का.आ. 87(अ).-भारत सरकार ने, पेट्रोलियम और खनिज पाइपलाइन (भूमि में उपयोग के अधिकार का अर्जन) अधिनियम , 1962 ( 1962 का 50 ) (जिसे इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 की उप-धारा ( 1 ) के अधीन जारी भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना संख्या का.आ. 2807(अ) तारीख 18 नवम्बर, 2010 द्वारा, उस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में , मैसर्स रिलाएंस इन्डस्ट्रीज लिमिटेड की आन्ध्र प्रदेश में संरचनाओं से काकिनाडा हैदराबाद ऊरण अहमदाबाद ट्रंक गैस पाइपलाइन के आन्ध्र प्रदेश में कृष्णा जिला के चेवुटूरू गाँव में टैप ऑफ फैसिलिटी से कोंडपल्ली गाँव में लैंको कोंडपल्ली पावर प्राइवेट लिमिटेड तक प्राकृतिक गैस के परिवहन के लिए मैसर्स रिलाएंस गैस ट्रांसपोर्टेशन इन्फ्रास्ट्रक्चर लिमिटेड द्वारा दूसरा स्पर पाइपलाइन बिछाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन करने के अपने आशय की घोषणा की थी ;
102दिसम्बर2010 और , उक्त राजपत्र अधिसूचना की प्रतियाँ जनता को तारीख 021 करा दी गई थीं ; (2010 को अथवा उससे पूर्व उपलब्ध
और, पाइपलाइन बिछाने के संबंध में जनता से प्राप्त आक्षेपों पर सक्षम प्राधिकारी द्वारा विचार कर लिया गया है और उन्हें अननुज्नात कर दिया गया है;
और , सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 6 की उप- धारा ( 1 ) के अधीन भारत सरकार को अपनी रिपोर्ट दे दीहै;
और, भारत सरकार ने, उक्त रिपोर्ट पर विचार करने के पश्चात् और यह संतुष्ट हो जाने पर कि उक्त भूमि पाइपलाइन बिछाने के लिए अपेक्षित है , उसमें उपयोग के अधिकार का अर्जन करने का विनिश्चिय किया है ;
अतः , अब, भारत सरकार, उक्त अधिनियम की धारा 6 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में पाइपलाइन बिछाने के लिए उपयोग के अधिकार का अर्जन किया जाता है ;

और , भारत सरकार, उक्त अधिनियम की धारा 6 की उप- धारा (4 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह निर्देश देती है कि उक्त भूमि में उपयोग का अधिकार इस घोषणा के प्रकाशन की तारीख से भारत सरकार में निहित होने के बजाए , सभी विल्लंगमों से मुक्त, मैसर्स रिलाएंस गैस ट्रांसपोर्टेशन इन्फ्रास्ट्रक्चर लिमिटेड में निहित होगा ।

NOTIFICATION
New Delhi , the 10th January, 2011
S.O. 87 (E). Whereas by notification of Government of India in Ministry of Petroleum and Natural Gas number S.O. 2807 (E) dated 18th November, 2010 , issued under sub- section ( 1 ) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962) (hereinafter referred to as the said Act) , Government of India declared its intention to acquire the Right of User in the land, specified in the Schedule appended to that notification for the purpose of laying second spurpipeline for transportation of natural gas from structures in Andhra Pradesh of M/ s Reliance Industries Limited on the tap - off facility of Kakinada - Hyderabad - Uran Ahmedabad trunk gas pipeline at Chevuturu village to LANCO Kondapalli Power Pvt Limited at Kondapalli village in Krishna District of the State of Andhra Pradesh by M/ s Reliance Gas Transportation Infrastructure Limited;
And whereas , the copies of the said Gazette notification were made available to the public on or before 02nd December, 2010;
And whereas , the objections received from the public to the laying of the pipeline have been considered and disallowed by the Competent Authority;
And whereas, the Competent Authority has under sub -section ( 1 ) of Section 6 of the said Act, submitted report to the Government of India;
And whereas , Government of India , after considering the said report and on being satisfied that the said land is required for laying the pipeline , has decided to acquire the Right of User therein;

Now, therefore , in exercise of the powers conferred by sub - section (1) of Section 6 of the said Act, Government of India hereby declares that the Right of User in the land, specified in the Schedule , appended to this notification, is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub - section (4) of Section 6 of the said Act, Government of India hereby directs that the Right of User in the said land for laying the pipeline shall, instead of vesting in Government of India, vest on the date of publication of the declaration, in M/ s Reliance Gas Transportation Infrastructure Limited, free from all encumbrances .
