सं..एन -12 /13/2/ 2010-यो. एवं. विकास. जबकि कर्मचारी राज्य बीमा ( साधारण ) विनियम, 1950 में और संशोधन करने के कतिपय मसौदा विनियम कर्मचारी राज्य बीमा अधिनियम , 1948 ( 1948 का 34) की धारा 97 की उप - धारा (1 ) के अंतर्गत यथा अपेक्षित भारत के राजपत्र के भाग 3 , खण्ड 4 दिनांक 30 अक्तूबर, 2010 में इससे प्रभावित होने वाले सभी व्यक्तियों से , भारत के राजपत्र की प्रतियाँ जिनमे उक्त अधिसूचना प्रकाशित की गई थी जनता को उपलब्ध कराने की तारीख से तीस दिन की अवधि की समाप्ति तक, आपतित्याँ और सुझाव आमंत्रित करते हुए प्रकाशित किए गए थे ।
तथा जबकि उक्त राजपत्र की प्रतियाँ 30 अक्तूबर , 2010 को जनता को उपलब्ध कराई गई थीं ।
तथा जबकि इस संबंध में किसी व्यक्ति से कोई आपत्ति या सुझाव प्राप्त नहीं हुआ है ।
इसलिए अब कर्मचारी राज्य बीमा निगम कर्मचारी राज्य बीमा अधिनियम , 1948 की धारा 97 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , कर्मचारी राज्य बीमा (साधारण) विनियम, 1950 में और संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाता हैं: -
1) ये विनियम कर्मचारी राज्य बीमा (साधारण) ( संशोधन) विनियम , 2010 कहे जाएंगे ।

2) ये 1 जनवरी, 2011 से लागू होंगे ।
3) कर्मचारी राज्य बीमा (साधारण) विनियम, 1950 में;
1. विनियम 2 में , उप खण्ड( 1 ) "निरीक्षक" शब्द को "सामाजिक सुरक्षा अधिकारी " शब्द से प्रतिस्थापित किया जाएगा ।
2. विनियम 31 ग के बाद निम्नलिखित नया विनियम अंतः स्थापित किया जाएगा " 31 - घ अपीलीय प्राधिकारी: अधिनियम की धारा-45 कक के अंतर्गत अपीलीय प्राधिकारी बीमा आयुक्त, अपर आयुक्त, क्षेत्रीय निदेशक तथा संयुक्तनिदेशक होंगे ।
31-ड . नियोजक को लौटाई गई राशि पर ब्याज
यदि कोई नियोजक धारा 45 कक के अंतर्गत अपील में अंततः सफल होता है तो उसके द्वारा निगम में जमा कराई गई राशि, अपीलीय प्राधिकारी के निर्णय के अनुसार, पूर्ण या आंशिक रूप में , विनियम 31 - क में विनिर्दिष्ट दर पर साधारण ब्याज के साथ लौटाई जाएगी ।
3. विनियम 32 में " फार्म 7 " शब्दों और अंकों को "फार्म 6 " शब्दों और अंकों से प्रतिस्थापित किया जाएगा ।
4. विनियम 65,66,68,77,78 और 81 में जहां कहीं "बीमाकृत व्यक्ति" आए हैं , उन्हें " कर्मचारी " शब्दों में प्रतिस्थापित किया जाएगा ।
5. विनियम 102 में,
(क) " संयुक्त बीमा आयुक्त, उप बीमा आयुक्त" शब्दों को "अपर आयुक्त" शब्दों से प्रतिस्थापित किया जाएगा ।
(ख) " उप क्षेत्रीय निदेशक, सहायक बीमा आयुक्त, सहायक क्षेत्रीय निदेशक " शब्दो को " संयुक्त निदेशक, उप निदेशक, सहायक निदेशक " शब्दों से प्रतिस्थापित किया जाएगा ।
(ग) "निरीक्षक " शब्द को "सामाजिक सुरक्षा अधिकारी " शब्दों से प्रतिस्थापित किया जाएगा ।
6. विनियम 102-क में , " एक निरीक्षक " शब्दों को " एक सामाजिक सुरक्षा अधिकारी " शब्दों से प्रतिस्थापित किया जाएगा ।
7. विनियम 103 - ख के खण्ड(2) में , "अधिवार्षिता आयु प्राप्त कर चुके" शब्दों के बाद " अथवा स्वैच्छिक सेवानिवृत्ति योजनाके अंतर्गत सेवानिवृत्त होता है या समयपूर्व सेवानिवृत्ति लेता है " शब्द अंतः स्थापित किए जाएंगे ।
8. फार्म-01 में;
(क) मौजूदा कॉलम 11 को निम्नलिखित से प्रतिस्थापित किया जाएगा:-
:
" 11. क्याविनिर्माण प्रक्रिया चल रही है तथा यदि ऐसा है तो इसकी प्रकृति" [ भाग III-खण्ड 4 ]

