he died, the quantum of benefit under this Scheme shall be determined with reference to the average wages of the aggregate of all the wages wherever he was continuously working for more than twelve months, subject to the wage ceiling of rupees six thousand five hundred. "