(ख) कॉलम-17 में , "7500 रुपये " शब्दों और अंकों को " 15000 रुपये " शब्दों और अंकों से प्रतिस्थापित किया जाएगा ।
(ग) कॉलम-18 में , "अथवा क.रा.बी. अधिनियम के अंतर्गत अधिक व्याप्ति-योग्य कर्मचारी मजदूरी के निमित्त नियोजित थे " शब्दों को " अथवा अधिक व्यक्ति नियोजित थे " शब्दों से प्रतिस्थापित किया जाएगा ।
पादटिप्पणी * *को निम्नलिखित से प्रतिस्थापित किया जाएगा ;
(घ)
" जो लागू न हो उसे काट दें । कारखाने के मामले में स्वीकार्य संख्या 10 या अधिक व्यक्ति है तथा स्थापन के मामले में स्वीकार्य संख्या 20 या अधिक व्यक्ति है । "
(ड. ) नोट-2 , हटा दिया जाएगा ।
(च) नोट 7 में (iii )के नीचे पैरा में , "अथवा स्थापन के स्थायी आदेशों के अंतर्गत" शब्दों को " तथा प्रशिक्षु के रूप में नियुक्त ऐसा व्यक्ति शामिल है जिसकी प्रशिक्षण अवधि का विस्तार किसी भी समय तक किया जाता है " शब्दों से प्रतिस्थापित किया जाएगा ।
9. फार्म -01 क में , कॉलम 7(ख) हटा दिया जाएगा ।
10. फार्म-01 में;
(क) फार्म-1 के अंत में अनुदेशों के पैरा-2 में, "परिवार " की परिभाषा में , उप खण्ड(V) के लिए, निम्नलिखित उप खण्ड अंतः स्थापित किए जाएंगे, नामतः " (V) आश्रित माता-पिता, जिनकी सभी श्रोतों से आय पाँच हजार मासिक से अधिक न हो;
(vi) बीमाकृत व्यक्ति के अविवाहित होने तथा उसके माता- पिता जीवित न होने की स्थिति में , बीमाकृत व्यक्तिके अर्जन पर पूर्णतया आश्रित अवयस्क भाई तथा /अथवा बहनें "
11. फार्म 1 -क में;
-फार्म-1 के अंत में टिप्पणी में "परिवार " की परिभाषा में , उप- खण्ड (V) के लिए निम्नलिखित उप - खण्ड अन्तः स्थापित किए जाएं , नामतः-
" (V) आश्रित माता-पिता जिनकी सभी श्रोतों से आय पाँच हजार रुपये मासिक से अधिक न हो;
(vi ) बीमाकृत व्यक्ति के अविवाहित होने तथा उसके माता - पिता जीवित न होने की स्थिति में बीमाकृत व्यक्ति के अर्जन पर पूर्णतया आश्रित अवयस्क भाई तथा/अथवा बहनें । " 4

12. फार्म -2में;
-फार्म-2के अंत में टिप्पणी में "परिवार" की परिभाषा में , उप- खण्ड (v) के लिए निम्नलिखित उप- खण्ड अन्तः स्थापित किए जाएं, नामतः-
" (V) आश्रित माता- पिता जिनकी सभी श्रोतों से आय पाँच हजार रुपये मासिक से अधिक न हो;
(vi ) बीमाकृत व्यक्ति के अविवाहित होने तथा उसके माता- पिता जीवित न होने की स्थिति में बीमाकृत व्यक्ति के अर्जन पर पूर्णतया आश्रित अवयस्क भाई तथा/अथवा बहनें । "
13. फार्म 3 में , " 7500 रुपये " अंकों को " 15000 रुपये " अंकों से प्रतिस्थापित किया जाएगा ।
14. फार्म -12में
(क) कॉलम 26 के बाद , निम्नलिखित नए कॉलम अंतःस्थापित किए जाएंगे: -
" 27 निवास स्थान से ड्यूटी के लिए रोजगार स्थान तक अथवा ड्यूटी पूरी करने के बाद रोजगार स्थान से निवास स्थान तक यात्रा करते समय दुर्घटना होने के मामले में: -
(1) दुर्घटना का समय और स्थान
(2) कार्य के घंटे ।
(3) परिवहन की रीति ।
15. फार्म-15 में, " बीमाकृत व्यक्ति " शब्दों को जहाँ कहीं भी ये आते हैं " कर्मचारी " शब्दों से प्रतिस्थापित किया जाएगा ।
16. फार्म-16में
(क) "बीमाकृत व्यक्ति " शब्दों को जहाँ कहीं भी ये आते हैं " कर्मचारी " शब्दों से प्रतिस्थापित किया जाएगा ।
(ख) घोषणा (ii) में "अवयस्क पुरुष/महिला आश्रितजन के मामले में अनुप्रयोज्य " शब्दों के बाद "वैद्य अथवा दत्तक पुत्र अथवा पुत्री के अलावा " शब्द अंतः स्थापित किए जाएंगे ।
(ग) घोषणा(iii) में " 18 वर्ष " शब्दों और अंकों को " 25 वर्ष " शब्दों और अंकों से प्रतिस्थापित किया जाएगा तथा "अविवाहित" शब्दों को हटा दिया जाएगा ।
(घ) घोषणा( iii) के बाद निम्नलिखित को अंतः स्थापित किया जाएगा; नामतः " ( iv) मैनें 25 वर्ष की आयु पूरी नहीं की है ( वैद्य अथवा दत्तक पुत्र के मामले में अनुप्रयोज्य) " 5

17. फार्म-24में
(क) " बीमाकृत व्यक्ति" शब्दों को, जहाँ भी ये आते हैं " कर्मचारी " शब्दों से प्रतिस्थापित किया जाएगा ।
(ख) घोषणा(ii) में " अवयस्क पुरुष/महिला आश्रितजन के मामले में अनुप्रयोज्य " शब्दों के बाद "वैद्य अथवा
दत्तक पुत्र अथवा पुत्री के अलावा" शब्द अंतः स्थापित किए जाएंगे ।
(ग) घोषणा(iii) में " अठारह वर्ष " शब्दों को " पच्चीस वर्ष " शब्दों से प्रतिस्थापित किया जाएगा " ।
(घ) घोषणा (iii) के बाद निम्नलिखित को अंतःस्थापित किया जाएगा; नामतः " (iv) मैनें 25 वर्ष की आयु पूरी
नहीं की है (वैद्य अथवा दत्तक पुत्र के मामले में अनुप्रयोज्य) " ।

New Delhi , the 9th, December, 2010
No. N- 12/ 13/2 /2010- P & D.- Whereas certain draft regulations further to amend the Employees' State Insurance (General ) Regulations, 1950, were published as required under sub - section (1) of section 97 of the Employees' State Insurance Act, 1948 (34 of 1948), in the Gazette of India , Part III , Section 4, dated the 30th October, 2010 for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period of thirty days from the date on which the copies of the Gazette of India in which the said notification was published , were madeavailable to the public;
And whereas, the copies of the said Gazette were made available to the public on the 30thOctober , 2010;
regard; And whereas no objection or suggestion has been received from any person in this
Now, therefore, in exercise of the powers conferred by section 97 of the Employees' State Insurance Act , 1948, the Employees' State Insurance Corporation , hereby makes the following regulations further to amend the Employees' State Insurance (General ) Regulations , 1950, namely: -
1) These Regulations may be called the Employees' State Insurance (General ) (Amendment) Regulations, 2010.
2) They shall come into force from 1st January, 2011 . 66GT/ 11-2 6

3) In the Employees ' State Insurance (General ) Regulations , 1950;
1. InRegulation 2, in sub -clause (I ) , the word " inspector " shall be substituted with the word " Social Security Officer" .
2. AfterRegulation 31C, the following new Regulations shall be inserted: -
"31-D-AppellateAuthority: The Appellate Authority under Section -45AA of the Act shall be the Insurance Commissioner , the Additional Commissioner, Regional Director and Joint Director .
31-E. Interest on amounts refunded to the employer.
Ifanemployer finally succeeds in the appeal under section 45AA, the amount deposited by him withthe Corporation , in full or part, as per decision of the Appellate Authority, shall be refunded to him along with simple interest at the rate specified in Regulation 31 -A. "
3. InRegulation 32, the words and figures " Form 7" shall be substituted with the words and figures "Form 6" .
4. InRegulations65, 66,68 , 77,78 and 81 the words " insured person" wherever the same occur, shall be substituted with the words " employee" .
5. InRegulation 102 ,
(a) the words, " Joint Insurance Commissioner, a Deputy Insurance Commissioner" shall be substituted with the words "Additional Commissioner" .
(b) thewords, " Deputy Regional Director, Assistant Insurance Commissioner, Assistant Regional Director" shall be substituted with the words, "Joint Director, Deputy Director, Assistant Director"
(c) the words, " Inspector" shall be substituted with the words " Social Security Officer".
6. InRegulation102-A, the words " an Inspector" shall be substituted with the words " a Social Security Officer" .
7. InClause (2) of Regulation 103 - B, after the words " has attained the age of superannuation " , the words " or retires under a Voluntary Retirement Scheme or takes premature retirement " shallbe inserted .
8. InForm -01;
(a) the existing column 11 shall be substituted with the following: -
"11. Whether manufacturing process is carried on and if so the nature of the same" 7

(b) incolumn -17, the words and figures " Rs.7500" shall be substituted with theworld and figures " Rs.15,000" .
(c) in column18, the words "or more coverable employees under the ESI Act were employed for wages" shall be substituted with the words " or more persons were employed" .
(d) Footnote ** shall be substituted with the following;
"Scoreout whichever is not applicable. In case of factory, the number applicable is 10 or morepersons and in case of an establishment the number applicable is 20 or more persons."
(e) Note-2, shall be deleted .
(f) in Note 7, in the paragraph below ( iii ) , the words " or under the standing orders of the establishment" shall be substituted with the words "and includes such person engaged asapprentice whose training period is extended to any length of time" .
9. In Form -01A, Column 7(b ) shall be deleted .
10. InForm-1;
(a) in para - 2 of instructions at the end of form - 1, in the definition of " family" , for sub- clause(v) , the following sub- clauses shall be inserted, namely: - " (v) dependent parents, whose incomefrom all sources does not exceed five thousand rupees a month;
(vi ) in case the insured person is unmarried and his or her parents are not alive, minor brothers and/or sisters wholly dependent upon the earnings of the insured person."
11 . InForm 1-A;
-inthe Note at the end of the form - 1A, in the definition of " family" , for sub - clause (v) , the following sub -clauses shall be inserted , namely: -
"(v) dependent parents, whose income from all sources does not exceed five thousand rupees a month;

(vi) in case the insured person is unmarried and his or her parents are not alive, minor brothers and/or sisters wholly dependent upon the earnings of the insured person ."
12. InForm 2;
-inthe Note at the end of the form - 2, in the definition of " family" , for sub- clause ( v) , the following sub -clauses shall be inserted , namely: -
"(v) dependent parents, whose income from all sources does not exceed five thousand rupees a month;
(vi) in case the insured person is unmarried and his or her parents are not alive, minor brothers and/or sisters wholly dependent upon the earnings of the insured person . "
InForm 3, the figures " Rs.7500 " shall be substituted with the figures " Rs.15,000" 13.
14. inform-12
(a) AfterColumn 26, the following new columns shall be inserted: -
"27. In case the accident happened while commuting from residence to the place of employment for duty or from place of employment to residence after performing duty: - (1) Timeand place of accident
(2) Duty hours.
(3) Modeof transport .
15. inform -15, the words " insured person " shall be substituted with the words " employee" wherever itoccurs.
16. In form 16
(a) the words " insured person " shall be substituted with the word "employee "wherever the same occurs .
(b) in declaration ( ii ) , after the words " Applicable in case of minor male/female dependant ", thewords " other than legitimate or adopted son or daughter " shall be inserted.

(c) in declaration ( iii) , the words and figures " 18 years " shall be substituted with the words and figures "25 years " and the words " unmarried" shall be deleted.
(d) after declaration ( iii) , the following shall be inserted; " namely, " ( iv) I have not attained the ageof 25 years (Applicable in case of legitimate or adopted son)"
17. In form 24
(a) the words " insured person" shall be substituted with the word " employee" wherever the same occurs .
(b) - in declaration (ii ), after the words " Applicable in case of minor male/female dependant" , the words " other than legitimate or adopted son or daughter" shall be inserted.
(c)- indeclaration ( iii ) , the words "eighteen years " shall be substituted with the words "twenty- five years"
(d) - after declaration (iii ) the following shall be inserted ; namely, "( iv) I have not attained the age of twenty- five years ( Applicable in case of legitimate or adopted son)"
